Read the Fine Print in Insurance PoliciesTo confirm that you’re protected as an ad-ditional insured, obtain certified copies of the policies and endorsements that confer additional insured status. Don’t rely on cer-tificates of insurance to determine whether you’re covered as an additional insured.

They generally provide little detail about the scope of coverage. Plus, they typically contain disclaimers stating that they’re in-formational only, confer no rights upon the certificate holder, and don’t expand or oth-erwise change coverage provided by the un-derlying policy. In other words, a certificate of insurance that lists you as an additional insured may be worthless if you’re not prop-erly named as such pursuant to the underly-ing policy.

Generally, there are two ways to name an additional in-sured: 1) by listing the party in a “named entity” endorse-ment, or 2) by using a blanket additional insured endorse-ment. The latter automatical-ly confers additional insured status on a party if the named insured is contractually obli-gated to name that party as an additional insured. INSECT AND SPIDER BITES

Each year many workers experience insect and spider bites serious enough to make them lose time off the job.

If you are stung by a bee, remove the stinger gently (with tweezers, if possible) and avoid squeezing the poison sac. Apply an ice pack or a

cloth dipped in cold water to reduce swelling and itching. A sting from a yellow jacket can be deadly. These insects feed on dead animals

and can cause blood poisoning. If you have an allergic reaction to a bite, get medical help immediately.

Of spiders causing serious medical problems only the black widow and brown recluse are considered serious threats. The black widow has

a shiny black body, about the size of a pea. With legs extended, it’s about an inch long. Females have a red or yellow hourglass mark on

their underside. The black widow spider is partial to outdoor latrines and other places that attract flies. The black widow spider will attack

with even the slightest provocation. Its bite is less painful than a pinprick, and does not cause a hole in the skin, but soon, intense pain and

stiffness set in. Symptoms also may include fever, nausea, abdominal pain and chills. For children and the elderly, black widow bites can be

lethal.

Also beware of the brown recluse spider. When it comes to insect bites, the bite of the brown recluse spider is one of the most feared. This

yellowish-tan to dark brown spider is 1/4-1/2 inch long. It has a characteristic fiddle-shaped mark on its upper body. Its bite can have painful,

disfiguring, and even deadly results. Within hours of a bite, victims may suffer severe pain and stiffness, fever, weakness, vomiting or a

rash. The recluse’s venom destroys cells and clots blood, blocking blood vessels and leading to gangrene. Within 24 hours, the wound

erupts into an open sore ranging from the size of a thumbnail to that of an adult’s hand. Anyone bitten by either spider should seek medical

help immediately.

Experts say, spiders typically don’t go looking for human prey. Spiders are generally shy and try to avoid contact with humans. Leave them

to their dark, secluded spaces – under rocks, in debris piles, sheds, closets and attics, and there’s no worry. Invade their space, though, and

risk a bite. Spiders will attack if trapped or if pressed against the skin.

Not all people react the same way to these spider bites. The variation may be due to the amount of venom injected or the person’s

physiology or immune system. The first line of treatment, if you suspect a bite is to apply a cold compress. However, if you have a bite and

experience other side effects, get medical treatment immediately.

PICADURAS DE INSECTOS Y ARAÑAS

Cada año muchos trabajadores sufren picaduras de insectos y arañas lo suficientemente serias como para hacerles perder horas de

trabajo.

Si lo pica una abeja, sáquese el aguijón con cuidado (con unas pinzas de cejas, de ser posible) y evite hacer presión sobre la vejiga del

veneno. Aplique una bolsa de hielo o un paño mojado en agua fría para reducir la inflamación y la picazón. La picadura de una avispa

puede ser mortal. Estos insectos se alimentan de animales muertos y pueden ocasionar envenenamiento del sistema sanguíneo. Si usted

There is a price to pay when a consumer asks the Board to help find a contractor with a particular trade. We take ‘stock’ of the situation confronting a Responsible Managing Officer and help a family chart a course for the future in selling their contract-ing business…

Q: Do I have to own any shares in a Corporation as RMO in order to qualify for a license?

