John Norwood, a lobbyist whose clients include pool and spa contractors, as well as workers’ compensation insurance carriers, said contrac- tors from a number of industries are working with labor and state agencies to shut down un- insured and unlicensed contractors. Norwood said the “Construction Enforcement Coalition” is primarily focused on finding ways for the De- partment of Insurance, Department of Labor, Franchise Tax Board and the contractor board to better coordinate enforcement efforts. In the meantime, he said the bills by Monning and Berryhill should help identify and pros- ecute contractors who hide their true number of employees to keep workers’ compensation insurance costs down, Norwood said. “There’s a saying that you have to cheat to compete,” Nor- wood said. “The legitimate contractors are just trying to stay in business and it’s very difficult because the estimate in the pool industry is 50% to 70% of work is being done by cash contrac- tors.” Norwood estimated pool contractors who don’t maintain workers’ compensation coverage can underbid those who do by 30% to 40%. Pair of Bills Target Illegal ContractorsNew laws that take effect January 1 aim to crack down on the “underground economy” by pro-viding the Contractors State License Board with up-to-date information about the status of con-tractors’ workers’ compensation coverage. Gov-ernor Jerry Brown signed AB 397 by Bill Monning (D-Santa Cruz). The bill requires contractors to show proof of workers’ compensation coverage or certify under penalty of perjury that they have no employees and are exempt when applying for a contractor’s license and when renewing a license every two years.

The governor also signed AB 878 by Bill Berryhill (R-Stockton), requiring an insurance carrier to notify the Contractors State License Board when it revokes a policy following an audit or investi-gation.

John Norwood, a lobbyist whose clients include pool and spa contractors, as well as workers’ compensation insurance carriers, said contrac-tors from a number of industries are working with labor and state agencies to shut down un-insured and unlicensed contractors. Norwood said the “Construction Enforcement Coalition” is primarily focused on finding ways for the De-partment of Insurance, Department of Labor, Franchise Tax Board and the contractor board to better coordinate enforcement efforts.

Requirements for Contractors Include Certification & Training

Firms must have one or more “Certified Renovator” assigned to jobs where lead-based paint is disturbed. To • become certified, a person must successfully complete an EPA training course conducted by an EPA-accredited training provider.

All renovation workers must be trained. They can be trained to • use lead safe work practices on-the-job by a Certified Renovator if the work is not HUD regulated, or they can become Certified Renovators themselves.

Firms performing renovation, repair or painting work must also • become certified. This can be accomplished by applying to EPA and paying a fee.

Beginning on April 22, 2010 renovation, repair and painting contractors must:be “RRP certified”• use lead safe work practices when working in homes built before 1978.•

The RRP rule affects contractors, property managers and others who disturb known or presumed lead-based paint during renovation activities done for compensation. The includes most repair, remodeling and maintenance jobs, such as window replacement, weatherization and demolition. The rule applies to any work that disturbs painted surfaces in residential houses, apartments and child-occupies facilities such as schools and day-care centers built before 1978. 8 Core Elements Working Together to Prevent Injuries and Illness in Construction

The Cal/OSHA 8 course focuses on implementing an effective accident prevention program, with its primary audience being construction foreman/supervisors. This course is designed to educate and train foremen/supervisors on their daily roles and responsibilities of accident prevention on the site. This course is not a typical course on how to develop an accident pre-vention program, or an Injury and Illness Prevention Program as required in California. The Cal/OSHA 8 course is aimed at the importance of workplace safety and health, everyone’s responsibilities for safety on the job, and what the foreman/supervisor can do to prevent accidents and illnesses on the job. The course links these responsibilities and actions to the requirements of California’s Injury and Illness Prevention Program and to the California Title 8 Construction Safety Orders.

The course provides participants with a packet of safety resource material to be kept in the work vehicle. Examples include tailgate training information, IIPP requirements, and the Cal/OSHA Pocket Guide for the Construction Industry.

This course discusses:Safety responsibilities on the job.Examples and discussion of systems that ensure workers follow safety rules and regula-tions, including discussion on how to recognize individual safety performance.Methods for creating effective safety communications.Construction hazard recognition with reference to Title 8 California Code of Regula-tions sections.Investigation of accidents and exposures and near misses to prevent recurrence, includ-ing exercises on how to determine if the hazard is created by an unsafe action and/or unsafe equipment conditions.Procedures for ensuring timely correction of unsafe and unhealthy conditions and/or work practices.Methods of conducting safety and tailgate training.Documentation for use in improving the safety program and preventing recurrence of incidents.Attendees will receive a certificate of completion plus an official wallet card certifying course completion

GUARDING ELEVATED LOCATIONS

A fall from elevation can seriously injure or kill a worker. Employers should implement a fall safety program by identifying potential fall hazards throughout the workplace, training employees, providing fall protection equipment, and placing guardrails around elevated locations. Guardrails protect workers from falls and act as a barrier to prevent tools and equipment from falling on workers below.

