THE BOILERMAKERS 30th Consoli- dated Convention in Las Vegas, July 23-26, 2001, demonstrated our union’s strength and solidarity. Delegates re-elected all 11 Interna- tional officers, tackled dozens of diffi- cult questions regarding amendments to the International Constitution and union policy, listened to several guest speakers, and still had the time and energy to put together a sizeable mone- tary donation for the family of one of our members killed on the job. In his opening remarks, International President Charles W. Jones exhorted the delegates to let the best interests of their members guide them when they discussed issues and made votes. “The only legitimate reason for the existence of any union, including the Boilermak- ers, is to improve the lives of our mem- bers and their families,” he told them. The delegates followed that advice to the letter all week, listening to the reports, debating the issues, and mak- ing the sometimes-hard decisions nec- essary to keep our union functioning effectively for the next five years. President Jones’s report was filled with good news about our successful efforts over the past five years in organ- izing, improving benefits, and ensuring excellent service to members and to local lodges. He then spent some time discussing the importance of political involvement. “Legislative assaults on workers’ rights never let up,” he told the assembly. “We’re still fighting to keep Davis-Bacon, OSHA, and the 40- hour week. Bill 69, an anti-worker bill in Ontario that we defeated last year, has already been re-introduced.” Jones voiced special concern that international trade agreements may force the Canadian and U.S. govern- ments to water down their environ- mental, health, and labor laws. “The Free Trade Area of the Americas, which Bush wants fast-track authority to put into place, includes a provision for striking down any law that can be con- sidered to hinder trade. This provision can be used to strike down our food and safety laws, environmental laws, and worker protections — and it already has been used both in Canada and in the U.S.” At the end of his report, Pres. Jones announced a possible merger between the Boilermakers and the Brotherhood of Maintenance of Way Employes (BMWE), a railroad union with 45,000 members. The merger proposal has been passed by both executive councils and is now being voted on by BMWE members through a mail-in ballot. A decision is expected by October. Intl. Sec.-Treas. Jerry Z. Willburn then reported on the financial status of the International and related matters. His report showed the International is being well managed and is fulfilling its mission of serving members. ”I believe that our former officers and members would be proud of our accomplishments over the past 121 years,” he told the delegates. “Our organization has been a positive force for millions of working men and women who have held membership throughout the years.” Delegates do the hard work THE HARD WORK of the convention began immediately. In addition to electing International officers, the con- vention must review and renew our Constitution. Prior to the convention, the Law Committee reads all proposed resolu- tions and determines what changes to the Constitution, if any, to recommend to the delegates. During the conven- tion, the Law Committee goes through the Constitution article by article, either recommending a change or recom- mending no change. Each of the Law Committee’s recom- mendations is read to the convention. Delegates may accept the recommen- dation without change, amend the rec- ommendation, or reject it. This is often tedious work, but there is no other way to ensure that all aspects of our Brotherhood get reviewed by the delegates. He held a series of positions before becoming local lodge president, and he has always insisted upon the integrity of the lodge and its members. In his opening remarks, InternationalPresident Charles W. FOUR INTERESTING and articulateguest speakers provided delegateswith much food for thought as the con-vention got underway. A member ofPresident Bush’s cabinet and a repre-

sentative of some of our employerswere joined by two top officials fromthe AFL-CIO. Delegates got to hearabout employment, training, andworker protection issues from a broadspectrum of viewpoints.

The convention’s special guest, U.S.Secretary of Labor Elaine Chao, tolddelegates that Democrats and Republi-cans must work together to solve work-ers’ problems. “I think the issues facingworking families are just too importantto take a back seat to finger pointingand to partisan politics,” she said.

Chao discussed protecting workers’pensions, creating jobs, and eliminat-ing the “skills gap” in the workforce.“America needs skilled workers,skilled Boilermakers, skilled craftsmenand workers of every kind, so thatwhen we need a tough job done right, ajob like building modern warships likethe U.S.S Coleor repairing them afterthey have been attacked by terrorists asyou have, we can call upon the bestworkforce in the world to do the job.”

Chao got a strong ovation when shesaid that President Bush’s energy planprovides for building 1,500 new powerplants. She then asked the delegates tosupport President Bush’s patient’srights bill, implying that union healthcare plan managers support his planbecause they don’t want to turn theseplans over to trial attorneys; in fact,unions oppose his plan because it doesnot allow patients to sue their HMOsfor denying necessary treatment.

John J. Sweeney, president of theAFL-CIO, outlined how we can put ourcountry back on the high road. Hecalled for increased political involve-ment and bringing new members intothe union. “The truth is when it comesto politics, we in the union movementare very good at what we do. Nobodydoes it better. But we have to face thefact that there are simply not enough ofus. In terms of numbers, unions havebecome stagnant. Unions affiliatedwith the AFL-CIO currently representabout 13 million members. That meanswe are mobilizing politically off thesame 13 million member base we hadway back in 1956.”

Building & Construction TradesDepartment President Ed Sullivan alsospoke of organizing and politics. Hediscussed the labor movement’s signif-icant influence on the 2000 electionsand called for the Boilermakers andother construction trades unions toexpand our grass-root efforts to electpoliticians who will represent workingfamilies. Union success in getting outthe vote has grown in each of the pastthree national elections, showing thatwe can influence national politics whenwe work at it. Sullivan made the pointthat we must continue to mobilizepolitically, because no other group rep-resents working families.

Cynthia L. Brown, president of theAmerican Shipbuilding Assoc.,explained the importance of increasingour Naval ship reserve. The U.S. ship-building industry has had to lay off halfof its workforce since 1981, mainlybecause the U.S. government does notsupport this industry.

Construction of U.S. Navy ships is atits lowest level since 1932, and we arelosing the commercial shipbuildingindustry because the federal govern-ment has ended loan guarantees forshipbuilding. Other countries still pro-vide these guarantees, and they are get-ting all the new ship orders. ❑

JOHN BLAKE, who has served as coun-sel of the International Brotherhood fornearly 40 years, received a Distin-guished Service Award at the Boiler-makers’ 30th Consolidated Convention.

