Gittings, to the end that the estate, to which the plaintiff is enitled thereunder may be determined, and for such other and further relief as their case may require. The Bill of Complaint filed in the above cause states that Henry N. Git- tings, late of Balimore County, de- deased, departed this life in the year 1863, leaving a last Will and Testa- ment, duly executed to pass real estate which Will was admitted to probate by the Orphans' Court of Balimore County and letters Testamentary thereon graned to George A. Williams, a copy of said Will being filed with the bill. That by the first clause of said Will of Henry N. Gitings, he devised all his property, real and personal (except such as was otherwise provided for) to John S. Gittings, in trust for the com- plainant, who was then Ann E. Gitt- ings, his only child, and her heirs un- der a certain condition, mentioned in said Will, which condition provided that the said Ann E. Gittings should change her name to Rebedca Nichols Gittings, which was done, as appears by a certified copy of decree filed in this case. The bill further states that in the event of failure to change her name to Rebecca Nichols Gittings, the estate was to be held in trust for his sisters, Margaret Gittings and Eleanor Gittings now Eleanor Brogden, and their heirs in, equal portions, and in the event of the death of either of said sisters, the descendants of either to take the share of his or her parents. That the said Margaret Gittings de- parted this life, unmarried and with- out issfue, leaving however, a sister, Eleanor Brogden; a niece, Julia Read, who is married to Ha^rry S- Read;-a nephew, James C. Gittings; a nephew, Ernest Gittings, all of whom reside in Baltimore City and are of full age, and are the children of a deceased brother, James Gittings; also two nieces, Elizabeth D. Jones, who is mar- ried to John Paul Jones and Eleanor Addison Gittings, unmarried, the chil- dren of a deceased brother, William Gittings, all of whom reside in Wash- ington, D. C. That the children of the complain- ants are: Rich'd. E. Yellott, whose wife is Mamie Yellott, both of whom are of full age and reside in New Mexico. George Yellott, who is of full age, and whose whereabouts are unknown; Howard Yellott, unmarried; Daniel D. Yellott, whose wife is Settie Yellott, all of whom are of full age and reside in South Dakota; Emily J. Blandford, whose husband is Douglas M. Bland- ford, both of whom are of full age, and reside in Baltimore County, and Henry W. Yellott, whose wife is named Anna Yellott, both of whom are of full age and reside in the State of Minne- sota, That John Charles Gittings. mention- ed in said will, is dead, without is.sue surviving him. That under the terms of said will the complainant is advised that she, hav- ing complied with the terms and con- ditions of said Will as provided for therein, is entitled to a fee simple estate in the real estate devised there- under, but as the question has arisen as to just what your complainant is entitled to take under the Will, a con- struction of same by the Court is necessary to determine same to the end that any cloud may be removed frcfm said title. That the complainant has been in- absolute undisputed possession of the property since becoming of age, some forty years ago. We do hereby levy and impose an assessment or tax Of 35 1-3 cents on every $100 worth of as- assable prop- erty in Baltimore County as a State Tax, being $291,085.24 upon a basis of $82 382.615. 2nd. We do hereby levy and impose an assessment or tax of $1.78 on every $100 worth of assessable property in Baltimore County as a County tax, be- ing $1,645,520, upon the following- classes of property, viz: Real, fixed personal and mixed property (including distilled spirits in Bond) and stocks of Maryland-Corporations, (except Bank Stocks) being $1,645,520, on a total basis of $92,445,190, and a tax of 1 per cent, upon the assessed valuation of the shares of all Bank Stocks taxable in Baltimore County, being $30,000 on a total estimated basis of $3,000,000. 3rd. We do hereby levy and impose an assssment or tax of 15 cents on every $10.0 a s a State Tax upon all bonds, certificates of indebtedness or evidences of debt in whatsoever form, issued by any State, or other than the State of Maryland, or made or issued by any public or private corporation, incorporated by any such State or in any foreign country and owned by residents of Baltimore County, includ- ing as such owners, any resident of said County, who has an equitable in- terest in such property with the legal title to the same in some other, or cor- poration who is a resident of some Cunty in this State, or who is a resi- dent of the City of' Baltimore, said tax of 15 cents on the $100 amounting to $46,835, upon a basis of $31,223,610. 4h. We do hereby levy and impose an assessment or tax of 30 cents on every $100 as a County tax upon all bonds, certificates of indebtedness or evidences of debt in whatever form issued by any State, or other than the Sate of Maryland, or made or issued by any public or private corporation, icorporated by any such State or any foreign country and owned by resi- dents of Baltimore County, including as such owners, any resident of said County who has an equitable interest in such property with the legal title to the same in other, or corporation who is a resident of stome County of this State, or who is a resident of the City of Baltimore, said tax of 30 cents of the $100, amounting to $93,670 upon a basis of $31,223,610. 5th. At 1 P. M. sharp, On "Woodleigh Farm," about two miles from Ellicott City, on road lead­ing from .intersection of St. John's Road and the Frederick Pike, through to the Columbia Pike.

