This past month I was able to take a trip to the state of Washington where I grew up and then on to Canada to see family I only get to see every once in a while. This was very exciting and rejuvenating. Arriving back to Omaha to see what mother-nature had done to my car will have to be a story for another day. As most of you know I love to bake, cook and decorate food. From time to time as you are finishing your meal, you hear the saying “save your fork,” and then see a little smile from a loving family member. I always knew something better was

coming. What might you save your fork for in your life . . . . .

It was good to see so many of you at the Saltdogs game, Spike Party and Remodelers Golf Tournament this past month. I hope to see you at the Shrine Center for our General Membership Meeting on September 12th. If you are looking for opportunities to receive training on best practices for

OSHA or Lead Safe Remodeling, there are multiple opportunities available during the month of September. Watch for dates as you read through the Lincoln Business Builder.

HBAL members continue to meet almost weekly regarding OSHA. We have participated or are scheduled to participate in meetings with Congressman Terry, Fortenberry and Smith and Senator Johanns and Nelson. In these meetings we have discussed jobs, appraisals, financing, OSHA, EPA, mortgage tax credits and other items of interest to our Nebraska delegation. Each offering different insight on how to deal with these challenges in our industry based on experience and positions in various committees in Washington D.C. Unified support from Nebraska’s representatives is necessary in order for the voices from HBAL, NSHBA and NAHB to be most effective. Unfortunately, I will remind you that if you haven’t seen OSHA on a jobsite near you, it is very likely to happen in the near future. Please prepare yourself through training, establishing programs and knowing how to respond to an OSHA inspector.

There is strength in numbers and united we have a stronger voice. As you visit jobsites, request quotes or pay bills, look to see who is a member of HBAL. There is a membership drive underway and an opportunity to receive recognition for your efforts in recruiting new HBAL members. Benefits may include double spike points, opportunity to play in our October Poker Tournament for FREE, prizes, future Spike Parties right here in Lincoln and the satisfaction that you have done your part as a member of the team. Thank you!

Benefit for the Family of Lonnie Houchin

Lonnie and his wife Becky, were involved in a tragic motorcycle accident June 25, 2011. Lonnie did not

survive the accident. Becky was life-flighted to Creighton University Medical Center with critical injuries. Becky

has since been moved to Madonna Rehabilitation Hospital in Lincoln working on recovery.

Lonnie was an avid outdoorsman and hunter. He was a member of the Shriners and an Iron Noble. Lonnie loved his Harley, and his favorite partner in crime was Doug

(Sheri) Koozer. But most especially, he loved his family and spending time with his children and grandchildren.

Lonnie had worked for Lewis Construction, Rezac Construction & Window Option Specialists. Becky is

employed with Verizon Wireless.

Does it ever seem like you jump from one schedule to the next? I think I jumped from

the summer activities schedule to the school activities schedule. A little more planning and a lot

of flexibility seems to get everything that needs to be done, completed.

I would like to first congratulate our members for making another year of the Remodelers Golf Tournament a success. The Remodelers Scholarships are fully funded for another year!

Now for the planning, there are many opportunities available this month to meet the needs of our members. It is time to plan for the Remodeling Show to be held in Chicago, October 12-15th. If you plan to attend, please let the HBAL office know so that they can share with others who are attending. If you remodel and are not certified as a Lead Safe Remodeler, sign up for one of the few remaining seats in the September 22nd class. This class is once again funded by a grant and available to our members at no cost. Additional OSHA classes, CAPS I & II and a marketing class are coming up. Information about these classes can be found in this issue of the Lincoln Business Builder.

I look forward to seeing each of you at 11:00 a.m. on September 7th at Bedient Pipe Organ Company for a tour, followed by lunch at the Shrine Center. Come see what remodeling is often required in order to custom build and fit a pipe organ into an existing building. Beauty & Craftsmanship!

Will the EPA’s July 15th announcement re: Clearance Testing eliminate the White Glove Test? There is much speculation, but the details that were outlined in the proposal printed in the May 6, 2010 Federal Register provide some insight.

Contained in that document, the EPA states that they are proposing to require dust wipe testing be performed after the following interior renovation jobs: (May 6 Federal Register, page number 25047)

• Removal or replacement of window or door frames

• Use of a heat gun below 1100 degrees F, or high speed tools (i.e. sanders) for paint removal.

• Scraping 60 or more square feet of painted surface.

• Removing 40 or more square feet of trim, cabinetry, molding or other fixtures.

• Removal of 6 or more square feet of plaster and lath by “destructive” means, which the EPA has loosely defined as that done with a sledgehammer. If you are not performing these types of work, the new ruling may not have any effect on your business.

These work sites would require dust-wipe testing by an accredited dust-sampling technician, a certified inspector, or a certified risk assessor in an EPA-certified off-site laboratory or in a mobile laboratory on-site.

In the Federal Register it is clarified that “under this proposal, dust-wipe testing would be performed after cleaning verification, not instead of it.”

If you do the types of work listed above, the proposed changes are would greatly impact the cost, procedure, timing and difficulty of performing RRP. If the EPA decides to extend the proposal for all types of work currently noted in the RRP Rule, it will mean that current methods of sampling and clearance testing will no longer be something a firm can accomplish … unless the new rule allows renovators to choose to take on more training, tools, and certification to allow compliance.

Clarification of Terms You Need to KnowSome of our readers have indicated confusion about the July 15 Clearance Testing proposal terminology and requirements, with respect to clearance testing, dust sampling, and certification levels as defined by the EPA. There is good cause for the confusion, since we aren’t lawyers and there is a lot of gray area in RRP and the proposed changes as far as how things are defined. Here are some common terms used by the EPA as they are defined in the May 6, 2010 Federal Register:

Dust-wipe sampling vs. Dust-wipe testing Dust Wipe Sampling refers to specific activity of collecting the wipe samples, not to the analysis or reporting of results.

Dust Wipe Testing goes beyond the collection. It is the collecting of wipe samples of dust on floors, windowsills, window troughs, and the analyzing of those samples for lead content, and reporting the results of the analysis to the owners and occupants of the building being renovated.

EPA is using “Dust Wipe Testing” in this notice to signal that sample analysis may be performed offsite in a traditional lab setting

or on-site by a portable lab, so long as the entity performing the analysis is accredited by National Lead Laboratory Accreditation Program.

Clearance This is demonstrating, through dust wipe testing, that the floors, windowsill and window troughs in renovation work are below regulatory clearance standards. Clearance provides permission for occupancy and further work to continue and signals the finalization of on-site RRP work.

Certified Renovator vs. Dust Sampling TechnicianCertified Renovator is the basic certification level that every firm performing RRP work must have. It is important to note that the certified renovator is not the same as a Dust-sampling technician, which requires further credentials. To become an EPA-certified dust sampling technician, an individual must successfully complete the appropriate course accredited by EPA under §745.225.

A Dust Sampling Technician can perform dust clearance sampling. The Dust Sampling Technician is also able to prepare the final clearance report based on the results from the EPA-certified lab.

Risk Assessors and Certified InspectorsA lead risk assessor is trained to conduct risk assessments. He can also sample for the presence of lead in dust and soil for the purposes of abatement clearance testing.
