The Santa Cruz Association of REALTORS® held its Annual Golf Tournament on August 20 th 2004 at De Laveaga Golf Course. This event raised over $12,000 for Families in Transition, Women’s Crisis Center, Habitat for Humanity, Second Harvest Food Bank, and the Santa Cruz Association of REALTORS® Housing Foundation. This year, we had the honor of entertaining Jim Hamilton, C.A.R’s incoming President, who flew up from Redondo Beach to join us for the day. Over 140 golfers and 20 local real es- tate related companies contributed to the success of the event. Thanks to the help of the REALTORS® and many commu- nity businesses, such as Title companies, Annual Golf Tournament Raises over $12,000 for Local Charities Mortgage Lenders, Home Inspectors, Ter- mite companies and the many other local merchants that donated goods or services to be won as raffle prizes. If you missed out on the fun, don’t let it happen again. You don’t need to be a golfer to participate. There are many opportunities to volunteer on-site the day of the event, or in planning for the event. Every year we get more and more people to join in the fun, and each year we raise just a bit more money than last year. So don’t get left out. As is often the case, many activitiesand functions within the Santa Cruz As-sociation of REALTORS® go on yearafter year without many of our membersbeing aware of how these activities areaccomplished. The Affiliate Committeemay be a case in point.

The Affiliate Membership is com-prised of the designated representativesof companies that are Affiliate membersof the Santa Cruz Association of REAL-TORS®. Most Affiliate members arecompanies actively engaged in somefacet of the real estate business other thana REALTOR® engaged in representingbuyers and sellers. Typical Affiliatecompanies include title companies,mortgage lenders, banks, appraisers, pestcontrol companies, sign companies, ar-chitects, publications, home inspections,attorneys, roofers, insurance companiesand vendors such as flooring, repair andmaintenance. Current SCAOR Affiliatemembership is now in the neighborhoodof 100 members.

Welcome to the second issue of ournewly redesigned newsletter. There is alot of progress being made on manyseparate fronts at the Association thesedays, and the new newsletter is represen-tative of the many improvements beingmade throughout SCAOR, as we striveto continually provide more value to ourmembers.

The major undertaking of 2004 hasbeen the creation of the Santa Cruz As-sociation of REALTORS® HousingFoundation (SCAORHF). SCAORHF isan autonomous charitable foundationthat is in the final stages of organization.The Foundation was recently grantedtax-exempt status from the State of Cali-fornia Franchise Tax Board, and we hopeto complete the arduous process with theInternal Revenue Service soon. Thisyear, the Board of Directors also ap-proved a Strategic Plan that gives theorganization a clear vision of where weare heading, and incorporates measur-able goals and objectives that ensure weare accomplishing what we set out to do.

As part of that plan, a Marketing & Pub-lic Relations Committee has been intro-duced to the organizational structure toincrease our exposure throughout thecommunity. The new design of this pub-lication furthers that goal as well.

I am very pleased with the look andfeel of the new newsletter, and also quiteproud of its evolution over the past twoyears. In addition to increasing the edi-torial content, you will notice that thenewsletter has increased its advertising,hoping to provide additional exposure forthose companies targeting the SantaCruz real estate community. We are cog-nizant of the ratio of editorial content toadvertising space, and have alreadyadded an additional 4 pages to this issueto allow for more editorial content, en-suring a better mix.

Advertising specific property listingswill not be included in this or future is-sues of the newsletter. The associationis not interested in competing with themany media outlets throughout the com-munity that are already successfully per-

forming these services. Brokerage re-cruitment ads will be discouraged aswell. SCAOR has built an invaluablesense of community – an atmosphere ofnetworking and education – thatshouldn’t be jeopardized by allowing theassociation to become a recruitingground for agents.

The SCAOR newsletter is a dynamicprocess that will be continually improv-ing with each new issue. If you haveany comments or suggestions on howthis publication may be of more value tothe members, please let me know. Youmay reach me at 464-2000 or [email protected].

