DEAR MEMBERS ,

This year the Executive Committee has been focused onfinding ways to improve members’ access to committee andchapter activities. Toward that end, the FCBA has under-taken several initiatives to explore remote web-based accessto CLEs and dial-in access to brown bags.

During the month of March, the FCBA will begin offeringour Committees and Chapters the opportunity to imple-ment remote access for out-of-town participation in selectbrown bag events. In furtherance of this initiative, the FCBA staff is compiling alist of local venues that have the audio infrastructure to support this capabilityfor our select brown bags. I encourage all of you that have the office space andaudio infrastructure to contact Stan Zenor.

The FCBA has also just completed the second of two trials of web-based access toFCBA events. Through the leadership of Bill Levis, Rocky Mountain ChapterCo-Chair, the FCBA successfully offered remote web-based access to the SiliconFlatirons program on February 11. We will be soliciting the feedback of partici-pants in the two trials regarding the quality and costs of access.

Consistent with our emphasis on broadening opportunities for participation inFCBA related matters, the co-chairs of the Law Journal Committee — JamisonPrime, Bill Richardson, and Ellen Goodman— have been working with IndianaUniversity to implement an Online Forum for the Federal Communications LawJournal (FCLJ) to enable the publication of responses to published articles aswell as submissions of new and timely communications law commentary. Thiswill enable broader engagement on a more rapid timeline with respect to break-ing developments in communications law, while maintaining the high standardsof the Journal. Further details of this initiative will be forthcoming.

I’d like to offer my thanks and congratulations to the Moot Court CompetitionCo-Chairs – Ronnie London, Amy Mushahwar, and Paul Werner III – as well asall of the FCBA members that participated as judges throughout the intense com-petition at The Catholic University of America, Columbus School of Law. Itoffers the FCBA a wonderful opportunity to demonstrate the volunteer spirit andnature of our FCBA membership to the students – who themselves are potentialfuture leaders for the FCBA. In addition to the Moot Court Competition, thisyear the FCBA is also associating itself with Catholic University’s CommLawConspectus Symposium, being held on March 15.

Finally, I look forward to seeing many of you on Wednesday, March 14 – foreither our Breakfast with DHS Assistant Secretary Richard C. Barth, or theCongressional Reception that evening, or both!

highlight the fast-paced technological,business and regulatory changes thataffect nearly every aspect of the com-munications industry.

The Annual Seminar will, as always,feature a variety of programming and arange of activities for industry profes-sionals and their families and guests.As in the past, panel discussions andother programming will be scheduledfor Friday afternoon and Saturdaymorning. Recreational and otheractivities will be scheduled for Fridayevening, Saturday afternoon, andSaturday night. A complete scheduleof the activities and events for theAnnual Seminar will appear in nextmonth’s FCBA newsletter. In themeantime, here is a sneak peek onwhat the Annual Seminar Committeeis working on:

T HE SEMI NAR PROGRAMThis year’s seminar is expected to fea-ture a range of industry panels, includ-ing:

n New Voices: The communicationsindustry traditionally has beenregulated at the federal level by asmall handful of federal agencies. Inrecent years, however, as the industryhas evolved, so too have the numberand types of federal agencies with aninterest in regulatingcommunications matters. The FCBAhas invited officials from thesevarious agencies, including the WhiteHouse, the Department of HomelandSecurity, the Federal TradeCommission, the U.S. Department ofState, and the Department ofCommerce/NTIA, to share theirinsights and objectives about ourindustry with us.

n Going Mobile: Forget abouttechnology that is keeping youtethered to your desktop. The futureof communications is mobility.Today’s voice and text-messaginghandsets are fast-becoming the

platform for mobile video, music,Web surfing, and advertising. TheFCBA has invited a range of serviceproviders, content providers andequipment manufacturers to identifysome of the key developments theyare working and to discuss with uswhat they expect those keydevelopments will do to the moretraditional models.