A: There is no requirement that a RMO own any shares of the corporation. This being said, an ex-isting contractor should notify the CSLB regarding any change in ownership. Owning less than 10% of corporate stock will require the company to post a $12,500 Bond of Qualifying Individual. If applying for a new license, this ‘ownership’ question is asked on the application. Please contact us if you have further questions.

Q: Can you provide me with a list of plumbers in my area? A: While we don’t have that information readily available, the CSLB will provide you with a list of specific contractors based on certain criteria. The

form allows you to pick parameters such as classi-fication, business type, county, etc. There is a $245 fee for this service. The form can be found on the CSLB web site.Q: It’s been a long time... hope you are doing well. We are surviving...actually more than surviving. Our landscape business, which had been very slow the past two years, is picking up now. In fact we are thinking of re-tooling for a final push to sell it before I retire... that is the nature of my inquiry.

Can I change the name of a corporate license? I think having my name as the business name may limit our possibilities to expand and ultimately sell the whole business to a non-family member. My boys are in completely different fields and really don’t want to carry on with this business. Or per-haps we do a DBA with a different name? Got any ideas? Thanks.

A: Nice to hear that things are going well. Have you decided how you’re going to sell the business -- as-set or stock sale? If an asset sale, the buyer will likely set up their own corporation; purchase the assets, and continue operating as you have been doing

for years. The buyer may want to keep your existing name or change it. Either way, it should not matter what official name you’re using at the time of sale.

With a stock sale, again, the buyer can continue us-ing your existing business name or amend it. You certainly could add a dba, however, I’m not sure it would make a big difference since the buyer will be looking at your profitability and other financial considerations. They may even want to maintain the existing name because it is known in the com-munity.

We recommend that you contact a professional business broker or your legal council. Discuss these questions with him or her, including the issue of the business name. Caution should be used around interior •wall wiring. Ensure that electric boxes have proper shielding to prevent screws and nails from penetrating them. Powered nail guns, fasteners, and drills •should be properly grounded and in good working order to reduce the risk of electric shock. Other tools should be in good working or-•der and used properly.

Drywalling activities can be hazardous at heights when workers install walls or ceilings.

Use ladders when safe to do so, and follow •all ladder safety rules. Do not use unstable objects as working •platforms or supports such as lean-to or jack scaffolds, shore scaffolds, nailed brack-ets, loose tile, loose brick, or loose blocks. Stilts should never be used due to their in-•

Drywalling is physically challenging work, and can be hazardous as well since drywalling is of-ten performed at heights. Drywalling is typically one of the last activities on a construction proj-ect, so workers are frequently under deadline pressure.

Workers must be in good physical condition and physical stamina is essential. Proper techniques must be used when lifting, cutting, and maneu-vering heavy, awkward sheets of drywall and fix-ing them into place.

Working in pairs will help to reduce the •chance of worker injury and strain. Seam taping and sanding tools with spring-•assisted or powered systems can help to make overhead finishing work easier and ergonomically safe. Completing work one task at a time (hang-•ing, taping, finishing, etc.) may be efficient, but is harder on the body. Instead, workers should focus on completing one area at a time, this will allow them to rotate tasks and give their muscles a break.

Setting Up a Tailgate/Toolbox Safety Meeting Tailgate or Toolbox safety meetings are 10-15 minute on-the-job meetings held to keep employees alert to work-related accidents and illnesses. Tailgate/toolbox safety meetings have proved their worth by alerting employees to workplace hazards, and by preventing accidents, illnesses and on-the-job injuries. Why Have Them?

In both the tunneling and construction industries, tailgate safety meetings are required by Title 8, Sections 8406 and 1509 of the California Code of Regulations.

While tunneling and construction are the only industries that specifically require tailgate safety meetings, all California employers must have a safety program that includes employee training in safe work practices.