These two registered Holsteins, Lady Pontiac Pet Korndyke, 4 years old, milking (|even gallons daily. Heifer calf by side, entitled to papers; Win-jola De Kol Fairfax, been milking about two months.

The cows are mostly heavy spring­ers. Some are fresh now and four or five will be fresh by day of sale. This herd is one of the best in the county; some of the cows are six and seven gallon milkers.

The object of this suit is to have the Court construe the Last Will and Tes­tament of Henry N. Gittings, to the end tha t the estate, to which the plaintiff is enitled thereunder may be determined, and for such other and further relief as their case may require.

The Bill of Complaint filed in the above cause s ta tes tha t Henry N. Git­tings, late of Balimore County, de-deased, departed this life in the year 1863, leaving a last Will and Testa­ment, duly executed to pass real estate which Will was admitted to probate by the Orphans' Court of Balimore County and letters Testamentary thereon graned to George A. Williams, a copy of said Will being filed with the bill.

That by the first clause of said Will of Henry N. Gitings, he devised all his property, real and personal (except such as was otherwise provided for) to John S. Gittings, in t rust for the com­plainant, who was then Ann E. Gitt­ings, his only child, and her heirs un­der a certain condition, mentioned in said Will, which condition provided that the said Ann E. Gitt ings should change her name to Rebedca Nichols Gittings, which was done, as appears by a certified copy of decree filed in th is case.

The bill further s tates tha t in the event of failure to change her name to Rebecca Nichols Gittings, the estate was to be held in t rus t for his sisters, Margaret Gittings and Eleanor Gitt ings now Eleanor Brogden, and their heirs in, equal portions, and in the event of the death of either of said sisters, the descendants of either to take the share of his or her parents.

That the said Margaret Gitt ings de­parted this life, unmarried and with­out issfue, leaving however, a sister, Eleanor Brogden; a niece, Jul ia Read, who is married to Ha^rry S- Read ; - a nephew, James C. Gitt ings; a nephew, Ernest Gittings, all of whom reside in Baltimore City and are of full age, and are the children of a deceased brother, James Gitt ings; also two nieces, Elizabeth D. Jones, who is mar­ried to John Paul Jones and Eleanor Addison Gittings, unmarried, the chil­dren of a deceased brother, William Gittings, all of whom reside in Wash­ington, D. C.

That the children of the complain­ants are: Rich'd. E. Yellott, whose wife is Mamie Yellott, both of whom are of full age and reside in New Mexico. George Yellott, who is of full age, and whose whereabouts are unknown; Howard Yellott, unmarried; Daniel D. Yellott, whose wife is Settie Yellott, all of whom are of full age and reside in South Dakota; Emily J. Blandford, whose husband is Douglas M. Bland-ford, both of whom are of full age, and reside in Baltimore County, and Henry W. Yellott, whose wife is named Anna Yellott, both of whom are of full age and reside in the State of Minne­sota,

That John Charles Gittings. mention­ed in said will, is dead, without is.sue surviving him.

That under the terms of said will the complainant is advised that she, hav­ing complied with the terms and con­ditions of said Will as provided for therein, is entitled to a fee simple estate in the real estate devised there­under, but as the question has arisen as to just what your complainant is entitled to take under the Will, a con­struction of same by the Court is necessary to determine same to the end that any cloud may be removed frcfm said title.

That the complainant has been in-absolute undisputed possession of the property since becoming of age, some forty years ago.

It is thereupon this 7th day of De­cember, 1920, Ordered by the Circuit Court for Baltimore County, in Equity, that the plaintiffs by causing a copy of this order to be inserted in some newspaper published in Baltimore County, once in each of four successive weeks before the 10th dav of January, 1920, give notice to said defendants of the object and substance of this bill, warning them to be and appear in this Court in person or by solicitor, On or before the 10th day of January,

Baltimore County, having met as re­quired by law for the purpose of mak­ing the annual levy for the ens/u'ng fiscal year beginning January 1st, end­ing December 31st, 1921, and providing for all the expenses and disbursements of said county for said period, do now order and publish as follows:

1st. We do hereby levy and impose an assessment or tax Of 35 1-3 cents on every $100 worth of as- assable prop­erty in Baltimore County as a State Tax, being $291,085.24 upon a basis of $82 382.615.

