Safety and Construction Standards for New and Existing Residential DocksLocatedonGrandRiverDamAuthorityLakes
PURPOSE AND PREFACEThesestandardsoftheGrandRiverDamAuthorityapplytoallresidentialDocksonlakes,riversandtributariesunderthecontroloftheGrandRiverDamAuthority.ThesestandardsareadoptedpursuanttotheauthorityoftheGrandRiverDamAuthorityasprovidedbylawandareintendedtoprovideminimumrequirementstoprotectpublicsafety,accessandwaterquality.
Expansion: AnyincreaseinthewatersurfaceareaoccupiedbyaresidentialDock.
Existing Residential Dock: Anon-commercialresidentialDockthatispermittedonorbeforetheeffectivedateofthesestandardsconstructedandlocatedonthewatersurfaceofGRDAlakesorwaterways.
GRDA:TheGrandRiverDamAuthority.
GRDA Lakes: GrandLake,LakeHudson,W.R.HolwayLakeandallrivers,creeksorothertributariesintheGrandRiversystemunderthestatutorypurviewoftheGrandRiverDamAuthority.
Modification: Anychange,additionoralterationofaresidentialDock; or any change, addition or alteration in the location,configuration, structure or substructure of a residential Dock. Amodification does not include routinemaintenance and repairs,or repairs required byGRDA to bring a residential Dock that isdilapidatedorabandonedintocompliancewiththesestandards.
Residential Dock: AnoncommercialDockaccommodating10orlesswatercraftassociatedwithasingle-familyresidenceforwhichnocompensationis/willbereceivedbytheowneroftheDockforitsuse.Thisdefinitionalsoincludesswimplatforms.
Shoreline: Thelineatwhichthewatersurfacecomesintocontactwiththelandatanygiventime.Theshorelinewillmoveaswaterlevelschange.
Water Surface Area: Theareaincluding,butnotlimitedto,thelengthtimesthewidthoftheresidentialDocksfloating;andfixedstructureswithopenandcoveredslipslocatedonoroverthewater.Walkwaysareincludedinwatersurfaceareameasurements.
DEFINITIONSAbandoned Dock:ADockthat(1)isadrift;or(2)ownercannotbelocatedwithinareasonableamountoftime.
Approved Flotation: Allflotationmaterials,whicharecommerciallymanufacturedformarineuseshallbefabricatedsoasnottobecomewaterlogged,crack,peel,fragmentorbesubjecttolossofbeads,orinthecaseofsnaptogether,sectionalrotomoldedpolyethyleneDocks(i.e.includedbutnotlimitedtoE-ZDock,orConnect-a-Dock).Styrofoamflotationmustbefullyencasedofsolidpolyethyleneorsimilarmaterials.
Design Elevation: Thenormalelevationforeachlakeis: GrandLake-742feetPensacoladatum, LakeHudson-619feetmeansealevel.
Dilapidated Dock: ADockthat(1)hasanystructuralmembers,roofing, decking, flotation or walkways that are not securelyattachedandcouldposeanimmediatesafetyornavigationhazard;(2)issubmerged;(3)isnotfloatingupright;(4)hasdeckorfloorsthatarebroken,missingand/orbelowwaterlevel;(5)isinastateofdisrepairor (6) isotherwisenot in full compliancewith theseminimumstandards.
Dock: Anon-commercialfloatingstructureonGRDAwaterswhichisattachedtotheshoreline.ADockincludes,butisnotlimitedto,anenclosedfloatingstructure,afloatingplatform,awharf,and/oraboathouse.ADockmayormaynotincludewatercraftslips.
Encapsulated Flotation: Expandedpolystyrenefullyencasedbyhighdensity,highmolecularweightpolyethylenewithaminimumthicknessof.150”onthebottomand.125”onthetop.
STANDARDS - GRDABoardApprovalDate:June7,2006A. NoDock shall be installed until such time as the Applicant
receives a letter fromGRDA approving such installation.A
samplecopyoftheletterofapprovalisattachedasExhibit“A”
totheseStandards.
