Executive Summary

On 15th March 2018, Human Liberty Network and Dr. Ram Manohar Lohiya National Law University jointly organized “Round Table Consultation with Academicians on Human Trafficking, Bonded & Child labour in Uttar Pradesh”. In the consultation total 38 participants (Annexure I) including professor, Assistant professor from 16 different universities, institutions and member organizations of HLN participated. All participants hared their rich and given recommendations to combat human trafficking and bonded & child labour from Uttar Pradesh as well as for role of Academicians. Due to well thoughtful schedule (Annexure II) workshop took a wonderful action oriented shape in the presence of very vibrant participants as well as the knowledgeable speakers, academicians and motivating guests. The workshop began with the welcome of all dignitaries and sharing of objectives and agenda of the day. Following of this RMLNLU introduced HLN and requested to share about HLN with participants. In inaugural session Ms. Neeta Minz, from Geneva Global discussed all the issues and shared her experiences. In the continuation she did brief sharing about bonded labour through documentary movie. Following of this Ms. Ministhy S. Nair (IAS) shared about the government's responses and responsibilities on human trafficking, child labour and bonded labour issue. Subsequently Mr. Sanjay Singh acting vice-chancellor of RMLNLU discussed roles of academic institutions and shared his experiences regarding bonded labour. Following of inaugural sessions, other technical sessions began where distinguished speakers like Dr. M. M. Rehman, former Sr. Fellow, V.V. Giri National Labour Institute, Noida, Dr. Bhanuja Sharan Director of MSEMVS & HLN member, Mr. Syed Rizwan Ali from labour department, Dr. Ugrasen Pandey, Head of SRK PG College Firozabad , Ms. Ruchi Sinha from TISS Mumabi, Ms. Sangeeta Sharma visiting faculty of IGNOU Lucknow, as well as CWC member Lucknow, Dr. R.V. Singh, Professor Dr. B. R. Ambedkar University, Dr. Vinay Mishra , assistant professor Dr. Ram Manohar Lohiya Awadh University Faizabad, Dr. Prashant Chauhan from Amity University Noida, Dr. K. A. Pandey professor RMLNLU Lucknow, Ms. Jyoti Yadev, assistant professor, Amity University Lucknow , Mr. Sachin Kumar, Geneva Global, shared their rich experiences and considerate views to combat human trafficking, child and boded labour as well as role of academicians & researchers. During technical sessions some research scholars from various universities also put their points before the house. The remarkable discussion happened during all sessions. The key discussion points were; data of human trafficking, child & bonded labour, modern ways of slavery like in surrogacy, to combat modern day slavery system we all should be organized and create an army of good people of different departments and organizations including media because it is an organized crime, role of academicians to give evidences to policy makers for making changes in existing government policies, use of technology to spread information about modern day slavery issue as well as government schemes to combat it at mass level, civil society can play significant role like HLN is playing in Naya Sabera project of, engagement of youth, Need of more field researches and study on modern day slavery issues, better implementation of government schemes, push and pull factors of modern day slavery, difference between child labour and working child, rehabilitation of rescues victims, engagement of community and local leaders and capacity building of stakeholders. Mr. Prasanjit Kundu, assistant professor RMLNLU Lucknow facilitated all the sessions very nicely in the flow of schedule. In the valedictory session Mr. S. K. Rastogi, officer on special duty, Uttar Pradesh State Legal Service Authority addressed participant and congratulate to organizers to organize such a useful consultation and promised for full support from the UPSLA. Mr. Sachin Kumar shared following takeaways of the consultation-

1. We needs friends in media and should sensitized Media(both print and electronic)on modern slavery so that trafficking cases are highlighted

2. Student engagement in innovative sense. We should form youth club with students, researchers’, educationists and NGOs

3. We should also spread information of government schemes for survivors of bonded labour, human trafficking and child labour. An e-book for all government schemes

4. Should undertake traditional research work focusing on the human trafficking, sex trade and poverty, strategy for elimination bonded / forced labour & child labour, effective practices for takeoff rehabilitation

5. Should organize orientation programmes for labour/ enforcement officials, vigilance committee members, trade union activist, NGO activists, vulnerable workers

6. Universities can introduce the curriculum focusing on human trafficking, bonded/forced labour and child labour.

7. Community awareness programs including Pradhans of villages & community meetings to aware them about government schemes and facilities

