New European Court Ruling, 13th May 2019
“Member States must require employers to set up an objective, reliable and
accessible system enabling the duration of time worked each day by each worker to
be measured”
“The Court holds that, in the absence of a system enabling the duration of time
worked each day by each worker to be measured, it is not possible to determine,
objectively and reliably, either the number of hours worked and when that work was
done, or the number of hours of overtime worked, which makes it excessively
difficult, if not impossible in practice, for workers to ensure that their rights are
complied with”

What Does it Mean for Employers?
• Details will be decided by implementation in each member country
• However, most experts agree that the new regulation doesn‘t allowcurrent practices like▪ „Trust based“ working time
▪ Negative time recording – assuming all is normal, if nothing is recorded
• The wording also suggests that capturing durations alone withoutrecoding clock times won‘t be enough
• So, employers should consider their options for a lean solution that will comply with the new regulations