B. There shall be a permit issued by the GRDA EcosystemsManagement for each residential Dock located on
thewaterways controlled by GRDA. A permitmay be obtainedonlyafterthesubmissionofanapplicationdulyexecuted,
inwritingbytheapplicant,uponaformprescribedandprovidedbyGRDA.Saidapplicationshallhaveattached:
1. ScaledDrawings:OverheadandProfiledimensionsdrawn
toscale(i.e.1”=10’).DetaileddescriptionofDock(i.e.
color,coveredoruncovered,enclosed).YourlocalDock
buildercanprovidethesedrawings.
2. Lengthandwidthofwalkway.
3. Detaileddescriptionofanchoringandstabilizationsystem.4. Copyofplatmap.
5. PlotdrawingshowingplacementofDockonwaterandminimumdistancesbetweenDockandanyotherfloatingstructures ormarkers within 150’. Must include theshortestdistanceacrosscovefrom750’to750’(Grand)or622’to622’(Hudson)elevation.
6. EvidenceoflandownershipasfiledofrecordintheCountyClerk’sOffice.
7. Drivingdirectionsbylandandwater.8. WaiverApplicationifvarianceisrequested.9. LandownerPermissionFormifapplicantisnottheowner

Additionally,evidenceoflandownershipasfiledofrecordintheCountyClerk’sOfficeisrequired.
10. ASurveymustbeprovided toverify 1) theapplicant’s propertyline, and2) GRDA’s propertyline if applicant’s property isnotadjacentto GRDA property. Survey must be completed, signed, and sent directly to GRDA office from a certified land surveyor, licensed to do business
in Oklahoma. The applicant need not havea new survey completed if (i) an old survey clearly indicates the GRDA
property line or (ii) the legal description of a previous owner’s deed of conveyance uses the GRDA property line as a point of reference. GRDA reserves the right to

C. AresidentialDockmustbeconstructedofsuchqualitymaterialastowithstandlakelevelchangesandexposuretostrongwind,fastmovingwaterandseverewaveaction.Mainsupportframeshallbeconstructedofnolessthantwo(2)inchschedule40steelpipeortwo(2)inchsquaretubing,3/16inthickness,orothersuchmaterialhavingthesametensilestrength.Deckingandwalkwaysshallbeconstructedofmarinegradematerialofnolessthanoneandone-fourth(1¼)inchthickness.Sheetmetal for roofs andwalls shall be twenty-six (26)gaugeorgreaterinthickness.Flotationmaterialsshallbeasstatedbelow.
Flotation: 1. All flotationmaterials for: (i) newly constructedDocks,
(ii) relocatedDockswhichmove from one location toanother location, (iii) Dockswhich have been taken intradeandofferedforre-saleortradebyalicensedDockbuilder, or (iv) otherwater-use structures and facilitiesshallbeconstructedofApprovedFlotationmaterialandbecommerciallymanufacturedformarineuse.IntheeventaDockissoughttoberelocatedandhasnon-encapsulatedwhitestyrofoamingoodcondition,theApplicantmayseekwrittenpermissionfromtheGRDAEcosystemsManagementforthestyrofoamtoremainwiththedockuponrelocation.ThewrittenpermissionmustbeobtainedfromtheGRDAEcosystemsManagementpriortorelocationofthedock.IntheeventtheGRDAEcosystemsdeniesApplicant’srequestfortheStyrofoamtoremain,ApplicantmayrequestthattheGRDABoardofDirectorsreviewtheApplicant’srequest.Otherwise,allstyrofoamflotationmustbefullyencapsulatedinsolidpolyethyleneorsimilarmaterials.
2. Existingtraditionalflotationmaterial(i.e.non-encapsulatedwhite styrofoam) which was secured in place as ofDecember 31, 2004, and is not being relocated ortransferredand is incompliancewithprevious rules isauthorizeduntil,inGRDA’sjudgment,theexistingflotationisnolongerserviceableatwhichtimeallflotationmaterialshallbereplacedwithApprovedFlotationuponnotificationfromGRDA.AnyreplacementmaterialshallbeApprovedFlotationmaterialunlessotherwiseprovidedherein.
