Newsletter 2015 -11 March 20, 2015 S.B. 361, PREVAILING WAGE RATE BILL, TOPIC AT STATE MEETING BREAKFAST S.B. 361 becomes effective Monday, April 13. It creates immediate changes to West Virginia's state prevailing wage requirements by raising the current threshold on project size from $25,000 to $500,000. By June 1, a new methodology must be developed by which future prevailing wage rates will be determined. By July 1, new wages rates will be in effect for all state, county and local governmental entities. S.B. 361, and the process going forward to establish future prevailing wage rates, will be discussed at the CAWV State Meeting, which will be held Wednesday, March 25, at 7:30 a.m. the Charleston Civic Center. In addition to contractors, subcontractors and suppliers, a number of federal and state contracting officials are planning to attend the meeting. All CAWV members are invited and encouraged to attend the March 25 meeting, which is being held in conjunction with WV EXPO. In addition to a program on the new prevailing wage bill, the State Meeting will feature CAWV Safety, Concrete and Scholarship awards. LEGISLATURE COMPLETES SESSION WITH PASSAGE OF BUDGET Legislators completed their work on the state's 2015-2016 budget Wednesday, ending this year's legislative session. The $4.3 billion budget only used $22.7 million from the state's Rainy Day reserve fund, much less than originally anticipated. A number of accounts were reduced in order to balance this year's budget, including taking $10 million from the WV Infrastructure Fund and $8 million from the School Building Authority. The governor's original budget included taking $8 million a year for five years, or $40 million. The governor also proposed taking $11.5 million from the State Road Fund to help balance the budget but legislators decided not to. Lawmakers have struggled the past few years to balance the budget due to declining severance tax collections and lottery proceeds. They said next year may be better since this year was the last of the annual $350 million payment to pay off the $3 billion unfunded liability for Workers' Compensation benefits dating back to the 1970s. FAYETTE SCHOOLS HOPE TO TAKE BIG STEP WITH BOND ISSUE The Fayette County school system plans to seek the approval of nearly $39 million from voters June 13 in a school construction bond issue that has been posted on the school system’s website. The total bond would be worth $66.5 million with $25.1 million coming from the state School Building Authority.

The projects listed on the bond call released include: –new construction Mount Hope Elementary School $12.7 million –new construction Collins Middle School $28 million –renovation Midland Trail High School $17 million –renovation Oak Hill High School $2.6 million –HVAC replacement Ansted Middle School $1.3 million –athletic fields renovation Valley High School $2.7 million –classroom addition Fayette Plateau Vo-Tech $650,000 The plan also includes the closings of both Fayetteville and Meadow Bridge high schools. The Fayette County school system is currently under the direction of the state Board of Education. REPORT STATES WV HIGHER EDUCATION FACILITIES REQUIRE $50 MILLION IN OVERDUE MAINTENANCE According to a report presented to the state Higher Education Policy Commission (HEPC), a dozen of West Virginia’s four-year colleges and universities need $50 million of annual spending on overdue maintenance. The $709,000 report was assembled after a six-month review by Guildford, Connecticut-based Sightlines – the education-facilities advisement company. The report determined that HEPC facilities are the second oldest in a group of nine other systems the company works with – finding Shepard University to be the youngest and West Virginia University Institute of Technology campus to be the oldest. The study also analyzed money spent on campus facilities and concluded that “capital investment has been sporadic and reliant on one-time funding.” However, state lawmakers recently approved a budget with a $4.6 million cut to higher education funding. Vice Chancellor for Finance for the HEPC and the state CTC system, Ed Magee, said the report conveys to him the importance of state appropriations to higher education institutions, which he believes are exhausting their ability to raise tuition and fees to fund repairs. Magee will use the report to develop a facilities master plan for HEPC campuses, which could take a year or longer.

EYE INJURIES

Every day an estimated 1,000 eye injuries occur in American workplaces. No matter where we work, flying particles, dusts, splashes or flying objects are apt to expose us to potential eye injury. Fortunately, we can protect against these hazards by using the appropriate protective eyewear for our jobs.

A survey by the Labor Department's Bureau of Labor Statistics (BLS) of about 1,000 minor eye injuries reveals how and why many on-the-job accidents occur:

Not wearing eye protection. BLS reports that nearly three out of every five workers injured were not wearing eye protection at the time of the accident.

Wearing the wrong kind of eye protection for the job. About 40 of the injured workers were wearing some form of eye protection when the accident occurred. These workers were most likely to be wearing eyeglasses with no side shields, though injuries among employees wearing full-cup or flat-fold side shields occurred, as well.

What Causes Eye Injuries?

Flying particles. BLS found that almost 70% of the accidents studied resulted from flying or falling objects or sparks striking the eye. Injured workers estimated that nearly three-fifths of the objects were smaller than a pin head. Most of the particles were said to be traveling faster than a hand-thrown object when the accident occurred.

Contact with chemicals caused one-fifth of the injuries. Other accidents were caused by objects swinging from a fixed or attached position, like

tree limbs, ropes, chains, or tools which were pulled into the eye while the worker was using them.

The BLS reported that more than 50% of workers injured while wearing eye protection thought the eyewear had minimized their injuries. But nearly half the workers also felt that another type of protection could have better prevented or reduced the injuries they suffered. It is estimated that 90% of eye injuries can be prevented through the use of proper protective eyewear. There are several types of eye protection and it’s important you wear the right protection for the task.
