Summary To many people, the idea of thinking like a lawyer conjures up sinister thoughts of finding loopholes and work

arounds, assisting in miscarriages of justice, and stretching the truth. Many of our more shocking current events

have some lawyer's action that seems outrageous at their core.

We may be somewhat cynical about lawyers on a global scale, and in the United States in particular, because so

much of our cultural capital seems to be expended on litigation and on the high costs associated with legal advice.

Yet, it is difficult to refute the critical role that the law, and by extension, lawyers play in the smooth running of

commerce, the facilitation of invention, and our ability to exchange ideas about all shades of controversy. And these

are just a few areas where the law makes a positive contribution to our lives.

If we start our review with the ways in which lawyers are taught, we see that the seeds of "thinking like a lawyer"

are embedded in the structure of legal education. Distilled down to its most basic parts, law students spend three

years studying a variety of subjects. Almost all of these subjects are designed to develop five abilities research,

reasoning,

Lawyers are information perfectionists who must know the level of authority and the source of everything cited or

used in legal argument. They also approach research as information optimists. There is an assumption that a "mirror"

(or at least a complimentary case) exists or a statute or regulation is on point with a client's needs. Lawyers are very

hesitant to declare something to be a "case of first impression." By the same token, information professionals have

trouble facing the prospect that information does not exist.

Mention Desa Sri Hartamas and most people would think of the small commercial area where Souled Out is located.

It was once a serene commercial area set away from the booming condo district of Mont’Kiara, but of late more and more shops offices have been built around the original area adding to the already congested traffic situation.

For those lucky homeowners who bought the landed homes next to the commercial area where the school is located,

it’s probably turning into a windfall many times over for them already, but of late the landscape of their homes has

been changing, both the better and otherwise. Already, there has been some new low-rise development under

construction on the hillock next to it, with some massive foundation work set into solid granite clearly visible as you

drive up the road to Kiara Hills.

Now, there is going to be a massive condo project made most of the residents here either cringe or cheer. Maymont

has soft launched a hillside condo project overlooking Desa Sri Hartamas called Matahari.

There are a few things to note here. Number one, it’s massive. There may not be as many units as some of the condos have further up the road in Mont’Kiara, but the sheer scale of the project covering the entire side of the hillock will completely change the view and population outlook here. The second thing is that the project is built

with lots of infrastructure works due to the nature of the slopes and underlying hard strata. Not going into details

here, but a lot of extra care is required for this hillside project, as with any hillside project for that matter, especially

one with existing homes nearby.

With beach closures and the closing of fishing waters in the Gulf of Mexico, the Deepwater Horizon incident had a

dramatic impact on the economy of the Gulf Coast during the summer and autumn of 2010. Even after the well had

been killed and no further oil was reaching shore, the region struggled to change public perceptions of the impact of

the spill.

Tourism

Throughout the Gulf Coast, we are providing financial support for state tourism promotion efforts. Within weeks of

the accident, we had announced block grants of $70 million to help promote tourism and mitigate the economic

impact of the oil spill in Louisiana, Mississippi, Alabama and Florida. In the autumn of 2010, we further increased

our support for tourism in the region by committing an additional $47 million in total to the four states affected.

Each state is using the tourism funds to develop specific marketing programmes that promote their state’s key tourism selling points. In Louisiana, for example, the state is using the BP funds to improve awareness of coastal

amenities and the state’s brand as the “Sportsman’s Paradise” by encouraging tourism through charter fishing and

nature-based adventures. The funds will also be used to promote tourism in New Orleans and other tourism-related

events.

Elsewhere along the coast, state and local tourism officials have used BP funds to sponsor concerts and other special

events that have attracted thousands of visitors to impacted cities.

Boeing has played a significant role in U.S. Space Flight programs from the beginning, designing, building and

On August 4, 2011, we announced the selection of the United Launch Alliance (ULA) Atlas V rocket to launch the

Boeing Crew Space Transportation (CST)-100 spacecraft from Florida's Space Coast.

Boeing is one of four companies developing Crewed Space Transportation solutions to restore the United States'

capability to provide access to the International Space Station by 2016.