Intl. Pres. Charles W. Jones presentedthe award, praising both Blake and theBlake & Uhlig law firm for their work.

“Blake & Uhlig is widely respectedfor the work they’ve done for all unionsin the labor movement,” said Jones.“We have given them ideas about howwe want to negotiate, knowing weneeded help with the laws, and theyhelped us.

“We now have the most effective in-plant strategies in the United States orthe world. And our Fight Back organiz-ing strategy has served us well and hasbeen widely copied by many other con-struction unions.

“I can’t give them a medal, we don’thave one, but I do have an award forpeople who distinguish themselves inservice to the Brotherhood and itsmembers.”

Upon accepting the award, Blakethanked Pres. Jones, the members ofthe executive council, and our localunion membership for this honor. “Wewill certainly display this award in aprominent place,” he said. ❑

to the Constitution, including raisingthe weekly benefits paid to strikingmembers, having the International bearthe cost of pins awarded to membersfor 20 years or more of continuousmembership, changing the formulaused to determine vice presidents’salaries, and allowing the ExecutiveCouncil to make changes to the name ofour union if needed to facilitate amerger with another union.

The pace on the convention floor canget hectic, and sometimes delegateslose track of where they are. That hap-pened on Tuesday during a debate onthe Law Committee’s motion to raisestrike benefits from $75 a week to $100 aweek. Several delegates rose to arguethat the $25 raise was an improvement,but it was not enough.

Many of the speakers were very pas-sionate in their presentations, but inthe heat of the discussion, no onethought to propose an amendment tothe Law Committee’s recommenda-tion. Finally, someone called for a vote,and the Law Committee’s recommen-dation was approved by a narrowmajority in a voice vote.

Some of those voting nay wereunhappy with the chairman’s judg-ment as to the winner, but no onecalled for a division of the house, so thevote stood. When the conventionadjourned for the day, many delegatesleft the room unhappy with the resultsand not entirely sure about what hadhappened or why.

Unprecedented action letsdelegates reconsider voteTHE FIRST ORDER of business on daythree was an unprecedented move torevisit Tuesday’s confused vote on rais-ing strike benefits.

Usually, once an issue has beendebated and voted on, it cannot berevisited until the next convention. Butthe Executive Council met followingTuesday’s session and agreed that thevote on raising strike benefits had con-fused many delegates. Although theLaw Committee’s motion had passedin accordance with the rules of the con-vention, the Executive Council votedunanimously to allow the chairman ofthe convention to bend the rules inorder to allow more discussion and anew vote on an amended motion fromthe Law Committee.

International President Charles W.Jones took the podium to say he wasaware that many delegates wereunhappy with the vote that was takenon Tuesday. It was apparent to himthat many delegates did not realizethat by merely defeating the Law Com-

mittee’s recommendation they wouldhave left strike benefits at $75 a week.To raise the benefits, they needed anamendment to the motion, but no onehad proposed one.

President Jones also went over themethod for calling for a hand count orroll-call vote, should the delegates beunhappy with how the conventionchairman hears the voice vote.

He then took the unprecedented stepof asking the Law Committee to submitan amended recommendation, raisingstrike benefits from $75 to $125. Goingany higher, he said, would be too costlyand would result in raising the percapita tax to compensate.

The Law Committee’s amendedreport passed unanimously, prompt-ing several delegates to take to themicrophones in praise of the outcome.

Tom Brennan, a delegate from Local1, Chicago, Ill., said, “This unprece-dented move has made me very proud,one of the proudest moments of my lifeas a Boilermaker.”

In a rare and brave move, L-1239President David Hulne, Aurora, Ill.,stepped up to the microphone to apol-ogize to the convention and his mem-bers for misunderstanding the vote. “Ihighly commend you for realizing thatsome of us did not know the properway to do our jobs,” he said. He was

not alone in his misunderstanding, buthe was the only one to apologize.

Paying for membershippins becomes a hot topic

ONE OF THE LONGEST and mostcontentious debates of the conventionturned out to be over who pays formembership pins. In 1996, the conven-tion voted to require local lodges toshift the burden of tracking years ofmembership and cost of pins from the

ON WEDNESDAY, July 25, Local 169BM-ST John Marek, Detroit, Mich.,asked convention delegates to make acontribution to the family of JeffDavis. Davis, a Local 13 apprentice,was killed the previous week in a job-site explosion at the Motiva Refineryin Delaware.

A total of $6,910 was collected.Local 13 Vice Pres. John Lattanzi,

Philadelphia, Pa., thanked the dele-gates for their generous contributionsaying, “Davis was a personal friendof mine and this will mean a lot to hisfamily. You should all be proud to be amember of this organization, because Iknow I am.”

The next day, Local 27 PresidentDave Snead, St. Louis, Mo., madeanother plea to the delegates to onceagain dip into their pockets to help thisfamily out. The second collectionraised $4,808, making the total con-vention delegate contribution to theDavis family $11,758.26.

Davis, 40, was a steel mill workermost of his life, and leaves behind hiswife and five children.

What delegates did at this conven-tion is nothing unusual for Boilermak-ers. Whenever tragedy strikes one ofour members or their families, weshow the true meaning of “brother-hood,” which goes far beyond payingdues and working under a contract.

International to local lodges. At thisconvention, the Law Committee rec-ommended having local lodges pay $5each for pins for members with lessthan 30 years of service, while the Inter-national pays for members with 30years or more.

After much discussion and twoamendments, the delegates passed aresolution requiring the Internationalto pay for all pins of 20 years or more.

Another issue that generated a greatdeal of debate was the matter of chang-ing the name of the International. TheLaw Committee recommended chang-ing the Constitution to allow the Inter-national Executive Council to changeour union’s name when doing so willhelp facilitate a merger. On everyone’smind was the proposed merger withthe Brotherhood of Maintenance ofWay Employes (BMWE) and other pos-sible mergers.

Many delegates opposed changingour name or giving the ExecutiveCouncil authority to change it betweenconventions. A group of delegates fromthe Cement, Lime, Gypsum, and AlliedWorkers Division proposed adding“Cement Workers” to our name.

