PROPOSED EARTH WORKS AND LANDSCAPE WORKS AT BULATAN SULTAN TENGAH AND ALONG JALAN SULTAN TENGAH, KUCHING

(DBKU/CQS/P/2/16). SECTION 1 - PRELIMINARIES AND GENERAL 1.01 GENERAL

This is a lump sum contract to which bill of quantities do not form part and calls for the general supply of labour, materials and equipment for the Proposed Earth Works and Landscape Works At Bulatan Sultan Tengah and along, Jalan Sultan Tengah, Kuching. Tenderers are advised to take all reasonable precautions and care to prevent loss or damages by accident or any other cause to the existing work/finishes including that of the nominated subcontractors. The Contractor is to maintain the site of the works in good condition and is to take all precautions to prevent nuisance of any kind on the premises.

1.02 DEFINITION OF TERMS

“DBKU” means the Commission of the City of Kuching North or in Bahasa Malaysia “Dewan Bandaraya Kuching Utara” established under Section 4 of the City of Kuching North Ordinance, 1988, who for the purpose of this Contract is the Director of DBKU. “Schedule of Rates” means the schedule comprising items and rates of works as stated in the Contract Documents “Superintending Officer” means the person indicated by name or by office in the letter accepting the tender and his successor in office or any person from time to time appointed in writing by the Director. “Director” means the Director of DBKU appointed under section 8(1) of the City of Kuching North Ordinance, 1988 who shall carry out the obligations and exercise the rights and due performance of this Contract. “Contract” shall mean the Agreement executed between the DBKU and the Contractor together with the documents forming part thereof. “Month” shall mean Gregorian calendar month. “Equivalent approved” shall means to be approved, selected or directed by the Superintending Officer. Words importing the singular also include the plural and vice versa where the context requires.

1.03 SCOPE OF WORK

This Contract comprises the supply, construct, completion and maintenance of the Proposed Earth Works and Landscape Works At Bulatan Sultan Tengah and along Jalan Sultan Tengah, Kuching including temporary works, demolishing works, planting and other associated works, all in accordance with drawing and Specifications.

1.05 SITE

The site is located at Bulatan Sultan Tengah and along Jalan Sultan Tengah, Kuching.

1.06 PERFORMANCE SECURITY

The Contractor is to enter a contract and a performance security amounting to five (5%) percent of the contract sum.

1.07 DISCREPANCIES

Should the Specification or drawings not agree or unintelligible to the Contractor or if the materials, or workmanship be considered as insufficiently described the Contractor must ascertain the exact requirements from the Superintending Officer (particularly before tendering) as no allowance will be made later for any alleged discrepancies or deficiency of description.

1.08 ENTIRETY OF CONTRACT

Any matter of construction and workmanship which are fairly and obviously intended, but which may not be definitely referred to in the Specification or drawings, and which are usual in sound building construction practice and essential to the works are to be considered as included in this contract.

The Contractor is to produce copies of the orders of essential materials to the Superintending Officer before the works commence.

No part of the existing premises is to be used for any other purposes such as temporary workers accommodation, cooking and washing or bath without approval from the Superintending Officer.

1.10 ACCESS TO WORKS The Contractor will make his own arrangement for the access to the works. 1.11 SECURITY

The Contractor is to provide watchmen, temporary cover and adequate security as necessary or as required by the Superintending Officer to prevent injury to all persons and property, including the works, the work people and the public.

1.12 PROTECTION OF MATERIAL ON SITE

The Contractor is to prevent damage or loss by any cause in materials delivered for use in the works, including those of nominated Sub-Contractors.

1.13 TIME FOR COMPLETION AND DAMAGES FOR NON-COMPLETION ON TIME

The whole of the works are to be completed to the satisfaction of the Superintending Officer in four (4) months from the official date of commencement which will be communicated in writing to the successful tenderer. If the Contractor fails to complete the works within the time stated in his Appendix to the Form of Contract or within any extended time fixed under the Form of Contract, the Contractor shall pay the sum stated in the Appendix to the Form of Contract as Liquidated and Ascertained Damages during which the works shall remain incomplete.

1.14 DEFECTS LIABILITY PERIOD

The defects liability period shall be twelve (12) months commencing from the date of practical completion.

1.15 TEMPORARY LIGHT AND POWER

The Contractor is allowed to make use of the existing lighting for the proper execution of works including the works of nominated Sub-Contractors.

1.16 WATER FOR WORKS

The Contractor can make use of the existing supply of water for works to be carried out and the Employer may levy charges accordingly.