8. Research reports should be reach to the policy maker

9. Publications on modern day slavery issue

10. Legal camp in association of DLSA & SLSA (Bihar Modal)

Minutes of the consultation

(Objectives of the consultationEnabling Conducive environment in Uttar Pradesh to combat human trafficking and bonded labour system through academicians and research scholars.Including human trafficking and bonded labour subjects in higher education syllabi.Formulating and suggesting recommendations to the government to combat human trafficking and bonded labour system in Uttar Pradesh.Enable an environment to conduct new research and studies by youth researchers on human trafficking and bonded labour.Sharing the best practices of the partners of the Human Liberty Network.)Roundtable consultation with academicians began with welcome speech by Mr. Prasenjit Kundu, Assistant Professor RMLNLU. He requested to all participants to share their name & organization. After introduction of participants he welcomed all the guests. Following the introduction session Mr. Sanjay Gupta Director of CHETNA a member organization of HLN shared objective of the workshop in brief and said that human trafficking, bonded labour and child labour are very sensitive topics and we all are here to discuss on these issues.

He shared data of the National Crime Record Bureau 2016, that total cases of human trafficking, as registered under IPC were 8132 from total victim of trafficking 15379 and out of these, trafficking of children were 9034 which was more than 60% of total registered cases. In this Report, forced labour emerges as a major purpose of human trafficking. From these figures it clearly indicates that child trafficking is being made for forced labour.

Pandey, professor of RMLNLU said that this is an important subject for which we have all gathered today at this unique platform to discuss such sensitive issues with the academicians of various universities of the entire state. He also told that RMLNLU has been working on such issues with all NGOs, stakeholders and government from 2015.

(Inaugural Session)

Mr. Kundu from RMLNLU welcomed all the guest of inaugural session through present bunch of flowers and requested to Mr. Sanjay Gupta to facilitate inaugural session.

(Ms. Neeta Minz, addressing participants during inaugural session)Mr. Gupta gave thanks to all eminent guests to spare there time for this consultation and an opportunity to all of us to listen their valuable experiences and take note of their recommendations. To begin inaugural address he requested to Ms. Neeta Minz, from Geneva Global. She kept her voice through a documentary film. This documentary film was based on the workers working in the brick kilns, showing how bonded laborers work on these brick kilns day and night and live their lives. It was also visible in this film that people with their entire family work on these brick kiln, which includes women and children too. After showing the documentary film, Ms. Neeta Minz said that this is a ground reality and there are many more people are forced to live like this bonded life. Every year 25% of the bonded labours are increasing, including men, women and children. Many of them are in the condition that they are working from their 3rd generation and their children are also involved in these works. Their children are also living a bonded life like them, and to end this kind of situation our organization Geneva Global is working with the government through our partners. She also urged to participants that we should work together to eliminate these sensitive issues from the root.

Subsequently facilitator invited Ms. Ministhy S. Nair (IAS). She thanked everyone for the invitation and shared about the government's response & responsibilities. She said that government of U.P. is very sensitive on issues of women and children and to protect them from human trafficking home department has taken various steps like training of 225 public prosecutors on human trafficking has done or women trafficking and child related laws. We have been conducted series of trainings and trained officers of 450 police stations of Uttar Pradesh to enhance capacity of special Juvenile Police Units and Anti Human Trafficking Units in association of NGOs. Developing Child Friendly Police Station in 20 districts is also an initiative and RMLNLU play a very key role in it. U.P. Police has a special cell named as Mahila Samman Prakoshtha who looks after matters of human trafficking and other issues of women and children.

(Ms. Ministhy S Nair (IAS), addressing participants during inaugural session)Sometime we think very stereotype and say that police is very insensitive but we should keep in mind that good persons are everywhere and bad persons are also everywhere and to fight against organized crime we need to develop an army of good. Very first we need to believe that there are good people everywhere, even if there are judiciary, IAS officers, IPS officers, CWC members, public prosecutors and if all good people will work together then only we will be able to get justice. So we have to bring changes in our mind set and this should not be happening only in the academicians and officers while in civil society too. She appreciated step of HLN & RMLNLU to organize this consultation with academicians because academician play a significant role in social changes and reformation. She stated that not only academicians while each one of us can make big changes and to make those big changes, we need to feel our self powerful and should create army of good people through technology and links. She gave an example of Prashant Nayar of Kerala and told that he uploaded a picture of the child on social media and asked for the help and within few hours, people came ahead to help, which shows that the technology can also mobilize army of good people together. Today mostly people have android phones today and we can all make videos of such issues and put them in social media so that people can aware on the issue. She quoted a viral video clip of Priya Warrior and recommended to make an informative documentary on such issues and spread the message to millions of people. We needs friends in media and trapped the youth power in innovative sense. We should also spread information of government schemes for survivors of bonded labour, human trafficking and child labour Like in Uttar Pradesh Rani Lakshmi Bai scheme, every human trafficking victim must get a compensation of 2 lakh, similarly in POSCO case there is a provision of get Rs 2 lakh to victims because people do not know about these schemes so it does not reach to them. Finally she shared that we need to more dialogue, we need to sit together and work as an army of good people to fight against these issues together.