International President Jonespointed out that the Boilermakersunion has been created through fivemergers, so in a sense we are now fiveunions — Boilermakers and Ship-builders; Blacksmiths and Forgers;Cement, Lime, and Gypsum; StoveWorkers; and Metal Polishers.

If our merger with the Brotherhoodof Maintenance of Way Employes isratified, we will be six. “If we puteverybody’s name into the title itwould be more than a paragraph.”

Jones said that the Executive Councilneeds the liberty to put everything onthe table during merger discussions.Union mergers can become emotion-ally charged. If adjusting the name ofour union makes the merger go moresmoothly, it is a small price to pay.

After much debate, the committee’srecommendation passed.

Another proposal that drew debatewas the proposal to raise field dues forConstruction Division members fromthree-fourths of one percent of wages toone percent. Construction memberspay field dues to finance the many pro-grams that their division has that areunique to their division, such as theirmarketing program, Fight Back organiz-ing, and training for local lodge leadersin how to retain jurisdiction over all ofthe work that is rightfully ours.

Raising dues is never popular, andthis proposal had some detractors, butit also garnered an enormous amountof support.

Wally Ferguson, Local 108, Birming-ham, Ala., and Bob Hall, BM-ST ofLocal 11, Helena, Mont., rose tooppose the motion. They said they’dbeen sent to the convention to protecttheir members, and they interpretedthat mission to include protectingthem from dues increases.

Ferguson and Hall were followed bya long string of delegates who rose tosupport the motion, nearly all making asimilar argument — that we shouldstrengthen the union while times aregood so we will be financially strongenough when work gets leaner.

Because field dues are a percentageof wages paid, the union’s income fromthem is reduced during times of loweremployment levels, even if member-ship levels do not drop.

But when work is slow, the programspaid for by field dues are more impor-tant than ever. Without them, we haveno way to find new work for our mem-

bers, to protect the work we alreadyhave, and to ensure that nonunion con-tractors don’t gain ground. Without asecure financial base, the union cannotprotect its members.

Despite passionate debate on severalissues, all of the delegates showed theutmost respect for each other and forthe convention chairmen. When theconvention adjourned sine die onThursday, many veteran delegateswere heard saying it was one of the bestconventions they had attended, full ofserious debate and hard decisions, butvoid of anger.

Delegates were able to go homeknowing they’d done a good job and theBrotherhood could continue in strengthand solidarity for another five years. ❑

TWO EMPLOYERS USED the conven-tion as an opportunity to honor Intl.Pres. Charles W. Jones for his manyachievements during his 59-year Boil-ermaker career.

Woodley-Griggs Boiler Repair, asmall company employing members ofLocal 83 in Kansas City, Mo., presenteda miniature version of a boiler to Presi-dent Jones before the convention ses-sion began on Wednesday, July 25.Members of Local 83 carried the boilerto the convention floor so delegatescould get a closer look.

Jones told the delegates he plans todisplay the boiler at the BoilermakersNational Archives in Kansas City, Kan.

The miniature is a working model,and before the day was over Boiler-makers had fired it up and it was emit-ting a thin plume of gray smoke.

Fluor Maintenance Systems alsohonored Jones. Ron Weatherred, seniordirector of labor relations for the com-pany, presented an award for out-standing achievement in labormanagement cooperation to Intl. Pres.Jones for his leadership and vision.

In presenting the award, Weatherredsaid, “Through programs you insti-tuted and your leadership and direc-tion, signatory contractors, regions,and local lodges have implemented

and coordinated programs to maxi-mize the staffing levels required forskilled craft employees to support criti-cal outage schedules, thus achievingthe shared advantages of your vision oftripartite cooperation.”

Fluor Maintenance Systems is a newcontractor for the Boilermakers, havingsigned on in order to have access to theBoilermakers in Local 4, Page, Ariz.

Charles W. Jones has been the Inter-national president of the Boilermakerssince 1983, but he distinguished him-self long before he became president.

A graduate of the Harvard TradeUnion Fellowship Program at HarvardUniversity, 1946-47, Jones served as anorganizer and field representative, andwas named director of research in 1956.Always a strong advocate of education,Jones initiated and developed the Inter-national’s Union Education and Train-ing Program, including the summerinstitutes for local lodge leaders at theUniversity of Wisconsin’s School forWorkers.

He has been described as the “archi-tect” of the Construction Division, wasinstrumental in creating the annuityfund, and has made numerous admin-istrative changes to make our unionmore efficient. In 1960, he became theIntl. vice president for the Southeast,

and Intl. Pres. Harold Buoy nominatedJones as his replacement when heannounced his retirement in 1983.

As International president, Jones hascontinued to be an innovator, creatingthe Fight Back and in-plant organizingprograms, initiating the ConstructionDivision marketing program, and sup-porting MOST and our many safetyand productivity programs through-out their development.

His leadership has resulted in theBrotherhood’s continued success, andhe is highly regarded by Boilermakers,contractors, and owners alike. ❑

Delegates to the 30thConsolidated Convention did so on thesecond day of the convention, begin-ning with Intl. Pres. Charles W. Jones,who was nominated by Intl. Sec.-Trea-surer Jerry Willburn.

“What we do here this week will livein eternity in the history of our organi-zation,” Willburn told the delegates.He then cited a long list of reasons to re-elect Jones to the position he has heldsince 1983.

Citing Jones’s incredible record of 59years of service to the Brotherhood,Willburn reminded delegates thatJones was “significantly involved invirtually every program that we havein the Brotherhood today.”

He specifically referred to the annu-ity, which Jones created, and the pen-sion, which he championed beforemany members saw its value. He calledJones the “architect” of the ConstructionDivision, and recalled Jones’s work tosupport and promote the MOST pro-grams that won the Nova Prize for inno-vation in 1998.

Speaking of Jones’s dedication to theBoilermakers, he said, “President Joneshas one hobby, and we all know whatthat hobby is. It’s the Boilermakers.”

Seconding the nomination wasInternational Vice President Jim Hick-enbotham, who said Jones’s leader-

ship qualities are second to none. “Oneof the things that I am most impressedwith about Charles Jones is that he willtake the time to speak to the most jun-ior member of this International aswell as the most senior member,”Hickenbotham said. “He is alwayswilling to assist everyone with his orher problems.”

