Subject: Calling quotations for unskilled labours on ‘No Work No Pay’ basis for

Central GST & Central Excise, Haldia Comm’te for the period from 1st April, 2018 to 31st March 2019– reg.

The Office of the Commissioner of Central GST & Central Excise, Haldia Comm’te invites

quotation from reputed Placement Agencies/Manpower Suppliers for supply of 06 (six) no. of unskilled labours for Central GST & Central Excise, Haldia Comm’te at M. S. Building, Customs House, 15/1, Strand Road, Kolkata-700001 for the period from 1st April, 2018 to 31stMarch, 2019 on ‘No Work No Pay’ basis. The period of the contract may be extended further subject to approval of the competent authority.

The tender is invited in two parts/folders i.e. (1) Technical Bid and (2)Financial Bid. The tender for technical bid as prescribed in Annexure-I and for the Financial bid in Annexure-IV duly complete in all respects shall be submitted separate folders addressed to the Assistant Commissioner (HQ), Central GST and Central Excise, Haldia Comm’te, M. S. Buidling, Custom House, 15/1, Strand Road, Kolkata-700 001. The Technical Bid shall be opened by the Tender Committee. Incomplete bid documents shall be rejected. The valid bids shall be scrutinized by the tender Committee to shortlist the eligible bidders. Thereafter, the financial bids of the short listed bidders shall be opened by the Tender Committee. Bidders shall submit the Technical as well as Financial bids by hand/post/courier.

GENERAL GUIDANCE FOR TENDERING

Instructions/Guidelines for submission of the tenders have been given below for

assisting the contractors to participate in Tendering.

1. Eligibility for Participation

Registered security agency/contractors/firms, Consortiums, Partnership and

Individual firms registered with the Central Government are eligible to participate.

A prospective bidder shall be allowed to participate in the job either in the capacity of

individual or as a partner of a firm. If a prospective bidder is found to have applied

severally in a single job in different capacity all his applications will be rejected for

that job.

3. Submission of Tenders

3.1 General Process of submission

The quotations are to be submitted in two parts, i.e. Technical Bid as per Annexure – I

and Financial bid as per Annexure – IV separately in two different sealed envelopes. These envelopes shall be super-scribed ‘TECHNICAL BID’ and ‘FINANCIAL BID’ and put inside a bigger sealed envelope which shall be superscribed with the words “Quotation for Hiring of Unskilled labours for Central GST & C. Ex., Haldia Commissionerate.”

3.2 Technical proposal

The Technical proposal should be in the standardized formats in covers (folders).

4. The tender Notice along with terms and conditions can be obtained from office of

the Commissioner of Central GST & Central Excise, Haldia comm’te, M. S.

Building, Customs House, 15/1, Strand Road, Kolkata-700 001 on all working

days or can be downloaded from the official website http://www.cbec.gov.in.

5. If it is seen that two or more than two bidders quoted same rates in their respective

Financial Bid then Tender Committee will take their decision after conducting personal

hearing with those bidders. The decision of the Committee in this regard shall be final

and binding on all.

6. If the tenders are sent by post/courier, it should be ensured that cover should be

intact at the time of reaching destination without any damage or loss. Department is

not responsible for delay on account of postal/courier services.

7. The last date for receipt of Tender is 06.03.2018 till 17:00 hrs.

TERMS AND CONDITIONS

[Bid document for providing unskilled labour to CGST & CENTRAL EXCISE Haldia Commissionerate on outsourcing basis.]

NOTICE INVITING TENDER

The Office of the Commissioner of CGST & Central Excise, Haldia Comm’te invites online quotation from reputed Placement Agencies/Manpower Suppliers for supply of 06 (six) unskilled labours for Central GST & Central Excise, Haldia Comm’te at M. S. Building, Customs House, 15/1, Strand Road, Kolkata-700001 for a period from 1st April, 2018 to 31st March, 2019 on ‘No Work No Pay’ basis. TENDERING PROCESS:

The tender is invited in two parts/folders i.e. (1) Technical Bid and (2) Financial Bid. 1. QUALIFICATION FOR THE BIDDER:

The bidder is required to enclose self-attested scanned copies of the following documents along with the Technical Bid failing which their bids shall summarily be rejected and will not be considered any further.

a) Registration Certificate with the Labour Department b) Copy of PAN c) Copies of EPF and ESI certificates d) Copy of GST Registration Certificate e) Work experience of providing manpower during past 03 (three) years in Govt./Semi

Govt./Autonomous Organizations/PSUs.

2. TECHNICAL REQUIREMENTS FOR THE BIDDER

a. The bidder should be registered with appropriate registering authority such as Labour Commissioner, GST, E.S.I, E.P.F. etc.

b. The Placement Agency/Manpower Supplier should possess a valid license from the respective Government Agency.

c. Unskilled labour should preferably be below 50 years.

d. The agency will have to comply with all legal provisions relevant for this purpose.

e. The agency will be required to submit, in every month, the documentary evidence for payment of minimum wages to its workers engaged for the job in the office along with bill raised.

