A. The London Borough of Hounslow (Prohibition of Stopping on Taxi Ranks) (Amendment No.**) Order 20**

1. The London Borough of Hounslow proposes to introduce a road hump under section 90a of the Highways Act 1980 and make the above Orders under sections 6, 45, 46, 49, 51 and 124 of the Road Traffic Regulation Act 1984.

2. The location of the proposed road hump is on Power Road at its junction with Gunnersbury Avenue. The road hump would be a maximum of 75mm high, 9m long, with ramp gradients no greater than 1:12.

3. The general effect of the Orders would be to: a) introduce a taxi rank on Power Road adjacent to the Clayton Hotel; b) introduce three electric vehicle recharging bays adjacent to No.6 Power Road; c) amend the waiting restrictions in Power Road; and d) amend the existing shared-use parking bays to accommodate the above changes, but

to also introduce new controlled parking bays to increase the on-street parking provision for West Chiswick CPZ permit holders and visitors to the area.

4. Documents giving further information of the proposals and Orders, including detailed descriptions and plans, can be viewed for a period of 21 days from the date of this Notice: a) online at hounslow.gov.uk by typing in the term “traffic notices” in the search bar; or b) from 22 March until 12 April 2019 at the Forms and Documents Counter, Civic Centre,

Lampton Road, Hounslow TW3 4DN, between the hours of 9am and 4.15pm, Mondays to Fridays, from 15 April until 19 April 2019 at the Customer service reception, Hounslow House, 7 Bath Road, Hounslow, TW3 3EB, between the hours of 9am and 4.45pm, Mondays to Fridays.

5. Any person wishing to comment on the proposed road hump and/or object to the proposed Orders, should send a statement in writing stating the grounds of the objection to the Head of Traffic, Transport & Environmental Strategy at the address above or by email to [email protected] quoting the reference TMO/P013/19, to be received by no later than Friday, 19 April 2019.

The Council of the London Borough of Hounslow, after consulting the Commissioner of Police of the Metropolis, in exercise of the powers conferred by section 6 of the Road Traffic Regulation Act 1984a, and of all other powers thereunto enabling hereby make the following Order: 1. This Order shall come into operation on ** ***** 20** and may be cited as the London

Borough of Hounslow (Prohibition of Stopping on Taxi Ranks) (Amendment No.**) Traffic Order 20**.

2. In this Order: “the Order of 2012b” means the London Borough of Hounslow (Prohibition of Stopping on Taxi Ranks) Traffic Order 2012.

3. Without prejudice to the validity of anything done or to any liability incurred by the coming into operation of the Order, the Order of 2012 shall have affect as though: (a) The item numbered ** was added to the Schedule to that Order as set out in the

The Council of the London Borough of Hounslow, having consulted the Commissioner of Police of the Metropolis, in exercise of the powers conferred by sections 6 and 124 of the Road Traffic Regulation Act 1984a as amended and of all other enabling powers hereby make the following Order: 1. Citation and commencement

(1) This Order may be cited as the London Borough of Hounslow (Electric Vehicle On-Street Parking Places) Order 20** and shall come into operation on ** ***** 20**

2. Revocation

(1) Without prejudice to the validity of anything done or to any liability incurred in respect of any act or omission before coming into operation of this Order the following Orders shall we hereby revoked: (a) The London Borough of Hounslow (Electric Vehicle On-street Parking Places) (No.1)

Order 2019b 3. Interpretation (1) In this Order, except where the context otherwise requires:

"Council" means the Council of the London Borough of Hounslow; “civil enforcement officer” has the same meaning as in the Traffic Management Act 2004; "driver" in relation to a vehicle waiting at a recharging point, means the person driving the vehicle at the time it was left at the recharging point; “electric vehicle” means a vehicle in which the electrical motive power is derived from an electrical storage battery which is not connected to any source of power derived from fossil fuel when the vehicle is in motion; “penalty charge and reduced penalty charge” means a charge set by the Council under the provisions of Section 66 of the Road Traffic Act 1991 and with the approval of the Secretary of State for Transport which is to be paid to the Council within 28 days beginning on the date of the Notice, or 14 days in the case of a reduced penalty charge, following the issue of the penalty charge notice; “penalty charge notice” has the same meaning as in the Civil Enforcement of Parking Contraventions (England) General Regulations 2007; "permitted hours", in relation to a recharging point, means at any time; “recharging place” means any area on a street designated as such by this Order. “recharging post” mans a device designed for the recharging of electric vehicles; “recharging space” means a space in a recharging place described in the Schedule to this Order which is provided for the leaving of vehicles;

(2) Any reference in this Order to a numbered Article or Schedule shall, unless the context otherwise requires, be construed as a reference to the Article or Schedule bearing that number of this Order;

4. Designation of recharging places

(1) The areas of street as described in column 2 of the Schedule are designated as recharging places.

