Introduction
In the framework of public procurement decentralization, RPPA has organized a two day workshop for Public
Procurement Officers and Internal Auditors, held at Sports View Hotel Remera, Gasabo District, City of Kigali from 3rd to
4th May 2012. It was attended by 319 representatives of all procuring entities from all over the country.
Engagement in procurement processes has been sporadic or limited in scope and impact to date, reflecting constraints in
opportunity and capacity. However, there is growing recognition that monitoring of procurement processes can serve an
effective oversight function in controlling fraud and corruption in public contracting. Creating a level playing field with
transparent and fair processes for the award and implementation of contracts serves all sectors of society – government,
private sector and citizens. This is the actual RPPA mission.
Therefore, the major aim of this workshop was to discuss on issues surrounding this decentralization process and sharing
experience thereof. After different presentations and interventions, various recommendations have been set out.

2. Workshop proceedings
2.1. Opening of the workshop
The meeting was officially opened by Mr. Augustus SEMINEGA, the Director General of Rwanda Public Procurement
Authority. In his speech, the RPPA DG said that in the process of Public Procurement decentralization which began by
February 20th 2011, all public procuring entities are allowed to undertake any tender regardless of its threshold. He called
upon all participants to follow attentively different presentations and interventions to allow this workshop be beneficial to
all.

He took the opportunity to ask the assembly to adopt the workshop agenda if any amendment was not to be done, and it
has been done.
2.2. Public procurement decentralization and the contribution of RPPA in its implementation
The Director of Capacity Development (DCD) in RPPA covered a range of issues on this topic. He said that procurement
matters were an issue even during the post-colonial period until now, showing changes carried out since the very
beginning up to now and laws and regulations thereof.
In his exposé, the DCD said that RPPA is keen to professionalize the procurement profession by partnering with other
stakeholders in delivering advanced training that help people involved in public procurement develop their career and
highlighted the future trends in strengthening decentralization of public procurement. He ensured that SFB and RIAM
already establish and deliver permanent programs (short courses and academic courses) which is going to continue; and
that RPPA prepares continuous on job trainings and coaching; organizes induction and refresher courses; monitor and
evaluate the impact of training programs; supervises drafting law establishing the procurement profession; intends to
organize procurement professionals into an association and seeks adopting internal regulations and code of conduct for
the procurement association. He also answered questions relating to the decentralization process.
2.3. The advantages and challenges of implementation of public procurement decentralization
As stated by MUKANGANGO Virginie, Procurement Specialist, Rwanda Transport and Development Agency (RTDA) and
OMAR Djuma, Procurement Specialist, Rwanda Development Board (RDB), public procurement decentralization has both
advantages and challenges. As advantages, it has facilitated the tendering process where a procuring entity is the sole
responsible and has to act according to the needs without delaying in asking a non objection from RPPA for some tenders
or wait the RPPA act on its behalf for big tenders as it used to be. For challenges, the main problem is that there has been
decentralization of works (responsibilities) without decentralizing staff.

2.4. The current picture of public procurement procedures after implementation of public procurement decentralization through procurement audit results
According to Antoine KAYIRA, to better fulfill their missions, public institutions buy goods, works, services of consultancy
and other services from suppliers, entrepreneurs and consultants and payment is the key element to take into
consideration in this cycle. This purchase transaction is governed by appropriate procedures as provided for by the law
and regulations relating to public procurement.
RPPA makes audit of those procedures each year to ensure that there is respect of the fundamental principles in
allocation and execution of public contracts. Based on the analysis and interpretation of the recent results from audit, it is
noticeable that there is an indicator of improvement during the period of decentralization.
2.5. Presentation of results on assessment of best performing entities in public procurement procedures for the financial year 2010/2011
The event brought a new feature in encouraging Procuring Entities to compete in respecting tendering procedures as it
has been afforded very recently. This came with the idea of publishing the best performing entities in public procurement
procedures for the financial year 2010/2011 together with a key element of awarding them. With this perspective, there
will be a strong focus on learning from peers and selecting the right tools and approaches for the particular Procuring
Entity in tendering procedures.
2.6. Working hand in hand between Chief budget Managers and Procurement Officers & the respect of laws

In his presentation, Mr. Eugene BARIKANA called upon participant to be guided by the principle of working hand in hand
between Procurement Officers, Members of Tender Committees and Chief Budget Managers when it comes to deal with
procurement matters. He emphasized this by asking participants to always observe laws and regulations relating to public
procurement to avoid bad future consequences if they don’t do so. This came in response to many questions asked by
participants on the fact that they sometimes face challenges from Chief Budget Managers when members of tender
committees try to avoid awarding tenders with some irregularities.
2.7. Public Finance Management challenges resulting from lack of compliance with Public Procurement Law and procedures
In his presentation, the Auditor General stated that there has been a very noticeable improvement in public fund
management and asked participants to congratulate their respective institutions for that. However, he showed that there is
still being some irregularities in tendering procedures where, sometimes Procuring Entities fail to justify the awarding
aspect (lack of proofs, lack of adequate filing, etc.). He then asked them to show professionalism in their daily duties.
After his presentation, participants got time to ask him a big number of questions and their discussions mainly focused on
the perfect use of public fund as the Office of Auditor General is the supreme organ to safeguard it.
2.8. Awarding of certificates to the five best performed entities in public procurement procedures for the financial year 2010/2011.
RPPA has proceeded to the evaluation of Public Procuring Tender committees all over the country to see how they
comply with procurement procedures. During this two days workshop, the five best ones have been awarded with
certificates for their commitment or their very good performance in complying with public procurement procedures during
the year 2010/2011.