4. OTHER TERMS & CONDITIONS

A. GENERAL

i) The contract is likely to commence w.e.f. 01-04-2018 and shall continue for a period upto 31st March, 2019 unless it is curtailed or terminated by this office owing to deficiency of service, sub-standard quality of manpower deployed, breach of contract, reduction or cessation of the requirements of work.

ii) The contract maybe extended further by the mutual consent of contracting agency and this office subject to approval of the competent authority.

iii) This office reserves its right to terminate the contract during the contract period after giving one month notice to the contracting agency in case of any deficiency in service.

iv) The successful bidder shall not be allowed to transfer, assign, pledge or sub-contract its rights and liabilities under this contract to any other agency without the prior written consent of this office.

v) The successful bidder will be required to pay prescribed minimum wages to the manpower supplied as prescribed under the Minimum Wages Act 1948, as revised from time to time and as notified by the Government of India with Provident Fund and Employees State Insurance etc. in respect of the persons deployed by them in this office. The Successful bidder will maintain proper records as required under the Law / Acts.

vi) The successful bidder will be bound by the details furnished by him / her while submitting the bid or at subsequent stage. In case, any of such documents furnished by him / her is found to be false/ misleading at any stage, it would be deemed to be a breach of contract making him / her liable for cancellation.

vii) The successful bidder shall ensure that the manpower conforms to the technical specifications, qualification and experience prescribed in the bid document.

viii) The service provider shall ensure that any details of office, operational process, confidential information, security arrangements, and administrative/ organizational matters are not divulged or disclosed to any person by its personnel deployed in this office.

ix) In case, the person employed by the successful bidder commits any act of omission / commission that amounts to misconduct /indiscipline/ incompetence / security risks, the successful bidder will be liable to take appropriate disciplinary action against such persons, including their removal from site of work, immediately on being brought to his/ her notice.

x) The unskilled labour will have to perform duty for 8 (eight) hours a day subject to proper attendance of entry and exit with signature.

xi) The unskilled labour should be well conversant with for doing miscellaneous work, as required by the department.

xii) The unskilled labour deployed should be neat in appearance, courteous but firm & meet presented physical standards for discharging miscellaneous functions. .

xiii) For all intents and purposes, the successful bidder shall be the "Employer" within the meaning of different Labour Legislations in respect of manpower so employed and deployed in this office for contractual services. No person(s) assigned by the bidder shall have any claim for regular or ad-hoc employment/absorption whatsoever in the Central Excise Department.

xiv) The successful bidder shall be solely responsible for any damages, losses, claims, financial or other injury to any person deployed in the course of their performing the functions/duties, or for payment towards any compensation. The Central Excise Department shall not be liable for payment of any compensation or damages.

xv) The man power deployed by the contractor for the contract shall not be entitled for claim, pay, perks and other facilities which may be admissible to casual, ad-hoc regular / confirmed employees of this office, during the contract or after expiry of the contract.

xvi) Payment shall be made only to the contractor and on monthly basis as per actual services. The contractor has to raise invoice/bill in the first week of the following month for the services rendered in the month.

xvii) Tenders received after the prescribed time limit will not be entertained under any circumstances.

xviii) The Last Date for receipt of Tender is 06.03.2018 till 17:00 hrs.

xix) The Commissioner of Central GST & Central Excise, Haldia Comm’te at M. S. Building, Customs House, 15/1, Strand Road, Kolkata-700001 reserves the right to accept / reject any or all quotations received without assigning any reason thereof.

xx) For any clarification, site inspection etc, bidders may contact the Superintendent (HQ) of Central GST & Central Excise, Haldia Comm’te 7th Floor, M. S. Building, Custom House 15/1, Strand Road, Kolkata-700001 on any working day between 11.30 am to 4.00 pm or the Tenderer can contact through phone no. 033- 2243-6486.

B. LEGAL

i) The successful bidder will be responsible for compliance of all statutory provisions relating to Minimum Wages, Employees Provident Fund and Employees State Insurance etc. in respect of the persons deployed by them in this office. ii) The successful bidder shall maintain all statutory registers under the applicable Law. The agency shall produce the same, on demand, to the concerned authority of this office or any other authority under Law. iii)In case, the successful bidder fails to comply with any statutory / taxation liability under appropriate law, and as a result thereof this office is put to any loss / obligation, monetary

or otherwise, this office will be entitled to get itself reimbursed out of the outstanding bills to the extent of the loss or obligation in monetary terms.

C. FINANCIAL

I. The agency shall raise the bill, in duplicate, along with attendance sheet duly verified by the concerned officer, CGST & Central Excise, Haldia Commissionerate in respect of the persons deployed and submit the same to Commissioner, Central GST & Central Excise, Haldia Comm’te in the first week of the succeeding month.

II. The Commissioner, Central GST & Central Excise, Haldia Comm’te at M. S. Building, Customs House, 15/1, Strand Road, Kolkata-700001 reserves the right to withdraw / relax any of the terms and conditions mentioned above so as to overcome any problem encountered by the contracting parties.

The wages per month is equal to the prescribed minimum wage rate vide Ministry of

Labour & Employment, Office of the Chief Labour Commissioner ( C ), New Delhi’s order

no. 1/13(5)/2017-LS-II dated 20.04.2017. Similarly, EPF, ESI and Service Tax shall be as

required by laws. In our bid, the service charge per month is fixed but other factors/price

components shall be minimum as required by law. The amount which has been quoted in

financial bid is as per the current minimum wage rate and other statutory requirement.

The rate of minimum wages will be changed, as and when the rate of minimum wages will

be revised by Ministry of Labour & Employment, New Delhi.