n A Conversation with FCCCommissioners: The FCBA hasinvited the FCC Commissioners tothis very popular panel. Attendeeswill have an opportunity to hear theCommissioners discuss their viewson the evolving communicationsindustry and regulatory landscape.

n The Chiefs: It has become an AnnualSeminar tradition for attendees to

hear from the Chiefs of the FCC’svarious Bureaus. The FCBA hasinvited these Chiefs and theircounterparts in key FCC Offices todiscuss recent developments relatingto their organizations.

n Follow the Money: It goes withoutsaying that no analysis of a changingindustry can be complete without anexamination and discussion offinancial matters. The FCBA hasinvited representatives from variousbanks, investment companies andfinancial firms to share their views ofsuch matters, as well as on thecommunications industry in general.

TPRC is an annual conference oncommunication, information, andinternet policy that brings a diverse,international group of researchersfrom academia, industry, government,and nonprofit organizations togetherwith policy makers. It serves two pri-mary goals: (1) dissemination ofresearch relevant to current communi-cations regulatory and policy debatesin the US and around the world; and(2) promotion of new research onemerging issues.

TPRC is now soliciting abstracts ofpapers for presentation at its 2007conference. Proposals should be basedon current theoretical or empiricalresearch relevant to communicationand information policy, and may be

MOOT COURT Competition

The 2007 National Telecommunications Moot Court competition sponsored bythe FCBA and Catholic University was an outstanding experience for the stu-dents involved. This year’s competition was the largest thus far, and featuredfourteen teams representing law schools from California, Colorado, Indiana, andNew York, as well as local competitors from George Washington, Georgetownand Catholic University law schools.

A highlight of this year’s competition was the stellar four-judge final round panelconsisting of the Honorable Edward J. Damich of the U.S. Court of FederalClaims, former FCC Commissioner and current Akin Gump Strauss Hauer &Feld LLP, partner Kathleen Q. Abernathy, former FCC Enforcement Bureau Chiefand current partner at Wilkinson Barker Knauer, LLP, partner David H. Solomon,and the FCBA President, Jennifer Warren of Lockheed Martin.

The winner of this year’s competition was Catholic University (Jennifer Hanleyand Tyler Van Voorhees). Second place went to George Washington Law School(Colin O’Sullivan, Adam Copeland, and Neil Chilson). Tyler Van Voorhees wonthe award for Best Oral Advocate and Best Brief honors went to the team fromthe Southwestern University School of Law (Sarah R. Wolk, Lindsay E. Harrell,and Julia E. Romano). We congratulate all of competitors and sincerely thank allof the FCBA members who made this event possible. The FCBA Moot CourtCommittee is co-chaired by Amy Mushahwar and Paul Werner of Hogan &Hartson. Vinton (Vint) Cerf, will discuss policyand technical issues affecting theInternet’s evolution for 2007 andbeyond at a program presented by theEngineering and Technical PracticeCommittee on Thursday, March 22from 9:30 – 10:30 a.m. Specifically onthe policy front, among other things,he will be exploring the implicationsof net neutrality, privacy, customerfreedom of choice, Internet gover-nance, spam, fraud, authentication,etc. He will also discuss the implica-tions of technical developments suchas Internet mobile uses, audio andvideo streaming, security, broadbandaccess, QOS, etc.

Vinton G. Cerf is vice president andchief Internet evangelist for Google.Cerf served as a senior vice presidentof MCI from 1994-2005.

Widely known as one of the “Fathersof the Internet,” Cerf is the co-design-er of the TCP/IP protocols and thearchitecture of the Internet. Hereceived the U.S. National Medal ofTechnology in 1997 and the 2004ACM Alan M. Turing award. InNovember 2005, he was awarded thePresidential Medal of Freedom.

Vint Cerf serves as chairman of theboard of the Internet Corporation forAssigned Names and Numbers(ICANN) and was founding presidentof the Internet Society. He is a Fellowof the IEEE, ACM, and AmericanAssociation for the Advancement ofScience, the American Academy ofArts and Sciences, the InternationalEngineering Consortium, theComputer History Museum and theNational Academy of Engineering.