...to increase communication, the SCAORPresident-Elect has been added to this com-mittee, it’s one standing REALTOR®member. Each year the current President-Elect takes this role. The Chairman of theAffiliate Committee is chosen in the samefashion as all other committee chairs withinthe Santa Cruz Association of REAL-TORS®. The seated President appointsthe Committee Chairs, and allows them topull together their committee for that year,with the final committee roster being ap-proved by the SCAOR Board of Directors.

In 2004, the Board of Directors approvedan SCAOR Strategic Plan. One compo-nent of that plan established specific ob-jectives to be accomplished by each of thecommittees. The Affiliate Committee ob-jectives fell under Goal 5, “To market andcommunicate the benefits and value of theREALTOR® and the REALTOR® Asso-ciation to both the public and our mem-bers.”

The Affiliate Committee is actively in-volved in many aspects of our REAL-TOR® Association, with a current empha-sis in three areas: Fundraising and Char-ity events, Social Activities and Education.· The Affiliates are responsible for put-ting on the annual Golf Tournament fundraiser which benefits Families in Transi-

Total State Existing-House Sales Set Record in 2Q, NAR ReportsStrong housing market fundamentalspropelled total existing-home sales to thehighest pace on record in the secondquarter, according to the NATIONALASSOCIATION OF REALTORS®.Sales rose by double-digit rates in 34states and the District of Columbia com-pared to the same quarter in 2003, andno state recorded a decline. Completedata for two states was not available. TheNAR survey showed that nationwide, theseasonally adjusted annual rate of exist-ing single-family, apartment condo-minium and co-operative home sales to-taled 7.79 million units in the secondquarter, up 16.0 percent from the 6.72million-unit pace in the second quarterof 2003. The previous record was a salesrate of 7.36 million in the third quarterof 2003.Low Rates Not Only FactorDavid Lereah, NAR’s chief economist,says low mortgage interest rates are onlypart of the picture. “Technology stream-lining in mortgage origination has re-duced costs in recent years through in-creased efficiencies,” he says. “Combinethat with low interest rates and a strongdemand from both the growing and ag-ing segments of the population, alongwith rising consumer confidence in animproving economy, and you have both

the wherewithal and the need to create arecord housing market.” According toFreddie Mac, the national average com-mitment rate for a 30-year conventionalfixed-rate mortgage was 6.13 percent inthe second quarter, up from 5.60 percentin the first quarter. The rate was 5.51percent in the second quarter of 2003—the lowest quarterly average since theseries began in 1971.NAR President Walt McDonald, broker-owner of Walt McDonald Real Estate inRiverside, Calif., says favorable marketconditions are expected to continue.“Mortgage interest rates have come backdown to the 6.0-percent range over thelast few weeks,” he says. “Althoughmortgage rates will trend gradually up-ward, they will remain historically low.What won’t change is the demographicdemand from more people entering theyears in which they typically buy a firsthome, which is freeing existing ownersto make another purchase and keep homesales at a higher plateau than we saw inthe beginning of this decade.”Nevada, Idaho Record Biggest GainsThe strongest year-to-year increase wasin Nevada, where the second quarter re-sale pace rose 32.5 percent over the sec-ond quarter of 2003. Next came Idaho,which rose 31.0 percent from a year ago.

Arizona posted the third highest in-crease, up 25.1 percent from last year’ssecond quarter rate. Regionally, the Westexperienced the strongest increase withsales activity in the second quarter at arecord annual rate of 2.17 million units,up 19.8 percent from a year ago. AfterNevada, Idaho and Arizona, the nexthighest increase was in Colorado, whereexisting-home sales rose 23.5 percent.Oregon re-sales were up 21.8 percentfrom the second quarter of 2003. TheSouth, with a record resale rate of 3.17million units, posted a 17.5 percent risefor the second quarter of 2004 comparedwith the same quarter a year ago. Thestrongest increase was in North Carolina,where the resale pace was 24.8 percenthigher than the second quarter of 2003.South Carolina was up 23.5 percent,while Florida rose 22.8 percent in the lastyear.Record Pace in NortheastIn the Northeast, total existing-homesales jumped 12.6 percent to a recordpace of 903,000 units in the second quar-ter from the same period a year ago.Leading the region was Connecticut,where existing-home sales rose 23.3 per-cent from the second quarter of 2003.At the same time, both Massachusettsand New Jersey increased 22.5 percent

