Appeal of a mother in Morong 43

a FTER denying the petition filed by Morong 43 mother Carina Judilyn Oliveros for temporary release for humanitarian grounds, the local court ordered that

she and her newborn son be transferred to a hospital.Oliveros is one of the 43 health workers arrested on Feb.

6 in Morong, Rizal. The 43 were charged with illegal posses-sion of firearms and explosives. They were detained at Camp Capinpin in Tanay, Rizal before being transferred to a deten-tion facility at Camp Bagong Diwa in Bicutan.

Oliveros gave birth by cesarean section to her first child last July 22 at the Philippine general hospital (Pgh). On aug. 18, the jail guards hauled Oliveros, together with her son, back to jail. Presiding Judge gina F. Cenit-Escoto of the Morong Regional Trial Court Branch 78 ordered the transfer, saying that there is no basis to grant the petition for temporary

release filed on Oliveros’s behalf by her counsels.The mother and child joined the rest of the Morong 43

women detainees in an overcrowded, damp and poorly ventilated detention cell where rats, bed mites and other insects are found.

Oliveros’s lawyers filed an appeal, and in a decision issued august 25, the Morong court ruled that mother and baby be allowed to stay at the Pgh for three months so that the mother could breastfeed her child.

Even as the petition for her temporary release was not granted, Oliveros, her legal counsels and supporters never-theless welcomed the court’s decision.

“…the grant of the instant motion would result to avoid-ance of any harm and danger that the child may suffer while in Camp Bagong Diwa, including the unjust incarceration of the said child in a detention facility,” the order stated.

as of press time, Oliveros and her baby are still at Camp Bagong Diwa. The jail warden has received the official copy of the order this morning, according to the health alliance for Democracy (head).

“This welcome development is clearly the result of the unwavering perseverance of the detainees, their families and supporters to further the call to free the Morong 43,” Carlos Montemayor, spokesperson of the Free the 43 health Work-ers! alliance said in a statement.

However, Montemayor criticized jail officials for delaying the transfer of Oliveros and her baby to the Pgh. “Despite the august 25 court order and the jail warden’s personal knowledge of the decision, jail officials are delaying the transfer of Judilyn and her son citingreasons that are plainly unacceptable,” he said.

“Every hour that the mother and baby spend inside the jail is a risk to the latter’s health and welfare. The baby’s stay with his mother inside detention is also tantamount to his unjust incarceration,” Montemayor added.

Senate President Juan Ponce Enrile has filed a bill seeking to increase the exemption on estate tax to help those inheriting real property, especially houses, from their deceased parents or relatives cope with the continuing rise in the cost of living.

“Persons inheriting homes from deceased parents or relatives usually are overburdened by the estate tax which they could ill afford. The inability to pay the estate tax forced some heirs to just sell their inherited property,” Enrile stressed.

Under Senate Bill 132, Enrile called on Congress to exempt from the estate tax homes with a fair market value not exceeding P10 million, from the current P1 million.

In particular, Enrile wants Congress to amend Section 86 of RA 8424.He said the the prevailing provisions of Republic Act No. 8424, as amended,

allow for the deduction from the gross estate an amount equivalent to the current fair market value of the decedent’s family home up to P1 million.

According to the lawmaker, despite the deduction, the increasing value he family home nowadays and its inclusion in the computation of the estate tax contribute significantly to the amount to be paid by the surviving spouse.

SENDING of lewd messages through texts, elec-tronic mail, and internet will soon become punishable as Senator Loren Legarda has filed a bill amending the “Sexual Harassment Law.”

Legarda filed Senate Bill No.1412 expanding the medium of communication by which demands and requests for sexual favors constitute acts of sexual harassment, as defined under Republic Act 7877.

The lawmaker said Under SBN 1412, Section 3 of the said law states:

“The act or the sending of text messages, electronic mail or other similar means, making sexual advances or lurid remarks, causing embarrassment to the receiver or by their nature may qualify as vulgar, smutty, sexist, obscene or malicious."