Selecting the Atlas V as our launch vehicle of choice is a major step forward as it adds a proven and reliable launch

capability to our commercial crew transportation service. If NASA selects Boeing for a development contract with

sufficient funding, ULA will provide launch services for an autonomous orbital flight, a transonic autonomous abort

test launch and a crewed launch, all by 2016.

The Boeing and ULA teams will now begin detailed design work on an integrated system for launch and spacecraft

operations and also refining launch abort operations that will meet NASA's stringent human rating requirements to

safely transport crew and cargo to the ISS.

That work will lead to wind tunnel testing of the Atlas V and the CST-100 this year. The results will be used to

complete a preliminary design review of the integrated system in 2012, in the current second round of Boeing's

Commercial Crew Development Space Act Agreement with NASA.

The Commercial Crew program consists of developing, manufacturing, testing and evaluating and demonstrating the

CST-100 spacecraft, launch vehicle and ground/mission operations - all part of Boeing's Commercial Crew

Transportation System - for NASA's new Commercial Crew human spaceflight program.

Later in the same month, we will have our Annual Bar Leaders Conference in Warsaw, Poland, May 25-26, 2011.

Topics will include the cost of compliance, electronic communications, the court of public opinion, and a topic

presented by the Polish bar associations.

At the IBA Annual Conference in Dubai, October 30-November 4, 2011, our theme will be “Why? And How?”, where we will explore why we have Bar Associations and Law Societies and how are they set up. We will explore

such topics as why have bar associations, why should they be independent, why have an independent judiciary, why

have rules and regulations, and look at how a bar association is established.My sincere thanks go to our immediate

past-chair, Michael Kutschera. Under his committed leadership, the profession became much more aware of the

difficult debates facing Bar Associations and the practice of law, and Bar Leaders became even more engaged in

This program document describes the Second Development Policy Loan Program in a program of three possible

Development Policy Loans (DPL) to Romania. The first DPL (DPL1) disbursed Euro 300 million in September

2009. This second DPL (DPL2) is also for Euro 300 million. A third DPL (DPL3) for Euro 400 million is tentatively

targeted for CY2011. This DPL program supports the Government's structural reforms in three key areas: a)

improving fiscal sustainability and management of public finances, including at sectoral level in health and

education; b) enhancing social protection systems to address the immediate needs of the poor and vulnerable while

ensuring more sustainable social protection over the longer-term; and c) strengthening contingency planning in, and

the resilience of, the financial sector. The Bank operation reinforces and complements existing programs by the

International Monetary Fund (IMF) and the European Commission (EC). The DPL series is central to the Bank's

engagement in Romania as described in the Country Partnership Strategy (CPS) that was presented to the Board on

July 16, 2009, together with DPL1. While financing a relatively small share of the Euro 20 billion package agreed

by the Government with the IMF and the EC, the DPL targets structural reforms which will considerably improve

Romania's medium to long term outlook for sustainable development.

As we pause this Memorial Day to honor those who have died in service of our great Nation, it is also useful to

reflect on what this day of remembrance reveals about the character of our Nation and its people. History records

that Major General John Logan, national commander of the Grand Army of the Republic, formally designated May

30th, 1868 as a day to decorate the graves of the fallen.

History also suggests, however, that long before this formal decree, the people of several towns and cities organized

local efforts to decorate service members' graves, demonstrating the deeply personal and heartfelt gratitude that

Americans express for those who serve-and for those who sacrificed. Since its origin, Memorial Day has been an

opportunity to pause and reflect on the sacrifices of the more than one million Soldiers, Marines, Sailors, Airmen,

and Coast Guardsmen who have made the ultimate sacrifice to secure our freedoms.

Let us also not forget those who are still counted among the missing, including over 1,600 from action in Vietnam,

8,000 in Korea, and well over 73,000 in the Second World War. We also demonstrate America's character through

our ceaseless efforts to account for each of them, with gratitude for their sacrifices and that of their families. No

other nation in history has dedicated as much care, effort, and expense as we have to find our missing comrades and

bring them home with the honor that they deserve. And, thanks to our staunch determination, 80 formerly missing

service members-including 31 Airmen-have been returned to their families since January 2010.

