Letter of Explanation
To Whom it May Concern,
A variance is being requested for the property line setback to allow construction ofan 11' x 16'deck. The area is also considered to be within slopes 15% or greater.
The property is zoned R1 , which was applied to the lot decades after the site was originallydeveloped. (The ohginal dwelling on the property was constructed in the 1940s prior to theseregulations. ) The R1 zoning category is typically used on large lots that can easilyaccommodate the minimum setback requirements. The minimum lot size under R1 is 40, 000 sqft and 125' 0" of width. The subject property is 10,000 sq ft and only 25% of the minimum. Thehouse and accompanying decks/porches was originally built in what would become the frontand side yard setbacks. We, as the current owners, had nothing to do with the creation of thishardship.
The county has acknowledged the need for an exception by approving variances to construct a1 and story addition in 2006, a second story addition in 2016, and construction of a deck in2017.
Per the advice of our architect and Anne Arundel County Planning and Zoning personnel,variance and building permit applications for a deck addition in 2017 were completed in amanner that would be "most likely approved" by the county without considering what was mostappropriate for our growing family. At that time, a complete wrap-around deck should have beenapplied for because that is what was most needed. No platform/deck on the driveway side of thehouse poses a major safety risk.
We have four children under the age of five, one of which was injured after falling down the hillbecause no intact barrier or staircase existed. When loading and unloading the car, the childrenare either forced toward the street (which is a blind spot to vehicles driving by) or toward a

dangerous hill. Additionally, there is no safe way to access the walk-out basement because theoriginal staircase was derelict and falling down upon our purchase of the home. It has sincebeen removed, as it was another safety hazard.
The proposed 11' x 16' deck would only add 176 sq ft of non-impervious surface and wouldgreatly improve the quality of our family's lives.