President Jones was re-elected with-out opposition, after which the dele-gates treated him to a long, loudstanding ovation.

Intl. Vice President Rick Albrightthen nominated Jerry Willburn for Intl.secretary-treasurer. He said, “Jerry hasearned the trust of the InternationalExecutive Council. He is what I call aboilermaker’s boilermaker.”

Albright said Willburn has excelledin all of his responsibilities, includingkeeping the Brotherhood buildingoccupied and earning rent. He con-cluded his nomination with a fewwords in French for our French-Cana-dian Boilermakers.

Willburn’s nomination was secondedby Allen Meyers, BM-ST of Willburn’shome local, Local 627, Phoenix, Ariz.Referring to Willburn’s “many out-standing qualities and abilities,” Mey-ers said he had “no reservationsnominating Willburn for another term”in the office he has held for 12 years.

Don Lacefield was nominated for Intl.vice president of the Western States byHenry McCoy, BM-ST of Local 101,Denver, Colo., who praised Lacefieldwith a quote from President Teddy Roo-sevelt: “The most important singleingredient in the formula of success isknowing how to get along with people.”

McCoy added, “Getting along withpeople has always been Don’s mode ofoperation with clients, contractors, andunion members alike.”

Lacefield’s nomination was secondedby Tim Carr, BM-ST of Local 104, Seat-tle, Wash., who said Lacefield is “aproven leader, a competent administra-tor, and a good trade unionist.”

Local 744 BM-ST Pat Gallagher,Cleveland, Ohio, nominated LarryMcManamon for Intl. vice president ofthe Great Lakes and Ohio Valley, say-ing that he has “provided outstandingleadership by being a problem solverand accepting and managing change ina positive way.”

Seconding the nomination was Intl.Representative James Pressley, whopraised McManamon’s ability to repre-sent all of the industries in the GreatLakes Area with “skill of hand andintegrityof heart.”

Larry Turner, Lodge 132 BM-ST,Galveston, Texas, nominated GeorgeRogers for Intl. vice president of theCentral States, citing his many years ofexperience as a boilermaker, businessmanager, International rep., director ofthe National Transient Division, and

vice president. He said Rogers “hasboiler making in his blood — and that’sa good thing for us.”

Local 74 BM-ST Ron Keck, Houston,Texas, seconded the nomination, prais-ing his courage, compassion, integrity,and ability to listen to problems.

Local 154 Bus. Mgr. Ray Ventrone,Pittsburgh, Pa., nominated Michael S.Murphy for Intl. vice president of theNortheast. He spoke of Murphy’s loy-alty, commitment, and integrity.

Kenny DelaCruz, Local 614 bus. mgr,New London, Conn., seconded thenomination, praising the hard workMurphy has done on behalf of Boiler-maker members.

Newton B. Jones was nominated forIntl. vice president of the Southeast byDistrict No. 57 BM-ES Sam May, Chat-tanooga, Tenn., who spoke at length ofJones’s involvement with the Boiler-makers union from a very early age. Hebegan as a pre-teen, folding and pass-ing out handbills on an organizingcampaign, and continued through tenyears in field construction, followed bywork as an organizer, director of organ-izing, and vice president. May alsocited Jones’s recent successes in obtain-ing work and negotiating agreements.

Jones’s nomination was seconded byLocal 903 President and MississippiAFL-CIOPresident Robert Shaffer,who praised Jones’s ability to commu-nicate and respond to challenges.

Guy Villemure, BM-ST of Local 271,Montreal, Quebec, nominated Alexan-der “Sandy” MacDonald for Intl. vicepresident of Eastern Canada. He saidMacDonald has “always been there”for Local 271, no matter what the issue.Calling MacDonald more a friend thana vice president, he apologized to Mac-Donald’s wife for taking him awayfrom her to work the long hours of anIVP for five more years. Guy repeatedhis nomination in French for the benefitof his French-speaking members.

MacDonald’s nomination was sec-onded by Local 203 BM-ST Tom Walsh,St. John’s, Newfoundland. He saidMacDonald did “everything humanlypossible” to help the lodges and mem-bers in his area.

Local 555 BM-ST Norm Ross, Win-nipeg, Manitoba, nominated RickAlbright for Intl. vice president ofWestern Canada. He traced Albright’slife from his start in 1967 as an appren-tice welder in Lodge 146 to his work asa business agent, Intl. rep., and vicepresident, including many positionson boards outside the Brotherhood. Hepraised Albright for his leadership,commitment, knowledge, support,and dedication.

Rob Lauzon, BM-ST of Cement Dis-trict Lodge D11, Brisco, British Colum-bia, seconded Albright’s nomination,praising the way Albright has workedwith lodges in the CLGAW Division.

ON JULY 24, 2001, hearing no othernominations for the office of Intl. vicepres. of Western Canada, Conven-tion Chairman J. W. Moore askedIntl. Sec.-Treas. Jerry Willburn to castthe vote of the 30th ConsolidatedConvention for Rick Albright.

Willburn approached the podiumand asked the delegates if they weresure there were no other nominations,bringing a roar of laughter from thedelegates, and Albright, too.

That laugh continued the follow-ing day, when the nominee picturedabove unexpectedly turned up inWillburn’s office. ❑

Barrie uses his skills, anda little improvisation, torestore 1942 tank IT’S REALLY NO BIG deal for aBoilermaker to restore a tank. Butwhen that “tank” is a 1942 UniversalCarrier, well, that’s stretching our tankskills just a bit.

At least it is for most Boilermakers.But Don Barrie, an eight–year memberof Local 128, Toronto, Ontario, Canada,used his trade skills to restore a tankfor a military museum.

Originally built by Ford Canada attheir Windsor, Ontario, plant, the tankBarrie received was broken, rusted,and had no mechanical capability.Using his Boilermaker skills (platework, welding, tool making, etc.), aswell as his mechanical knowledge,Barrie was able to rebuild the tankshell and drive train.

He had to improvise quite a bitwhen it came to finding such things assockets that could manage British-made threads and unique bearings.He created a “track jack” using a jackfrom a modern-day Volkswagen.

