1. ELECTION OF CHAIR

RESOLVED to elect Councillor Gweno Glyn as Chair of this committee for 2014/15.

2. ELECTION OF VICE-CHAIR

Two names were proposed and seconded for the post of vice-chair, namely CouncillorEirwyn Wailliams and Councillor Mair Rowlands.

Five members voted in favour of Councillor Eirwyn Willaims and five members in favour ofCouncillor Mair Rowlands. Councillor Eirwyn Williams noted that he was willing towithdraw his name.

RESOLVED to elect Councillor Mair Rowlands as Vice-chair of this committee for2014/15.

3. DECLARATION OF PERSONAL INTEREST

Councillor Siân Gwenllian declared an interest in item 8 on the agenda – Social HousingAllocations, because she served on the Cartrefi Cymunedol Gwynedd ManagementBoard.

Item 2 – Matter arising from the minutes of 15 January 2014Item 2 – Urgent Item – Dealing with Welsh prescriptions

A copy of the Welsh Language Commissioner’s letter to the First Minister of Wales wascirculated regarding the right to use the Welsh language on prescriptions in Wales whichrecommended the steps that could be taken by Welsh Ministers under Part 2, Section 4 ofthe Welsh Language Measure (Wales) 2011.

It was noted that the Health Minister had pledged that he would respond to the letter bythe end of this term.

5. REPORT OF THE CABINET MEMBER – THE WELSH LANGUAGE

Submitted – the verbal report of the Cabinet Member for the Welsh Language, detailingrecent development in the field, including:-

Reporting back from the last meeting of the Workplaces Sub-group which hadbeen established under Hunaniaith;

The presence of Hunaniaith and Gwynedd Council at the Urdd Eisteddfod and theevents attended during the week;

Specific meetings regarding developing software to track the development of theLanguage Charter;

An informal meeting with the Chairman of the Betsi Cadwaladr University HealthBoard to discuss the use of the language by staff;

Discussions on the concerns regarding the lack of Welsh language provision forformer soldiers.

A paper was distributed to members following the meeting of the Language Delivery Panelon 25 June, detailing the activities, the progress thus far and the pledges to be achievedduring 2014/15 with regard to the Gwynedd Primary Schools Welsh Language CharterProject and the Communities Promoting the Welsh Language Project. Referring to thework of tracking the Language Charter, the Cabinet Member noted that although a specificexperiment in Ysgol Pen y Bryn, Bethesda had shown progress in the children’s use of theWelsh language over a period, he was extremely disappointed that so few children in thecounty listened to the radio and watched TV in Welsh and the vast majority of childrenused Facebook and Twitter almost entirely through the medium of English. He noted thathe would provide a further update to the committee following the next Language DeliveryPanel.

RESOLVED to note the report.

6. SOCIAL HOUSING ALLOCATIONS

Submitted – a report and PowerPoint presentation by the Senior Housing Manager andthe Housing Options Team Leader on the Common Housing Allocation Policy and SocialHousing Allocation in Gwynedd. The Common Housing Allocation Register was detailed,along with the Policy, the legal framework, the partnership work, the role of the HousingOptions Team and the definition of local connection (including statutory considerations),fact and figures along with a series of messages to close.

Members were given an opportunity to ask questions and offer their observations. Duringthe discussion the following main matters were highlighted:-

(1) Concern was expressed that it appeared that outsiders could have priority over localpeople for social housing in the rural communities of the county. These people couldcome from socially harder areas and could influence the nature of small estates inthe county and challenge the indigenous Welsh speakers.

(2) It was regrettable that language had not been included as one of the characteristicssafeguarded by law against all types of discrimination under the Welsh GovernmentCode of Guidance on Allocating Houses and Homelessness. It was explained thatlanguage was associated with ethnicity, which was one of the characteristics and,therefore, there could be no discrimination on the basis of language. It was arguedthat Welsh speakers in Wales were not an ethnic minority and it was emphasisedthat there was a need to challenge the legal framework.

(3) It was noted that very often problems arose when tenancies were exchanged and itwas explained that this was a statutory right of any public tenant in Wales andEngland, subject to complying with special requirements noted in the Housing Act1985. It was enquired whether it was within the Assembly’s power to revisit thislegislation as the housing field had now been devolved to Wales. It was reportedthat Housing was a matter that had been devolved and it would be possible to pressfor change. However, this issue had not been addressed in the Housing Act thatwas going through the statutory process at the moment. The homelessness serviceconsidered local connection when providing services but any person from any areahad the right to ask to be included on the housing register.