2nd. We do hereby levy and impose an assessment or tax of $1.78 on every $100 worth of assessable property in Baltimore County as a County tax, be­ing $1,645,520, upon the following-classes of property, viz: Real, fixed personal and mixed property (including distilled spirits in Bond) and stocks of Maryland-Corporations, (except Bank Stocks) being $1,645,520, on a total basis of $92,445,190, and a tax of 1 per cent, upon the assessed valuation of the shares of all Bank Stocks taxable in Baltimore County, being $30,000 on a total estimated basis of $3,000,000.

3rd. We do hereby levy and impose an assssment or tax of 15 cents on every $10.0 as a State Tax upon all bonds, certificates of indebtedness or evidences of debt in whatsoever form, issued by any State, or other than the State of Maryland, or made or issued by any public or private corporation, incorporated by any such State or in any foreign country and owned by residents of Baltimore County, includ­ing as such owners, any resident of said County, who has an equitable in­terest in such property with the legal title to the same in some other, or cor­poration who is a resident of some Cunty in this State, or who is a resi­dent of the City of' Baltimore, said tax of 15 cents on the $100 amounting to $46,835, upon a basis of $31,223,610.

4h. We do hereby levy and impose an assessment or tax of 30 cents on every $100 as a County tax upon all bonds, certificates of indebtedness or evidences of debt in whatever form issued by any State, or other than the Sate of Maryland, or made or issued by any public or private corporation, icorporated by any such State or any foreign country and owned by resi­dents of Baltimore County, including as such owners, any resident of said County who has an equitable interest in such property with the legal title to the same in other, or corporation who is a resident of stome County of this State, or who is a resident of the City of Baltimore, said tax of 30 cents of the $100, amounting to $93,670 upon a basis of $31,223,610.

5th. We do hereby further levy and. impose an additional assessment or Special Tax at the rate of ten cents on every $100 worth of assessable prop­erty within the limits of the Twelfth District of Baltimore County as de­scribed in Chapter 442 of the Acts of the General Assembly of Maryland passed' a t the January Session 1910, excepting therefrom such portions of said District as were annexed by Chap­ter 82, Acts of 1918, to Baltimire City, for the purposesset forth in said Act.

6th. We do hereby further levy and impost? an additional assessment or Special Tax at the ra'te of ten cents on every $100 worth of assessable prop­erty withinthe. limits of the village of Towson, in Baltimore County, as de­scribed in Chapter 861 of the Acts of the General Assembly of Maryland, passed at the January Session of 1914, for the purposes set forth in said Act.

Under and by virue of a writ of fieri facias issued out of the Circuit Court for Baltimore County at the suit of The American Oil Company, a body corporate, against the goods and chat­tels, lands and tenemental of Joseph Noto, to me directed, I have seized upon and taken in execution all the right, title, interest, claim and demand at law and in equity of the said Joseph Noto, in the following described prop­erty,' to wit :

Beginning for the same at the south­west corner of Main Street and the Baltimore and Washington Turnpike and running thence northerly bounding on the westernmost side of Main Street 26 feet 3 inches; thence westerly par­allel with Baltimore and Washington Turnpike 100 feet; thence southerly parallel with Main Street 30 feet to the northernmost side of the Baltimore and Washington Turnpike and thence easterly on the northernmost side of the Baltimore and Washington Turn­pike 100 feet.

The object of this suit is to procure a divorce a vinculo matrimonii by the plaintiff, Cordelia Hunter, from the de­fendant, Edward Estes Hunter.

The Bill recites tha t the part ies were married in the City of Alexandria, in he State of Virginia, on September 22nd, 1913, by a Minister of the Gospel, and lived together up to the month of October, 1917, when he deserted her in he City of Washington, D. C.; tha t the plaintiff has been a resident of the State of Maryland for more than two years prior to the filing of this Bill of Complaint, while the defendant, Edward Estes Hunter, is a non-resi­dent of the State of Maryland, his last known place of residence being Wash­ington, D. C ; that there was no issue as the result of siaid marr iage; tha t though the conduct of your orator to­ward her said husband has been af­fectionate and above reproach, the de­fendant, Edward Estes Hunter, her husiband, has without just cause or reason abandoned and deserted her, and declared his intention to live with her no longer; tha t said abandonment has continued uniterruptedly for more than three years, is deliberate and final, and the separation of the parties is be­yond any reasonable hope or expecta­tion of reconciliation.

I t is therefore Ordered by the Circuit Court for Baltimore County, this 18th day of November, A. D., 1920, tha t the plaintiff by causing a copy of this Or­der to be inserted in some weekly newspaper, published in Baltimore County once a week for four successive weeks before the 20th day of Decem­ber, 1920, give notice to the said non­resident defendant, Edward Estes Hunter, of the object and substance of this suit and warn him to be and ap­pear in this Court either in person or by solicitor, On or before the 5th day of January,