(2) The limits of each recharging place and the limits of each recharging space within a recharging place shall be indicated on the street by traffic signs of any size, colour and type prescribed or auhorised under Section 64 of the Road Traffic Regulation Act 1984

5. Number and situation of recharging spaces (1) The number of recharging spaces within in each recharging place shall not be less than the

number specified in relation to that parking place in column 3 of the Schedule. (2) The number and situation of recharging spaces in each recharging place shall be determined

by the Council. 6. Manner of standing in a recharging place (1) Every vehicle left in a recharging place shall stand so that every part of the vehicle is wholly

within the limits of any recharging space if so marked, or within the limits of any recharging place.

(2) Every vehicle left in a recharging place in relation to which special provisions as to the manner of standing of a vehicle in that recharging place is specified in column 4 of the Schedule shall stand so that as to be in accordance with those provisions.

7. Vehicles for which recharging parking places are designated. (1) Each recharging place shall only be used, subject to the provisions of this Order, for the

leaving of electric vehicles. (2) At all times during which an electric vehicle is left in a recharging place referred to in the

Schedule during the permitted hours, the driver thereof shall cause that vehicle to be connected and actively charging via a recharging lead attached to the recharding post relating to that recharging place.

8. Contravention (1) If a vehicle is left in a recharging place referred to in the Schedule without complying with the

requirements of this Order, a contravention shall be deemed to have occurred and a penalty charge shall be payable.

9. Power to suspend the use of a parking place (1) A person duly authorised by the council or by the Commissioner of Police of the Metropolis

may suspend the use of a recharging place or any part thereof whenever they consider such suspension reasonably necessary: (a) for the purpose of facilitating the movement of traffic or promoting its safety; (b) for the purpose of any building operation, demolition or excavation adjacent to the

parking place, the maintenance, improvement or reconstruction of the highway or the cleansing of gullies in or adjacent to the parking place, the laying, erection, alteration or repair in or adjacent to the parking place of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or any telecommunication system or the placing, maintenance or removal of any traffic sign;

(c) for the convenience of occupiers of premises adjacent to the parking place on any occasion of the removal of furniture to or from one office or dwelling house adjacent to the parking place from or to a depository, another office or dwelling house;

(d) on any occasion on which it is likely by reason some special attraction that any street will be thronged or obstructed; or

(2) A police constable in uniform or traffic warden may suspend for not longer than twenty four hours the use of a recharging place or any part thereof whenever they consider suspension

reasonably necessary for the purposes of facilitating the movement of traffic or promoting its safety.

(3) A duly authorised person suspending the use of a recharging place or any part thereof in accordance with the provisions of paragraph (1), or as the case may be, paragraph (2) of this Article shall thereupon place or cause to be placed in or adjacent to any part of that recharging place which is suspended a traffic sign of any size, colour and type prescribed or authorised under Section 64 of the Road Traffic Regulation Act 1984 indicating that waiting by vehicles is prohibited.

(4) No person shall cause or permit a vehicle to wait in a recharging place or part thereof during such period as there is in or adjacent to that part of the recharging place a traffic sign placed in pursuance of paragraph (3) of this Article. Provided that nothing in this paragraph shall apply to: (a) any vehicle being used for fire brigade, ambulance or police purposes or any vehicle

which is waiting for any reason specified in Article 11(1) (c), (e) or (f); or (b) anything done with the permission of the person suspending the use of the parking

place or part thereof in pursuance of paragraph (1) of this Article. 10. Restriction on use of a recharging place (1) No person shall use any recharging place or any vehicle while it is in a recharging place in

connection with the sale or offering for sale of any goods to any person in or near the recharging place or in connection with the selling or offering for sale of his skill in handicraft or his services in any other capacity. Provided that nothing in this Article shall prevent the sale of goods from a vehicle: (a) if the goods are immediately delivered at or taken into premises adjacent to the vehicle

from which the sale effected; or (b) if the vehicle is one to which provisions of Article 11(1)(i) apply.

11. Restriction on waiting by a vehicle in a recharging place (1) Any vehicle may wait during the permitted hours anywhere in any part of a recharging place

if the use of that part has not been suspended and if the vehicle is waiting: (a) for so long as is necessary to enable a person to board or alight from the vehicle and to

load thereon or unload therefrom their personal luggage; (b) for so long as is necessary to enable goods to be loaded onto the vehicle from

premises adjacent to the recharging place or unloaded from the vehicle to premises adjacent to the recharging place;

(c) for so long as is necessary for postal packets to be collected from or delivered to premises or posting boxes adjacent to the recharging place in which the vehicle is waiting;