3. Beginning July 1, 2006, no non-encapsulated whitestyrofoammaybeusedtoreplaceflotationmaterialunlessawaiverisobtainedpriortoconstruction.
D. NoDock shall extendmore thanone third (1/3) of the covemeasuredfrom750feetPensacoladatumto750feetPensacoladatumonthenearestoppositeshorelineofGrandLakeunlessthepermitsetsforthadirectionalbearingoftheDock’sorientationensuringadequatepublicaccessandsafety.OnLakeHudson,theelevationshallbe622feetmeansealevelinfiguringtheonethird(1/3)ofthecoverule.Additionally,noDockshallextendmorethan125feetfromtheapplicablePensacoladatum/meansea level unless thewaterdepthunder the shoresideof theDock,at742PensacoladatumonGrandLakeand618meansealevelonLakeHudson,islessthan8feet.Insuchinstance,theGRDAEcosystemsManagementmayapprovetheextensionoftheDockuptothelengthnecessarytoreachadepthof8feetofwater.TheGRDAEcosystemsManagementreservestherighttodenyanapplicationifthedockextendsmorethan125feetfromtheapplicablePensacoladatum/meansealevel,iftheDockexceedsmorethan1/3ofthecove,orifthedockposesahazardtothepublic.Inconsideringwhethertoapprovesuchapplication,theGRDAEcosystemsManagementshallconsiderthepositiveandnegativeimpactstothecharacteristics,zoningandprevailingpermitteduseswithinahalf-mileradiusoftheproposedactivity;theshorelinetopographyandgeometry;thesafety,navigationandfloodcontrolrequirements;environmentalimpacts;potentialeconomicdevelopmentandtourismbenefits;recreationaluseimpacts;andapplicablestatutorymandates.
E. IfaDockislocatedparallelwiththeshoreline,theopenend,fromtheedgeoftheDocktothepropertyline,mustbeoneandonehalf(1½)timesthelengthoftheslip.Forexample,athirty(30)footslipwouldrequirefortyfive(45)feetfromtheedgeoftheDocktotheadjacentpropertyline.
F. AresidentialDockmustbelightedfromsunsettosunriseandduringperiodsoflowlightconditionsiftheDock:(1)extendsbeyond125feetfromtheshoreline,or(2)otherwiseposesanavigationhazard.Theminimumsafetylightingshallbeflashingorcontinuouslightsdefiningthedistal(lakeside)cornersofthedock.Solarlightsarerecommended.
G. Any residentialDock that has electrical service shall strictlyadheretotheregulationssetforthintheStateofOklahomaFireCodeforfloatingstructures.AllDocksconstructedormodifiedafterJune1,2006shallberequiredtoprovidetoGRDA,withinthirty(30)daysfollowingcompletion,acertificatesignedbyalicensedelectricalcontractor,evidencingcompliancewithalllaws,regulationsandcodesregardingelectricalsystemsandwiring.BeforeaDockpermitmaybetransferred,acertificatesignedbyalicensedelectricalcontractorevidencingcompliancewith all laws, regulations and codes regarding electricalsystemsandwiringshallbeprovidedtoGRDA.GRDAElectricalInspectionStickersaretobeprominentlydisplayedonDocksindicatingcompliancewiththisrequirement.
H. AnyDockwhich is classifiedas “NotElectricallyWired” (RedSticker)maynothaveanypermanentelectricalsupplyinstalledwithoutcomplyingwiththeseRules.Atemporaryelectricalsupply(extensioncord,etc.)shallnotbeleftunattended.AnytemporaryelectricalsupplymustbeanapprovedULListedSupplyCordandbeingoodconditionwithallelectricalconnectorsattachedandinuse.AnytemporaryelectricalsupplymustuseGFCIReceptacles.
