PURPOSE SEC.  2.  An  ultimate goal  of  the United States is  a  world which  is  free from  the  scourge  of  w^ar  and the  dangers  and  burdens  of  armaments; in which  the  us e  of  force  has been subordinated  to the  rule  of  law;  and in which international adjustments  to a  changing world  are  achieved peacefully.  I t is the  purpose  of  this  Act to  provide impetus toward this goal  by  creating  a new  agency  of  peace  to  deal with  the  problem of reduction  and  control  of  armaments looking toward ultimate world disarmament. Arms control  and  disarmament policy, being  an  important aspect of foreign policy, must  be  consistent with national security policy  as a whole. The formulation  and  implementation  of  United States arms control  and  disarmament policy  in a  manner which will promote  the national security can best be insured  by a  central organization charged by statute with primary responsibility  for  this field. This organiza tion must have such  a  position within  the  Government that  it can provide  the  President,  the  Secretary  of  State, other officials  of the executive branch,  and the  Congress with recommendations concerning United States arms control  and  disarmament policy,  and can  assess the effect  of  these recommendations upon  our  foreign policies,  our national security policies,  and our  economy. This organization must have  the  capacity  to  provide  the  essential scientific, economic, political, military, psychological,  and  technologi cal information upon which realistic arms control  and  disarmament policy must  be  based.  It  must  be  able  to  carry  out the  following pri mary functions: (a)  The  conduct, support,  and  coordination  of  research  for arms control  and  disarmament policy  formulation; (b)  The  preparation  for and management  of  United States participation  in  international negotiations  in the  arms control and disarmament field; (c)  The  dissemination  and  coordination  of  public information concerning arms control  and  disarmament;  and (d)  The  preparation  for,  operation  of, or as  appropriate, direction  of  United States participation  in  such control systems as  may  become part  of  United States arms control  and  disarma ment activities. DEFINITIONS SEC.  3.  As used  in  this  Act— (a)  The  terms arms control and  disarmament mean  the identification, verification, inspection, limitation, control, reduc tion,  or  elimination,  of  armed forces  and  armaments  of all  kinds under international agreement including the necessary steps taken under such  an  agreement  to  establish  an  effective sytem  of  inter-

R E S E A R C H

SEC.  3 1 . T he D irec tor i s au tho r ized and d i rec ted to exerc ise h is

powers in such manner as to insure the acquisi t ion of a fund of

theore t ica l and prac t ica l know ledge concern ing d isar m am ent . To

th is end , the Direc tor i s au thor ized and d i rec ted , under the d i rec t ion

of the Pres ident , (1 ) to insure the conduct of research , development ,

an d o ther s tud ies in the fie ld of a rm s cont ro l and d is arm am en t ; (2)

to make a r rangemen t s ( i nc lud ing con t rac t s , ag reemen t s , and g ran t s )

for the conduct of research, development , and other studies in the

f ie ld of a rms cont ro l and d isarmament by pr iva te or publ ic ins t i tu

t ions or persons; and (3) to coord ina te the research , development , and

other s tud ies conducted in the f ie ld of a rms cont ro l and d isarmament

by or for o ther Government agencies in accordance wi th procedures

es tab l i shed un der sec tion 35 of th i s Act . In c arr y in g out h i s responsi

b i l i t i es under th i s Act , the Direc tor sha l l , to the maximum exten t

feasible, make ful l use of avai lable faci l i t ies, Government and private.

The au thor i ty of the Direc tor wi th respec t to research , development ,

(e) the s t ruc ture and opera t ion of in terna t ional cont ro l and

other organiza t ions usefu l for a rms cont ro l and   disarmament;

( f ) the t ra in i ng of sc ien t is t s , t echnic ians , and o ther personn el

for manning the cont ro l sys tems which may be crea ted by in terna

t i ona l a rms con t ro l and d i sa rmamen t ag reemen t s ;

(g) the reduct ion an d e l imin at ion of the da ng er of w ar resu l t ing

from acc ident , misca lcu la t ion , o r poss ib le surpr i se a t tack , inc lud

ing (bu t no t l imi ted to) im prove me nts in the m ethod s of comm uni

(k ) methods for the maintenance of peace and security d uri ng

different stages of arms control and

 disarmament;

(1) the scientific, economic, po litical, legal, social, psychological,

military, and technological factors related to the prevention of

war with a view to a better understanding of how the basic

structure of a lasting peace may be

 established;

(m) such related problems as the Director may determine to

be in need of research, development, or study in order to carry

out the provisions of this Act.