(d) whilst being used for fire brigade, ambulance or police purposes or, not being a passenger vehicle, is being used in the service of a local authority in pursuance of statutory powers or duties provided that in all the circumstances it is reasonably necessary in the exercise of such powers or in the performance of such duties for the vehicle to wait in the place in which it is waiting;

(e) the vehicle is waiting only for so long as may be necessary to enable it to be used in connection with the removal of any obstruction to traffic;

(f) owing to the driver being prevented from proceeding by circumstances beyond his control or to such waiting being necessary in order to avoid an accident;

(g) the vehicle not being a passenger vehicle is waiting only for so long as may be reasonably necessary to enable it to be used for any purpose specified in Article 9(1) (b);

(h) the vehicle is in actual use in connection with the removal of furniture to or from one office or dwelling house adjacent to the recharging place from or to a depository, another office or dwelling house; or

(i) in a recharging place if goods are being sold or offered or exposed for sale from the vehicle by a person who is licensed by the Council to sell goods from a stationary vehicle on a pitch situated in a recharging place.

(2) Nothing in the foregoing provisions of this Order shall be taken as authorising anything which would be a contravention of any Regulations made or having effect as if made under Section 25 of the Road Traffic Regulation Act 1984.

12. Manner of waiting in a recharging place (1) Every vehicle waiting in a recharging place by virtue of the provisions of this Order shall

stand so that every part of the vehicle is wholly within the limits of the recharging place unless the width of the vehicle precludes compliance with this paragraph.

(2) If the width of the vehicle does preclude compliance with paragraph (1) of this Article the vehicle waiting in the recharging place shall stand so that the longitudinal axis of the vehicle is parallel to the edge of the carriageway and the distance between the said edge and the nearest wheel of the vehicle is not more than 300 millimetres.

(3) Every vehicle left in a recharging place in relation to which special provisions as to the manner of standing of a vehicle in that parking place is specified in column 4 of the Schedule shall stand so that as to be in accordance with those provisions.

13. Removal of a vehicle from a recharging place (1) Where a civil enforcement officer is of the opinion that any of the provisions contained in this

Order have been contravened or not complied with in respect of a vehicle left in a recharging parking place they may remove or cause to be removed the vehicle from the recharging parking place and, where it is so removed, shall provide for the safe storage of the vehicle

(2) Where a vehicle has been removed from a recharging parking place in accordance with the provision of paragraph (1) of this Article a fee shall be payable to the Council in respect of the removal of the vehicle. A daily charge, commencing on midnight after the day of removal of the vehicle, shall be payable in respect to the storage of the vehicle.

14. Movement of a vehicle in a recharging place in an emergency

(1) A police constable in uniform or a civil enforcement officer may remove or cause to be removed, in case of emergency, to any place they think fit, any vehicle left in a recharging place.

15. Placing of traffic signs (1) The Council shall:

(a) cause the limits of each recharging place to be indicated by placing and maintaining traffic signs of any size, colour and type prescribed or authorised under Section 64 of the Road Traffic Regulation Act 1984; and

(d) carry out such other work as is reasonably required for the purpose of the satisfactory operation of a parking place.

This Order designates electric vehicle recharging places which will allow electric vehicles which are connected and actively recharging via the recharging leads which may be left in the designated areas of Power Road, Chiswick. This Order will also consolidate existing electric vehicle recharging bays in Boston Manor Road, Brentford, Edensor Gardnes, Chiswick, Gloucester Road, Hounslow; Harvard Road, Isleworth; Linden Gardens, Chiswick, Maswell Park Road, Isleworth; Spencer Road, Chiswick, Strand-on-the-Green, Chiswick, Summerwood Road, Isleworth, Sutton Court Road, Chiswick, Queens Road, Hounslow and Tiverton Road, Hounslow into one Order.

STATEMENT OF REASONS Proposed taxi rank, electric vehicle charge points, waiting restrictions and side road entry treatment – Power Road, Chiswick The council is consulting on introducing a taxi rank, electric vehicle charging points and a road hump in Power Road, Chiswick.

The purpose of introducing the taxi rank outside of the Clayton Hotel is to serve the hotel and local area. All taxis are fully accessible and wheelchair friendly, helping to improve access for all taxi passengers and to enable people with disabilities to benefit from a door to door service.

As part of targets set out in Hounslow Council’s ‘Air Quality Action Plan’ and the Mayor of London’s ‘Transport Strategy’, proposals to introduce three electric vehicle charging points along with dedicated bays have been included with this consultation. These bays can be used by any electric vehicle owner at no extra cost other than the monetary charge for electricity used.

The introduction of new controlled parking bays will provide additional on-street parking for West Chiswick permit holders and visitors to residents and businesses in the area. The provision of a road hump on Power Road at its junction with Gunnersbury Avenue would create a safer environment for all road users and would particularly benefit vulnerable road users, especially the young, elderly and those with disabilities, who wish to cross Power Road at this junction.