He thanked all the academicians, guests and HLN members who came in the workshop. Then he said that our university is organizing this program with the Human Liberty Network and the issues that we have taken are very important. He shared his forest journey and Tong's people who were living in that forest and said that whenever we talk about human trafficking, child labour and bonded labour then district administration starts running away from its responsibilities. He stated that the policy should change as per the need of time and government should improve our old policies. Academicians may play a significant role here to give evidence to government for making changes in present policies through their studies. Government should prepare an holistic action plan to combat human trafficking because crime like human trafficking, bonded labour and child labour don’t have a single reason, there are multi-reasons who affect each other and to find concrete solutions then we should also work for those multi–reasons. The biggest help can be done by our bureaucrats because they understand all the aspects of field better than anyone else and these kinds of workshops should be done with the people of the same area so that they can help to improve the policies, added by him.

RMLNLU and its team is always dedicated to work on social issues and we are already working with UNICEF, Home department U.P. and Human liberty network to address social issues and will continue these kind of efforts, added by speaker.

Session ended with the felicitation of guests of inaugural session by a memento and Mr. Sanjay Gupta added that HLN has already prepared and submitted an action plan for combat human trafficking to home key stakeholders and UPSCPCR has constituted a working group to finalize that action plan and home department has putted on website too.

(First technical Session - Status of Human trafficking, child and bonded labour system in Uttar Pradesh)Following of the very motivating and promising inaugural session facilitator invited speakers (Dr. M. M. Rehman, former Sr. Fellow, V.V. Giri National Labour Institute, Noida & Dr. Bhanuja Saran, Director of MSEMVS a member organization of HLN) and moderator (Mr. Sanjay Gupta, Director of CHETNA a member organization of HLN) of the first technical session.

Dr. M. M. Rehman, former Sr. Fellow, V.V. Giri National Labour Institute, Noida addressed to the participants and shared his precious views and information about human trafficking and child labour. He said that without work / labour no one can survive because everyone have their need which can be fulfill by earning through work and in the market of work / labour poverty and dependency, together, play a vital role to push workers and laborers in vulnerability. A person who work in vulnerable situation often become bonded labour who exploit by a section of society who have land, capital and muscle power.

(Table 1: Human Trafficking as reported in, crime in India- 2016)Data always play an important role for studies, researched and making policies and due to lack of exact data we always struggle with good policies that can address social issues like human trafficking, child labour and bonded labour, said by speaker. The phenomenon of exploitation of vulnerable people began to be recognizing as an evil and unacceptable practice by government and came up with Immoral Traffic (Prevention) Act, 1956. The purpose of the Act was to prevent sexual exploitation of people, especially women under the force circumstances. Despite the existence of the law for more than six decades, the cases of immoral trafficking have not waned. In fact has been growing day by day. The figures presented in the Table 1 demonstrate that it still requires adequate efforts to eradicate human trafficking.

(Table 2: Children Missing, 2016)Data in table 1 evidently shows that number of human trafficking for forced labour is very high which means now a day’s human trafficking is not happening only for commercial sex work. When we see in the field then we will find that number of missing cases is also high and probably these children get in trafficking trap. Speakers also had shown the data of missing children of 2016 in table 2.

(Dr. M.M. Rehman, former senior fellow of VVGNLI, sharing his views)With of given figure he shared the profile of child labour in Uttar Pradesh. He started with the importance of education by the lines of Shri Rabindranath Tagore, “In my view the imposing tower of misery which today rest on the heart of India has its sole foundation in the absence of education.” Subsequently he told that child labour existed in the past but did not become subject of discussion and debate. It became an important phenomenon during Industrial Revolution. In India, during the last quarters of the last century, the issue and concerns for child labour became very prominent and since then enormous effort is being made to ‘abolish and regulate’ the practice. Despite many efforts, the practice of child labour has been continuing and flourishing. Then he shared that according to 2011 Census, the total number of Child Labour in Uttar Pradesh was 21,76,706; which is highest in the country

He sum-up his views with the following roles and responsibilities of universities, Education and Research Training Institutes -