(4) Concern was expressed regarding the welfare of those incomers who were sent torural communities far from services and family networks. Although these applicantscould reach the top of the list in terms of points if there was no local demand forproperties, allocating them in rural areas could lead to tensions and the situationwas not ideal for them, let alone the communities. It was explained that theapplicants’ rights to choose the areas where they wished to live had to be acceptedand respected and that allocations were more likely for hard to let properties orproperties where local applicants had no priority points. However, the housingassociations were becoming more proactive and were fostering a relationship withprospective tenants before signing them up and were looking increasingly at thesocial side also.

(5) It was emphasised that any planning permission granted for a social housingdevelopment in a rural community should include a 106 agreement restricting theoccupancy of those houses to local people.

(6) It was noted that there had been empty houses in Deiniolen for some time althoughthere were a number of local people on the waiting list and the Housing OptionsTeam were asked to put pressure on Cartrefi Cymunedol Gwynedd (CCG) to movethe process forward sooner to release the properties. It was explained that thefunction of the Housing Options Team was not to put pressure on CCG to managetheir stock as they were an independent company and body, but the Teamcollaborated closely with CCG so that a speedy response could be given once thewaiting lists were to hand. Also, CCG had given an explanation for keeping thehouses vacant for renovation work and that had to be accepted.

(7) It was questioned whether Nefyn as a community was an urban or rural area inrespect of the rural allocations policy and it was suggested that there could be adiscussion regarding this.

(8) Referring to the Localism Act 2011, which was operational in England, it was notedthat England was far ahead of Wales in terms of safeguarding communities. It wasexplained that this act had not been enacted in Wales and perhaps legislation wasneeded for this to happen.

(9) It was noted, although there was a perception that communities were being drownedby outsiders, it was heartening to understand that 91.41% of current applicationsthat had been registered with the Housing Options Team had a local connection withGwynedd. Despite this, the language was in decline in the county’s communities

and it was obvious that the local connection was no longer sufficient to safeguardthe language and there had to be a language condition. Guidance was sought onhow to challenge the Code to place more emphasis in terms of the local connectionand that the Welsh language was a condition in planning and housing matters. Itwas explained that persuading the Assembly to revisit the code was quitechallenging but it would be possible to correspond with them noting the members’observations and concerns and raising questions regarding the current Code.

The officers were thanked for the presentation.

RESOLVED that the officers of the Housing Service correspond with the Assembly,noting the members’ observations and concerns and calling for:-(a) Adding language to the characteristics that are safeguarded by law against all

types of discrimination under the Welsh Government’s Code of Guidance onAllocation of Houses and Homelessness.

(b) Introducing legislation to extend the Localism Act so that it is enacted inWales.

7. GWYNEDD COUNCIL’S LANGUAGE SCHEME - MONITORING REPORT 2013-14

Submitted – the draft Monitoring Report 2013/14 and members were invited to submitobservations and approve the report prior to it being submitted to the Welsh LanguageCommissioner.

Referring to the Language Skills of Staff, the Equality and Language Officer noted thatthere were more figures to be included in the report for Social Services and that 94% ofstaff in the department were Welsh speakers.

During the ensuing discussion it was noted:-

(1) The problem was in Meirionnydd and specifically in Dolgellau Leisure Centre whichwas very obvious from the report.

(2) The report was a baseline which could be built upon. There was room forimprovement in some areas but the committee’s hands were tied until the LanguageStandards were published.

(3) It was enquired whether the Language Charter could be tailored for Youth Clubs.(4) An observation was made on the details of figures for Welsh speakers in the Social

Services Department (submitted during the meeting). It was explained that therewould be figures available for the various functions within Social Services in duecourse and they would also be submitted to the Language Commissioner; theywould also be continuously monitored as part of the ‘More than Just Words’structure.

RESOLVED to approve the report and submit it to the Welsh LanguageCommissioner.

