    [ REPUBLIC ACT NO. 9 22 ]ANACT TO STRENGTHEN THE REGULATORY FUNCTIONS

    OF THE PHILIPPINE OVERSEAS EMPLOYMENTADMINISTRATION (POEA), AMENDING FOR THISPURPOSE REPUBLIC ACT NO. 8042, OTHERWISEKNOWN AS THE "MIGRANT WORKERS ANDOVERSEAS FILIPINOS ACT O F 1995"

    Be it enacted by the Senate and House of Representatives of thePhilippines in Congress assembled:SECT~ON. Section 2 3 , paragraph (b.1) f Republic Act

    No. 8042,otherwise known as the "Migrant Workers and OverseasFilipinos Act of 1995"is hereby amended t o read as follows:

    "(b.1)Philippine Overseas Employment Administration.The Administration shall regulate private sector participationin the recruitment and overseas placement of workers by settingup a licensing and registration system. It shall also formulateand implement, in coordination with appropriate entitiesconcerned, when necessaty, a system for promoting and monitoringthe overseas employment of Filipino workers taking intoconsideration their welfare and the domestic manpowerrequirements.

    "Inaddition to ts powers and functions, the administrationshall inform migrant workers not only of their rights as workersbut also of their rights as human beings, instruct and guide theworkers how to assert their rights and provide the availablemechanism to redress violation of their rights.

    "In the recruitment and placement of workers to servicethe requirements for trained and competent Filipino workers offoreign governments and their instrumentalities, and such otheremployers as public interests may require, the administrationshall deployonly to countries where the Philippines has concludedbilateral labor agreements or arrangements: Provided, That suchcountries shall guarantee to protect the rights of Filipino migrantworkers; and Prouided, urther, That such countries shall observeand/or comply with the international laws and standards formigrant workers."

    SEC. 2. Section 29 of the same law is hereby repealed.SEC. 3. Section 30 of the same law is also hereby repealed.SEC. 4. All laws, orders, issuances, rules or regulations or

    parts thereof inconsistentwith the provisionsof thisAct are herebyrepealed, amended or modified accordingly.

    SEC. 5. If, for any reason, any portion or provision of thisAct isdeclared unconstitutional or invalid, the other portions orprovisions hereof shall not be affected thereby.

    SEC.6. This Act shall take effect fifteen (15) days after itspublication in a t least tw o newspapers of general circulation.