· Should undertake traditional Research work focusing on the human trafficking, sex trade and poverty, strategy for elimination bonded / forced labour & child labour, effective practices for takeoff rehabilitation

· Should Organize Orientation Programmes for labour/ enforcement officials, vigilance committee members, trade union activist, NGO activists, vulnerable workers

(Dr. Bhanuja Sharan “Director of MSEMVS a member organization of HLN” addressing participants)Following of very informative moderator requested to Dr. Bhanuja Sharan “Director of MSEMVS a member organization of HLN” to share his experiences. Firstly, he thanked all participants to give their priceless time for round table consultation and said that for the last 21 years, he has been working on the bonded labour and human trafficking issues. As per my experience, coordination and collaboration between government non-government organization is very important. Looking at the data of in previous session, he said that the data of the child labour is actually the data of the children who are involved in labour activities but in reality it is too high because we can see children in our daily life working at tea or food stalls. We have to work to fill these types of gaps, because the data we see in the paper and in reality are different. Describing the project of labour department Naya Savera data, he said that Chandauli is a district of Uttar Pradesh which has the most migration ratio, neither will the adults lives in the village nor the children. Sometimes the government does not want to see the data that comes from NGOs. In today's society people still think that the bonded labourer will be a hostage or they will not have the freedom to visit but now days there are many people who are being controlled by moneylenders and kiln owners and forced them to live with them for 20 years. He drawn attention of all academicians and said that it is a right time to work in collaboration and as an academician we have to come forward to eliminate bonded labour issue because within 15 days of taking oath our chief minister shree Yogi Aditya Nath issued a circular to eliminate bonded labour system in brick kilns and labour department of Uttar Pradesh is also trying to work for wellbeing of child labour and bonded labour. Standard Operating Procedure (SOP) also came to liberate bonded labourers by the central government. He winded-up his words with the promise that he will continue his work in wellbeing of child labour and bonded labour with is dedicated team as well as partner of HLN.

Then moderator extended thanks to both speakers and said that “both of you opened the whole box of knowledge through facts and data. Subsequently he invited participants for open discussion then Mr. Pradeep kumar sharma, Researcher, Dr. B. R. Ambedkar University; Agra said that data collection is a very big challenge in research work. If we go to collect the data anywhere then we cannot find the exact data. In order to collect accurate data, we have to understand the circumstances and get information from different sources and write it accordingly.

Ambedkar University Agra, sharing their experiences)Subsequently Ms. Sunita sahu told that I am doing research on the cases of surrogacy, which looks like a bonded labour. It is not in our Uttar Pradesh but it is very much found in Mumbai, Delhi, Kerala, Karnataka, Goa and other states. A draft bill has also passed on surrogacy in South India in 2016, in which commercial surrogacy has been totally banned. Meanwhile, In South India there has been many cases where 10 to 15 women were held hostage for 9 months and they were released after surrogacy, and in after that our society does not even accept them added by her.

(Ms. Anvita Verma, Sharing her views with participants)Surprisingly Dr. Sharan responded that “Labour I have heard for the first time the case of surrogacy as Bonded.” He mentioned that this kind of new researched would be very useful to define Modern day Slavery. He advised to form youth club with students of social science and social work, researchers’ students, educationists and NGOs, which can work and learn together for issues of Human Trafficking, Bonded Labour and Child labour. These clubs may make better changes in the society. Keeping Mr. Bhanuja's statements, Ms. Avnita Verma, Assistant Professor of Shri Ramswaroop Memorial University, Lucknow and Dr Prashant Chauhan, from Amity University Noida shared their agreement with Dr. Bhanuja and advised to extend reach of these clubs from students of social science and & social work to other students too because it is a moral responsibility of all citizens of country and youth energy can be channelize for good cause through these clubs. Three years ago, Amity University has started a course of human value and community outreach which was mandatory for all students of University. There was a provision for contribution of 30 hours as volunteers for each student. This was a good experiment where we linked our students with NGO’s and NGO’s gave certificates, Said by Dr. Prashant. Session ended with felicitation of speakers and moderators.

(Second technical Session - Initiative taken to combat human trafficking, child and bonded labour system in Uttar Pradeshlabour system in Uttar Pradesh)

Dr. Kundu, from RMLNLU invited speakers (Syed Rizwan Ali, Coordinator, State resource cell, Office of the Labour Commissioner Uttar Pradesh & Dr. Ugrasen Pandey “Head of SRK PG College Firozabad) and moderator (Mr. Sachin Kumar from Geneva Global) of the second technical session (Initiative taken to combat human trafficking, child and bonded labour system in Uttar Pradesh).