According to Legarda, it will also be punishable un-der SBN1412 if the sexual favor is made as a condition in the hiring or in the employment, re-employment or continued employment of said individual, or in grant-ing said individual favorable compensation, terms, conditions, promotions, or privileges; or the refusal to grant the sexual favor result in limiting, segregating or classifying the employee which in any way would discriminate, deprive or diminish employment oppor-tunities or otherwise adversely affect said employee.

Legarda said the above acts "would impair the employee's rights or privileges under existing labor

laws" or "would result in an intimidating, hostile, or of-fensive environment for the employee."

“In an education or train-ing environment, sexual harassment is committed through oral, written or with the use of a telephone, cellular phone, fax machine, electronic mail or other simi-lar means against one who is under the care, custody or

supervision of the offender,” she explained.“RA 7877 enacted in 1995, is a landmark law

providing a comprehensive policy and legal frame-work for the recognition of the problem of sexual harassment and penalizing perpetrators of said crime,” she added.

Legarda added that data from the National Tele-communications Commission (NTC) showed there are more than 1.4 million subscribers of internet services and an estimated 35 million subscribers of telecommunication services. OFFICIALS in Michael Jackson's hometown of Gary, Indiana are plan-ning a birthday tribute over the weekend, particularly on August 28, the day before what would have been the late singer's 52nd birthday.

None other than Jackson's hometown is planning a birthday tribute to the singer to honor the King of Pop’s contribution to the music industry.

The late ‘Thriller’ hitmaker -- who died of acute Propofol intoxication at his home in Los Angeles on June 25 last year -- will be honored with a spe-cial ‘This Is It’ birthday party outside his childhood home in Gary, Indiana on Saturday.

Gary Mayor Rudy Clay said: “The passing of our favorite son, Michael Jackson, is still fresh in our hearts. A year later, on the day before his birth-day, we honor his memory as a great and giving person and as the world's greatest entertainer.”

Michael's father, Joe Jackson, will attend a cake cutting ceremony at the tribute, which will also feature a group ‘Thriller’ dance.

As well as the birthday celebrations, a separate four-day MJFanvention begins in the town tomorrow (26.08.10).

The main attraction at the fan event will be a special tribute concert on Saturday, featuring Tony Award-winner Melba Moore and the late singer's former tour guitarist Jennifer Batten, as well as impersonator Edward Moss and a choir of Indiana residents.

A stage production based on the life and music of the legendary singer entitled ‘Yesterday, Today & Forever’ will also take place in the town on Thursday (26.08.10).

Michael's mother Katherine Jackson unveiled an eight-foot granite plaque in his honor at the house in Gary on the fi rst anniversary of the King of Pop's death earlier this year.

The Jacksons left Gary in 1969 after the Jackson 5 became a success-ful recording group. The Jackson Family Foundation – headed by the late singer's father – is planning to build a multi-million-dollar museum, golf course and performing arts centre in Michael's honor in the town.

But, in totality I’m very happy [for] the movie. First time kong napanood yung pelikula.

OFFICIALS in Michael Jackson's hometown of Gary, Indiana are plan-ning a birthday tribute over the weekend, particularly on August 28, the day before what would have been the late singer's 52nd birthday.

None other than Jackson's hometown is planning a birthday tribute to the singer to honor the King of Pop’s contribution to the music industry.

The late ‘Thriller’ hitmaker -- who died of acute Propofol intoxication at his home in Los Angeles on June 25 last year -- will be honored with a spe-cial ‘This Is It’ birthday party outside his childhood home in Gary, Indiana on Saturday.

Gary Mayor Rudy Clay said: “The passing of our favorite son, Michael Jackson, is still fresh in our hearts. A year later, on the day before his birth-day, we honor his memory as a great and giving person and as the world's greatest entertainer.”

Michael's father, Joe Jackson, will attend a cake cutting ceremony at the tribute, which will also feature a group ‘Thriller’ dance.

As well as the birthday celebrations, a separate four-day MJFanvention begins in the town tomorrow (26.08.10).

The main attraction at the fan event will be a special tribute concert on Saturday, featuring Tony Award-winner Melba Moore and the late singer's former tour guitarist Jennifer Batten, as well as impersonator Edward Moss and a choir of Indiana residents.

A stage production based on the life and music of the legendary singer entitled ‘Yesterday, Today & Forever’ will also take place in the town on Thursday (26.08.10).

