Rights of State Register Service

• State Service of Real Estate Register is the central executive body carrying out a number of activities, such as state registration of real estate rights, as well as other rights on certain items, development of united cadastre of intangibles, inventory of the necessary registration activities on the real estate and other rights, preparation of relevant technical documents.

• Carries out registration of property rights, as well as other rights of intangibles at state register

• Prepares and implements united cadastre of real estate • Carries out the inventory activities necessary for registration of

property rights • Ensures calculation of net value of constructions including buildings,

equipments, residential and nonresidential areas and property complexes in accordance with inventory and market relations.

Some Functions of Register Service

• To draw up and carry out state register either via computer technology on electronic facilities (disk, hard disk, etc.) or on paper via writing means without using computer

• To accept the application or the annexed documents on the state registration of rights

• To check the correspondence of the information in the submitted documents with the stocked at the state register

• To find out if there are any irrelevance between the claimed and registered rights, as well as other grounds for rejection of state registration of rights or their suspension

• To register the rights within the relevant period • To make notes on approval documents and include relevant information into state

register• To prepare and implement the common cadastre with the view to ensure the state

registration and description• To take necessary measures within its authority with the aim to improve the structure

and work

Registering• The state register shall keep the information on intangibles, their holders, as well as

the property rights.• The register (Registration book of the application) as well as files including

documents for state registration of tights are an integral part of the state register. • The register shall include the information on the following:• a) Applicants, application content, documents on real estate, right holders• b) Extracts from the state registration of the rights• c) State register certificates and their holders• The state register (Registration book) and the documents for registration of the rights

shall always be kept.• Each state register section consists of the following three chapters:• 1. Information on the title, location, area, definition and other necessary information• 2.Property and other object rights, name of the rights holder, passport information

and other necessary information• 3. Limitation on property and other objects rights (servitude, mortgage, usufruct,

arrest on real estate, leasing, etc.)

Next Steps

• State Service of Real Estate Register under the State Committee on Property Issues of Azerbaijan executes the Azerbaijani Presidential Decree on improving the state service of real estate administration in Azerbaijan

as of May 19, 2009

• By 2013 we intend to create a national inventory of Real Estate Registration System in Azerbaijan in accordance with the international experience

• State Service of Real Estate Register under the State Committee on Property Issues of Azerbaijan plans to improve real estate registration system supporting the real estate markets and suitable systems for management and use of real estate