It took 600 hours, more or less, a lotof resources, a few helpers, and anabundance of WD-40 to finish the job.But when the engine turned over, itwas clear that both Barrie and Fordbelieve that “Quality is Job One!”

The restored tank will be displayedin the Thunder Bay Military Museum,Thunder Bay, Ontario, as an exampleof Canada’s role in World War II. Italso illustrates the skill and workman-ship Boilermakers are proud of —though the tanks we usually work onare much larger and unarmed. ❑

It doesn’t look like much now, but with a little ‘Boilermaker’ know-how, Local 128member Don Barrie restored this old tank.

MEMBERS OF LOCAL 363, East St.Louis, Ill., have successfully completedthe erection of an SO2 scrubber at theCity, Water, Light, & Powers’ DallmanNo. 31 and 32 units in Springfield, Ill.

Working for Siciliano, Inc., the mem-bers installed over 600 linear feet ofductwork for the Lurgi, Lentjes,Bischoff-designed scrubber.

According to general foreman CurtGarrett, nearly all of the ductwork wascantilevered and counterbalanced by

itself. Add to this the limited installa-tion space, and this job turned into avery complicated and dangerous erec-tion process.

However, whenever a difficult taskcame up, the Boilermakers all workedtogether as a team and got the jobdone, said Garrett. “Their profession-alism and dedication to their craftmade this job go very smoothly. I amextremely proud of each of them.” ❑

This useful tool organizesthe information you’ll needto process a grievance

IF YOU DO A THOROUGH job ofresearching your grievance, you'llend up with quite a bit of informa-tion. The Steward Fact Sheet shown

below is a useful tool that can help youorganize that information.

Developed by Rob Lauzon, BM-ST ofCement District Lodge D11, and stew-ards in the CLGAW Division, this sim-ple form can help you a great dealwhen you get ready to write up yourgrievance. In fact, if you conscien-tiously investigate the complaint andfill in all of this form, you should be ableto write your grievance just by transfer-ring the information from the form.

Filling in all the sections is also a goodway to double-check to make sureyou’re collecting all of the informationyou’ll need to investigate and handlethe grievance properly. Begin filling inthis form as soon as you determine thatyou have a complaint that could lead toa grievance.

Each grievance is unique, and con-tracts differ greatly. Some areas on thisform might not be important to yourcase and you can ignore them. But takea good, hard look at the facts before youdo so. You don’t want to leave out any-thing that might help you refute thecompany’s argument.

Areas that you must not overlook arethe sections requiring the reason thisaction is considered a grievance, the

corrective action requested, and whatthe employer contends.

The basis for your grievance is crucialin determining how you will argueyour case. You must determinewhether your complaint involves a vio-lation of 1) the contract, 2) state or fed-eral laws, 3) company rules andregulations, 4) well-established prac-tices, or 5) workers’ rights.

Writing this down will help youdecide how to argue the case and willalso help weed out complaints thatseem serious but are not grievable. Ifnone of these violations occurred, youdo not have a grievance.

The corrective action you are seekingis also extremely important. This formreminds you to decide what youbelieve the grievant should get beforeyou actually file the grievance.

For most grievances, the remedy is to“make whole” the grievant, i.e., toreturn the grievant to the same positionhe or she would have had if the incidenthad not occurred. If you don’t knowwhat to ask for, simply say you wantthe grievant made whole.

If you don’t specify the remedy youwant, you can win the grievance but thegrievant will still not get the back pay,overtime, or whatever.

Perhaps the single most importantsection is the section for the employer’sposition. Getting the employer’s posi-tion on paper helps you plan the wayyou will argue your case.

For example, if the employer is mak-ing an affirmative claim, such as thatJoe Smith violated a rule, then you canassume the negative argument and the

burden of proof will be on them. Theyneed to prove that he did, indeed, vio-late the rule and that the rule was clearand known to everyone. If they fail toprove any of these points, you may beable to win your grievance.

It is always easier to win the negativeargument. In this case, you would onlyneed to cast doubt on whether he actu-ally broke the rule.

However, if you pass up this easyargument and instead claim that the

company is “out to get” Joe, you haveshifted the burden of proof back ontoyourself. Even if you are right and theyreally are trying to get Joe, you’ll proba-bly lose the grievance unless you havemountains of evidence from uninter-ested third parties.

Take the easier way. Make the com-pany prove what they have claimed.Don’t shift the burden of proof back toyourself by making a new claim ofcompany wrongdoing. ❑

THE BOILERMAKERS’International Executive Council(IEC) Scholarship Committee has

announced its selection of scholarshipaward recipients for the International,three local lodges, and the CanadianFederation of Labour.

The committee awarded a total of$50,000 in grants — $38,000 to UnitedStates students and $12,000 toCanadian students — for theInternational’s program; $5,000 in locallodge awards; and $1,000 from theCanadian Federation of Labour.

IEC scholarship winners

THE IEC COMMITTEE selected 18award winners from a pool of 150applicants for the International’sscholarship awards. The amount ofeach grant is determined by theScholarship Committee. This year, thecommittee awarded two $5,000grants, one $4,000 award, five $3,000awards, two $2,500 scholarships, andeight $2,000 grants, based upon theapplicant’s high academic achieve-ment, leadership skills, participationin extra-curricular activities, and per-formance on a typed essay.

How to apply for a Boilermaker Scholarship

THERE ARE BILLIONS of dollars infinancial aid available for college stu-dents that basically comes from fourmajor sources — colleges, the federalgovernment, state governments, andprivate sources.

Dependents of Boilermaker mem-bers can apply for the InternationalScholarship, the Union Plus CreditCard Scholarship, and some of ourlocal lodges offer scholarships todependents of their members, too.Scholarship applicants are evaluatedaccording to academic ability, socialawareness, and appreciation of therole of the labor movement.

To qualify for most federal, state,and college aid, an applicant mustdemonstrate need. Need is defined asthe difference between the cost of col-lege attendance and how much youcan afford to pay based on yourincome and assets. A college will try to

meet an applicant’s needs by creating afinancial package from the aid pro-grams available.

