Caterpillar Inc., or any of its subsidiaries ("Caterpillar"),warrants the following products sold by it to be free fromdefects in material and workmanship:

New parts and assembled components, Classicparts and assembled components, Cat Reman partsand assembled components, each when used in thefollowing products or applications:

Engines and gensets used in Petroleum, GasCompression and Marine applications

Branded marine control systems (branded meanshaving Cat brand nameplate installed)

On-Highway vehicle transmissions and engines

Vocational On-Highway Trucks and Glider Kits

C175, 3500 & 3600 Series Locomotive engines

Well Stimulation Pump Power Ends and WellService Pump Power Ends used in Petroleumapplications.

Cat Selective Catalytic Reduction (SCR) System for Aftertreatment Retrofit

Draglines

Cat Water Delivery System

This warranty does not apply to: Cat batteries

Parts and assembled components installed prior todelivery of new product.

Third party brand on-highway parts and assembledcomponents sold by Caterpillar.

These products are covered by other Caterpillarwarranties.

This warranty is subject to the following:

Warranty Period

For parts and assembled components installedin C175, 3500 and 3600 Series engines used inlocomotive applications: 12 months, starting fromthe date the product is installed or 15 months fromthe date of sale to the first user, whichever occursfirst.

For parts and assembled components installed inall other products and applications covered by this

warranty: 12 months starting from date of sale to thefirst user.

Caterpillar Responsibilities

If a defect in material or workmanship is found during thewarranty period, Caterpillar will, during normal workinghours and at a place of business of a Cat dealer or othersource approved by Caterpillar:

Provide (at Caterpillars choice) New, Classic, CatReman parts or Caterpillar approved repaired parts,assembled components, Cat Reman engines orattachments needed to correct the defect.

Note: New, remanufactured, or Caterpillar approvedrepaired parts or assembled componentsprovided under the terms of this warranty arewarranted for the remainder of the warrantyperiod applicable to the parts or assembledcomponents being replaced as if such parts orassembled components were the original partsor assembled components. Items replaced underthis warranty become the property of Caterpillar.

Replace lubricating oil, filters, antifreeze, andother service items made unusable by the defect.

For petroleum, gas compression and marine productsand applications covered by this warranty: providereasonable and customary repair labor needed tocorrect the defect, excluding labor to disconnect andreconnect engines to attached equipment, mountingand support systems, if required.

For on-highway engine and transmission productsand applications covered by this warranty: Providereasonable and customary repair labor needed tocorrect the defect including labor to disconnect andreconnect to attached equipment, mounting andsupport systems, if required.

For all other products and applications covered bythis warranty: In the case of assembled components,provide reasonable and customary repair laborneeded to correct the defect of the assembledcomponent, excluding labor to remove and reinstallthat assembled component.

User Responsibilities

The user is responsible for:

Providing proof of sale date to the first user.

Providing proof of date of installation.

Labor costs, except as stated under "CaterpillarResponsibilities."

Transportation costs.

Premium or overtime labor costs.

Parts shipping charges in excess of those that areusual and customary.

Local taxes, if applicable.

Costs to investigate complaints, unless the problemis caused by a defect in Caterpillar material orworkmanship.

Giving timely notice of a warrantable failure andpromptly making the product available for repair.

Performance of the required maintenance (includinguse of proper fuel, oil, lubricants, and coolant) andreplacement of items due to normal wear and tear.

Allowing Caterpill ar access to all electronic allystored data.

Limitations

Caterpillar is not responsible for:

Failures resulting from any use or installation thatCaterpillar judges improper.

Failures resulting from attachments, accessoryitems, and parts not sold by Caterpillar.

Failures resulting from abuse, neglect, and/orimproper repair, including installation of parts andassembled components in contaminated systems.

Failures resulting from users delay in making theproduct available after being notified of a potentialproduct problem.

Failures resulting from unauthorized repair oradjustments and unauthorized fuel-setting changes.

For products operating in Australia, Fiji, Nauru, New Caledonia, New Zealand,Papua New Guinea, the Solomon Islands, and Tahiti, the following is applicable:

THIS WARRANTY IS IN ADDITION TO WARRANTIES AND CONDITIONS IMPLIEDBY STATUTE AND OTHER STATUTORY RIGHTS AND OBLIGATIONS THAT BYANY APPLICABLE LAW CANNOT BE EXCLUDED, RESTRICTED, OR MODIFIED("MANDATORY RIGHTS"). ALL OTHER WARRANTIES OR CONDITIONS, EXPRESSOR IMPLIED (BY STATUTE OR OTHERWISE), ARE EXCLUDED.

NEITHER THIS WARRANTY NOR ANY OTHER CONDITION OR WARRANTY BYCATERPILLAR, EXPRESS OR IMPLIED (SUBJECT ONLY TO THE MANDATORYRIGHTS), IS APPLICABLE TO ANY ITEM CATERPILLAR SELLS THAT ISWARRANTED DIRECTLY TO THE USER BY ITS MANUFACTURER.

TO THE EXTENT PERMITTED UNDER THE MANDATORY RIGHTS, IF CATERPILLARIS THE SUPPLIER TO THE USER, CATERPILLARS LIABILITY SHALL BE LIMITEDAT ITS OPTION TO (a) IN THE CASE OF SERVICES, THE SUPPLY OF THE SERVICESAGAIN OR THE PAYMENT OF THE COST OF HAVING THE SERVICES SUPPLIEDAGAIN AND (b) IN THE CASE OF GOODS, THE REPAIR OR REPLACEMENTOF THE GOODS, THE SUPPLY OF EQUIVALENT GOODS, THE PAYMENT OFTHE COST OF SUCH REPAIR OR REPLACEMENT OR THE ACQUISITION OFEQUIVALENT GOODS.

CATERPILLAR EXCLUDES ALL LIABILITY FOR OR ARISING FROM ANYNEGLIGENCE ON ITS PART OR ON THE PART OF ANY OF ITS EMPLOYEES,AGENTS, OR REPRESENTATIVES IN RESPECT OF THE MANUFACTURE ORSUPPLY OF GOODS OR THE PROVISION OF SERVICES RELATING TO THEGOODS.

CATERPILLAR IS NOT LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES

UNLESS IMPOSED UNDER MANDATORY RIGHTS.

IF OTHERWISE APPLICABLE, THE VIENNA CONVENTION ON CONTRACTS FORTHE INTERNATIONAL SALE OF GOODS IS EXCLUDED IN ITS ENTIRETY.
