RESUME OF BUSINESS TRANSACTED DURINGTHE FOURTH SESSION OF THE THIRTEENTH
KERALA LEGISLATIVE ASSEMBLY
The summons dated February 19, 2012 for the Fourth Session of theThirteenth Kerala Legislative Assembly was issued to the Members onFebruary 21, 2012. The session commenced at 9.00 a.m. on Thursday, March 1,2012 and adjourned sine-die at 12.00 noon on Friday, March 23, 2012. The Housemet on the following days viz., March 1, 2, 5, 6, 8, 19, 20, 21, 22, 23 (10 daysof sittings). The House transacted business for 57 hours and 8 minutes.
Governor’s Address
The Governor Shri H. R. Bharadwaj addressed the members of theLegislative Assembly at 9.00 a.m. on March 1, 2012. The discussion on theMotion of Thanks to the Governor’s Address commenced on March 5, 2012 withShri T. A. Ahammed Kabeer moving the following motion:

The discussion on the Motion of Thanks lasted for 3 days, viz. March 5, 6and 8, 2012. The motion was adopted on March 8, 2012. The House devoted13 hours and 18 minutes for the discussion on the Motion of Thanks and43 members including Ministers participated in the discussion.
Obituary Reference
On March 2, 2012, the Speaker made references on the demise ofM.O.H. Farook, who died while holding the office of Governor. Shri OommenChandy, Chief Minister and Leaders of various parties associated themselves withthe sentiments expressed by the Chair. As a mark of respect to the deceased, themembers stood in silence for a while. The House adjourned for the day withouttransacting other business.
On March 5, 2012, the Speaker made references on the demise ofEappen Varghese, P. Vijayadas, A. N. Yousuf, M. I. Markose and K. Sreedharanformer members of the House. As a mark of respect to the deceased, the membersstood in silence for a while.

Rulings by the Speaker
On March 5, 2012, the Speaker gave ruling regarding the web-publication ofa Private Member Bill for which notice had been given for motion to leave forintroduction in the House, but before printing and circulating the Bill amongmembers.

Financial Business
I. Vote on Account
Vote on Account for the first four months of the Financial Year 2012-2013was laid on the Table of the House on 19-3-2012. The Demands for Grants onAccount were discussed and passed by the Assembly on 23-3-2012.
Out of 125 cut motions received, none were moved. There were 65occasions for speech including reply by the Minister for Finance, Law andHousing, in connection with the discussion and voting on Demands for Grants.
The Assembly devoted 43 minutes for transacting financial business relatingto the Vote on Account for 2012-2013.
The Appropriation (Vote on Account) Bill, 2012, in respect of the Vote onAccount for the year 2012-2013 was introduced by the Minister for Finance, Law &Housing, on 23-3-2012. The Bill was taken up for consideration and passed on thesame day.
II. Supplementary Demands for Grants 2011-2012
The final batch of Supplementary Demands for Grants for 2011-2012 waslaid on the table on 19-3-2012. The Supplementary demands were discussed andpassed by the Assembly on 23-3-2012.

SALIENT FEATURES OF THE BILLS
THE PAYMENT OF SALARIES AND ALLOWANCES(AMENDMENT) BILL, 2011
As per the provision in sub-section (6) of section 8A of the Payment ofSalaries and Allowances Act, 1951, every Member of the Legislative Assemblyshall be entitled to the services of an officer of his choice not above the rank of aSelection Grade Assistant in the Government Secretariat and who is in the serviceof the Government or a local authority or any Corporation owned or controlledby the Government or any other authority specified by the Government.
2. Requests have been received from the Hon’ble Members of theLegislative Assembly to amend the relevant provisions of the Payment of Salariesand Allowances Act, 1951 with a view to enabling the Members of the LegislativeAssembly to have the services of an officer of their choice. The Governmenthave considered the requests and have decided to amend sub-section (6) of section8A of the Payment of Salaries and Allowances Act, 1951, so as to enable aMember of the Legislative Assembly to have the services of any officer otherthan a member of an All India Service.
3. The Bill Seeks to achieve the above object.
THE PAYMENT OF SALARIES AND ALLOWANCES (SECONDAMENDMENT) BILL, 2011
The last revision of salaries and allowances of the Ministers, the Speaker, theDeputy Speaker, the Leader of Opposition, the Chief Whip and the Members ofthe Legislative Assembly was made in the year 2008 by Act 25 of 2008. For thelast three years, the price of all the commodities including petrol, diesel,electricity, telephone charges etc. has increased manifold. Considering the above,the Hon’ble Speaker in consultation with the Hon’ble Chief Minister, appointedMr.Justice R. Rajendra Babu, Retired Judge, High Court of Kerala to study andmake recommendations to revise the salaries and allowances payable to theMinisters, the Speaker, the Deputy Speaker, the Leader of Opposition, the ChiefWhip and the Members of Kerala Legislative Assembly and also to examine andsuggest necessary amendments to the Payment of Salaries and Allowances Act,1951, the Payment of Pension of Members of Legislature Act, 1976 and mattersconnected therewith. Justice R. Rajendra Babu Commission submitted its report

on 14th October, 2011 containing various recommendations. On the basis of therecommendations of the Commission, the Government have decided to revise thesalaries and allowance and to make necessary amendments in the Payment ofSalaries and Allowances Act, 1951.
2. The Bill seeks to achieve the above object.
THE PAYMENT OF PENSION TO MEMBERS OF LEGISLATURE(AMENDMENT) BILL, 2011
The last revision of pension and other allowances to the Ex-Members of theLegislative Assembly was made in the year 2008 by Act 26 of 2008. For the lastthree years, the price of all the commodities including petrol, diesel, electricity,telephone charges etc. has increased manifold. THE KERALA APPROPRIATION BILL, 2012
The Bill is introduced in pursuance of clause (1) of Article 204 of theConstitution of India read with Article 205 thereof, to authorise payment andappropriation of certain further sums from and out of Consolidated Fund of theState of Kerala required to meet the supplementary expenditure charged on theconsolidated Fund of the State of Kerala and the grants made by the LegislativeAssembly for the expenditure of the Government of Kerala for the Financial Year2011-2012.
THE KERALA APPROPRIATION (VOTE ON ACCOUNT) BILL, 2012
The Bill is introduced in pursuance of Clause (1) of Article 204 of theConstitution of India read with Article 206 there of, to provide for theappropriation out of the Consolidated Fund of the State of Kerala of the moneysrequired to meet the expenditure charged on the Consolidated Fund of the State

and the grants made in advance by the Legislative Assembly in respect of theestimated expenditure of the Government of Kerala for a part of the FinancialYear 2012-2013.
THE KERALA FINANCE BILL, 2012
The Bill seeks to amend the following enactments to give effect to thefinancial proposals of the Government of Kerala for the financial year 2012-2013as announced in paras 364, 369, 372 to 394 and 396 of the Budget Speech2012-2013, namely:—
1. The Kerala Stamp Act, 1959 (17 of 1959);
2. The Kerala Land Tax Act, 1961 (13 of 1961);
3. The Kerala General Sales Tax Act, 1963 (15 of 1963);
4. The Kerala Motor Vehicles Taxation Act, 1976 (19 of 1976);
5. The Kerala Tax on Luxuries Act, 1976 (32 of 1976);
6. The Kerala Value Added Tax Act, 2003 (30 of 2004);
