2 1. Plaintiff Randal Pham is a professional service provider who resides and practices in the County o

3 Santa Clara, California.

4 2. On information and belief, defendants Jenny Lee and Alvin Lee are individuals residing with the

5 State of California.

6 3. Defendants Jenny Lee and Alvin Lee posted statements regarding plaintiff and plaintiffs business

7 on various online websites.

s 4. On information and belief, defendants Jenny Lee and Alvin Lee are not direct recipients of any

9 goods sold or services rendered by plaintiff.

10 5. The statements posted by defendants are false, inaccurate, and/or defamatory.

11 6. Plaintiff seeks compensatory and injunctive relief against defendants.

12 PARTIES

13 7. Plaintiff is a professional services provider residing within the County of Santa Clara.

14 8. On information and belief, defendant DOES 1-10 are individuals residing in California.

15 9. The true names and/or capacities, whether individual, corporate, associate, or otherwise of

16 defendant DOES 1-10, inclusive, are unknown to plaintiff, who therefore sue said defendants by

17 such fictitious names pursuant to California Code of Civil Procedure § 4 74. Plaintiff alleges that

18 each of said fictitious defendants is in some manner responsible for the acts and occurrences

19 hereinafter set forth. Plaintiff will amend this complaint to show their true names and capacities

20 when the same as ascertained, as well as the manner in which each fictitious defendant is

21 responsible.

22 10. Upon information and belief, at all times relevant hereto, Defendants were acting as the agents,

23 ostensible agents, employees, servants, partners, aiders and abettors, co-conspirators, and/or joint

· 24 venturers of each other, and in performing the acts and course of conduct set forth herein,

25 Defendants were acting within the course and scope of such agency or conspiracy, and Defendants

26 approved, ratified, permitted, condoned and/or affirmed the acts and course of conduct set forth

27 herein.

3 11. Defendants are subject to the jurisdiction ofthis Court by virtue of his residence in California.

4 12. Venue is proper in this county because defendants made defamatory statements arising out of or

5 regarding services that took place in Santa Clara County. The defamatory statements also led to

6 injuries to plaintiff's business in Santa Clara County.

8 FIRST CAUSE OF ACTION

9 (DEFAMATION)

10 (Plaintiff against All Defendants)

11 13. Plaintiff re-alleges and incorporates by reference all paragraphs of this Complaint.

12 14. Plaintiff is informed and believes and thereon alleges that defendants have made false and

13 defamatory statements regarding plaintiff and defendants knew or should have known that such

14 statements were false at the time they were made. The statements, including but not limited to the

15 publications shown in Exhibits A, B, and C to this Complaint, were made with malice and intent to

16 injure plaintiff's business and business reputation. The statements were not discovered by plaintiff

17 until on or around mid-2012.

18 15. Defendants reasonably understood or knew that the statements were about plaintiff. Defendants

19 reasonably understood or knew the content of the statements they made and the effects it would

20 have on plaintiff.

21 16. Defendants failed to use reasonable care to determine the truth or falsity of the statements.

22 17. As a result of such defamatory statements, plaintiff has thereby suffered injury and damage to his

23 business and goodwill in an amount to conform to proof at trial, but in no event less than the

24 jurisdictional minimum of this Court.

25 18. The statements were a substantial factor in causing the harm.

26 19. Because the defamatory statements were made with malice and intent to injure, plaintiff is entitled

27 to exemplary and punitive damages in a sum appropriate to punish such defendants.

WHEREFORE Plaintiff prays for trial by jury and judgments against defendants as follows:

PRAYER FOR RELIEF

1. That judgment be entered in favor of plaintiff against defendants;

2. That plaintiff be awarded costs of suit;

3. That defendants be preliminarily and permanently enjoined from defaming plaintiff;

4. That plaintiff be awarded compensatory, special, nominal, and punitive damages.

5. That the Court grant such further relief as the Court deems just and proper.

WHEREFORE, a jury trial is demanded.

To Parties In Rule 3.740 Collections Cases. A collections case does not include an action seeking the following: (1) tort damages, (2) punitive damages, (3) recovery of real property, (4) recovery of personal property, or (5) a prejudgment writ of attachment. The identification of a case as a rule 3.740 collections case on this form means that it will be exempt from the general time-for-seNice requirements and case management rules, unless a defendant files a responsive pleading. Therefore, all matters shall be referred to an appropriate fonn of Alternative Dispute Resolution (ADR) before they arc set lbr trial. unless there is good cause to disPense with the ADR requirement.

ADR is the general tem1 for a wide variety of dispute reSolution processes that arc alternatives to litigation. Types of ADR processes include mediation, arbitration, neutral evaluation, special masters and referees, and settlement conferences, among others forms. ·
