In that decision we interpreted and appliedin the case there i::lvolvcd section l02(g) of the Career CoopensationAct of 1949) ch. 681, approved October 12, 1949, 63 Stat. 804, 37 U.S.C.231(g) (1958 ed.), a provision of l.aoz wlUch is substantially similar to37 V.S.C. 401, centioned above.

In view of the cost savings possible through the use of conventionaltelephone lines, we believe that HllO, DOl, COLC and EPA should reevaluatetbe need for providing toll-free telephone service. If it is found thattoll-free 'service is needed, COLC and EPA should reevaluate the need forfull-time -WAIS lines.

The action to be taken by our Office with respect to the expendituresof appropriated funds in violation of law is limited to recovery of the~uat8 illegally expended. While appropriated funds were used in connec­tion with the preparation of news reports which were part of an effort toinfluence directly pending legisiation in the manner described, the amount~ended for each violation would have been relatively small and commingledv.1th proper expenditures. In view of the small am~unts involved, the diffi­culty in determining the exact amount expended illegally as well as theideatity of any particular voucher involved, we believe that it would beinappropriate for us to attempt to effect their recovery.

As you are aware, Senator Proxmire has also asked that we examine1nt~ the practices of the Federal executive departments in prOViding pre­recorded news reports to radio stations. As agreed with the Senator andyou, we will transmit to the Senator the identical information containedin this report, after you have had an opportunity to examine it. "Written reports of interviews conducted with theAmerican Iron and Steel Institute, the Motor VehicleManufacturers Association, and the Portland CementAssociation. 11

Based upon our review of the requested documents, weconclude that the interview records are exempt from disclo­sure under section 81.6(a)(5) of our access to records regu­lations, copy enclosed. This exemption specifically includes"* * * internal drafts, workpapers, memorandums between offi­cials or agencies, opinions and interpretations perpared byagency staff * * *." Moreover, we point out that, at the timethe information was obtained, it was agreed that individualand company positions would not be identified on the issuesdiscussed. "Disclosing the interview documents at this timewould be a breach of that pledge. We also point out thatrecords containing "* * * information submitted by any personto the Government in confidence or where the Government hasobligated itself not to disclose information it received* * *11 is exempted from disclosure by our regulations.
