1. EXECUTIVE SUMMARY
Rotorua District Council (RDC) is mandated under section 35(2)(a) of the Resource Management Act 1991 (RMA) to monitor the state of the environment. Protected Natural Areas (PNAs) are one of the indicators used to understand trends in the district. A Protected Natural Area is a defined area of land that has formal or legal status intended to protect indigenous ecosystems, vegetation, habitats, or species. This report is the latest update to PNAs in the Rotorua District to August 2011 and describes changes from 2006. To understand where PNA are located, their number and extent, data was requested from different organizations that have a legal mandate for PNA, or that land owners or managers of land that are under formal protection for PNA. From this a spatial layer was developed in the Geographic Information System (GIS) ARCVIEW 3.1 using existing digital data provided by relevant organisations.
From 2006 to 2011, there were an extra 41 PNAs, making a total of 214 PNAs in the Rotorua District, covering more than 31478 ha. These areas all have formal protection under one of the 19 protection mechanisms identified. The Conservation Act 1987 and Reserves Act 1977 were found to be the main mechanisms used to protect natural areas, together with the Crown Forest Assets Act 1989, Wildlife Act 1953, Resource Management Act 1991, as well as Queen Elizabeth ll and Māori covenants. The most common type of protection was Scenic Reserves under the Reserves Act (42) which also covered the greatest area (18, 966 ha). This was followed by Fixed marginal strip (41) and Stewardship Area under the Conservation Act 1987 (33). Stewardship area covered the second greatest area of PNA (5707 ha). Despite 41 extra PNA in 2011 it was found that the area covered by PNA was 2533 ha less than that counted in 2006. There are various reasons for this discussed in this report.

2. INTRODUCTION AND BACKGROUND
Rotorua District Council (RDC) is mandated under section 35(2)(a) of the Resource Management Act 1991 (RMA) to monitor the state of the environment. Protected Natural Areas (PNAs) are one of the indicators used to understand trends in the district. In 2002 an inventory of all PNAs in the Rotorua District was prepared, along with a digital data layer showing the location and spatial extent of all PNAs. This report was then updated in 2006. This report is the latest update to PNAs in the Rotorua District to August 2011 and describes changes from 2006. In addition to state of the environment monitoring the Protected Natural Areas (PNAs) relate to a number of anticipated environmental results in the District Plan relating to reserves and water bodies, and are included in the draft district plan if they relate to a significant natural area (SNA) or any other matter of national importance under section 6 of the RMA.
3. DEFINING PROTECTED NATURAL AREAS A Protected Natural Area is a defined area of land that has formal or legal status intended to protect indigenous ecosystems, vegetation, habitats, or species. This report defines a PNA for the purpose of State of Environment reporting only and does not encompass all aspects as described by legislation. The various levels of protection and protection categories included within the scope of this definition are included in Appendix 2. These areas may include relatively minor areas of exotic vegetation, e.g. grassed picnic areas. Information on the vegetation, flora, and fauna of many of these areas is presented in Beadel et al. 1998, Shaw & Beadel 1998, and Beadel 1995.
4. METHODOLOGY
Data was requested from different organizations that have a legal mandate for PNA, or land owners or managers of land that are under formal protection for purposes of PNA. From this a spatial layer was created and analysis undertaken.
4.1 DATA SOURCES
All areas conforming to the definition of a PNA were collated from the updated information from existing databases held by the following organisations:
• Department of Conservation (DOC)
• Queen Elizabeth II National Trust (QE11)