INTERNATIONAL ROYAL AUSTRALIAN COY ARMY BATTALION

On the 45th anniversary of the Battle of Long Tan, veterans of Delta Company (1966), 6th Battalion, The Royal

Australian Regiment (6 RAR) were presented with the Unit Citation for Gallantry (UCG) for acts of extraordinary

gallantry by the Governor General at Gallipoli Barracks, Brisbane.

The Battle of Long Tan is regarded as an iconic Australian battle of the Vietnam War and is of great symbolic

importance for all Australians. In this battle, 18 Australians were killed, the most killed in any one engagement of

the Vietnam War.

The presentation of the UCG honours the service and sacrifice of the veterans of Delta Company, 6 RAR. Carrying

on the proud legacy of their regimental forbearers, current members of 6 RAR attended the presentation of the UCG

and are the custodians of the history and traditions of the 6th Battalion.

On this day, a parade at Gallipoli Barracks also marked the presentation of a Meritorious Unit Citation (MUC) to the

6 RAR-led Mentoring Task Force 1, for service in Afghanistan in 2010.

"The presentation of the Meritorious Unit Citation to the 6 RAR-led MTF-1 recognises the outstanding service in

warlike operations on Operation Slipper in Uruzgan Province, Afghanistan," Lieutenant General David Morrison

said.

"The parade commemorates the sacrifices made by the fallen members of 6 RAR and its supporting elements in

Vietnam and also recently in Afghanistan," he said.

The actions of 6 RAR, which earned these awards, reflect the highest ideals of the Australian Defence Force the

sacrifice and continuous commitment in defending Australia and its national interests.

The Federal Reserve System (also known as the Federal Reserve, and informally as the Fed) is the central banking

system of the United States. It was created in 1913 with the enactment of the Federal Reserve Act, largely in

response to a series of financial panics, particularly a severe panic in 1907The Federal Reserve System's structure is

composed of the presidentially appointed Board of Governors (or Federal Reserve Board), the Federal Open Market

Committee (FOMC), twelve regional Federal Reserve Banks located in major cities throughout the nation, numerous

privately owned U.S. member banks and various advisory councils. The FOMC is the committee responsible for

setting monetary policy and consists of all seven members of the Board of Governors and the twelve regional bank

presidents, though only five bank presidents vote at any given time. The Federal Reserve System has both private

and public components, and was designed to serve the interests of both the general public and private bankers. The

result is a structure that is considered unique among central banks. It is also unusual in that an entity outside of the

central bank, namely the United States Department of the Treasury, creates the currency used.According to the

Board of Governors, the Federal Reserve is independent within government in that "its decisions do not have to be

ratified by the President or anyone else in the executive or legislative branch of government." However, its authority

is derived from the U.S. Congress and is subject to congressional oversight. Additionally, the members of the Board

of Governors, including its chairman and vice-chairman, are chosen by the President and confirmed by Congress.

The U.S. Government receives all of the system's annual profits, after a statutory dividend of 6% on member banks'

capital investment is paid, and an account surplus is maintained. In 2010, the Federal Reserve made a profit of $82

billion and transferred $79 billion to the U.S. Treasury.

An aviator is a person who flies an aircraft. The first recorded use of the term (aviateur in French) was in 1887, as a

variation of 'aviation', from the Latin avis (meaning bird), coined in 1863 by G. de la Landelle in Aviation Ou

Navigation Aérienne (Aviation or Air Navigation). The term aviatrix (aviatrice in French) is used for a female

aviator.

The term is often applied simply to pilots, but can be extended to include aviation navigators, bombardiers, Weapon

Systems Officers, Electronic Warfare Officers. This should not be confused with the term naval aviator, which refers

to crew members in the U.S. Navy, U.S. Marine Corps and U.S. Coast Guard.

The term "aviator", as opposed to "pilot" or other terms, was used more in the early days of aviation, before anyone

had ever seen an airplane fly, and it was used to show connotations of bravery and adventure. For example, the

editors at the Dayton Herald, (in an article of December 18, 1903) described the Wright brothers' first airplane as

thus: "The weight, including the body of the aviator, is slightly over 700 pounds".