To find out how much aid you areeligible for, you must complete the col-lege’s financial aid form(s), and youmust reapply for aid every year (assoon as possible after January 1 prior tothe school year for which you willneed funding).

Local Lodge 13 names 23scholarship winners

LOCAL 13, Philadelphia, Pa.,announced the winners of 23 scholar-ship awards, each totaling $6,000, to

dependents of Local 13 members whoparticipated in the local’s annual com-petition. Winners were selected basedon the results of a college aptitude testadministered and graded by St.Joseph’s University. The grants will beawarded over a period of four years;$750 per semester for eight semesters.

IEC scholarship program

SINCE 1988, when the Internationalbegan the scholarship program, theBoilermakers union has awarded atotal of $426,000 to 153 children anddependents of Boilermaker members.

This year, the scholarship committeewas again highly impressed by theexcellent grades earned by the scholar-ship applicants throughout their highschool years, by their many achieve-ment awards, by their participation inextracurricular activities, and by their

well-written essays. All of the appli-cants deserve special recognition. Andso does the committee, who spenddays reviewing applications, readingthe essays, and making sure that eachapplicant complied with the scholar-ship application rules.

This year’s committee included Intl.Vice Presidents Newton Jones (chair-man), Alexander MacDonald, andOthal Smith Jr. Assisting were attorneyJohn Blake, representing the legal firmof Blake & Uhlig, and AdministrativeSecretary Tracy Buck.

Intl. Pres. Charles W. Jones is proudof each applicant, but concerned thatthe scholarship is not getting adver-tised as much as it should. “This year,we received 150 applications, which is17 less than last year. It is vital to adver-tise the benefits of this program to our members so that each of their children

have an opportunity at the scholarshipawards.” (See the box on page eight forhow to apply.) ❑

COMMITTEES ARE ESSENTIAL tothe success of a convention. They pro-vide guidance to the delegates in thevarious areas of their expertise, areasin which the individual delegatesmight not be knowledgeable.

In the course of the convention, dele-gates must look at every section of theInternational Constitution and eitheraccept it as it stands or amend it. ThisHerculean responsibility is made mucheasier by committee recommendations.

Several weeks before the conven-tion, the Resolutions Committee goesto work. Their job is to review all ofthe resolutions submitted for consider-ation at the convention and recom-mend action by the delegates.

Resolutions that require amendingthe Constitution are referred to theCommittee on Constitution and Law,which also begins its work long beforethe convention. During the convention,this committee takes up each section ofthe Constitution one at a time andeither recommends no change or rec-ommends a specific change. Delegatesthen vote whether to accept the com-mittee’s recommendation, or theymove to amend the recommendation.

With nearly 900 delegates in atten-dance, the convention could not getmuch done without the pre-conven-tion work of these two committees.

Numerous other committees alsoperform necessary functions.Committee members work hard dur-ing the convention, often meetingbefore and after the daily sessions todiscuss new developments.

The first committee to report is theCredentials Committee. They areresponsible for ensuring that the prop-er delegates are seated in the conven-tion. To be seated, all delegates mustmeet the criteria set forth in theConstitution.

The Rules Committee reports next,laying down special rules for the con-vention. In general, the convention fol-lows Robert’s Rules of Order, but theRules Committee may establish excep-tions or determine a manner for han-dling unusual situations.

A new Welcoming Committeehelped convention delegates find theirway, while the DistributionCommittee ensured that every dele-gate received the publications neededfor each day’s business.

The Sergeant-at-Arms Committeeensured that only authorized personswere allowed on the convention floor.

The Finance Committee made rec-ommendations regarding the financ-ing of the union.

Industry committeesemphasize organizing

SEVEN SPECIAL COMMITTEES formembers in various industries weserve reported on the condition oftheir industries and membership.They also made recommendations tothe convention and to theInternational on how they believemembers in their areas can best beserved. The most frequently heard rec-ommendation was a call for moreorganizing.

The Special Committees on Forgingand Allied Industry, Industrial andUtility Boilers, and Shipbuilding allreported serious losses of membershipover the past 20 years. In these threeindustries, the Boilermakers now rep-resent one-third to one-fourth of the

number of workers we representedonly 20 years ago.

Nearly all of these losses have beencaused by the shrinking of theAmerican industrial sector. Manyindustries have reduced their man-power needs by modernizing theiroperations. Others have moved theirplants overseas.

The U.S. shipbuilding industry hascontracted to its lowest level since1932 because the U.S. government nolonger provides the loan guaranteesnecessary to attract large shipbuildingprojects. In addition, the U.S. Navyhas cut its orders for new ships andhas begun repairing ships overseas.

Locals in the boiler and forgingindustries have benefited enormouslyfrom our in-plant solidarity programand our in-plant organizing program.Boiler lodges in right-to-work statesenjoy 99 percent membership.

The solidarity program has servedlocals in the cement industry well, too.Local D421 in Tulsa has signed a newcontract after working nearly ten yearsunder an implemented contract, andLocal D66 in Fort Dodge, Iowa, suc-cessfully turned back a well-financeddecertification campaign by theiremployer, National Gypsum.

The Special Committee on Stove,Furnace, Energy, and Allied ApplianceWorkers made organizing their high-est priority, vowing to have 15,000members by the next convention. Thisdivision includes our newest industry,emergency medical service personnel.Because this industry relies so muchon up-to-date training, the committeerecommended establishing an emer-gency medical services training pro-gram akin to our apprentice program.

The report by the Committee onOrganizing and Communication com-plemented the recommendations fromthese committees. This committeereported that the Fight BackConstruction Organizing program isbeing de-emphasized for the timebeing, because it works best in timesof low unemployment. Constructionboilermakers expect full employmentfor the next several years. Theseorganizers are now recruiting skilledcraftsmen from nonunion employers.

The committee recommended mak-ing the in-plant organizing programmandatory at all locals with less than100 percent membership, and askedlodges to identify targets for new-plant organizing.

This committee also recommendedthat the International continue to mod-ernize its communication efforts byexpanding and enhancing the union’sweb site, creating web sites to assistwith organizing, and exploring thepossibility of delivering theBoilermaker Reporter via email tosave money.

