Bihar polls in 3 phases; counting on Nov 10: EC PRESS TRUSTOF INDIA

New Delhi, 25 September

Voting for Bihar assembly elections will be held in three phases on October 28, November 3 and

November 7 in one of the biggest elec-tions globally during the Covid-19 pan-demic, followed by counting of votes on November 10, the Election Commission announced on Friday.

The ruling NDA in the politically-crucial state will face a challenge from the RJD-Congress alliance, though uncertainty still prevails over the com-position of the two main political blocks and about a number of smaller parties as to which way they will go in this bat-tle of alliances.

While the BJP-JD(U) alliance and the Congress-RJD combine are firmly in place, a key NDA member LJP and some oppo-sition parties like former Union minister Upendra Kushwaha-headed RLSP have kept their options open. The announce-ment of dates by the Election Commission is likely to speed up the process of political realignment in the coming days.

In the outgoing assembly, the RJD has 80 members while the JD (U) has 69. The BJP has 54 seats, Congress has 25, while the remaining seats in the 243-member assembly are held by other parties.

The NDA has already announced that JD(U) president and Chief Minister Nitish Kumar will be its face for the top job in the state, which has an estimated 7.29 crore voters. The BJP said it is fully prepared for the elections and exuded confidence that it will form the government with a three-fourth majority, while Kumar and his party also welcomed the election dates and said it was confident of a win. The RJD, on the other hand, asserted that people of the state have made up their mind for a change of government.

Political activities have already intensi-fied in the state with all major parties having stepped up their efforts in the last few months, despite the pandemic situation, while a number of projects have been announced by Prime Minister Narendra

Call on bypolls on Sept 29, says CEC PRESS TRUST OF INDIA

New Delhi, 25 September

The Election Commission will take a call on bypolls to one Lok Sabha and 64 assembly seats on September 29 after going through inputs provided by poll officials and chief secretaries of the states concerned, Chief Election Commissioner Sunil Arora

said on Friday. Responding to

questions on the issue during a press conference to announce the schedule for Bihar assembly elections, Arora said EC Secretary General Umesh Sinha will issue a press release of the schedule the same evening based on the decision taken at the poll watchdog.

Earlier, the EC had said in a statement that Bihar elections and the bypolls will be held around the same time.

Arora said when the EC had decided on holding the bypolls along with Bihar elections then it had no inclination towards some states sending representations to raise issues related to the bypolls.

Chennai police book Franklin, top execs for 'fraud' T E NARASIMHAN

Chennai, 25 September

The Economic Offences Wing (EOW) of the Chennai Police has registered a first information report (FIR) against the beleaguered Franklin Templeton Asset Management India (FTAMIL)

and Franklin Templeton Trustee Services (FTTSPL) for an alleged criminal con-spiracy to defraud 300,000 investors by causing wrongful loss to them and unlawful gain to themselves.

The FIR also named Santosh Das Kamath, MD and chief investment officer, FTA-

MIL, Sanjay V Sapre, whole time member, FTAMIL, and their directors Jayaram Subramaniam Iyer, Vivek Kudva, RV Subramaniam, and Pradip P Shah, among others.

While EOW officials were not available for comment, Manoj Sheth, president, Chennai Financial Markets &

Accountability (CFMA) con-firmed the development.

The EOW registered the FIR after investigating a com-plaint filed by CFMA, the investors' group, and a few others with EOW in Chennai in May this year in the interest of millions of aggrieved inves-tors of Franklin Templeton.

A good Friday... There is scepticism about the sustainabil-ity of the rally. "The factors that were weighing on the market, such as the emer-gence of a second wave of the pandemic and rising geopolitical tensions, may con-tinue to influence it in the coming weeks," said Thomas.

Overseas investors remained net sellers despite the sharp rebound in stocks. On Friday, they sold shares worth more than ~2,000 crore, taking their six-day selling past the ~10,000-crore mark.

Experts said the strengthening of the US dollar was weighing on foreign investor sentiment. If the US stimulus comes through, it will be a boost for the markets, they said. "All the foreign flows coming into India were connected to some stimu-lus package somewhere or the other. Another stimulus package will enthuse the markets, and some of it will trickle down to India. There are reports of a package by the Indian government. But last time when they announced a package, it was not appreciated by the market. The market is hoping that this time, there will be a lot more of pumping money into the econ-omy," said U R Bhat, director, Dalton Capital India.

