The CAWV Car Show and Open House is today from 4:00 p.m. to 7:30 p.m. at the CAWV Headquarters at 2114 Kanawha Boulevard, Charleston, rain or shine. In addition to food and refreshments, this year’s event will feature live music and over 30 unique and vintage cars, trucks and motorcycles owned by members. The CAWV has made arrangements to have a large covered area just in case of inclement weather. Attached with this Newsletter is a map showing parking areas. Over 150 members and local, state and federal contracting representatives have already said they’re coming. We’re expecting many more to show up. Please be one of them. HOUSE SPEAKER WANTS TO REVISIT ABOVEGROUND STORAGE TANK LAW House Speaker Tim Miley, D-Harrison, last week indicated that S.B. 373, The Above Ground Storage Act, has “unintended consequences” that may require action by the WV Legislature to correct. The legislation was written in response to the January 9 Freedom Industries chemical spill that contaminated tap water in parts of nine counties. “There are some consequences that impact, primarily, small operators that I don’t think were fully appreciated and considered as we were passing what many considered a monumental piece of legislation here in West Virginia,” the speaker stated on MetroNews “Talkline.” Now, he said he’s hearing about the legislation’s effects on the small oil and gas operators who have conventional wells – meaning they are not drawing from the Marcellus shale. “I have heard from any number of those conventional well operators and the cost of meeting the requirements of the new legislation is fatal to some of their businesses,” Speaker Miley wrote in a letter sent to Gov. Earl Ray Tomblin. He’s asking that the state Department of Environmental Protection attempt to address the issues during the rule-making process. If that is not possible, the speaker said the governor could delay the implementation of the part of the law dealing with small operators with an executive order or lawmakers could take up the bill again in a Special Session or during the 2015 Regular Legislative Session. The Speaker said there are 40,000 above ground storage tanks for oil and gas in West Virginia that now must be registered with the state even if they are outside of the zones of critical concern and not a threat to the water supply. Those tanks must be inspected and certified by a professional engineer before Jan. 1. CAWV contractor and supplier members who have tanks must also register if their tanks contain more than 1,320 gallons of liquid. Many construction-related tanks have secondary containment ponds or are situated in a way that any spill is contained and does not enter the groundwater. The CAWV would like to hear from members any recommendations they would want considered if the bill is reopened. Please contact Mike Clowser at 304-342-1166 with any comments. AGC OF AMERICA LAUNCHES PRIVATE INSURANCE EXCHANGE

MARK CALENDARS FOR 2015 CAWV MIDYEAR MEETING

August 8, 2014 OSHA INSPECTIONS - PART II

Onsite Inspections

1. Preparation Before Conducting an Inspection - OSHA compliance officers research the inspection history of a work site using various data sources, review of the operations and processes in use and the standards most likely to apply. They gather appropriate personal protective equipment and testing instruments to measure potential hazards.

2. Presentation of Credentials - The onsite inspection begins with the presentation of the

compliance officer’s credentials, which include both a photograph and a serial number.

3. Opening Conference - The compliance officer will explain why OSHA selected the workplace for inspection and describe the scope of the inspection, walk around procedures, employee representation and employee interviews. The employer then selects a representative to accompany the compliance officer during the inspection. An authorized representative of the employees, if any, also has the right to go along. In any case, the compliance officer will consult privately with a reasonable number of employees during the inspection.

4. Walk Around - Following the opening conference, the compliance officer and the

representatives will walk through the portions of the workplace covered by the inspection, inspecting for hazards that could lead to employee injury or illness. The compliance officer will also review worksite injury and illness records and posting of the official OSHA poster.

5. Closing Conference - After the walk around, the compliance officer holds a closing conference

with the employer and the employee representative to discuss the findings. The compliance officer discusses possible courses of action an employer may take following an inspection, which could include an informal conference with OSHA or contesting citations and proposed penalties. The compliance officer also discusses consultation and employee rights.