(Mr. Sachin Kumar, moderating second technical session) Moderator, Mr. Sachin kumar thanked to all the academicians came in the round table consultation and shared the experience of their college days. He told that when he was studying social development himself, all professors talked about agriculture, social and environmental education. Even today there are many colleges where there is no discussion and study on bonded labour or human trafficking. Journey of development starts from academic institutes and students go into two sections, one section goes to the academic work like writing books, doing researches and teaching students another section goes to the field and the same section works in NGOs. The content and efforts of these two sections does not combine anywhere. There is a need to combine efforts of both section and thanks to HLN & RMLNLU to organize this consultation to begin combining both sections.

With the tone of thanks he requested Mr. Syed Rizwan Ali, Coordinator State Resource Cell, office of Labour Commissioner to share initiatives of labour department U.P. Mr. Syed Rizwan Ali appreciated efforts of HLN and thanked to all the academicians who came in the round table consultation. He shared following initiatives of labour department U.P. to eliminate child labour and bonded labour-

· Project Naya Sabera to make child labour free villages. In this project government of U.P. has identified child labour prone villages on the bases of census data 2011 and did rapid survey too through survey agency and HLN is also one of these agencies, who is working with us in 05 Districts of U.P.

· Capacity building of Bonded labour vigilance committee to educate them about law as well as their role to stop bonded labour system and HLN is playing vital role in this too for 11 districts

· Allotment of corpus funds for all districts to emergency support to rescued bonded labour. U.P. is the first state who did it, proudly added by him.

· Deputed DNO (District Nodal Officers) in all districts for responding cases of child labour through PENCIL portal. PENCIL PORTAL is an electronic platform that aims at involving Centre, State, Districts, Governments, civil society and the general public in achieving the target of child labour free society. The PENCIL Portal (pencil.gov.in) has various components, namely Child Tracking System, Complaint Corner, State Government, National Child Labour Project and Convergence

· Rehabilitation of children rescued in child labour cases from other state too and recently HLN is also playing role in this initiative

· Identification of universities and organizations for survey or study work in most of the districts of U.P.

(Mr. Syed Rizwan Ali, sharing his view in the second technical session)He agreed with Dr. Rehman and research student of Dr. B.R. Ambedkar University Agra, about challenge of accurate Identification and accurate data but in Uttar Pradesh Labour department has data related child labour of every district, every village and ward. If universities and institution required it we can provide it to colleges and universities to keep it in libraries so that students can get it. He also invited to universities and research students to labour department library which can help them to get information for their studies and researches. I know many of university or institution does not even know about this Labour department Library because of lack of information, said by him. In the end he endorsed that in present time of U.P. HLN the most active network is in Uttar Pradesh, and they are working hand-in-hand with government. Even they are contributing in restoration of 13 children rescued in Mumbai to labour department.

(Dr. Ugrasen Pandey, sharing his view in the second technical session)Subsequently, moderator requested to second speaker of the session. Dr. Ugrasen Pandey said that India is a religious country and here people pray to God to get children, but even then people force their children to work. It is written in every religion that children are the form of Lord, but people still take work from them. This is a very big question as how people are making their children's life hell with their own hands. He said that they did a child labour survey, there was lot of trouble, even when our students use to take the data, they had to face a lot of trouble because many people did not tell them the right thing and did not allow them to do the survey. He shared that he participated in various survey of government like BPL & APL family & MNREGA in Firozabad and found that these kinds of welfare schemes does not reach to actual beneficiary. People of our country need workshops to know the pros and cones of child labour then only we can make our dream (child labour free country) true. He ended with poem in Hindi “ राही को सिर्फ राह चाहिए, केवल एक पड़ाव चाहिए. मंजिल तो खुद ही मिल जाती है बस ह्रदय में सद्भाव चाहिए “ (Rahi ko shirf rah chahiye, keval ek padao chahiye , manzil to khud he mil jati hai, Bas hirdhya mai bas sadbhawh chahiye ")" means “We all have to work with this same goodwill to achieve our goal.”