Michael's mother Katherine Jackson unveiled an eight-foot granite plaque in his honor at the house in Gary on the fi rst anniversary of the King of Pop's death earlier this year.

The Jacksons left Gary in 1969 after the Jackson 5 became a success-ful recording group. The Jackson Family Foundation – headed by the late singer's father – is planning to build a multi-million-dollar museum, golf course and performing arts centre in Michael's honor in the town.

Benefi ts for barangay offi cialsBARANGAY offi cials who would be able to serve

three terms can now look forward for more benefi ts, as the City Council has approved the unique ordi-nance penned by Liga ng mga Barangay President and Valenzuela City Councilor Alvin Feliciano.

Ordinance 001 series of 2010, also known as “Standardized Barangay Offi cials Welfare Benefi ts,” aims to provide additional benefi ts for barangay offi cials who can complete three successive terms in offi ce.

The ordinance states that a barangay captain would be entitled to P100,000 while a barangay councilman (kagawad) would be entitled to P30,000 once they complete three successive terms.

Meanwhile, barangay offi cials who would be able to serve three terms in succession but in different positions would still be able to get cash benefi ts, the worth of which would depend on the position involved.

Aside from this, hospitalized barangay offi cials would be given a P5,000 cash benefi t. Families of departed barangay captains will be able to receive P50,000 while those of councilmen will be entitled to P25,000.

Feliciano said the ordinance is meant to recognize the hardworking barangay offi cials who take on heavy responsibilities day by day.

“Alam natin kung ano ang hirap ng trabahong nakaatang sa balikat ng mga barangay offi cials at sa pamamagitan ng pagbibigay sa kanila ng benepisyo ay masusuklian ng lokal na pamahalaan ang kanilang naibigay na serbisyo sa kanilang mga kabarangay,” Feliciano said.

He pointed out that barangay offi cials from all over the country are waiting for the implementation of section 393 of the local government code which also enumerates the benefi ts that they are entitled to.

THE Quezon City government, on orders of Mayor Herbert Bau-tista, is setting aside P500 million for the modernization of the city’s day-care and health centers.

The Mayor said his admin-istration shall be utilizing the 20 percent mandatory reserve in the city’s community development fund to bankroll the modernization pro-gram which underscores the city’s continuing efforts to strengthen the foundation in the delivery of basic health services and early-education among pre-school children.

Already, the Mayor has direct-ed the engineering department to prepare the physical development plan as well as the costing plan. Mayor Bautista wants both physical and costing plans submitted by the end of September this year.

Mayor Bautista hopes to achieve a 70% to 80% completion rate of the modernization plan before his three-year term ends in June 2013.

The plan includes the construc-tion of 10 additional day-care centers in the city’s barangays to

provide children from poor families a good headstart when they enter regular schooling and level up with the quality of education offered in private schools for well-to-do- children.

The Mayor unveiled the city government’s modernization plan for its day-care program when he led city offi cials during the signing of a memorandum of agreement with Miriam College aimed at profession-alizing the teaching and management of barangay-based day -care centers in QC.

Under the agreement, an ad-ditional 128 Quezon City day-care workers have been given sponsorship by the city government to complete a two-year certifi cate course in teach-ing early childhood education at Miriam College as part of a continu-ing effort to upgrade the quality of day-care instruction in the city.

Joining the Mayor in signing the agreement was Dr. Maria Lourdes Quisumbing-Baybay, dean of the College of Arts and Sciences, and QC social services development depart-ment chief Teresa Mariano.

The teaching certificate pro-gram, now on its third year of implementation, has already ben-efi ted 100 QC day-care workers, who are scheduled to graduate in October this year.

“This is a milestone program for the city government, especially to the social services development department. What we now have is further institutionalizing the partner-ship between the QC government and Miriam College,” said Mayor Bautista.

As provided under the agree-ment, the city government shall be paying Miriam College the amount of P12,226 for each enrollee cover-ing payment for tuition and other fees every semester.

Aside from the two-year cer-tificate course, the school also offers QC day-care workers with an enrichment course on commu-nity development. Age-appropriate curriculum was also developed by Miriam College.

To date, the city has about 272 day-care centers spread over QC’s 142 barangays.

