Mission:

• To afford local farmers a profitable location to sell their produce and other goods. • Provide consumers the opportunity to personally interact with farmers & gain first hand

knowledge of the origin of their food. • To support our local economy.

General Information:

• The Poplarville Farmers Market is located on the green at 410 South Main Street. • The Poplarville Farmers Market is open every 1st and 3rd Thursday, April through

October, from 3:00 -6 :00 PM. • Applications must be submitted a minimum of 1 week in advance of Market

participation. • The Market Advisory Committee will have the final authority regarding the acceptance or

rejection of vendors, their applications, and their products. • Each booth area is approximately 10’ x 10’. • Please let us know if you have any special needs

Check-in Requirements:

• Market opens for vendors at 2:00 PM. • Set-up should be completed and vehicles moved by 2:45 PM, the market officially opens

at 3 PM, but sales before official opening are permissible. • Vendors arriving late should call Market Manager at least one hour before opening when

possible.

2017 Fee Structure:

• Daily: $10 Season: $100

Products to be Sold:

The Poplarville Farmers Market strives to achieve a balance of products. While we want to promote our local craft artisans the focus of the market is food and agricultural products. There will be limited spaces for craft items - must be locally sourced and made.

The Market’s ideal balance will be: (Note: there may be vendors selling similar items and availability of some items will vary by season)

50% fresh produce; 30% value added products (i.e., baked goods, home canned/ processed goods, fresh juices and cider, limited craft and plant items*); 20% dairy products and MS regulated meats (frozen meats, fluid milk, fresh cheese, canned and pickled products, cured sausage and meat).

*Florists/Plant Nursery- Priority will be given to those vendors that raise their own plants.

Food Items- All processed foods must adhere to the Cottage Food Bill guidelines. All prepared foods must exhibit a list of ingredients if there are more than two, given in descending order of predominance by weight, and the name and complete address of the business. “Low risk” prepared foods, which include; baked goods, honey, jellies, jams, cider, and sauces, if the foods contain verifiable locally grown ingredients. Except for these “low risk” items, vendors must utilize an approved commercial food processing facility to sell any prepared foods.

Rules & Requirements

• Vendors are responsible for their own sales taxes, licenses, permits and fees required for operation and will abide by all local, state and federal laws.

• Vendors will supply their own tables, chairs, signage, scales, tents, displays, bags, and change for customers.

• The booth must be occupied by the vendor or one of their agents at all times while the Market is open

• Separate vendors may not share booth space. • Vendors are allowed to set-up NO EARLIER than 2:00 PM and NO LATER than 2:45

PM • Market staff or volunteers may ask that you move your vehicle once you are unloaded.

Leave all handicap spots open for handicapped customers. • Vendors MUST REMAIN COMPLETELY SET UP UNTIL 6PM and are responsible for

the cleanliness of their areas during AND after operation; public receptacles are NOT for vendors’ disposal of market waste so please bring a receptacle and take your trash home with you.

• Vendors are expected to be courteous to customers, other vendors, the market manager and volunteers.

• The booth fee must be paid at the beginning of the market day. A receipt will be provided to you by a market staff-member.

• The Market Manager retains the right to immediately deny a vendor the privilege of selling at the market for any of the following reasons: misrepresentation of products, poor quality of products or produce, nonpayment of fees, or disorderly conduct.

• To the fullest extent allowed by law, each vendor shall indemnify, defend, save, hold harmless, protect and exonerate representatives, volunteers, the Market Manager, and the State of Mississippi from and against all claims, demands, liabilities, suits, actions, damages and losses for personal injury, death or property damage, including, without limitation, court costs, investigative fees and attorneys’ fees arising out of such vendor’s operations on the city’s grounds, and whether caused by the vendor or his agents, employees or subcontractors. Each vendor shall be solely responsible for all costs and/or expenses associated with such defense.

By signing this form, I hereby consent to all the terms of this application and agree to abide by all rules, regulations, and policies as put forth by the Poplarville Farmers Market. Market staff may visit any approved producer’s facilities to ensure compliance with applications and market regulations. Non-compliance issues will be reported in writing by the Market-Manager. Section 27-65-103 (b), Mississippi Code of 1972, provides an exemption from sales tax for sales of agricultural products only when sold by the producer and when sold in their original state without further processing or preparation. This exemption is applicable only if the producer is selling those agricultural products that he or she has produced. The mixing of products purchased from another producer with products raised by the seller will result in all sales becoming taxable. By signature on this form, I hereby understand that I will be liable for sales tax on all of my sales if I sell any agricultural products that I have not grown or that are not in their original state.