The awarded institutions are Huye District, Rwanda Bureau of Standards (RBS), Rwanda Natural Resources Authority
(RNRA), Public Sector Capacity Building Secretariat (PSCBS) and Rwanda Demobilization and Reintegration
Commission (RDRC).
During the awarding ceremony headed by the RPPA DG on behalf of Mr. Damien MUGABO, the Chairman of RPPA
Board of Directors, Huye District was represented by its Mayor, Mr. KAYIRANGA MUZUKA Eugène; RBS by its DG, Mr.
CYUBAHIRO BAGABE Marc; RNRA by DUKUZE Deus, internal auditor; PSCBS by NTARE Bonane, Coordinator of
General Services at PSCBS and RDRC by Mr. SAYINZOGA Jean, the Chairman of the Commission.
During the two days of the workshop, the Director General of RPPA discussed with participants about a range of problems
encountered all over procurement procedures. With the Director of Capacity Development, he answered questions
relating to public procurement asked by participants and coordinated all interventions thereof.
2.9. Conclusions and recommendations from the meeting
Before the end of the workshop, participants have formulated some conclusions and recommendations. Most points have
been raised and solutions proposed. Among others, participants have suggested that:
1. All tender committees’ members are required to read carefully the law no 12/2007 of 29/03/2007 on Public
Procurement in order to comply with it all over the procuring process;
2. Good plans for tenders must be done and prices checked as well as necessary before any attempt to award
tenders;
3. The idea of creating an association of Procurement Officers and Internal Auditors was raised but this point has not
been deeply discussed about to be sure of its implementation;
4. It is very crucial to harmonize a good relationship between Chief budget managers and Procurement Officers;

5. In procuring process, a good planning is required and has to be observed. However, in case of urgent non-planned
tenders , the chief budget manager and the tender committee have to consult each other to take a practical
decision thereafter and, have to refer to justifying documents if there are some;
6. Participants concluded that the best tendering must be a concern of every member of tender committee, requiring
specific knowledge in different domains;
7. It has been requested to proceed to the amendment of some articles of the Law on Public Procurement;
8. Participants also sorted out that there is no obligation to award the tender to the supplier with the lowest price.
What matters is that the tender committee agrees on that the lowest price must be of the bidder technically
qualified among his peers;
9. Participants raised the problem of that TCs be fully independent in awarding the tender even if they have this
independence as per the law on public procurement;
10. On the issue that some tender committees have a lot to do while there is not enough personnel, RPPA asked
information about to see how to solve that problem. Within the framework of well fulfilling their duties, Tender
Committees have to deal with few tenders that they are able to do correctly instead of affording many tenders they
cannot finish;
11. On the problem of procurement officers frequently leaving their jobs to seek others, it was requested that
Procurement Officers be guided by moral value of honesty even if their job presents a big number of difficulties;
12. Participants have been promised that RRA will always manage to look for their capacity development in partnership
with other institutions such as RIAM and SFB.
13. The idea of providing trainings to suppliers to help them comply with the law relating to public procurement to
harmonize procurement procedures has been supported;
14. In tender awarding process, Tender Committees must consider priorities and try to do their best in complying with
procurement procedures;

15. The report on the evaluation of the best performers in complying with public procurement procedures during the
year 2010/201 will be published at RPPA website;
16. Participants have suggested such a workshop be held annually;
17. Participants suggested that it would be better if auditing authorities such as the Office of the Ombudsman, the
Office of the Auditor General communicated their audit programs to entities to be audited;
18. Participants have been told that the security of Procurement Officers and Internal Auditors is to perform well their
duties;
19. Participants have been keen with the amendment project of the law on Public Procurement now in the Parliament
where provisions on penalties have been reviewed;
20. Internal Auditors have requested their pledge toward MINALOC to facilitate them undertake ACCA trainings.

2.10. Closing Remarks
In his speech, the RRA DG, Mr. Augustus SEMINEGA has reminded all participants that they must always compete to
fulfill duly their duties. He advised them to take into consideration all they have discussed about during this two days
workshop as it will help them comply with the requirement of the law on public procurement in their daily activities.
3. General Conclusion This workshop has been fruitful for all participants. After sharing their experiences, everyone got an idea of how to
improve their ways of dealing with their attributions. As they mentioned it in their recommendations, it would be helpful if
such meetings were held regularly to help procuring entities to be updated in public procurement matters.