THIS ANALYSIS of the 54agreements outlined above isbased on information providedin the Contract Summary andTransmittal Report forms, andcovers approximately 2,825employees.

Wage IncreasesFORTY-THREE facilitiesreceived pay increases in 2000,averaging $0.56 per hour or2.96 percent. Fifty-onefacilities will receive payincreases in 2001, averaging$0.48 per hour or 3.15 percent.Thirty-nine facilities willreceive pay increases in 2002,averaging $0.48 per hour or2.96 percent. Fifteen facilitieswill receive pay increases in2003, averaging $0.45 per houror 3.86 percent.

PensionFIFTY-THREEfacilitiesparticipate in some type ofpension program. Thirty-ninefacilities participate in theBoilermaker-BlacksmithNational Pension Trust;contributions range from $0.25to $3.25 per hour for the firstyear. Average cents-per-hourcontributions are $1.28 for thefirst year, $1.35 the secondyear, and $1.37 the third year.

Ten facilities offer a 401(k), 13

facilities have company-sponsored plans. One U.S.facility participates in a profitsharing program; two Canadianfacilities participate in theRegistered Retirement SavingsPlan, which is similar to theIndividual Retirement Accounts(IRAs) found in the U.S.

Shift DifferentialFORTY-NINEagreementsprovide a second shiftpremium, of which 43 report acents-per-hour premiumranging from $0.10 to $2.00.The average is $0.51 per hour.

Forty-six agreementsprovide a third shift premium,of which 39 provide a cents-per-hour premium rangingfrom $0.10 to $1.00. Theaverage is $0.56 per hour.

Of the remainingagreements, two provide apercentage of pay as thepremium and three providefull pay while working areduced schedule in additionto an hourly premium.

Sickness & AccidentFORTY-SIX agreementsprovide weekly sickness andaccident indemnity. Of these,26 pay a set dollar amountranging from $110 to $445 perweek. The average rate forthe first year is $248.77. Of theremaining agreements, 11provide a percentage of theemployee's weekly earnings

as the benefit, six facilities inCalifornia receive statebenefits, and three provide aflat amount distributed overthe entire leave.

The length of time off rangesfrom 13 to 52 weeks. The mostcommon is 26 weeks found in23 agreements. In addition, fouragreements report long-termdisability until the age of 65.

Life Insurance/AD&DFORTY-NINEagreementsprovide life insurance. In 46 ofthese agreements there is aset dollar amount rangingfrom $2,000 to $40,000. Theaverage benefit for the firstyear is $14,402.17. Theremaining agreements useannual wages as the benefitor multiply wages by 2080hours for the benefit amount.

Forty-seven agreementsprovide Accidental Death andDismemberment (AD&D)insurance. In 45 of theseagreements there is a setdollar amount ranging from$2,000 to $80,000. The averagebenefit for the first year is$16,277.78. The remainingagreements double theannual wages as the benefit.

VacationFORTY-NINEagreementsprovide a one-week paidvacation. Forty-eightagreements provide a two-week paid vacation. Fifty

agreements provide a three-week paid vacation. Forty-twoagreements provide a four-week paid vacation. Eighteenagreements provide a five-week paid vacation, andseven provide a six-week paidvacation. Ten agreementsprovide vacation pay basedon a percentage of earnings.

Paid HolidaysALL OF THE AGREEMENTSprovide paid holidays, rangingfrom seven days to 17. Theaverage is ten days.

Other ProvisionsFORTY-NINEagreementsprovidefuneral leave.

Paid leave for jury duty isfound in 41 agreements.

Union leavelanguage isfound in 12 agreements.

HAROLD J. MAUPIN, 84, whoretired as administrator of the Boiler-makers National Apprenticeship Pro-gram in 1985, was killed in a carwreck July 12, 2001.

A member of Local 105, Chillicothe,Ohio, since 1938, Maupin worked as aconstruction field boilermaker until1941, when he enlisted in the Navy.After serving four years in Europe dur-ing World War II, Maupin returned tothe trade until 1956, when he waselected Local 105 business managerand secretary treasurer. In 1980, he wasappointed national administrator ofthe apprentice program, setting up hisoffice in Kansas City.

When he retired in 1985, he said themost satisfying period of his 47 years inthe Brotherhood had been spentimproving and advancing our appren-tice program.

Following his retirement, Maupinmade his home in Florida, where hisbrother, Don, who also served as aLocal 105 BM-ST, lived nearby. ❑

Salvatore Consiglio, 91, oftenreminisces about his careerSALVATORE “SAM” CONSIGLIOjoined the Boilermakers union in 1927.Ten years later he left the union forthree years. When he came back in1940, he stayed.

Consiglio, now 91, often thinks abouthis life as a boilermaker. Work wasn’talways steady. There were layoffs inthose early winters, but that was a boil-ermaker’s life. You took the good withthe bad.

Consiglio began his career at the ageof 11 at the Erie Railroad in Meadville,Pa. When he completed his apprentice-ship, he was transferred to the Erie rail-road shop in Hornell, N.Y.

Consiglio was exempt from servingin the armed forces during World WarII because the railroad industry was avital necessity to the war effort — boil-ermakers kept the trains running thattransferred our troops and the materi-als they needed. He did, however,serve in the Civil Defense Corps, walk-ing the streets to make sure all lightswere out during air raid drills.

When the railroad began using dieselengines 27 years later, Consiglio waslaid off. He found work at the OldmanBoiler Works in Buffalo, where hestayed until his retirement at age 62.

Consiglio is what you call “an old-time boilermaker.” He would make hisown chisels, tempering and hardening

them, and he knew exactly what to doin any given situation. He was one ofLocal 7’s best tube rollers. He could cutout six-inch stay bolts on tube sheetsattached to freighters, while they weredocked in the Buffalo harbors. You hadto be an excellent burner to cut themout without touching the threads.

Now this “old-time boilermaker” isenjoying his retirement. It may be

harder for him to get around, but hekeeps himself busy creating shell art,ceramics, and working in his veg-etable garden.