Domestic institutions were net buyers to the tune of ~2,000 crore on Friday.

All the 30 Sensex components ended in the green, with Bajaj Finserv gaining the most, at 6.9 per cent, followed by HCL Technologies and Bharti Airtel, rising 5 per cent each. The market breadth was posi-tive, with 1,972 stocks advancing and 682 stocks declining.

Govt plans floor price... For April-September 2020, the domestic natural gas price was set at $2.39 per mil-lion metric British thermal unit (mmBtu), which is expected to be $1.8-$1.9 mmBtu during the October 1-March 31 period of FY21. "Based on the current formula, prices were going down. Hence, there was demand coming from producers, espe-cially ONGC, to give a support price or basic floor price, as prices are expected to go further down in the upcoming cycle," said the official.

Under the current norms, the price of domestic gas is linked to a formula that is indexed to the weighted average of global benchmarks like Henry Hub, Alberta gas, NBP, and Russian gas. The price is fixed for six months based on the formula pric-ing of the preceding six months. Besides, the government through the PPAC also notifies a cap price for difficult fields.

For producers like ONGC, gas prices

are much lower than per barrel operating expenditure, resulting in negative returns even at the current price. The average cost of production of natural gas by ONGC was around $ 3.6 per mmBtu during the last financial year, which means the company will only be earning about half its operat-ing cost if prices are revised to $1.8-$1.9 per unit. The new floor price is likely to be set based on an international benchmark. Industry experts indicate the floor pricing may be set somewhere around $3 a unit.

"If a floor price is set, there will be a temporary relief for producers as prices are falling and the demand for natural gas is going down internationally. There is excess natural gas in the market, with LNG prices also declining. I believe that they should give away with the formula and it should be a free market price, which will ensure that producers will get better returns," said Ashu Sagar, secretary gen-eral of the Association of Oil and Gas Operators. He added the current formula was defective as an energy short market (India) was following an energy excess market as its base.

Consumer goods... In the last nine months, for instance, the value share of FMCG within e-commerce increased to 12 per cent, Nielsen said, thanks to the steady shift of consumers online during the pandemic. But mobile phones continued to contribute 48 per cent, fashion 18 per cent, and appliances and electronics 17 per cent to e-commerce sales, it said.

"Our recent survey among CXOs shows that most of them are now focussed on e-commerce than they were before the pan-demic. And many are paying attention to last-mile delivery," said Shukla.

Traditional and modern trade owners, he said, were optimising shelf space to improve sales.

demic trend. While India's economy continues to do

better than its peers at a similar level of income on 10-year weighted average real GDP per capita, its performance on this metric has weakened somewhat. Even prior to the onset of the pandemic, the economy had slowed measurably.

The existing vulnerabilities, including a weakened financial sector, rigid labour markets, and weak private investment, could hamper economic recovery.

Vodafone wins... The company said in a statement: "Vodafone confirms that the investment treaty tribunal found (the case) in Vodafone's favour. This was a unanimous decision, including India's appointed arbi-trator Mr Rodrigo Oreamuno. The tribunal held that any attempt by India to enforce the tax demand would be a violation of India's international law obligations."

The finance ministry said in a state-ment the government would study the award. A senior official, however, said, "Implementation of foreign tribunal award decisions is governed by the Indian Arbitration Act, and the government is not obliged to accept the award."

Finance ministry sources said the gov-ernment had defended its position in the arbitration panel, saying it had sovereign right to tax capital gains on the transfer of assets located in India and was well within its right to take all measures to stop avoid-ance of taxes through indirect transfers via tax havens.

They said Parliament rightly clarified its intent through an amendment in the Income-Tax Act and therefore such meas-ures could not be opposed by simply label-ling it as a retrospective amendment. The question is, should the government have allowed such loopholes to continue, asked the sources. The answer is obviously no. "It (the government) is duty-bound to take all steps to protect public money and exchequer, and if there is any attempt to avoid the taxes by routing the transaction through a tax haven like Cayman Island, it was entitled to take all measures, includ-ing amendments to law, to stop such abuse," said a source.

Vodafone has not paid the department anything and hence the question of refund does not arise. But write-off is also ruled out and tax demand raised against the tele-com major will remain, an official said. Together with the cost imposed on India by arbitration, this will be around ~85 crore only, the official said.

Sources said the government might have to refund ~45 crore only if it does not go for appeal against the award. More on business-standard.com