Results OSHA must issue a citation and proposed penalty within six months of the violation’s occurrence. Citations describe OSHA requirements allegedly violated, list any proposed penalties and give a deadline for correcting the alleged hazards. Violations are categorized as other-than serious, serious, willful, repeated and failure to abate. Penalties may range up to $7,000 for each serious violation and up to $70,000 for repeated offences. Penalties may also be reduced based on the employer’s good faith, inspection, history and business size. For serious violations, OSHA may also reduce the proposed penalty based on the gravity of the alleged violation. No good faith adjustment will be made for alleged willful violations.

FEDERAL HIGHWAYS CALLS OFF HIGHWAY FUNDING CUTS U.S. Transportation Secretary Anthony Foxx announced Thursday that FHWA is calling off plans to cut payments to states for construction projects in the wake of a transportation funding patch passed by Congress last week. FHWA and WV Division of Highways had given contractors on federally funded highway project the option to halt work or take 50 percent payment, effective August 1, if Congress had not acted to prevent a bankruptcy. “As a result of the short-term fix for the Highway Trust Fund that Congress passed on July 31, I am writing to let you know that we will not need to implement these cash management procedures at this time,” Sec. Foxx wrote in a letter to state transportation officials. “While I am pleased the Congress took action to avoid the immediate insolvency of the Highway Account this summer, I am disappointed that they merely kicked the can down the road again,” Foxx wrote. “This is the tenth surface transportation extension-on top of eighteen short term budget measures – in the last 6 years. There is still no long-term certainty.” The Secretary added that he might have to implement the cutbacks in payments to states again in a couple of months if Congress lets its latest transportation patch go back down to the wire. HIGHWAY REVENUES TAKE NOSE DIVE IN JULY Highway revenues for July are under the governor’s estimate by $5.5 million, or 8.71 percent. This in itself is discouraging since July is historically a good month for motor fuel tax collections. More disturbing is that July revenues are considerably less than actual collections in July 2013. Motor Fuel collections for July totaled $38.9 million, compared to $55.5 million last July, a $16.6 million and 30% drop. The Privilege Tax, which has been holding steady, was $14.2 million in July 2014, 13.3 percent under the governor’s estimate and a $4.6 million and 24% drop from last year’s figure. The Registration Tax was the only revenue figure above estimates. In July $15.9 million was collected, 63% above the governor’s estimate and $7 million and 80% over 2013 totals. For the first month of the 2014-2015 fiscal year, total revenue was $69 million, $5.5 million ahead of the governor’s estimate but $14.2 million, 17%, under the actual July 2013 figure of $83.2 million. The governor’s office and the WV Division of Highways will be monitoring very closely August figures to see if there is a rebound in revenues. A new poll has found that while Americans believe it is beneficial to invest in the nation’s transportation infrastructure, they are strongly divided on how to fund these projects. The Associated Press-GfK poll released August 5 surveyed 1,044 randomly selected adults in the U.S. over a five-day period in July. The poll found that:

The most popular choice (30 percent) by respondents to pay for transportation projects was turning over the responsibility to state and local governments;

20 percent support replacing federal gas and diesel taxes with a vehicle-miles-traveled (VMT) tax;

17 percent support having private companies pay for transportation projects, in exchange for charging tolls to fund the projects;

A majority (58 percent) of respondents opposed raising the federal gas tax to pay for transportation projects (14 percent support it);

67 percent of respondents find gas prices extremely/very important, with 21 percent saying it is moderately important to them and 10 percent saying it is slightly/not at all important to them;

59 percent believe that the benefits of good quality highways, railroads and airports outweigh the cost to taxpayers;

35 percent of respondents believe the quality of their roads and bridges is getting worse, with 38 percent stating that they believe the quality is the same and 25 percent believe that it is getting better;

A majority of respondents (56 percent) believe that traffic in their area has gotten worse.