Tailgate/toolbox safety meetings can be used to address actual problems on the job or in the shop. The supervisor leading the meeting can draw on the experience of workers, and use that experience to remind all employees –especially newer ones – of the dangers of working with particular kinds of machinery, tools, equipment and materials. What to Talk About?

Talk about work practices, machinery, tools, equipment materials, attitudes, and anything else that may cause or contribute to a work-related accident or illness. Keep the topic relevant to the job or tasks at hand.

An excellent source for construction related topics is the publication Cal/OSHA Pocket Guide for the Construction Industry. Supervisors can choose individual sections or topics and relate them to their specific site requirements. Copies can be ordered from the Division of Occupational Safety and Health.

Choose a topic you think needs safety review. If you notice that spills aren’t being cleaned up promptly, discuss it. If there has been an accident or a near-accident on the job, talk about it. What happened? Where did it happen? How can it be prevented from happening again? Encourage employees to suggest topics. They often know best - what and where the dangers are. How to Run a Good Meeting 1. Hold the meeting on the job, preferably where everyone

can sit and relax. 2. Hold meetings at the beginning of shift or after a break. 3. Choose the topic carefully. Topics should be about health

and safety problems on the job. Research the problem before the meeting. For machinery, consult the manufacturer’s operations manual. For handling toxic substances, get a copy of the material safety data sheet. Your company’s insurance carrier is another good source

of information. Cal/OSHA also supplies a wide range of printed material on worksite safety and health.

4. Don’t choose too broad a topic. 5. Encourage employee participation - keep your meeting

short. Sample Topic for Tailgate/Toolbox Safety Meetings:

Why are guards left off machines? Guards are placed on machines to prevent workers from

contacting moving parts. They are required by Cal/OSHA regulations.

Many California workers are killed or injured every year because guards are removed and not replaced.

Why are guards left off? Ask the group to give reasons. Some common ones are:

♦ I didn’t have time to replace the guard. ♦ I wanted to make sure the machine was working okay. I

just never got around to replacing the guard. ♦ I put on a new drive and the old guard didn’t fit. ♦ I had to remove the guard to adjust the machine. ♦ I couldn’t work with the guard on. It slowed me down. ♦ Listen I’ve run these machines for years without guards

and I’ve never been hurt. These excuses have been given countless times. After the

accident has happened, the guard is replaced and strict rules are enforced. Of course, it’s too late for the victim. The purpose of meeting on this topic is to make sure rules are enforced before an accident can happen.

The WWTP was built in 1954 and was upgraded or expanded in 1972, 1987, 2002, and 2008 but has not been comprehensively upgraded since 1954. The WWTP upgrade is intended to bring the plant into compliance with current and anticipated discharge regulations, as well as local regulatory requirements and City goals and policies. The upgrade work is to be completed on the site of the existing treatment plant and the existing treatment plant is to remain in operation while the upgrades are constructed.

Unlicensed Operators

Like legitimate contractors, unlicensed operators sometimes use advertising to find new clients. Ads without license numbers or with numbers that are not issued by the CSLB are frequently used by the Board to identify sting targets.

The CSLB and other enforcement agencies use two sections of the law—B&P Sections 7027.1 and 7099.10—to take legal action against unlicensed contractors and, on occasion, against licensed contractors who advertise illegally.

If an unlicensed operator advertises as a contractor in a telephone directory, and if an investigation determines the entity doing the advertising is unlicensed, under B&P Section 7099.10 (a), the Registrar can issue a citation for a fine or other civil penalty assessment. The citation will also include an order of correction that requires:

any phone number in the unlawful ad and to not refer subsequent calls to any new number obtained by that person. If the order of correction isn’t made, the Registrar can have the Public Utilities Commission disconnect the phone service.

If you believe that an unlicensed contractor is actively working on a construction project, contact the CSLB at 1-800-321-CSLB (2752) or fill out a “SWIFT Lead Referral” form, which is available on the CSLB Web site, www.cslb.ca.gov.