(Mr. Jitendra from NIPCCD is putting his point before the house, )Moderator extended thanks to both speaker and requested to participants to share their views and ask questions. Mr. Jitendra Yadav from NIPCCD said that economic condition of the family push their family members in child labour, human trafficking and bonded labour condition. Without economic rehabilitation of survivor complete abolition of the problem is very challenging. Dr. Vinay Mishra, Assistant Professor Dr. RML Avadh University, Faizabad emphasized need of community awareness programs because community members are not aware about government schemes. Mr. Prashant Chauhan agreed with Dr. Mishra and said that it is true that even community leaders are not aware about government schemes and therefore Amity University, recently, had organized a workshop of the Panchayati Raj Institution in Noida, where we had invited all the Pradhans of Noida and give them knowledge about child labour and related schemes.

Here Mr. Rizwan Ali mentioned that our studies reviled that child labour exist due to poverty which is a wrong perception. According to our study there are many such families whose income is more than 15000 but their children go to work and in the other place, children of 4000 earning families do not go to work, so we cannot combine poverty with child labour together. If you talk about the awareness of government scheme, then we are giving our constant for this jointly with NGO’s and civil society.

Session ended with felicitation of speakers and moderators and facilitator invited everyone for lunch.

(Third technical Session - Challenges to combat human trafficking, child and bonded labour system)

After the lunch facilitator invited speakers (Ms. Ruchi Sinha “Assistant professor Center for criminology and Justice, Tata Institute of Social Science & Dr. Sangeeta Sharma, Member Child Welfare Committee, Lucknow) and moderator (Ms. Jyoti Yadev, assistant professor, Amity University Lucknow) of the third technical session (challenges to combat human trafficking, child and bonded labour system).

(Participants blowing balloons during exercise) (Table 03- India Child Labour Population (according to 2011 census)) Moderator requested to Ms. Ruchi Sinha to share her view on challenges to combat human trafficking, child labor and bonded labour. She used very attractive activity and have given three different colored balloons to everyone and asked them to blow. After that, she asked to write why does child labour exist, on one balloon and how to minimize child labour on another balloon. All participants shared different reasons, including poor education system; lack of awareness, lack of accountability, economic condition, lack of jobs, lack of community services etc. Maximum participants emphasize education, as well as unaware family members. Along with these points Ms. Ruchi Sinha said that the approaches of understanding of child, childhood and welfare are different and every discipline deals with it pragmatic approach in case to case. She also describes the child labour and said that the Child labour is the practice of engaging children in economic activity, on part time or full time basis. According to the UNICEF conceives that if a child or adolescent's participation in economic activity does not negatively affect his/ her health and development or interferes with education, it is child work. When the reverse happens it is child Labour. Then she showed the child labour population of India according to 2011 census in table 3.

After showing the data she said that one in every 11 child in India is working. 80%of working children are based in rural areas and three out of four children works in agriculture, as cultivation or in household industries, most of which are home based employments. Then she told that more than half of the 5.5 million working children in India are concentrated in five states- Bihar, Uttar Pradesh, Rajasthan, Madhya Pradesh and Maharashtra. Then with the help of some points she differentiated the child work and child labour, which are as fallows-

Child Labour includes child prematurely leading adults lives, working long hours for low wages, under conditions damaging their health and to their physical and mental development, sometimes separated from their families, frequently deprived of meaningful education and training opportunities that could open up for them a better future. (ILO)

Helping parents in their households activities and business after school in their free time, also contributes positively to the development of the child.

Hampers the normal and physical, Intellectual, emotional and moral development of child.

When such work is truly part of the socialization process and a means of transmitting skills from parents to child. It is not a child labour.

Children who are in the growing process can permanently distort and disable their bodies when they carry heavy loads or are forced to adopt unnatural position at work for long hour.

Through such work children can increase their status as family members and citizens and gain confidence and self- esteem

UNICEF classified the hazards of child labour into three categories namely (i) Physical (ii) Cognitive (iii) Emotional, social and moral.

In the end, she requested to participants to see the other balloon where you have written the solution to eliminate child labour. There are many government schemes which connects ensure children right and advised Human Liberty Network to create an e-book for all government schemes by which anyone can easily know about all the schemes running by government. On the other end lots of NGOs are working for same cause still situation is not changing because we all don’t work in coordination, said by her. So to eliminate child labour, human trafficking and bonded labour we need to work together and it is the big challenge.

(Ms. Jyoti Yadev Moderating the session, )Following of the interactive session moderator thanked to Dr. Sinha for her valuable presentation on child labour and trafficking. The solution she showed in presentation is very important for all of us and we will also apply it in the future, so that we can save the lives of such children from being ruined, she said. As an academician we will try our best to prevent these serious issues such as child labour and human trafficking, added by her. Later on moderator requested to Dr. Sangeeta Sharma CWC member Lucknow to share her views.