His son, Frank, followed in his foot-steps, becoming a Boilermaker in 1964.

Like his dad, Frank takes pride indoing the best job he can every day —it’s the only way Consiglio’s know howto work. ❑

Trustees announce five pensionimprovements effective October 1PENSIONERS AND BENEFICIARIES receiving benefits onSept. 30, 2001, will receive a five percent retroactive increasein their benefits.

For participants retiring on or after October 1, 2001, the fol-lowing benefit improvements will apply:

1. The basic pension calculating factor will increase from 50to 51.5 percent.

2. Participants with 30 years or more of pension credit canretire at age 58 with no benefit reduction, and can choose the50% Husband-and-Wife Pension without any reduction.

3. Participants who retire before age 58 who have at least 30years but less than 35 years of pension credit will receive apension reduced by six percent for each year, or 1/2 of onepercent for each month, that they are younger than age 58.

4. Participants who retire before age 58 who have 35 ormore years of pension credit will receive a reduced pensionof three percent for each year, or 1/4 of one percent for eachmonth, that they are younger than age 58.

5. Participants can now choose a Level Income Option,allowing a pensioner to receive adjusted higher benefitamounts up to the time his Social Security payments begin,and lower amounts after, so the total income remains level.

In addition to the above improvements, the Death Benefit forparticipants who die prior to becoming vested or retired hasbeen increased from $12,000 to $15,000. The Death Benefit paidto designated beneficiaries of pensioners who retired with atleast ten years of pension credit has also been increased, from$4,500 to $6,000.

In order to be considered retired, a participant must com-pletely withdraw from and refrain from any employment orself-employment in a job classification included in any U.S.collective bargaining agreement and cannot supervise anysuch job or occupation worked in prior to retirement.

How the Level Income Option works THE LEVEL INCOME OPTION adjusts the amount a retireereceives in benefits from the pension fund so total benefitsremain level before and after collecting Social Security.

Here is how it might work for a participant retiring at age 56with a Social Security Normal Retirement age of 65, an esti-mated $1,000 per month Social Security Benefit, and pensionfunds entitling him to $1,500 a month from the Boilermaker-Blacksmith Pension.

Without the option, total benefits would be $1,500 at 56(Boilermaker pension only) and $2,500 after 65 (Boilermakerpension plus Social Security. With the option, benefits wouldbe $1,970 from date of retirement on.

This example does not reflect cost-of-living adjustments orunscheduled increases awarded by the pension board. ❑

Bush’s tax cut. And even though your$300 or $600 check is chump changecompared to the million-dollar tax cutsthat America’s wealthiest families willrealize, you’d better hang onto it.

You’re going to need every penny ofit to start a retirement account or buyhealth insurance. President Bush’s taxcut is his first step in a plan to take the“security” out of Social Security and the“care” out of Medicare. Workers retir-ing after 2020 will be the ones who gethurt the most, but all workers shouldpay close attention to what the WhiteHouse is doing in these areas.

The problem is that Bush’s tax cutand our economic slowdown havecombined to completely eliminate theprojected budget surplus. The surplusfor 2001 will be only about $1 billion,not counting the Social Security sur-plus. A billion dollars may seem like alot of money, but it is less than $4 foreach American citizen. Not exactly sav-ings you can count on in an emergency.

And even that billion-dollar figure isoverstated. At the request of PresidentBush, the U.S. Treasury has changed itsmethod for reporting the budget, shift-ing an additional $4.3 billion from theSocial Security surplus to other govern-

ment accounts. Without this account-ing gimmick, the non-Social Securitypart of the budget would be in the red.

Keep this deceptive trick in mindwhen Bush claims his tax cut didn’tforce the government to dip into theSocial Security surplus. They did. Theyjust found a way to hide it.

Like his father, who, as president,oversaw the largest budget deficits inU.S. history, George W. Bush is deter-mined to keep our country in the red. Inless than nine months in office, he man-aged to reverse the trend toward sur-pluses that began appearing in 1998.

While many write off his penchantfor red ink as incompetence, it is morelikely part of a cunning plan to destroySocial Security, Medicare, and manyother programs that help working fam-ilies. Hints of the Bush administration’strue agenda come from his advisors.He’s too savvy a politician to tell thenation directly that he would like to dis-mantle our social insurance programsand make corporations exempt fromfederal taxes, but his lieutenants havebeen spreading that word.

An article this past May in The Nationmagazine quoted Grover Norquist, aBush spokesman and advisor, as say-ing his goal is “to cut government inhalf. To get it down to the size wherewe can drown it in the bathtub.”

I don’t have to tell you what pro-grams they will drown in the bathtub.They will start with Medicare andSocial Security.

Secretary of the Treasury PaulO’Neill said as much in an interviewwith the Financial Times. He said he iscommitted to abolishing corporateincome tax and capital gains taxes,shifting the entire federal tax burden towage earners.

He then proposed doing away withMedicare and Social Security, sayingpeople should put money aside fortheir retirement and medical needs.That advice is easy to follow when youmake $59 million a year, the amountO’Neill made last year as CEO of Alcoa.Working families live in a differentworld — a world where unexpected ill-nesses, layoffs, and other family emer-gencies can wipe out savingsovernight.

We need the safety net of Medicareand Social Security.

During last year’s election campaign,Bush promised not only to protect thatsafety net, but also to improveMedicare by adding a prescriptiondrug benefit. But now that he’s squan-dered the surplus on a tax giveaway tothe rich, there is no money left to do so.His prescription drug plan forMedicare is a joke — asking insurancecompanies to voluntarily sell low-costplans to retirees.

His plan for Social Security is evenworse — reducing benefits through pri-

vatization. A Congressional ResearchOffice study shows that the addedadministrative costs of privatizingSocial Security would reduce retirees’benefits anywhere from 4.7 to 10.8 per-cent for those workers who retire after2020. Privatizing would cost $40 to $800billion annually — mostly fees paid tofinancial managers; current adminis-trative costs are less than $3 billion.

When you look at the long-term costof the Bush tax cut, that tax rebate checkseems awfully expensive.

If Bush continues to get his way,you’ll need a lot more than $600 to getyourself back to even. ❑