• Rotorua District Council
• PF Olsens
• Timberlands and New Zealand Forest Managers Ltd.
The data provided by the various organisations was accepted as correct. Verifying its accuracy was outside of the scope of this study.
Detailed methodology for collation of this data is included in Appendix 3.
4.2 SPATIAL LAYER AND ANALYSIS
A spatial layer was developed in the Geographic Information System (GIS) ARCVIEW 3.1 from existing digital data provided by the relevant organisations. Information on each site was recorded in an attribute table (Appendix 1) linked to the GIS layer. The data was extracted from the Digital Cadastral Database (DCDB) to produce a map of the PNAs under the various protection categories as shown in Figure 1. Where there were differences the reason for the differences was reconciled according to whether they were no longer PNA, new PNA, and amalgamated or fragmented PNA. The outcome and reasons for these differences are discussed in section 7. The PNAs were summarised according to protection categories listed in table 1 of section 5.
5. RESULTS
5.1 PROTECTED NATURAL AREAS - NUMBER AND EXTENT IN 2011
In August 2011, 214 PNAs were identified in the Rotorua District, covering more than 31,478 ha. These areas all have formal protection under one of the 19 protection mechanisms listed in Table 1. The Conservation Act 1987 and Reserves Act 1977 were found to be the main mechanisms used to protect natural areas, together with the Crown Forest Assets Act 1989, Wildlife Act 1953, Resource Management Act 1991, as well as Queen Elizabeth ll and Māori covenants. 5.2 CHANGES TO PROTECTED NATURAL AREAS 2006 TO 2011
In 2006 a total of 34,011 hectares were protected and in 2011 a total of 31,478 hectare were protected. This is 2533 less hectares counted as protected land in 2011, despite 41 additional, new PNA created in this time. Possible explanations for this are:

• the spatial extent of protected natural areas was redefined to include only the areas requiring protection rather than including the whole parcel on which it is located;
• Corrections to the data based on new and more accurate information;
• Land no longer requiring protection;
• Land now managed by a private institution, rather than being crown land.
The 2006 data set was matched with references from the 2011 data set. Comparisons were made to identify:
• New (additional) areas protected
• areas missing in the 2011 data that were included in 2006 data or vice versa
• changes to PNA extent, or their protection category
• Department of Conservation Management Strategy changes. The 214 PNAs in 2011 comprise of:
• 41 new PNAs
• 8 PNAs where there were no changes to the extent: o 1 conservation Area (PNA No 45), o 3 marginal strips (PNA No 151,152,159) and o 4 RDC PNAs (scenic reserves: No 164 and 165; covenants set
aside as a condition of a resource consent: no 172 and 173).
• 6 PNAs where the 2006 data was used because the 2011 data provided extended to include land outside the district (PNA No's 40, 41, 44, 57, 76 and 150 as outlined in Table 5)
• 159 sites that were altered, where the extent or area of the PNA has changed.

5.3 NEW AREAS PROTECTED
There are 41 new PNAs covering 1004 hectares, shown in table 4. These comprise:
• 15 recreation reserves
• 8 QE ll covenants
• 5 conservation covenants
• 5 local purpose reserves
• 2 kawenata
• 2 government purpose reserves
• 2 conservation covenants entered into under both the Conservation and Reserves Act
• 1 fixed marginal strip
• 1 scientific reserve
• 1stewardship area. Figure 2 shows the new PNA on a district map, while table 2 lists these, including their protection category.

PNA 206 and PNA216 to PNA236 (Appendix 1) have new PNA numbers and references assigned to them, however they are not new PNAs. Existing PNAs or a portion of an existing PNA from the 2006 data have been split or merged and a new reference assigned to the new portion created. In some instances, this also includes new areas that haven’t been protected before. Similarly area or extent has been added to other existing PNAs to that recorded in the 2006 data base that had not been previously protected. The extent of new areas of land added to existing PNAs could not be accurately identified as the difference in extent also needs to account for areas subtracted from a PNA (either excluded, split into more than one PNA or portions merged with another PNA) e.g. the decrease in one PNA could partially account for the increase in another. The extent of these changes is not known and identifying changes to every portion of a PNA does not form part of the purpose of this project. There are covenants as condition of resource consent, which haven’t been given effect to as yet due to the subdivision not being completed. If given effect to, these will be two new RDC PNAs. Their detail is as follows:

7. OTHER NATURAL AREAS WITH FORMAL AND INFORMAL PROTECTION The stand of Douglas fir (Pseudotsuga menziesii) forest adjacent to Lakes Tikitapu and Rotokakahi is protected by a Conservation Covenant under the Crown Forests Assets Act 1989, however this area has not been included in the PNA layer as it is a stand of exotic trees protected for historical and landscape protection purposes. Recreation Reserves were also not included in the PNA indicator because their legal status is not designed to protect indigenous ecosystems, vegetation, habitats, or species. However, there are several examples of significant natural areas in the Rotorua District that are within Recreation Reserves. One of these is Rotoma Recreation Reserve which contains a small high quality stand of kahikatea (Dacrycarpus dacrydioides) forest. This reserve is of considerable importance as very little kahikatea forest remains in the Rotorua Lakes Ecological District.
The Lake Rerewhakaaitu Recreation Reserve is another example of a Recreation Reserve which contains significant natural areas. There are also examples of geothermal vegetation and habitats in Rotorua City (e.g. Government Gardens and the Sanatorium Reserve) which are in Recreation Reserves. In addition, some areas of geothermal vegetation are in local purpose reserves (Cemetery Reserve) and unclassified land administered by Rotorua District Council (Kuirau Park). Many of these examples of geothermal habitats have been ranked as being of significant ecological value (Beadel et al. 1996; Shaw & Beadel 1998).

Another category is Esplanade Reserves which are primarily for public access rather than for ecological values. However, some do have significant ecological values, including forest, lake margins, and pohutukawa forest. The Draft Rotorua District Plan has made provision for significant natural areas in the Rotorua District. There are other areas within the Rotorua District which are informally protected, but these have not been included in the protected natural area database:
• Besides the two PNAs remaining under Timberlands’ management, Timberlands only hold forestry rights over land managed by New Zealand Forest Managers Ltd (Iwi land). There are several areas of natural values within the forests, managed under the principles of the New Zealand Forest Accord and under Forest Certification processes and Rotorua District Council rules.
• P.F. Olsen is also currently managing several areas in the Rotorua District for natural values under the principles of the New Zealand Forest Accord and Forest Stewardship Council:
- Three areas (totalling 31.3 hectares) under a soil erosion covenants.
- Seventy nine reserved areas (totalling 334.4 hectares) that are all either Forest Accord areas or protected under internal management planning protocols (because they likely do not meet Forest Accord conditions). They are best described as protected under Forestry Best Management Practice.
There may be more sites in the Rotorua District on private land which are protected as conservation covenants under Section 77 of the Reserves Act 1977 but no records are held by the District Council GIS Department and information was not able to be obtained on these within the timeframe of this project. Other areas in the Rotorua District may already be protected under this mechanism. (See recommendation in Section 5 below). There may be other PNAs not listed in this report.
6.2 AREAS EXCLUDED IN 2011

To maintain consistency with the 2006 data, these numbers have not been reassigned. Where only a portion of a PNA has been taken up in a new PNA, the remainder has been excluded in the 2011 data and is no longer retained as PNA. Four of the PNAs listed above, were not in the 2011 data and are no longer retained as PNAs. The reasons for this are explained under the “comments column in Table 3, section 5.4.
6. FUTURE MONITORING Changes to numbers of PNA and how they are created may be expected in response to the draft/ proposed district plan, two proposed regional policy statements and Central North Island treaty settlements. Central government’s proposed National Policy Statement for Indigenous Biodiversity (2011) and Statement of National Priorities for Protecting Rare and Threatened Biodiversity on Private Land (2007) are intended to protect biodiversity which may see more PNA created. Recommendations on how to more efficiently monitor PNA in the future can be found in Appendix 3.

APPENDIX 2: DETAILED DEFINITION OF PNA IN THE ROTORUA DISTRICT
The various levels of protection and protection categories included within the scope of this definition are listed below:
QE ll PNAs
These PNAs include land owned by the Crown and administered, controlled and managed by Queen Elizabeth ll National Trust through QE ll covenants.
Nga Whenua PNAs
These PNAs include land where DOC has a rau or covenant over Māori owned land to access the Nga Whenua Rahui Kawenata or fund, which is managed by DOC. There are three protection categories – kawenata, management agreement and Māori reservation.
RDC PNAs These PNAs include Crown owned and land vested in Council, administered, as well as controlled and managed by Rotorua District Council (with no DOC involvement). In terms of the RMA, Council can also through a condition of resource consent require a covenant to set aside an area of land to protect e.g. indigenous vegetation on privately owned land. The RDC PNAs are protected through the following protection categories:
• Marginal Strip, Section 24, Conservation Act, 1987 (RDC PNAs identified in terms of this legislation in the previous report is now covered by DOC PNAs)
• Scenic Reserve, Reserves Act, 1977
• Section 221, RMA 1991, resource consent conditions
DOC PNAs These PNAs are defined through the following three levels of protection:

PROTECTION CATEGORY CHANGES Changes to the DOC PNA protection categories were mainly due to correction of records. Table 4 provides a summary of these changes. Various categories in the 2006 data are now described by one category, e.g. data described in the 2006 data as Conservation Covenants, Scenic Reserve and Stewardship Area are now only in the Conservation Covenant category. These previous categories are retained in the definition of PNAs as at the time of writing this report DOC were in the process of reclassifying PNAs. There are two protection categories that are assigned to new PNAs and therefore there are no corresponding categories found in the 2006 data. APPENDIX 3: DETAILED METHODOLOGY AND ANALYSIS
METHODOLOGY FOR SOURCING DATA
Areas conforming to the definition of a PNA were collated from updated information held in existing databases by the following organisations:
• Department of Conservation (DOC) Due to the different protection functions, Nga Whenua PNAs and DOC PNAs as defined in section 2 were provided by two separate entities within DOC. Acknowledgement to Tom Payatt and Roland Pomana. DOC provided data on PNAs under private ownership (identified as “protected other” in Appendix 1) for which DOC holds the information. Apart from differences in the extent of some of the PNAs, this data was in essence the same as that provided in 2006. DOC is in the process of collating a new data base joint with Land Information New Zealand (LINZ). The new data base will initially hold information for DOC only, but will eventually hold all public land. Release of this data is scheduled for mid 2012.
• Queen Elizabeth II National Trust (QE11) The QE11 Trust provided information on PNAs owned and administered by QE11. Acknowledgement to Serge Peeters.
• Rotorua District Council The PNAs administered and controlled and managed by RDC, the existing 2006 data and information was used as there were no changes to the existing PNAs or any additional PNAs included in the schedule. Potential future PNAs were identified through the process described under section 5.3 “New areas protected”.
• PF Olsens - PF Olsens (acknowledgement to Kit Richards and Sally Haddon)
provided only a summary of soil erosion covenants and Forest Accords.
• Timberlands and New Zealand Forest Managers Ltd. Timberlands (Acknowledgement to Colin Maunder) confirmed they have only two PNA’s remaining under their management as the others are now managed by New Zealand Forest Managers Ltd (Contact person: John Hura) since the transfer of land to Iwi through the treaty settlements. The information is still held with Timberlands. At the time of this report, neither Timberlands, nor New Zealand Forest Managers Ltd were able to commit to providing the respective PNA data.

ANALYSIS OF DATA
Inventory of PNA in Rotorua district 2011 Appendix 1 lists all PNA in the Rotorua district in 2011. The GIS layer that pertains to the table in Appendix 1 includes:
• the site name, protection status and area (hectares); where the PNA had a name change, the name is presented in italic. Where applicable, the hectares are indicated with four decimals to provide a more accurate image of the size (0.1 Hectare represents 1000m ²) in order to account for changes in extent.
• the “notes” column describes the DOC Conservation Management Strategy and notes where it is a RDC PNA.
• the “reference” column refers to the reference provided by the relevant organisation that provided the data. In the case of DOC PNAs, it is the Department of Conservation Management Strategy (CMS) number.
• A number (“PNA No” column) is assigned by Council to each PNA for ease of reference.
• The “new sites” column indicates natural areas which have been formally protected for natural values between 2006 and 2011. It does not include existing PNAs where new areas have been added to the PNA.
• The “altered PNAs” column refers to PNAs where there may be a difference in extent between the 2006 data and the 2011 data. Where PNAs have been amalgamated or split to form a new PNA or more than one PNA, the extent of the change cannot be measured, but it is logged as an alteration to the PNA.
• The “comments” column relates to the “new” and “altered PNAs” columns and denotes where PNAs from 2006 have been amalgamated with another PNA or split into more than one PNA. This is further explained in section 6.
The 2006 data was overlain by the 2011 data to show the differences in PNA extent and new PNAs. There were various shortfalls in the data provided, which influenced the method followed to compare the 2006 and 2011 data. The following processes were followed:
• QE ll data did not have a similar reference as RDC's 2006 data. The spatial data had to be aligned against each other. Due to this, there were double-ups under the RDC data, which had to be clarified individually.
• Nga Whenua PNAs had to be compared in terms of spatial data since many of the names did not match up with the new names and numbers.
• DOC data had common reference numbers for the 2006 and 2011 data, but many had been merged and split and these changes had to be tracked.
• No record was available to confirm any new RDC PNAs. Spatial data was created for all rural subdivisions from 2006 and overlain with the data base for Protected Natural Areas (PNA), Significant Natural Areas (SNA) and Recommended Area for Protection (RAP). Areas where subdivisions may potentially have consent conditions relating to PNAs have been further investigated to identify any new PNAs. The two cases where protection was required, the subdivision hadn’t been given effect to and could thus not be