(Dr. Sangeeta Shrama. CWC Member Lucknow sharing her views, )Dr. Sangeeta highlighted the biggest challenge to combat human trafficking, child and bonded labour system is the lack of accurate data. As an academician as well as field worker we always face trouble for accurate data because when even anyone want to do research they don’t get exact data and when any grass root worker want to make strategy to address issue they also face same. Another challenge she shared was lack of rehabilitation plans with agencies. She stated her experience as CWC member, that there are many children to whom we have restored in their families after their counseling and medical but after some time the same children came again before us. She advised to do some action researches by the universities researcher to involve CWC process and take initiative to help the children and to stop bonded labour or child trafficking. If children are running away from home again and again, then we need to make such procedures or process so that we can stop these children from running and working.

Moderator concluded the session and repeated the importance of restoration and proper rehabilitation of children. Then facilitator, felicitated to both speakers and moderator for such an informative session

(Fourth technical Session - Recommendation and suggestion to combat human trafficking, child and bonded labour system in Uttar Pradesh through engagement of academicians)

Following of the last session, facilitators introduced and welcome speakers (Dr. R.V. Singh, Professor, Dr. B.R. Ambedkar University Agra, Dr. Vinay Mishra, Assistant professor of Ram Manohar Lohiya Avadh University Faizabad, Dr. Prashant Chauhan, Amity University, Noida,) and the moderator (Dr. K.A. Pandey Professor RMLNLU) for the last technical session of the day.)

(Dr. K.A. Pandey, Professor of RMLNLU moderating session and sharing his views)Moderator, Dr. Pandey started the session by thanking all the academicians and said that in the last session, and added that human trafficking is very sensitive issue that a woman does not understand what is happening with her same with the children. Means the victim of human trafficking doesn’t know that they are victims of human trafficking because trafficking began with non- violence manner and with attraction of various things but in later stage it happened in vicious way. We all know that it is a very well organized crime and to combat this we also need to be organized. As far as the concern of this session we have very experienced speakers and will give some recommendation to engage academicians in this mission, added by him.

(Dr. R.V. Singh, Professor, Dr. B.R. Ambedkar University Agra sharing his views)Then moderator called Dr. Singh to share his views and recommendations. Dr. Singh stated that this is a very sensitive issue for our society but there is no awareness program conducting by state government for the people of the society and academicians. As far as recommendation is concern he added that we all (academician, NGOs & government officers) have to work in a collective way in to get good result. Government universities as well as their faculties & researchers have their own limitations and they do researches only in some selective fields. Student or any faculty members cannot share their research report to any department without permission of University. University may share their reports of studies & researches done by their student to government department on a request letter from department, added by Dr. Singh. However our one student is doing his Ph.D. on human trafficking but for more studies and research if HLN or any department will write to us we can consider that too, said by him. He also recommended that we should do more researches in rural area because our 70% of the population belongs from there and the highest poverty is found in rural areas. Cause of poverty and relation of poverty with human trafficking, child labour and bonded labour can be analyzed through these studies, said by him.

Moderator extended thanks to speaker and agreed that academicians have their own limitations and research done by our research students are validated by the PhD Professor only. Due to limitation report does not reach to the policy makers. So here we need to think that how our research report can be reach to the policy maker and they can do changes in policy for the betterment of children. Subsequently he requested to Dr. Vinay Mishra to share his views.

(Dr. Vinay Mishra, Assistant professor of Ram Manohar Lohiya Avadh University Faizabad sharing his views)Dr. Vinay Mishra said that only Mr. Rehman from labour department was not agreed but since morning, poverty, lack of education & community awareness are emerging the causes of bonded labour, child labour and human trafficking. He also added that due to lack of implementation of our government schemes situation is same and people are also not know about the various schemes. Hence my recommendation is that we should do regular community meetings to aware them about government schemes and facilities. Any program or scheme cannot be success without public participation so we must ensure this, added by him. With sadness he added that the game of data is a very typical game in India because every year the data goes up and down, every year the survey happens and the same data goes back to government but actual work doesn’t happen at ground level. As long as the schemes and programs run by the government do not reaches to the common people’s situation cannot change, said by him. In the end he also suggested to universities and institutions to make a link on their website about social schemes so that common public and foremost our student can beget information about it.