The conference revisits Open SourceSoftware, a topic last explored twoyears ago. Much has changed in thatshort time, with large institutional andpolitical entities embracing the princi-ples of Open Source to varying levelsof commitment and, possibly, withvarying levels of sincerity. The World Wide Web is often referredto as a new frontier. The once familiarclaim that no real world analogiescould explain this still emerging tech-nological frontier has given way to thereality that courts and policymakersare invariably adopting frameworksfrom old and familiar contexts to makesense of the new technological reali-ties. One promising and often suggest-ed analog is the comparison betweenthe development of Web and theAmerican West. The original frontiermarked similar claims made about theWeb—that those without access tobasic infrastructure would be leftbehind (in ghost towns); that it didnot need rules of property (with squat-ters’ rights being championed); or thatthe rule of law or centralized govern-ment was unnecessary (the Wild Westmentality). Each of those claims weretested by history in the American Westand, as to the World Wide Web, thosevery claims are being tested onceagain.

For the2006-2007 term, the Committee hasalready sponsored a number of suc-cessful events. They started the yearwith a brown bag lunch with the 8thFloor wireline legal advisors; they fol-lowed that with an extremely informa-tive session on the challenges of bring-ing IP-based services to rural areas.This session explored regulatory, tech-nical, and business issues faced bytelecommunications providers andcable operators as they invest in IP-based rural networks. In January, theCommittee sponsored a CLE seminaron cybercrime issues that featured apresentation by an attorney from theDepartment of Justice.

The Committee already has two eventsplanned for Spring 2007. On March20, they will be hosting a brown baglunch focusing on telecommunicationspractice before agencies other than theFCC. They plan to have speakersfrom the NationalTelecommunications & InformationAdministration, the Federal TradeCommission, and the Department ofJustice. In May, the Committee plansto sponsor a CLE seminar that willtake an in-depth look at the evolutionof common carrier regulation and itsfuture applicability in an IP world.The seminar will examine the originsof the nondiscrimination requirementsapplicable to telecommunications car-riers, how those requirements haveevolved in response to technologicaland competitive developments, andwhat role they should play in a marketcharacterized by competing broad-band, IP-based networks.

sion at the end of last year, but isalways interested in hearing otherideas for topics and panelists. Continuing LegalEducationCommittee The Continuing Legal EducationCommittee recently surveyed FCBAmembers as part of an effort to under-stand better how you view CLE pro-gramming and why you attend FCBACLEs. We appreciate the input ofinterested members who offered awealth on insights on how we can bestfocus of CLE programming to meetthe needs of our membership.

A significant majority of those sur-veyed prefer two-hour long CLE pro-grams in the early evening, as opposedto morning, half-day, or all-day CLEprograms. We recognize that for manyof you it is difficult to schedule time toattend the longer CLE programs, andwe will continue to provide a mix ofevents that fits your busy schedule.

Those surveyed provided a number ofsuggestions for topics for future CLEs,including programs on wireless broad-band, transactional issues related toacquisitions, copyright and digitalrights management issues, cable fran-chise reform, and technology issues.Based on the survey results, interest inthe topic is your number one reasonfor attending a CLE program; there-fore, it is critical that you let the FCBAknow in what areas you would like tosee more programming.

The CLE committee will continue towork with the FCBA leadership andCommittee co-chairs to develop con-

tinuing professional education eventsfor our diverse membership. We alsocontinue to encourage all members toget involved. Law JournalWhether by e-mail hyperlink, paperissue, or website download, FCBAmembers had ready access to anotheryear of the Association’s long-runningacademic publication, the FederalCommunications Law Journal. Overthe past year, the Law JournalCommittee continued to serve as a pri-mary point of contact between theAssociation and the Journal’s hostschool and co-publisher, IndianaUniversity School of Law-Bloomington.The Committee works with theJournal’s student editors, faculty advisor,and administrators on matters relatingto our publication contract. Throughregular conference calls and an annualon-site visit, the Committee also worksto make the student editors aware ofspecific communications-related topicsof interest to our membership and dis-cusses general issues of editorial policy.In addition, the Committee tries to facil-itate interaction between students whoare members of the Journal and mem-bers of the Association by, for example,working with the FCBA leadership tosecure tuition for attendance at theannual Comm Law 101 seminar.

