T h e P l a i n t i f f ' s f i r s t c o n v i c t i o n w a s n e a r l y 30 y e a r s ago, and h i s c r i m i n a l r e c o r d i n c l u d e ss e v e r a l c o n v i c t i o n s f o r s e r i o u s o f f e n c e s , n o t a b l y i n c l u d i n g c o n s p i r a c y t o t r a f f i c i nn a r c o t i c s and s e v e r a l weapons o f f e n c e s . I n a d d i t i o n , t h e P l a i n t i f f l s c r i m i n a l r e c o r dr e f l e c t s a o n s i s t e n t contempt o f , and r e f u s a l t o obey o r d e r s of h e C o u r t .

T h e l a i n t i f f p l e a d e d g u i l t y t o u t t e r i n g a d e a t h ) h r e a t a g a i n s t t h i s Defendant i n 2012 andw a s s e n t e n c e d t o 12 months imprisonment and 3 e a r s ' p r o b a t i o n . 1 2 . Subsequent t o t h e J a n u a r y i n c i d e n t , t h e p o l i c e were c o n t a c t e d . For t h r e e hours t h e yengaged i n o n and o f f c o n t a c t w i t h t h e P l a i n t i f f b y c e l l phone. During a phonec o n v e r s a t i o n w i t h p o l i c e , t h e P l a i n t i f f s t a t e d t o a p o l i c e o f f i c e r t h a t he wa s going t o k i l lt h e D e f e n d a n t , e i t h e r b y d e c a p i t a t i n g h i m w i t h a machete o r s h o o t i n g him. This s t a t e m e n tt o t h e p o l i c e o f f i c e r formed t h e b a s i s f o r t h e P l a i n t i f f ' s s u b s e q u e n t t h r e a t e n i n gc o n v i c t i o n .

In t h i s l e t t e r t h e P l a i n t i f f , amon g o t h e r t h i n g s , s t a t e s :"Well, e l l , h e r e I s i t i n t h e can b e c a u s e y o u r B r o t h e r THERAT) i c k e d up t h e phone +LIED n e v e r t h r e a t e n e d him AT LL " n t h a t e t t e r t h e P l a i n t i f f t h r e a t e n e d t o r e l e a s e a s h i t storm" on, nter alia, h i s D e f e n d a n t . . In J u l y 2013, ( a f t e r t h e e v e n t s a l l e g e d i n t h e s t a t e m e n t of c l a i m b u t b e f o r e t h ecommencement of t h i s l i t i g a t i o n ) t h e P l a i n t i f f a l s o communicated w i t h T o r o n t o S t a rr e p o r t e r Robyn D o o l i t t l e w i t h r e s p e c t t o t h i s D e f e n d a n t . C o n t r a r y t o t h e a l l e g a t i o n s henow makes n t h e w i t h i n c l a i m , t h e P l a i n t i f f p r a i s e d t h i s Defendant, a y i n g :

"The Fords a s a whole f a m i l y t r e a t e d me i k e one of h e i r own and f o r t h et h i n g s t h a t I d i d t o them t h e y were more h a n f a i r and t would b e r e m i s s f o rme o s a y any d i f f e r e n t . . . At no p o i n t p r i o r t o t h i s p r o c e e d i n g d i d t h e P l a i n t i f f a c c u s e t h i s Defendant of h a v i n gc o n s p i r e d t o c a u s e him i n j u r y o r t o t h r e a t e n him w h i l e i n c a r c e r a t e d . This Defendant has no p e r s o n a l knowledge of whor e c o r d e d t h e s u r r e p t i t i o u s v i d e o .

25. The Video a l s o a p p e a r s t o be e d i t e d by a p e r s o n o r p e r s o n s u n i d e n t i f i e d by t h e P l a i n t i f f .This Defendant h o l d s t h e P l a i n t i f f t o t h e s t r i t proof t h e r e o f . T h i s Defendant has noknowledge of h e e d i t i n g o r o t h e r m o d i f i c a t i o n s done t o t h e s u r r e p t i t i o u s l y and s e c r e t l yr e c o r d e d v i d e o .