Quezon City modern day-care, health centersSENIOR citizens from 60 to 69 years old will be covered by a new free

immunization program under President Aquino's fi rst national budget, Cavite Rep. Elpidio Barzaga, Jr. said over the weekend.

Barzaga said some 865,950 seniors all over the country would benefi t from the vaccination program in the proposed General Appropriations Act of 2011.

”They will be given pneumococcal and infl uenza shots every fi ve years,” he said.

Barzaga also said a total of P871 million has been set aside to provide a P500 monthly pension to some 145,150 poverty-stricken seniors who are 80 years old and above.

He said indigent seniors who currently do not get any old-age pension from either the Social Security System (SSS) or the Government Service Insurance System (GSIS) stand to benefi t from the monthly allowance.

“This may not be much. But to seniors who are not getting any fi nan-cial support whatsoever, P500 monthly will surely provide some relief,” Barzaga pointed out.

The lawmaker from Cavite also said he expects seniors to benefi t from the government's expanded free health insurance coverage for needy families.

In the 2011 budget, he said a total of P3.5 billion has been allotted to pay for the Philippine Health Insurance Corp. (Philhealth) premiums of 4.6 million indigent families.

Apart from this, Barzaga said seniors would benefi t from the P1 billion allocation for the Department of Health's continuing implementation of the Cheaper Medicines Act.

He said the P1 billion includes P98 million to fund the installation of 3,931 new Botika ng Barangay outlets, each to be initially provided with P25,000 worth of low-priced medicines.

During the high schoolers’ spring ministry trip to Jamaica, they visited a home for troubled teens who had run afoul of the law or whose families could not handle them.

ConTrACTUAl workers in the govern-ment will get a permanent position if they completed 10 years in public service.

Manila 5th District Rep. Amado S. Bagatsing has filed House Bill 226 that grants civil service eligibility to government workers who have worked continuously for 10 years.

Bagatsing said many workers like garden-ers or street sweepers are hired on a casual or contractual basis for government’s numerous special projects and programs.

Republic Act 6850 was enacted in 1990, granting Civil Service Eligibility to government employees with provisional or temporary appointment who have

continuously rendered government service for seven years.

Bagatsing said the law failed to include casuals or contractuals, co-terminus and other legitimate regular plantilla positions such as office utility aide, office utility as-sistant and their equivalents.

Solon wants casual employees become permanent

A GroUP cam-paigning for a “litter-free Pilipinas” wel-comed the decision by the Metro Manila Development Author-ity (MMDA) to revive an anti-littering policy that has been dormant for years.

The EcoWaste Coali-tion said that the move to resuscitate MMDA Regulation No. 96-009 as amended by MMDA Regulation No. 99-006 should strengthen the agency’s operations, in collaboration with local government units (LGUs), to clear the streets and waterways of trash.

MMDA Chairman Francis Tolentino vowed to implement the littering ban such as the dumping and disposal of trash in pub-lic places as embodied in the said regulation that penalizes violators with a fine of P500 to P1,000 or a corrective community service.

“We seek and sup-port the earnest en-forcement of r.A. 9003 and related ordinances and measures by the MMDA and the 17 lGUs to curb indis-criminate waste dis-posal and encourage environmental stew-ardship among Metro Manila residents,” said roy Alvarez, President, EcoWaste Coalition.

MANILA Mayor Alfredo Lim leads the list of guests next week when the Senate calls another public hearing on the bloody hostage-taking incident last Au-gust 23.

Senate committee on public order and illegal drugs chairman Sen. Gregorio “Gringo” Honasan confirmed yesterday that Lim has been summoned to air his side on what many observers viewed as bungled police operations that

led to the killing of nine people, including eight tourists from Hongkong.

During the first seven-hour Senate hearing last Thursday, Manila Police District Chief Supt. Rodolfo Magtibay named Lim as the one who ordered the arrest of hostage-taker Rolando Mendoza’s brother Gregorio.

THE Ombudsman sacked an Immigration (BI) official in Cebu reporedly for extorting two Chinese nationals.

In an eight-page decision signed and approved by overall Deputy ombudsman orlando Casimiro, Senior Immigration Officer Geronimo S. Rosas was dismissed from the service in view of the substantial evidence found against him.