The Committee has traditionally beencomprised of members with differentprofessional perspectives, including pri-vate practitioners, FCC staff, and acade-mics who specialize in communicationslaw. The current make-up is no differ-ent, with Bill Richardson, a partner atWilmer Hale and Jamison Prime, of theFCC’s Office of Engineering andTechnology and a former editor of theJournal, returning as co-chairs; and

With the encouragement of the FCBAleadership, the Committee has contin-ued to examine how scholarly publish-ing is evolving in the electronic age, andto make recommendations as to how wecould better use electronic resources toenhance the Journal’s availability andvalue to the membership. For example,a test of the feasibility of providingmembers with advance electronic accessto upcoming articles in the Journal hasresulted in a regular email that is sentafter each issue is completed but whilethe paper edition is being printed andmailed. By clicking on the hyperlinksin the text, our members have earlyaccess to Journal content without hav-ing to wait for the paper copy to work

its way through the mail. In the nearfuture, the Journal expects to launch anonline forum that will allow forresponses to articles, short reviews andnotes, and new commentary concerningcommunications law that does not lenditself to the traditional publicationprocess. This electronic enhancementwill draw from existing online endeav-ors by journals at Harvard, Yale, Texas,and other schools, and is the result ofextensive work by FCLJ FacultyAdvisor Joshua Fairfield and formerCommittee co-chair Linda Smith,among others. Look for further details– including guidelines for submissions –in next month’s newsletter.

The Committee always enjoys theopportunity to engage with law studentsand the academic community, and hasbeen encouraged by the recent work atIndiana to expand its telecommunica-tions course offerings and for the enthu-siasm and contributions of ProfessorFairfield in his role as faculty advisor.This year’s student editorial staff is hard

at work on the remaining two issues ofthe Journal, which are slated to includecontributions dealing with the competi-tive effects of the NewspaperPreservation Act, the appropriate regu-lation of telco video services, the pro-motion of intermodal competition intelecommunications markets throughnew entry, the problem of asymmetricalaccess to industry research by interestedparties in FCC proceedings, and issuesof federalism in telecommunicationspolicies. In addition, the Journal plansto publish contributions by participantsin George Mason University’s recentsymposium addressing the problem ofpublic safety interoperability.

We encourage committee members andothers in the Association to participatein the upcoming online forum, as wellas to help with our ongoing efforts toassist student writers in the develop-ment of timely and informative notes.As always, we encourage all members ofthe Association to contact the co-chairswith their comments and ideas.

FCBA Membership &MarketingCommittee toVolunteer atMartha’s Table onMarch 25On Sunday, March 25, 2007, from10:00 a.m. to 1:00 p.m. members ofthe FCBA’s Membership & MarketingCommittee will be preparing and dis-tributing food at Martha’s Table, locat-ed at 2114 14th Street, NW in DC,near the intersection of 14th and UStreets. The FCBA has been meetingmonthly to volunteer at Martha’s Tablefor many years. On the last Sunday ofeach month, one of the FCBA’sCommittees takes the lead in staffingthis volunteer effort. Volunteers areasked to bring food if possible, (e.g.,cold cuts, bread, peanut butter, jelly,vegetables and potatoes) because thecenter often runs out of donated food.If interested in participating, pleasecontact Howard Weiss, 703-812-0471,[email protected].

McKenna’s WagonSeeking Volunteersfor March 25McKenna’s Wagon is a mobile soup andsandwich wagon that goes “on location”to deliver food to the needy. For thosewho have volunteered, it has been awonderful experience and a great way tohelp the needy in the D.C. community.This is an especially good experience forthe teens and pre-teens among us whodo not have a full appreciation of themany privileges they enjoy. Communityservice credits are also available.