8. UPDATE ON LANGUAGE STANDARDS

Submitted - for information, the report of the Language and Equality Officer, noting:-

(1) The Welsh Language Commissioner had published a Standards Report which notedthe conclusions of the Standards Investigation and had produced an advicedocument for Welsh Ministers, summarising the comments received from the publicand interested groups on the proposed Standards.

(2) It was anticipated that the regulations would come into force in November 2014.

9. THE LANGUAGE COMMITTEE'S WORK PROGRAMME

Submitted – the report of the Equality and Language Officer requesting the committee toapprove the work programme for 2014-15.

A feeling of frustration was expressed that the Language Committee had no power andthere was no follow-up to the discussions. A wish for the committee to be more proactiveand pioneering was expressed, rather than being accepting of everything and to promotethe language rather than trying to protect it every time It was suggested that rather thanlistening to presentations and asking questions only, the committee should have adiscussion and summarise the messages at the end and consider establishing a sub-group to examine the matter in more detail. It was also suggested that the committeecould do more of their general work at working group level as it was difficult to delvedeeply into issues in a full committee. However, it was emphasised that there was a needto ensure sufficient capacity to undertake the work properly.

It was noted that matters on the draft work programme involved the status of the languageonly and there was a need to address those matters that were crucial for the future of theWelsh language, such as housing, planning, the economy etc. The programme did notrefer to reporting back on any matter.

There was a discussion on establishing a sub-group without delay to examine the field ofsocial housing allocations as a result of receiving a presentation on the issue under item 6above but it was suggested that it was premature to do so before receiving the legalguidance that had been requested and before ensuring the capacity to undertake thework. It was noted that the Communities Scrutiny Committee was also investigating thisfield and it was proposed that a group from this committee met the Communities ScrutinyCommittee to discuss the issue.

RESOLVED(a) To approve the following work programme and to add to it as required.

(b) To invite the Language Commissioner to provide a presentation to a specialmeeting of the Language Committee following the publication of the LanguageStandards.

(c) That the Compliance and Language Manager asks the Strategic andImprovement Department if they have the capacity to support investigationsinto specific fields by sub-groups of the Language Committee.

10. MYNYDDOEDD PAWB CAMPAIGN

Resolved - the report of the Language Development Officer requesting the committee to:-

(1) Submit their observations at the request of Mynyddoedd Pawb for support to theircampaign to safeguard Welsh place names.

(2) Consider contacting the organisers of the campaign to express the support of thiscommittee to those aims.

It was noted that sometimes the Council used English versions of place names and it wasexplained that whilst there was a need for the Council to acknowledge English names toensure consistency with the Post Office list, the Language Scheme was clear that only theWelsh version was used by the Council.

RESOLVED(a) To refer the matter to the full Council to give political strength to the

campaign.(b) To contact Community Councils to remind them that it is important for them to

give their support to the campaign.(c) To nominate the Chair and Vice-chair of the Language Committee to be

present at the next Conference of Mynyddoedd Pawb.

11. HOUSE NAMES

Submitted – the report of the Equality and Language Officer. She noted that there hadbeen 137 cases of changing house names in Gwynedd in 2012, with two changing fromWelsh to English and nine changing from English to Welsh. A similar pattern had beenseen in 2013, with 118 cases of changing house names – one changing from Welsh toEnglish and 13 changing from English to Welsh. Therefore, the trend was more towardschanging from English to Welsh than conversely but it was a matter for GwyneddConsultancy to keep an eye on.

RESOLVED to note the report.

12. LANGUAGE COMPLAINTS

Submitted – report of the Equality and Language Officer detailing the latest languagecomplaints to hand.

Concern was expressed that the same issues raised their heads time after time and thatpeople felt that there was no need for them to do anything save for apologising. TheCouncil had no other methods of ensuring that the language received its due respect fromstaff and it was enquired how the Council could act in a proactive manner that promotedthe language, rather than having to listen to apologies all the time. It was agreed toinclude any ideas on the work programme for discussion.

TITLE: WELSH LANGUAGE COMMISSIONER’SENFORCEMENT POLICY (DRAFT)

AUTHOR: EQUALITY AND LANGUAGE OFFICER

PURPOSE OFREPORT:

TO ESTABLISH AND COLLECT THECOMMITTEE’S COMMENTS

1. BACKGROUND

1.1. The draft Policy is presented to the Language Committee in order gathercomments to be sent to the Commissioner. Note that the consultationperiod runs from15/09/14 to 10/11/14.

