ENFORCEMENT PROCEEDINGS

INVESTMENT ADVISER,CENSURED, ORDERED TO CEASE AND DESIST AND FINED FOR FAILING TO MAKE TIMELY YEAR 2000-RELATED DISCLOSURE

The Commission announced today that it entered an Order Making Findings, Issuing Cease and Desist Order and Imposing Civil Penalty as to Robert C Sears (Order) The Commission accepted Sears' Offer of Settlement, In which he agreed to the following relief a censure, an order that he cease and desist from committing or causing any violation and any future violation of the ADV- Y2K provisions of the Investment Advisers Act of 1940, Section 204 and Rule 204-5. Additionally, Sears was ordered to pay a $5,000 civil penalty

The Order finds that Sears was required to and failed to file Part I of Form ADV-Y2K by June 7, 1999 Form ADV-Y2K was designed to enable the Commission to evaluate the preparedness of investment advisers for the Year 2000 (Rei IA-1858, File No 3-9985)

RECEIVER APPOINTED IN MOBLEY CASE

The United States District Court has appointed Otto G Obermaier, a partner at the law firm of Weil, Gotshal & Manges LLP in New York City, as the receiver for David M Mobley, Sr , Maricopa Investment Fund, Ltd., and the other defendants and relief defendants

Under the Court's order, Mr Obermaier is empowered to take possession of all of the defendants' and relief defendants' assets and to search for any hidden or undisclosed assets Mr Oberrnaier is required to prepare a report by May 3 I, 2000, setting forth, among other