I. AtthetimeaneworusedDockisinstalled,theDockinstallershallpostapermanentsignvisibleontheDock.Thesignshall

require a new survey if justified by the circumstances.
include the name of theDock installer, theDock installer’sphonenumberandtheyeartheDockwasinstalled.Thesignshallmeasureatleast5”x5”.DockbuildershallprovideaspaceimmediatelyadjacenttoitspermanentsignforGRDAtoaffixthedocknumber.Bothsignsshallbeeasilyvisiblefromthewater.
J. Uponissuanceofsaidpermit,anumberwillbeassignedtoeachresidentialDock.Thesenumbersshallbenosmallerthanthree(3)incheshighandshallbeaffixedtotheresidentialDockastobeeasilyvisiblefromthewater.
K. PermitholderagreestopromptlypaytheannualpermitfeeassetforthintheScheduleofFeesintheRules&RegulationsGoverningtheUseofShorelandsandWatersoftheGrandRiverDamAuthority.AcoloredDockpermitstickerwillbereturnedtopermitholder.ThisstickeristobeprominentlydisplayedonDockandindicatesthattheannualpermitfeehasbeenpaid.
L. IfownershipofaresidentialDockissoldortransferred,thenewownermustapplyforanewpermitandnotifytheGRDAEcosystems Management within fourteen (14) days afterpropertytransferiscompleteorremovethefacilityandrestoretheuseareawithinthirtydays(30)afterownershiptransfer.TheapplicationprocesstotransferanexistingresidentialDockshallbethesameforrequestingapermitforanewDock,however,theapplicantneednothaveanewsurveycompletedif(i)anoldsurveyclearlyindicatestheGRDAtakinglineor(ii)thelegaldescriptionofapreviousowner’sdeedofconveyanceusestheGRDAtakinglineasapointofreference.GRDAreservestherighttorequireanewsurveyifjustifiedbythecircumstances.
M. The GRDA EcosystemsManagement reserves the right toauthorizerepresentativestoenterthepropertyofthepermitholderasnecessarytomakeinspectionsand/orotheractivitiesunderpermit.
N. TheBoard,uponwrittenapplicationandafterhearingsubjecttotheproceduralandsubstantivestandardshereinaftersetforthmaygrantwaiverstotheapplicationoftheserulesandregulations:
1. Waiversof these rulesand regulationsmaybegrantedbytheBoardofDirectorsofGRDAuponapplication.InapprovingwaiversoftheserulesandregulationstheBoardofDirectorsshallconsiderpositiveandnegativeimpactstothefollowing:
• Characteristics,zoningandprevailingpermitteduseswithinahalf-mileradiusoftheproposedactivity.
• Shorelinetopographyandgeometry.• Safety,navigationandfloodcontrolrequirements.• Environmentalimpacts• Potentialeconomicdevelopmentandtourismbenefits.• Recreationaluseimpacts.• Statutorymandates(820.S.861etseq.)
2. TheapplicantshallberequiredtogivenoticeandtheBoardshallallowpubliccomment,eitherataregularlyscheduledmeetingoftheAssetsCommitteeoratformalpublichearing,beforeactingonanyrequestforawaiveroftheserules.
3. Public notice of the waiver request shall be given inaccordancewithguidelinesestablishedbytheGRDAstaffandshallinclude:
a. Publication in newspapers of general circulation,includingthecountyinwhichthepropertyislocated.
b. Mailing ofwritten notice to all owners of propertywithina300-footradiusoftheexteriorboundariesofthesubjectshorelineproperty.(Pleasenote:Thisistheapplicant’s responsibility.CertifiedMail receiptsare required as proof ofmailing.)GRDA will not post in newspapers or website until receipts are received.
c. PostingonGRDA’swebsite foraperiodof thirty(30)days.
d. AndsuchothernoticeasdirectedbyGRDAstaff.
Arequestforawaivershallbeinitiatedbythefilingofawrittenapplicationandshallbesetforhearingasprescribedbytheserules.Awaiver,whichhasnotbeenutilizedwithinthree(3)yearsfromthedateoftheordergrantingthesameshallthereafterbevoidunlessotherwiseextendedbytheChiefExecutiveOfficer.