The Wagon is a white van that isloaded up with sandwiches, snacksand soup. We meet at Martha’s Tableat 4:45 pm in comfortable clothes andshoes. Martha’s Table is located in ayellow building at 2114 FourteenthStreet, NW, in the District, near the

intersection of 14th and U Streets.On-street parking is available.

Upon arrival we get assignments (someof us will distribute snacks and sand-wiches, others will serve soup), and puton aprons before we depart in the vanto 5th and New York Ave., NW (nearthe new Convention Center). We aredriven by one of our experienced vol-unteers and the trip to distributionlocation takes about 10-15 minutes.

We serve about 30-75 people per visitincluding a few mothers who come forfood for their families. The area iswell patrolled by police. The food dis-tribution is conducted in an efficient,calm and orderly fashion and many ofthe people we serve are quite apprecia-tive of our efforts. Once we serve allof the food, we do a clean up of theimmediate area. Total time for the dis-tribution takes about one hour and weusually return to Martha’s Table by orbefore 6:30 pm.

Chairman Robert E.Lee Scholarship andInternship Fund forLaw StudentsIn 1993 the Foundation established aScholarship and Internship Fund inmemory of former FederalCommunications Commission (FCC)Chairman Robert E. Lee, who passedaway in April 1993 after serving on theFCC for almost thirty years. ChairmanLee served as a Commissioner of theFCC for 28 years and was instrumen-tal in the early development of colortelevision, among other contributionsto federal communications policy.

For the 14th consecutive year, theFederal Communications BarAssociation Foundation will awardstipends to law students from itsChairman Robert E. Lee Scholarshipand Internship Fund. In 2007, theFoundation will award five $4,000stipends to law students employed asunpaid summer interns in positionswith the FCC and other governmentagencies or entities with jurisdictionover the communications industry(i.e., broadcasting, cable television,telephony, satellite, wireless, and infor-mation technology).

In addition, the Foundation will selectone outstanding intern among the fiveas the “Max Paglin Intern,” who willreceive an additional stipend of $600for the summer. Mr. Paglin was theformer General Counsel and ExecutiveDirector of the FCC, and the founderof the Golden Jubilee Commission onTelecommunications, which compileda definitive legislative history of theCommunications Act.

Applicants will be selected on thebasis of: (1) a demonstrated interest inthe communications field, (2) havingsecured or having pending, an unpaidsummer position (internship) for atleast 8 weeks in communications witha government agency, (3) dependenceon financial assistance in order toaccept the unpaid internship in a gov-ernment agency involved in communi-cations; and, (4) community activities.To the extent a recipient receivesunanticipated funding for the unpaidinternship, the FCBA Foundation’sgeneral policy is to reduce its scholar-ship awards by any amount that arecipient’s total funding (including allsources) for the internship would oth-erwise exceed $7,000.

Prior to assuming his current position,Assistant Secretary Barth wasCorporate Vice President and Director,Homeland Security Strategy, forMotorola’s Government RelationsOffice in Washington, D.C. In thiscapacity, Dr. Barth was primarilyresponsible for developing and main-taining working relations with the U.S.Government’s Executive andLegislative Branches in order to facili-tate Motorola’s businesses worldwide.He also managed a team that dealtwith first responder (public safety)communications issues, as well asother spectrum and telecommunica-tions regulations which directly

impacted Motorola’s internationaltrade and technology business.

Under President George H. W. Bush,Assistant Secretary Barth served on theNational Security Council staff withresponsibilities that included interna-tional trade and technology policyissues. This followed a career thatincluded various other trade and tech-nology related positions for theDepartments of Commerce andTreasury.

Assistant Secretary Barth has aDoctorate in inorganic chemistry fromthe University of Maryland and anA.B. degree from Franklin andMarshall College. He is married to theformer Ms. Carol Rabbitt ofPhiladelphia, and they have two chil-dren, Amy and Alex. AssistantSecretary Barth and family reside inthe District of Columbia.