while Maine was up 20.3 percent. In theMidwest, total existing-home sales in-creased 10.1 percent to a record annualpace of 1.54 million units, comparedwith the second quarter of 2003. Thestrongest increase in the region was inNorth Dakota, with a gain of 19.8 per-cent in resale activity over the same pe-riod in 2003, followed by Kansas with arise of 15.2 percent, and Minnesota,which increased 13.8 percent.

The exceptionally strong perfor-mance of home sales this year, com-bined with a favorable economy andaffordability conditions, means therecord expected for housing this yearwill be larger than earlier projected,according to the National Associationof REALTORS®.

David Lereah, NAR’s chief econo-mist, said the biggest surprise this yearhas been the performance of interestrates. “At the end of 2003, most econo-mists expected a gradual rise in mort-gage interest rates,” he said. “In real-ity, they declined in the first quarter,shot up during the second quarter andthen came back down. The bottom lineis mortgage interest rates have beenlower than expected, the economy isimproving and jobs are being createdin an environment of strong housingdemand – all favorable factors forrecord home sales.”

Lereah said the 30-year fixed-ratemortgage should gradually rise to 6.4percent in the fourth quarter. The av-erage rate for all of 2004 is expectedto be 6.1 percent, only modestly abovelast year’s 5.8 percent. Nearly a mil-

lion jobs have been created in the lastfive months, and unemployment is pro-jected to drop to 5.2 percent in thefourth quarter.

“The momentum of existing-homesales this year is unprecedented, risingsteadily each month and hitting a newrecord in June,” Lereah said. “In addi-tion, new-home sales have been at ornear-record levels each month in 2004.”

NAR forecasts existing-home sales torise 5.7 percent this year to 6.45 mil-lion, well above the record 6.10 millionin 2003. New-home sales also shouldhit a record, increasing 10.8 percent to1.20 million in 2004. Housing starts areexpected to come in at 1.90 million, 2.6percent above 2003, and would be thestrongest level of housing constructionsince 1978.

The median existing-home price willcontinue to show above normal appre-ciation, rising 7.3 percent in 2004 to$182,400. The median new-home priceshould increase 8.3 percent this year to$211,100.

Lereah forecasts the U.S. gross do-mestic product to grow 4.5 percent in2004. At the same time, the Consumer

Price Index is expected to increase 2.8percent. Inflation-adjusted disposablepersonal income should rise by 3.5 per-cent this year, while the consumer con-fidence index is forecast to reach 107by the fourth quarter.

On June 23, 2004, GovernorSchwarzenegger signed into law Assem-bly Bill 920—new legislation sponsoredby C.A.R. which simplifies the disclo-sure of airport influences and indus-trial use zones in real estate transac-tions, and makes minor but beneficialchanges to the Natural Hazard Disclo-sure Statement (NHD). Unfortunately,C.A.R. has recently learned of misin-formation that is being circulated re-garding AB 920...misinformation thatis now causing confusion in the RE-ALTOR® community. The purpose ofthis Realegal is to set the recordstraight on AB 920.

Effective January 1, 2005, AB 920alters the NHD form to allow a sellerand his or her agent to specifically dis-close, via a checkbox, whether the in-formation in the NHD was prepared bya third-party company as a “substituteddisclosure”, and acknowledges that theseller and agent used good faith in se-lecting the report provider. Many RE-ALTORS® are being told that the dutyto use good faith in choosing a disclo-sure company represents a significantchange in the law that could increase a