In buildings, guardrails are required on all open sides of elevated work locations that are more than 30 inches above the floor, ground, or other working areas. The elevated work locations include roof openings, open and glazed sides of buildings, balconies, porches, platforms, runways, and ramps. For other worksites, guardrails are required on open sides of the elevated work locations that are 4 feet or more above the ground.

There are exceptions to the guarding rules for specific industries and situations, including railroad car loading, gardens and plazas, and auditorium stages and balconies. The exceptions have specific guarding requirements or may allow removable guards. If removable guards are used, they should be fixed or tied off to prevent them falling on workers below. For more specific information, see the full text of California Title 8, Section 3210: Guardrails at Elevated Locations.

Wood, metal pipe, structural metal, and other suitable materials may be used to construct guardrails. They should have a smooth top rail, midrail, and posts. The top rail’s upper surface should be 42 to 45 inches tall. The midrail needs to be halfway between the top rail and the surface. If overhead clearance does not allow for a 42-inch guardrail, a lower rail should be installed. The ends of the rails must not overhang the terminal posts so much that people or equipment would run into them.

To protect employees from falls, guardrails and their connections and anchorages must withstand a live load of 20 pounds per linear foot applied outward or downward on the top rail. For heavy stresses from crowds, trucking, and handling materials, additional strength is required by use of heavier stock, closer spacing of posts, bracing, or other methods.

Toeboards are required if the elevated worksite is 6 feet or more above working employees to prevent a hazard from falling tools, material, or equipment. They may be constructed of wood, concrete, metal, or at least 1-inch metal mesh. The toeboard should be 3 1/2 inches tall. The bottom clearance (or gap) must not exceed 1/4-inch.

As the second leading cause of fatality in the workplace (homicide is the first), falls must be taken seriously on the job. Guardrails, along with other fall protection measures, can protect workers when they are working at heights.

Like the 800 lb gorilla in the room, government agencies can generally sit, contract or build how-ever they want in CA. This often doesn’t ‘sit’ well with contractors. Another contractor wants to know if there is ‘truth’ in advertising he received, and other contractors may have also gotten. He gets a ‘true and false’ answer…

Q: I noticed that the county where I have my business is contracting out less work and doing it in-house. I mean some major work like parking lots, curb, gutter, sidewalk, drainage improve-ments, etc. I also notice they do shoddy work, do not comply with traffic control requirements, use twice the work force and take twice as long.

My question: is the County Agency required to maintain the appropriate contractor’s licenses and have qualified individuals to do the work? Who inspects their work? Do they have to get permits from the appropriate agencies, or is it a free for all as it appears? Not to mention they are taking work away from the local businesses.

I have actually reported crews for violations of traffic controls and safety issues with no satisfac-tion. Any thoughts?

A: Interesting question, however, a local govern-ment agency (like your County) is not required to hold a contractor’s license. They are exempt (under Code Section 7040) and can self-perform this type of construction with county employ-ees. This exemption would also apply to the US Government, State of CA, incorporated cities, ir-

rigation districts, or any “other municipal or po-litical corporation or subdivision” when the work is being performed by their respective public employees.

As regards permitting or perceived violations, since the County likely controls all aspects of the permit process, they would be the ones to inspect their own work or investigate reported violations (sort of like a coyote guarding the hen house).

I cannot address the quality of work performed by any ‘public’ agencies nor can I make a deter-mination about how many jobs are impacted by the county self-performing this work. However, it would stand to reason that local construction business would be negatively impacted.

Q: I received a letter in the mail, which says “you may be eligible to receive your own California Contractors License without taking the state exam” because I am listed as an officer on my par-ents license. It also says this relates to 7065.1(c) and that the “State License Board has eliminated all other waivers”. I trust you to tell me if this is a scam or for real.

A: As I have referenced several times in this col-umn, the CSLB allows for an exam waiver under Code Section 7065.1(c). However, this is not the only available waiver and not everyone is eligi-ble simply because they are listed as an Officer on a license. Frankly during my many years of re-sponding to this type of question and handling

these types of applications, I have found as many “Officers” ineligible as I have found qualify for the exam waiver.

You must be able to show that you have worked full time for the corporation for at least 5 of the prior 7 years in the same classification(s) held by the company. You must have worked in a super-visory capacity not just served as Secretary or Treasurer.

If the letter states that the “State License Board has eliminated all other waivers”, this is false. The Board has two additional waivers including what is commonly referred to as the “family waiver” (7065.1(b) whereby a close family member can continue a family business in the “absence or death of the licensee” and the “additional class waiver” which is available through B&P Code 7065.3.

“We took a support position on both bills for that very reason,” he said.

The Fraud Assessment Commission Chairman Don Marshall said in June that he would like to see district attorneys spend more time investi-gating cases that have a significant impact on comp costs, such as major medical fraud. He said he supports prosecuting illegal contractors, but doesn’t think those prosecutions do enough to hold down work comp costs for employers.

The Fraud Assessment Commission is funded with assessments on workers’ comp premiums paid by employers. The commission distributes grants to district attorneys throughout the state to investigate and prosecute work comp fraud. Last year, the commission distributed $31.8 mil-lion. Commission members voted in September to distribute $31.8 million again in 2012.