O.Noattemptshallbemadebyanypermitholdertoforbidtheuseofallpublicaccesslandand/orwater,at/oradjacenttoapermittedfacility.
P. Thepermitholderagreesnottolease,rent,subletorprovidetoothers,byanymeansofengaginginacommercialactivity,thepermittedfacility.Thiswillnotprecludethepermitholderfromsellingtotalownershiptothefacility.
Q. Thepermitholderagreestooperateandmaintainanypermittedfacilityinamannersoastoprovidesafety,minimizeanadverseimpact on fish andwildlife habitat, natural environment orculturalresourcesvaluesandinamannersoastominimizethedegradationofwaterquality.
R. Ownership,construction,operation,useandmaintenanceofapermittedfacilityand/oractivityaresubjecttoallfederal,stateandlocallaws,aswellasallrulesandregulationsnowineffect;orthosepromulgatedinthefuturebytheboardofdirectorsoftheGrandRiverDamAuthority.Failuretoabidebytheselaws,rulesorregulationsmaybecauseforrevocationofthepermit.
S. ThepermitholderagreestosaveandholdharmlesstheGrandRiverDamAuthority,itsofficersand/ordirectorsfromanyandallcausesofaction,suitsatlaworequity,claimsordemands,orfromanyliabilityofanynaturefor,oronaccountof,anydamagestopersonsorproperty,includingapermittedfacility,growingoutoftheownershipconstruction,operationormaintenancebythepermitholderofthepermittedfacilityand/oractivities.
T. Ifthepermitholderfailstocomplywithapplicablelaws,rulesorregulationsor ceases touse,operateormaintainapermittedfacility,theGRDAEcosystemsManagementmayrevokethepermitandcausethefacilitytoberemovedbycontractorotherwiseandthepermitholderagreestopayallcostsincurredthereof.
U. NothinginthesestandardsshallpreventtheGRDAfromseekinginjunctiverelieforanyotherremedyinlaworequityatanytimeagainstanypersonallegedlyviolatingthesestandards.
V. Whenever regulations or restrictions imposed by thesestandardsareeithermoreorlessrestrictivethanregulationsorrestrictionsimposedbyanygovernmentalauthorityorotherentitythatmighthaveauthoritytoregulateresidentialDocks,theregulations,rulesorrestrictionsthataremorerestrictiveorimposehigherstandardsshallgovern.
W. Ifadockisdamagedbyweather(i.e.highwinds,tornado),thepermitholderhasninety(90)daystorepair.

Oncethedockhasbeeninstalled,thedockbuildermustcontactourofficeimmediatelyuponinstallation;GRDAstaffwillneedtotakepictures,obtaincoordinatesandcompletethefinalinspection.Shortlythereafter,providedyourdockisincompliance,youshouldreceiveinthemailacopyofyourpermitanddockstatementindicatinganyoutstandingfeesrequiredtocompletethepermit.Yourdockpermit/accountnumber is0000.Yourdockbuilder isresponsibleforplacingyourassigneddocknumbertoyourdockpriortonotifyingourofficeforinspection.Pleaseconsultyourdockbuilderifyouapreferenceonthespecificlocationofyourdocknumbers.OnceyourpaymentisprocessedyouwillreceiveadockpermitdecalindicatingthatthisyearspaymenthasbeenreceivedandprocessedbyGRDA.The dock permit decal (payment sticker), the permit number, AND the dock builder decal should be properly displayed on your dock and clearly visible from the waterway.
Byobtainingthispermit,youacknowledgeandstatethatyourdockusewillnotendangerthehealth,createanuisanceorotherwisebeincompatiblewiththeoverallprojectrecreationaluseandthatyouwilltakeallreasonableprecautionstoinsurethattheconstruction,operationandmaintenanceofthedockwilloccurinamannerthatwillprotectthescenic,recreationalandenvironmentalvaluesoftheproject.