PATENTS

SEC.

  32. A ll research with in the Un ited Sta tes contracted for,

sponsored, cosponsored, or authorized under authority of this Act,

shall be provided for in such manner that all information as to uses,

products, processes, patents, and other developments resulting from

such research developed by Government expenditure will (with such

exceptions and limitations, if any, as the Director may find to be

necessary in the public interest) be available to the general public.

This subsection shall not be so construed as to deprive the owner of

any background patent relating thereto of such rights as he may

have thereunder.

POLICY FORMULATION

SEC.

  33 . The Director is authorized and d irected to prep are for the

Presiden t, the Secretary of State , and the heads of such other Govern

ment agencies, as the President may determine, recommendations con

cerning United States arms control and disarmam ent p olicy:

  That no action shall be taken under this or any other law

(hat will obligate the United States to disarm or to reduce or to limit

the Armed Forces or armam ents of the Un ited S tates, except pu rsuan t

of the United States.

NEGOTIATIONS AND RELATED FUNC TIONS

SEC.

 34. U nd er the direction of the Secretary of

  State—

(a) the D irector, for the purpo se of conducting negotiations con

cerning arms control and d isarmamen t or for the purpose of exer

cising any other authority given him by this Act, may (1) consult

and communicate with or direct the consultation and communi

cation with representatives of other nations or of international

organizations and (2) communicate in the name of the Secretary

with diplomatic representatives of the United States in this coun

try and abroad.

(b) the Director shall perform functions pursuant to section

Vv^s^c^\33z-is  ^(^)  ^^  Reorganization Plan 8 of 1953 with respect to providing

positions and policy on arms control and disarmament matters

for dissemination abroad.

(c) th e Director is authorized (1) to formulate plans and make

preparations for the establishment, operation, and funding of

inspection an d con trol systems which may become p a r t of the

United States arms control and disarmament activities, and (2)

as authorized by law, to put into effect, direct, or otherwise assume

United States responsibility for such systems.

SEC.  35 . The Pres iden t i s au thor i zed to establish  procedures to (1)

assure cooperat ion, consul ta t ion, and a cont inuing exchange of in

format ion between the Agency and the Depar tment of Def jMise , the   ^

Atomic Energy Commiss ion , the Nat iona l Aeronau t i cs  stnd  Space

A dm inis t ra t ion and othe r af fected Go vern me nt agencies, in a l l signif i

cant aspects of Uni ted Sta tes arms control and disarmament pol icy

and re la ted mat ters , including cur rent and prospect ive pol ic ies , p lans ,

and programs, (2) resolve differences of opinion between the

Director and such other agencies which cannot be resolved through

consu l t a t ion ,

  and (3) prov ide for presenta t ion to the Pre s ide nt of

recommendations of the Director with respect to such differences,

when such differences involve major matters of policy and cannot be

resolved through consul ta t ion.

SEC.  41. In the per form anc e of h is funct ions , the Dir ecto r is au tho r

(a) u t i l ize or employ the services , personnel , equipment , or

faci l i t ies of any other Government agency, wi th the consent of

the agency concerned, to perform such functions on behalf of the

Age ncy as m ay ap pe ar des i rable . I t is the in ten t of th is sect ion

tha t the Di rec to r r e ly upon the Depar tment o f S ta t e fo r genera l

adminis t ra t ive services in the  Ignited  States and abroad to the

extent agreed upon between the Secretary of Sta te and the

SEC.  42.  The S e c r e t a r y of  S t a t e m a y a u t h o r i z e the D i r e c t o r  to  exer

cise,

 wi th r espec t to Fo rei gn Service Reserve officers and Fo re ig n Serv