Moderator agreed that there is a bog gap in data. As per NCRB data only 15500 cases of Human Trafficking registered while in reality numbers of cases are very high. If we believe this data then we should not worry. Flowingly he requested to Dr. Prashant Chauhan to address participants and share his valuable views

Dr. Prashant Chauhan shared that Amity University had taken 03 survey projects in Ghaziabad and Gautam buddha Nagar (Noida) from labour department. In which 2 were on Bonded Labour and one was on Child Labour. Our students had various challenges to do these surveys but as an academician, we guided them and motivated them to complete it. This is a responsibility of academicians to work on sensitive issues like child labour and facilitated to government to eliminate it, accepted by him. There are very few universities who offer courses and studies on child labour and relevant topics as well as few experts in universities who guide student for Ph.D. on child labour or related issues, added by him. Be an academician we have responsibility to engage students on these sensitive issues because student engagement is very important and they can make a big change if guided properly, admitted by him. He also said that capacity building programs for social worker are required to work on these issues because all NGOs are not perfect and, they also need guidance to run their programs perfectly. He again emphasize the role of academicians that we can adopt some area or village and work on those areas to eliminate child labour , bonded labour and human trafficking and can support NGOs to solve the problem. He also said that we have to focus on quality of publications on these issues so that it could be beneficial for youth professional in development sector as well as for common people. He agreed that (Dr. Prashant Chauhan, Amity University, Noida sharing his views)traffickers are very well organized and to fight with them we need to organize and for that we have to make connectivity with each other. We can form some anti human trafficking clubs, recommended by him

Subsequently, moderator appreciated Dr. Chauhan his qualitative views and suggestions as he emphasized on role of students and channelizing energies of the students towards social issues. Later on moderator requested to participants for ask any question if they have or share their views. Here Ms. Avnita Verma said that there are so many girl child labour are involved in domestic work and some time they sold by traffickers to rich person in big cities. Therefore as an academician we need to do some studies only for girl child to know their issues as child labour. They could be victim of trafficking, sexual offences etc. Dr. Prashan agrred and said that in Delhi NCR, life of the corporate workers are different both husband wife work and some time in different shift. Wife work in day time and husband work in night shifts and it might be possible that male who works in day time do sexual offence with female or girl child worker. Then Mr. Durgesh Kumar Shukla, Law Student from Amity University said that he deals with criminology in context of children and during research work or data collection, we do not get an appointment with government officers, which is a big challenge for us.

Following of brain storming discussion and being moderator of last session Dr. Pandey appealed to all participants to conduct some research work on human trafficking, bonded and child labour in future and all participants shown their interest and admired to do it. There are very good recommendations given by speakers which could make changes the situation if implemented same as said, added by him.

(Valedictory Session) (Mr. S. K. Rastogi, Officer from State Legal Service Authority (SLSA) addressing participants )Mr. S. K. Rastogi, Officer from State Legal Service Authority (SLSA) was the guest in Velidictory session he said that UPSLSA is aware about the issue of human trafficking, child labour and bonded labour but when such problems are seen in the society; we couldn’t implement laws properly. There are so many laws to prevent child labour and human trafficking but still we are struggling to eradicate these things. He shared that according to UP victim compensation 2014, which was amended in 2016, every Human Trafficking victims will get 2 lakh rupees by state government. To implement this right, the Central Government created SLSA for the State and DLSA for district. If you get any human trafficking or bonded labour case, you can contact to UPSLASA nad can give a letter to the DLSA for compensation to the victim. They also told us that we have now funded Rs. 2 lakhs each for 16 Universities and DLSA provide these funds for computer, internet, and furniture to every university. DLSA will open a legal service clinic at university campus and join your students to them as a paralegal volunteer. At the end he committed for full support from UPSLSA to work on these issues.

After the commitment from UPSLSA facilitator Mr. Sanjay Gupta requested to other participants to make some commitment to do on these issue then Dr. Vinay Mishra promised to do a community level workshop in Faizabad if will get some resources. Subsequently facilitator requested to Mr. Sachin Kumar, from Geneva Global, to give some tips to the participants for take away some actions from this consultation. Mr. Sachin shared following points-

1. He shared about collaborated of HLN with Bihar State and districts Legal Service Authority and shared success of legal camp program organized in collaboration where more than 1,000 people benefited. In U.P. also we can do same kind of activity.

2. Today we discussed crunch of accurate data so here academicians should carry the message that they will promote and motivate there students to do actual researches on these issues instead of copy paste. We can work with small samples, but do the utmost sincerity so that the right things get out, added by Dr. Chauahan

3. A collective effort is needed however reach of HLN in U.P. is till 12 districts of UP so with the help of today’s participants we can work in different areas too on these issues.

4. Media – both print and audio-visual – should be sensitized so that trafficking cases are highlighted