26. At no time was t h e Defendant aware t h e Video v v a s b e i n g r e c o r d e d and a t no time wa st h e D e f e n d a n t ' s c o n s e n t o b t a i n e d t o such r e c o r d i n g , which was a b r e a c h of t h eD e f e n d a n t ' s r i g h t t o p r i v a c y .

2 7 . According t o t h e media, t h e s e c r e t l y r e c o r d e d , s u r r e p t i t i o u s Video ( t a k e n w i t h o u t t h i sDefendant' knowledge o r c o n s e n t o n a n o c c a s i o n where t h i s Defendant had a e a s o n a b l ee x p e c t a t i o n o f r i v a c y ) was p u r c h a s e d by t h e Toronto S t a r f o r 5,000 fr om an un n a m e ds o u r c e . T h e Toronto S t a r used t h e Video t o g e n e r a t e revenue and p r o f i t s f o r i t s e l f t h r o u g hnewspaper and o t h e r s a l e s . T h e e x a c t p a r t i c u l a r s and t i m i n g o f h e f i n a n c i a l arrangementbetween t h e Toronto S t a r and whoe ver m a d e/ c o p i e d and/ o r e d i t e d t h e Video a r e unk now nt o t h i s Defendant.

2 8 . T o t h e b e s t o f h i s D e f e n d a n t s knowledge t h e Video d e p i c t s s n i p p e t s o f a p r i v a t e s o c i a lg a t h e r i n g i n a p r i v a t e r e s i d e n c e and r e l a t e s t o a p r i v a t e , j o c u l a r d i s c u s s i o n i n t h esupposed p r i v a c y o f a f r i e n d s h o m e where t h i s Defendant was d i s c u s s i n g and i m i t a t i n g ,a s a joke, t h e p r e-match r a n t o f a p r o f e s s i o n a l w r e s t l e r . This was i n a n t i c i p a t i o n o f ac h a r i t y e v e n t which was c o n t e m p l a t e d i n 2013 (long a f t e r t h e e v e n t s i n i s s u e i n t h es t a t e m e n t o f claim) wherein t h i s Defendant was o engage i n a c o n t e s t t o r a i s e m o n e y o rc h a r i t y with a w e l l k n o w n , e t i r e d p r o f e s s i o n a l w r e s t l e r . T h e Defendant i s mimicking f o rt h e purpose o f j o k i n g w i t h f r i e n d s a t a p r i v a t e g a t h e r i n g ( a d m i t t e d l y p o o r l y ) t h a tp r o f e s s i o n a l w r e s t l e r i n t h e p o r t i o n s o f t h e Video r e f e r e n c e d by t h e P l a i n t i f f an di n c o r p o r a t e d i n t o t h e s t a t e m e n t o f l a i m . T h i s was a t a time w h e n t h i s Defendant had acomplete and r e a s o n a b l e e x p e c t a t i o n o f p r i v a c y . 30. Without i m i t i n g the g e n e r a l i t y of he foregoing, he a l l e g a t i o n s in the statement of l a i mof a purported conspiracy somehow r c h e s t r a t e d b y t h i s Defendant, involving not onlythe other personal defendants but also nu merous unknown d m i n i s t r a t i v e personnel ofc o r r e c t i o n a l f a c i l i t y , a n d t h a t t h i s Defendant w a s somehow capable of manipulating theoperation of uch c o r r e c t i o n a l f a c i l i t y t o the extent a l l e g e d in t h e statement of laim, sbeyond a n y a t i o n a l p o s s i b i l i t y or a i r of e a l i t y . The l l e g a t i o n s in the statement of l a i ma r e p a t e n t l y a b s u r d on h e i r f a c e .

31. I n t h e a l t e r n a t i ve , t h i s Defendant p l e a d s t h a t t h e P l a i n t i f f s damages r e e x a g g e r a t e d a ndt o o remote an d h a t t h e P l a i n t i f f has a i l e d t o r e a s o n a b l y m i t i g a t e a g a i n s t such damages.