1.2. The purpose of the document is to give advice and information on the waythe Commissioner will undertake her enforcement duties under Part 5 ofthe Language Measure.

1.3. The document is aimed at bodies such as Cyngor Gwynedd who will haveto comply with the Language Standards.

2. THE DOCUMENT

2.1. The document outlines the proposed principles, processes and criteria inrelation to researching any complaint or accusation of failure to complywith the statutory requirements...

2.2. It outlines how a complaint can be taken to the Commissioner underSection 93 of the Welsh Language Measure and also how theCommissioner can consider evidence from other sources (e.g. evidencearising from inspection work).

2.3. The statutory investigation process is also outlined, along with the optionsavailable to the Commissioner: Ranging from finding no failure and takingno further action to enforcing measures following a failure to comply.

2.4. Following a failure to comply, the Commissioner may take any one ormore of the following actions:- Restore compliance (voluntary agreement to restore compliance)- Enforce compliance (steps to enforce compliance)- Impose civil penalty (up to £5,000)

2.5. Where there is failure to comply with an enforcement step or settlementagreement, the document outlines how the Commissioner may make anapplication to the county court to secure compliance.

3. RECOMMENDATION

3.1. The Language Committee is asked to provide any comments on thedocument to present to the Welsh Language Commissioner as part of theconsultation process.

TITLE: ENQUIRY STRUCTURE FOR THE LANGUAGECOMMITTEE

PURPOSE OFTHE REPORT:

TO ASCERTAIN THE COMMITTEE’S OPINION OFTHE POSSIBILITIES AND AREAS OF ENQUIRY

1. BACKGROUND

1.1. During the Language Committee of 26/06/14, a request was put forward forthe Committee to take a more proactive role in relation to some subject areas:One that would lead to a more detailed response and more concreterecommendations than that allowed by the Committee’s usual meetings.

1.2. It was noted that clarity was necessary about any new role and also thecapacity of our structures to support such a proposal. The purpose of thereport is to outline what may be possible and to decide on what areas theCommittee would like to investigate.

1.3. Any arrangement would have to be compatible with the LanguageCommittee’s terms of reference:

- Oversee Gwynedd Council’s Language Scheme.- Set a strategic direction on matters relating to the Welsh language as required.- Work as a consultative body on strategies to promote the Welsh language

within the county, making suggestions to Cabinet as required.

2. POSSIBILTIES FOR THE ENQUIRY STRUCTURE.

2.1. To keep a clear focus on the work, it is suggested that one enquiry only beundertaken at a time, with a maximum of 2 enquiries within a calendar year.This would be similar to the Scrutiny Enquiry arrangements.

2.2. It should be decided whether the structure will address the Council’s interiorwork, or wider matter in addition. Note however that this is a Committee thatdeals with the Council’s own policies and arrangements. If practicality andresults are the aim, this would be much easier to achieve throughconcentrating on what is within our control.

2.3. Having identified internal concerns, a Sub-Group of the language Committeecould come together to discuss matters in detail and presentrecommendations to the relevant Department or Unit, requesting a responseand monitoring action.

2.4. By looking beyond the Council’s arrangements, it must be accepted thatpractical solutions will not be as easy to achieve unless we have control andauthority over the body in question. This kind of work is likely to lead tolobbying as opposed to amendment and improvement. It should also be notedthat this approach may lead to long and complex discussions which would bemore of a drain on the Council’s capacity.

2.1. Note that the Commissioner requests written and oral information,with some enquiries earmarked for specific attention as part of ourfeedback meeting. For the purpose of this report, and to provideinformation for the Language Committee Members, a writtenresponse is provided for all the matters raised by theCommissioner.

Cyngor Gwynedd’s Comments on Response of the Welsh Language

Commissioner to our Annual Monitoring Report 2013-14

B.1 The 2012-13 Monitoring Reportreferred to a review of the Economy andCommunity Department’s grants andfunding in relation to the Welshlanguage. It was noted during themonitoring that there would be anopportunity to consider the conditionsagain when new grants were introduced.Have there been further developments?

No developments. Having discussed thesituation with the Business Grants Unit, itwould appear that new structures will notbe in place until June 2015. Followingthis, we will review our conditions, in linewith our commitment to ensure that wepromote the Welsh language as best wecan.