included as new PNAs. These are recorded at the end of section 5.3 “New areas for protection”
Table 5 summarises PNAs where a portion of the PNA fall outside Rotorua district boundary. That portion is excluded from Appendix 1. Since the difference in extent between the 2006 and 2011 data has been assigned to the area falling outside the district boundary, Appendix 1 reflects the extent from the 2006 data as indicated in the table below. CHANGES TO THE EXTENT OF PNAS
There are various changes in the extent of PNAs between the 2006 and 2011 data. One hundred and fifty eight PNAs (identified in Appendix 1) have had records adjusted. This does not reflect any real change in the extent of area managed as protected between 2006 and 2011 as explained below. Decreases in the extent of the PNA could be due to various reasons: - PNAs in its entirety or sections of land has been reclassified under another
existing or new PNA number; - Cadastral differences between the data used by the protection agency and the
latest version held by Council; - Land or sections of land are no longer required to be protected due to
corrections to PNA boundaries; - Land or sections of land are no longer managed by DOC.

Increases to the extent of the PNA could be due to the following reasons: - PNAs in its entirety or sections of land previously included in another PNA
number, has been reclassified and included in the said PNA. - New sections of land have been added and are now protected under the PNA. - Cadastral differences between the data used by the protection agency and the
latest version held by Council;
In some cases, a combination of a variety of the above changes in extent is evident in a single PNA. Similarly, some PNAs may seemingly not have significant changes in the extent, but it could be that the land taken away and land added to the PNA have balanced out. The extent of these changes is not known and identifying and verifying changes to every portion of a PNA does not form part of the purpose of this project. Where information of PNA amalgamation or splitting was available, it has been recorded in the “comments” column of Appendix 1. Due to this, some PNA numbers have lapsed
CHANGES TO DOC PNA MANAGEMENT STRATEGY
The management strategy for DOC PNAs has not changed significantly. Rather, most of the PNAs that were defined as “not administered by DOC” in 2006, are renamed as “protected other”, except for the ones now managed by “Fish and Game NZ and Administered by DOC”, for which the relevant reference number is found in the table below. There are four administration and management categories that are assigned to new PNAs and there are thus no corresponding category found in the 2006 data. RECOMMENDATIONS FOR FUTURE REPORTS
It is likely that Conservation Covenants under Section 77 of the Reserves Act 1977 or conditions imposed as part of subdivision consents are two of the key mechanisms currently used to protect natural areas in the District, both in the recent past and in the future. Therefore, if information on these covenants is not readily available, then any increase in extent or number of protected areas will not be able to be detected or recorded. It is recommended that information on these covenants or conditions of subdivision be captured on a GIS layer held by the Council as they are implemented, and that when resources allow, Council files are searched and existing covenants (and/or conditions) of subdivisions are also captured on a GIS layer.
Since DOC will provide a more comprehensive and correct list of PNAs in 2012, it is recommended that the data for DOC in this report be accepted and verification not be undertaken at this stage. More detailed study is required to verify the extent and reasons for changes and to identify land that is now controlled through other protection agencies e.g. where land are no longer managed by DOC, it needs to be confirmed if it is managed by a private owner or institution, in which case the data for these sections need to be retained.