To ensure the safety of people in the air as well as on the ground, it soon became a requirement for an aircraft to be

under the operational control of a properly trained, certified and current pilot at all times, who is responsible for the

safe and legal completion of the flight. The first certificate was delivered by the Aéro-Club de France to Louis

Blériot in 1908, followed by Glenn Curtiss, Léon Delagrange, and Robert Esnault-Pelterie. The absolute authority

given to the "pilot in command" is derived from that of a ship's captain.[citation needed]

In recognition of the aviators' qualifications and responsibilities, most militaries and many airlines around the world

award aviator badges to their pilots, as well as other air crews.

The International Bankers Association (IBA) seeks to foster and promote cooperation among financial groups,

banks, securities firms, and representative offices in Japan; to promote the growth and positive development of

banking and capital markets in Japan; and to advance the interests of its membership in the Japanese market. The

IBA is the only association exclusively devoted to representing and advancing the interests of the international

financial community in Japan.

We work closely with government authorities, regulators, and non-governmental bodies in Japan. These

organizations include the Financial Services Agency, the Ministry of Finance, the Bank of Japan, the Japanese

Bankers Association, and the Japan Securities Dealers Association.

We seek to make available to these authorities and market participants the collective knowledge and experience of

our member firms. The IBA currently has 57 financial institutions, spanning international financial groups,

commercial banks, securities firms and representative offices.

The IBA seeks no regulatory or quasi-regulatory role in Japan.

Several inquiries have been made into the conduct of Swiss banks during the Nazi Germany period (1933–1945),

especially regarding funds deposited by or allegedly stolen from victims of the Holocaust. The campaign causing the

highest outlays ($1.25 billion in 1999) on the part of the Swiss banking industry as of 2009 was the World Jewish

Congress lawsuit against Swiss banks launched by Edgar Bronfman, president of the World Jewish Congress, in

concert with US Senator Alfonse d'Amato of New York.[38]

The audit run by the Volcker commission which resulted from this lawsuit cost CHF 300 million and gave its final

report in December 1999. It determined that the 1999 book value of all dormant accounts possibly belonging to

victims of Nazi persecution that were unclaimed, closed by the Nazis, or closed by unknown persons was CHF 95

million. Of this total, CHF 24 million were "probably" related to victims of Nazi persecution.[39] In addition the

commission found "no proof of systematic destruction of records of victim accounts, organized discrimination

against the accounts of victims of Nazi persecution, or concerted efforts to divert the funds of victims of Nazi

persecution to improper purposes." It also "confirmed evidence of questionable and deceitful actions by some

individual banks in the handling of accounts of victims".[39]

In response to the lawsuit, the Swiss government commissioned an independent panel of international scholars

known as the Bergier Commission to study the relationship between Switzerland and the Nazi regime. It reached

similar conclusions about the banks' conduct in its final report,[40] and found that trade with Nazi Germany did not

significantly prolong the war

A mercenary, also known as, Professional Soldier, Soldier of Fortune, Swashbuckler, Private Military Contractor, or

Profitmaker, is a person who takes part in an armed conflict who is not a national or a party to the conflict and is

"motivated to take part in the hostilities essentially by the desire for private gain and, in fact, is promised, by or on

behalf of a party to the conflict, material compensation substantially in excess of that promised or paid to

combatants of similar ranks and functions in the armed forces of that Party".[1][2] A non-conscript professional

member of a regular army is not considered to be a mercenary although he gets monetary reward from his service.

As a result of the assumption that a mercenary is essentially motivated by money, the term "mercenary" usually

carries negative connotations. There is a blur in the distinction between a "mercenary" and a "foreign volunteer",

when the primary motive of a soldier in a foreign army is uncertain. For instance, the French Foreign Legion and the

Gurkhas of the British and Indian armies are not mercenaries under the laws of war, since although they may meet

many of the requirements of Article 47 of Protocol I to the Geneva Conventions, they are exempt under clauses 47

some journalists describe them as mercenaries regardless