Graft Investigation and Prosecution Officer I Giovanni Tianero said there was enough evidence against Rosas after he demanded P200,000 from Chinese Minwei Deng and Zhouzhi Cai who ar-rived at the Mactan Cebu International Airport last November 13, 2006 on Flight No. CX 921 of Cathay Pacific Airways.

BI Officer in Charge Rodolfo Ledesma was ordered by the Office of the Ombudsman to immediately implement the said order against rosas.

The Office of the Ombudsman gave credence to the complaint of witness Gabriel Andujar that rosas demanded the amount from the two Chinese inside the BI office at Mactan Cebu International Airport.

Businessman George Tan invited the two Chinese to help him in his prawn business.

However, the two Chinese who do not know how to speak English were questioned by the BI for hav-ing tourist visas and not working visas. Andujar was instructed by Tan to assist his two friends during their arrival at the airport.

The ombudsman argued that "the act of respon-dent Rosas clearly constitutes Grave Misconduct, subjecting him to administrative sanctions.

The solicitation by respondent rosas of the P200,000.00 transgressed the norm of conduct expected of public officials, especially of respondent rosas who hold the position of Senior Immigration Officer in the Bureau of Immigration. Such unac-ceptable conduct cannot be ignored nor forgone by this office.”

It ruled that mere denial made by rosas in his counter-affidavit is a weak defense and does not hold water to convince the Office of the Ombudsman.

SAN Beda’s Borgie Hermida and Nate Matute of Jose Rizal U stood out on a week when the top three teams kept their lofty positions in the 86th NCAA basketball tournament.

The 5-foot-8 Hermida, who joined the PBA Draft yesterday, came through with a pair of solid all-around perfor-mances in the pacesetting Lions’ two wins, while Matute flashed his deadly stroke from beyond the arc to power the third-ranked Bombers to back-to-back victories.

For their efforts, Hermida and Matute were named Accel/Filoil NCAA Press Corps Co-Players of the Week presented by Gatorade and Terrilicious Meat Products.

Hermida posted 14 points, 10 rebounds and 10 assists as the Lions streaked to their 10th straight victory by crushing Emilio Aguinaldo College, 92-68.

Hermida also had a solid outing in the 89-70 victory over St. Benilde last Monday, finishing with 9 points, 7 assists and 3 rebounds.

“Borgie is a good player,” San Beda coach Frankie Lim said of his starting point guard. “He’s PBA material.”

Matute shared the spotlight with Hermida last week as he buried 10-of-17 triples in two games.

The Filipino-American guard from Las Vegas made 22 points, including 15 from beyond the arc, to spark the Bombers past the Letran Knights, 76-60.

Five days after his breakout game, Matute was at it again, hitting 15 points, all from beyond the arc, in the 66-55 pummeling of Perpetual Help.

Arellano collides with Letran in NCAA

IT was the first Ultimate Fighting Champion-ship (UFC) bout between a world-class boxer and an equally proficient mixed martial artist, and the UFC 118 co-main event at TD Garden went as most expected yesterday, as Randy Couture impressively sent three-division world champ James “Lights Out” Toney to defeat via submission in the first round.

“I worked on that triangle for over a year,” said Couture, 19-10, of the finishing move, one that led him to receive his black belt in Brazilian Jiu-Jitsu by Neil Melanson in the Octagon after the bout. “A lot of credit to James for stepping up.”

After a few seconds of circling each other, Couture shot in for the takedown and immediately got it as he took Toney down by the ankle.

With the crowd chanting “UFC, UFC”, Couture got into the mount position and fired away. Toney held on, hoping to force a standup, but Couture was relentless, bulling his foe into the fence as he looked to sink in an arm triangle choke. Toney gamely resisted and Couture released the hold in order to go back to work with his strikes. But that was only a brief respite for Toney, as Couture sunk in the arm triangle again, this time forcing Toney to verbally tap out at the 3:19 mark.

Toney, 42, who has won major world boxing titles in the middleweight, super middleweight, and cruiser-weight divisions, as well as fringe belts in the heavy-weight division, falls to 0-1 in mixed martial arts.