In the meantime, a Report is beingprepared for the Language Committee,outlining the role of the Council andCommissioner in relation to promotingthe Welsh language within the businesssector.

C.1 Please provide an update onreceiving feedback [from CouncilDepartments]

We have a system of presenting reportsto the Language Committee fromdifferent Departments/ Units. Thus far,reports have been made on the followingwith reference to the Welsh language:

Planning and the Welsh language Human Resources (recruitment) Leisure Centres Social housing lettings

D.3 It was noted in the last report that theTraining Unit is developing an e-learningprogramme. When will the LanguageAwareness module be introduced?

We will be adapting our LanguageAwareness training to be introduced asan e-learning module.

The Training Unit is currently designingthe modules. We foresee that languageAwareness should be ready in about 12months.

3.C We would like to discuss this[Leisure Centres’ Language Championsscheme] as part of our feedbackmeeting.

We will be in a better position to preparea further report within the next year.

New arrangements and requirementshave been set. However monitoring thecompliance of all the contracts againstthe standards will take time. This has tobe done before we are in a position tomeasure progress against the additionalrequirements across all the contracts.

We will obviously be reporting regularlyon this, as required by More Than Wordsand the Language Standards.

Please report on the compliance of thehome care providers during 2013/14

New care contracts and requirementshave been presented to providers, but asresources were scarce during 2014, it willnot be possible to provide a full report atthe moment.

The Contracts Team are howeveraddressing this and will be reporting onperformance and progress as required.

5.A How many elected membersreceived [Language Awareness]training? Were any members of stafftrained?

Language Awareness training wasprovided for 3 members. The responsewas disappointing, and we will beoffering the training again in 2015.

Apart from the element of LanguageAwareness provided as part on theinduction process, Language Awarenesswas not delivered as a course for staffmembers. (Although the course remainsavailable to all)

Due to changes to our staff induction, wewill aim to provide Language Awarenessthrough e-learning.

At the moment, Social Services’ TrainingUnit are discussing with the WorkforceDevelopment Officer introducing anelement of Language Awareness intoWelsh lessons for Social Services staff.

June 2014 Complaint from a member ofthe public, presented throughthe Commissioner, regardingthe fact that she wastransferred by the TradingStandards Unit to a line whereno Welsh speaker wasavailable.

It was explained that the provision ofconsumer advice is no longer astatutory function for the Council. Thecall was transferred to the CAB callcentre (which is not funded by theCouncil).

The company which provides thisservice for the CAB does offer aWelsh language service, but noWelsh speaker was available whenthis call was transferred.

The Trading Standards Unit hasraised this matter with the CAB, andhas received confirmation that thiswill be discussed at the next contractreview meeting.

June 2014 Complaint that a member ofthe public had received anEnglish-only letter from theBusiness Support Unit

Having researched the matter, itwould appear that the Unitresponded through the medium ofEnglish to English correspondencewhich was sent to them (thiscomplies with the Welsh LanguageScheme).

The situation was explained and aWelsh version of the letter was sent.

July 2014 Complaint forwarded by theCommissioner regarding anEnglish-only sign on the A487near Groeslon

The relevant Unit have raised andresolved the matter with thecontractor, re-emphasising the needfor bilingual signage.

August 2014 Complaint regarding the lack ofWelsh on the Pont Briwet opennight

Contact Department for comment: Inorder to ensure a sufficient level ofexpertise and to respond to thewidest range of questions, it wasnecessary for a (non-Welshspeaking) representative from thecontractor company to make apresentation.

Since the presentation was to bemade walking around the site,simultaneous translation was notsuitable on this occasion. However,it was arranged that Welsh-speakingcommentators from the Departmentwere available to explain andrespond through the medium ofWelsh.

October 2014 General complaint regardingproblems with the Council’sWelsh website and an English-only CCTV sign

Website team have made furtherenquiries to ascertain the problemand the relevant Unit are looking intowhether the Council is responsiblefor the sign.

October 2014 Enquiry regarding the mediumof swimming lessons

Initial enquiries reveal that a localswimming club and not the Councilis responsible for the particularlessons.

The Department is in the process ofestablishing whether there is acontractual relationship with the clubbefore proceeding.
