R U L E 84 - GENERAL POWERS AND DUTIESOF EXECUTORS AND ADMINISTRATORS

Section 1. Executor or administrator to have accessto partnership books and property. How right enforced. Theexecutor or administrator of a deceased partner shall at alltimes have access to, and may examine and take copies ofbooks and papers relating to the partnership business, and

may examine and make invoices of the property belonging tosuch partnership and the surviving partner or partners, onrequest, shall exhibit to him all such books, papers, andproperty in their hands or control. On the written applicationof such executor or administrator, the court having

jurisdiction of the estate may order any such surviving partnerof partners to freely permit the exercise of the rights, and toexhibit the books, papers, and property, as in this sectionprovided, and may punish any partner failing to do so forcontempt.

Section 2. Executor or administrator to keep buildings inrepair. - An executor or administrator shall maintain in tenantablerepair the houses and other structures and fences belonging to the

estate, and deliver the same in such repair to the heirs or deviseewhen directed so to do by the court.

Section 3. Executor or administrator to retain wholeestate to pay debts, and to administer estate not Willed. - Anexecutor or administrator shall have the right to the possessionand management of the real as well the personal estate of the

deceased so long as it is necessary for the payment of the debtsand expenses of administration.

1. To give a bond, in such amount, as the court may fixbefore he enters upon the execution of the trust, and letters

testamentary or of administration issue;

2. To render an inventory and appraisal of all realand personal estate of the deceased which come to hispossession within three (3) months after his appointment;

3. To provide allowance and support to thesurviving spouse and children of the deceased, as orderedby the court;

4. To have access, examine and take copies ofbooks and papers, and property related to the partnershipbusiness;

5. To keep buildings in repair and to deliver themto the heirs and devisees when directed by the court;

6. To retain whole estate to pay debts andexpenses, and to administer estate not Willed;

7. To render an accounting of all interest,profits, and income of the estate, as well as theproceeds of the estate sold by him or the income of therealty used by him;

8. To sell, mortgage or otherwise encumberany portion of the estate under his administration, asmay be authorized by the court;

9. To render an accounting of hisadministration win one (1) year from the time hereceive the letters testamentary or of administrationuntil he is relieve of his duties, unless the court grantshim an extension.
