1 DEVELOPMENT OF 3.44 ACRES OF CITY OWNED PROPERTY The City of North Muskegon is seeking proposals from interested parties for the development of approximately 3.44 acres of City owned property. The property is located at 2113 Lake Avenue between Whitehall Road/M-120 and Center Street with access to Muskegon Lake. The City has developed a simplified process for the submittal and review of proposals to minimize the time and cost involved.

2 DEVELOPMENT SUMMARY The City of North Muskegon seeks proposals for the possible development of City owned property of 3.44 acres. The City’s goal for the site is a project that is compatible with the existing NC - Neighborhood Commercial zoning district and will enhance and benefit the neighborhood and community. The property may be sold to the selected Developer at appraised fair market value. Considerations on price will be made solely on the proposed development timeline.

Address: 2113 Lake Avenue, North Muskegon, MI 49445

Location: Total of 3.44 acres on the southside of Lake Avenue, abutting Muskegon Lake, west of Whitehall Road/M-120 and east of Center Street. The site is currently vacant and was home to the City’s Public Works Department until 2010.

Utilities: Access to public utilities are stubbed at the property line. Road frontage improvements include curb, gutter and bikepath/sidewalk. Lake frontage/access available to Muskegon Lake to the south.

Deed Restrictions: Groundwater may not be utilized for any purpose. Complete Due Care plan is available upon request.

Land Use: Zoned both NC – Neighborhood Commercial and R-1 – Low Density Residential. City is willing to consider rezoning the entire parcel to NC – Neigborhood Commercial.

3 DEVELOPMENT CRITERIA The proposed project is located at 2113 Lake Avenue, west of Whitehall Road/M-120, east of Center Street (see attached maps). The surrounding area has a mix of uses including: NC – Neighborhood Commercial, R-1 – Low Density Residential, LI – Light Industrial and RPO – Residential-Professional Office. The City of North Muskegon is offering this site for development to interested parties subject to the following:

Project Design The City of North Muskegon desires to solicit interest regarding ideas for the potential development of 3.44 acres of City owned property.

Developer Capabilities Interested parties must demonstrate the experience, financial capacity and readiness of the Developer and/or Developer Team to meet the proposed project schedule.

City Assistance The City of North Muskegon proposes to sell the property at the appraised fair market value. However, the City may grant price considerations based on development schedule.

Selection Process and Timeline The North Muskegon City Council is the final decision making body regarding selection of a Developer. The City of North Muskegon reserves the right to reject any and all proposals. Written proposals will be reviewed and evaluated based on the evaluation criteria outlined in the following section. The City Manager may request additional information, conduct interviews, contact references, investigate previous projects, and take any other information into account in his evaluation of Developer responses.

The goal of this review process is to select a Developer and enter into an Exclusive Negotiating Agreement. Under this agreement, the selected Developer will be required to prepare more refined conceptual plans as part of the development project and obtain City Council’s final approval. Building placement, use and impact are subject to Planning Commission review prior to construction.

Exclusive Negotiation Agreement Period: Up to 90 days

Proposal Evaluation Criteria In the selection process, emphasis will be placed on: the quality of design concept, financial capacity and the community benefit of the proposal. Submittals will be evaluated based upon the following five criteria, in no particular order:

• Organization background and experience • Financial ability to implement project • Project proposal and schedule • Benefit to the community • Business terms

Submittal Requirements Each responding Developer must submit three (3) signed, original proposals and one (1) electronic copy of the set of information below:

1. Organization background and experience a. Describe the Development Team and provide relevant qualifications and project specific

experience of the Developer(s). Identify the person with the authority to represent and make legally binding commitments on behalf of the Developer. Identify the contractual relationship among multiple developers, if applicable.

b. Identify the key team members (e.g., architects, engineers, commercial tenants, real estate and marketing representatives, consultants and contractors).

c. Describe the Developer’s relevant project experience. Provide examples that demonstrate successful projects related to this proposal.

2. Project proposal and schedule a. Provide a narrative of the development and/or reuse concept. b. Provide a schedule for the proposed project that addresses all phases of the project

including: acquisition, design, zoning approval and construction. c. Provide a preliminary site plan and any conceptual drawings. d. Provide a statement of financial capacity to secure financing. e. The City will require that all utilities to be buried.

3. Business Terms a. Provide a description of the proposed business terms and if your project will require any

special use permit(s) or variance(s) of the City’s Zoning Ordinance. 4. Submittal

a. Sealed proposals are to be submitted to Lee Ann Clausen, City Clerk at North Muskegon City Hall, 1502 Ruddiman Drive, North Muskegon, MI 49445, on or before June 1, 2018 at 5:00 p.m. The envelope shall display the following statement, “Lake Avenue Development Proposal.”

Waiver Each responding Developer to the RFP agrees that the preparation of all materials for submittal to the City and all presentations are at the Developer’s sole cost and expense, and the City of North Muskegon shall not be responsible for any costs or expenses incurred by a Developer, under any circumstances. In addition, each Developer agrees that all documentation and materials submitted with a proposal shall remain the property of the City of North Muskegon. Submittals are public records subject to disclosure under the Freedom of Information Act (FOIA).

4 SUMMARY OF THE DEVELOPMENT PROCESS This summary outlines the development process and documentation required for full development and contractual agreements with the City.

Current Requirement Request for Proposals (RFP) Stage. This RFP represents the initial step in the development of the site. Responses to this RFP should demonstrate:

1. Understanding of the City’s goals. 2. Specific expertise and financial capacity to undertake the proposed development.

Future Development Requirements Exclusive Negotiating Agreement (ENA) Stage. Once the City selects a Developer, parties will execute the ENA valid for 90 days from approval.

Development Agreement Stage. Once the ENA has been negotiated and approved by the City Council, a Development Agreement will be negotiated between the parties and presented to the City Council for approval. All legal rights and obligations between the selected Developer(s), if any, and the City will come into existence only when a Development Agreement is fully executed by both parties and then approved

by the City Council. The legal rights and obligations of each party shall be only those rights and obligations which are set forth in the Development Agreement and any other documents specifically referred to in the aforementioned Development Agreement and executed by the parties.

Construction Stage. Once all the Development Agreement conditions precedent to property transfer have been met, the City will transfer the site to the Developer(s), and construction will begin as negotiated by the City and the Developer(s).