1.17 REMOVAL OF RUBBISH

Allow for the cost of removing rubbish etc. at frequent interval during the progress of the works.

SECTION 1 - PRELIMINARIES AND GENERAL (cont’d ) 1.18 CONTRACTOR TO VISIT SITE

The Contractor is advised to visit the site and area of the works before submitting his tender and to familiarise himself with all aspects for the works and the conditions under which they are to be executed including existing features and services, means of access, storage area for materials and any other matter which may affect his tender. No claim on the ground of lack of knowledge of any such matter will be entertained by the DBKU.

1.19 CONTRACTOR TO PROVIDE EVERYTHING

Except where otherwise described the Contractor is to provide all labour and supervision, materials, plants, tools, transport and all other things necessary for the execution of the work according to the true meaning and intent to the Specifications, drawings or instructions, whether or not particularly referred to therein.

1.20 QUALITY OF MATERIALS

All materials are to be of a quality appropriate to and adequate for the work. Where so required the quality of any material is to be approved prior to its use and any samples required are to be provided free of charge by the Contractor. Any material rejected is to be removed at the Contractor's expense.

1.21 SETTING OUT

All wall setting out is to be approved by the Superintending Officer before any work is commence. No such approval shall in any way limit the Contractor's responsibility for accuracy of the setting up.

1.22 TEMPORARY WORKS

The lump sum tender shall include the supply, construction and final removal of all temporary works, such as temporary road, culvert, timber crossing, office, store, fencing, foot bridge and etc. for the satisfactory completion of the contract.

1.23 PROGRESS PHOTOGRAPHS

The Contractor shall take progress photographs of the site and the works at monthly intervals as directed by the Superintending Officer. The average number of different photographs to be taken shall not be less than 36 per month. The Contractor shall supply the negatives, two post-card size prints of each of the progress photographs to the Superintending Officer. Prints shall be titled, dated and signed by the Contractor and properly presented in the hard cover album.

1.24 EXISTING SERVICES

The Contractor shall be responsible for locating of services belonging or under the control of any public authority, company or person which may be or be liable to be interfered with by or in connection with the execution of the works. The Contractor shall, where necessary, prepared in advance of construction to determine the exact positions of installations and services which are or otherwise hidden and inform Dewan Bandaraya Kuching Utara. The costs for relocation, reinstatement and shifting of the public services to be borne by Dewan Bandaraya Kuching Utara. The Contractor is liable for any damage, intentional or unintentional, direct or indirect on any of the service line and shall make good such damage immediately and at his own expense.

1.25 TRAFFIC FLOW AND DIVERSIONS

The Contractor shall not during the course of the construction cause unnecessary obstruction or misuse to traffic using that road. The Contractor shall provide necessary detour or diversion to guide and regulated the traffic flow. Existing traffic shall not be interrupted for any lengthy period.

1.26 TRAFFIC AND WARNING SIGNS

The Contractor shall provide adequate warning signs, flagmen and watchmen, if necessary, to regulate traffic flow at hazardous places on the project and at any other places so directed by the Superintending Officer or his representative. Any cost of damage due to negligence of these shall be borne by the Contractor.

1.27 OPENING OF ROAD SECTION TO TRAFFIC

The Superintending Officer or his representative reserves the right to open any completed section of the road to traffic. The Contractor shall be responsible for maintaining the road including repair these sections and other completed sections during and up to the end of maintenance period.

1.28 LEAVE WORKS PERFECT

All plants and surplus materials are to be cleared away on completion, all debris is to be cleared away as it arises and on completion of all works and areas disturbed are to be made good. The Contractor is to remove all stains and dried up materials and to restore all areas affected to their original state.

SECTION 1 - PRELIMINARIES AND GENERAL (cont’d ) 1.29 INSURANCE

The following insurances are required to be taken up by the Contractor for the works :- a. Workmen’s Compensation Insurance.

b. Insurance for the full contract value of the works against damage by all

possible risks including Public Liability Insurance (Contractors All Risks).

c. Any other insurance when deemed necessary for this purpose. The Contractor shall comply with all advice, recommendations and instructions of Dewan Bandaraya Kuching Utara appointed Insurance Consultant for the project. Such advice, recommendations and instructions shall include all matters pertaining to the terms and conditions of insurance and the extent of insurance coverage for the Contract.

The Contractor shall deposit with the Superintending Officer the policies and the receipts for the premiums paid for such insurance. In case of failure by the Contractor to effect or renew such insurances and pay the premium in respect of the Contract, the Superintending Officer may and will deduct the amount so expended from any money due to or to become due to the Contractor.

The Policy for (b) above shall state specifically the damage resulting from flood or due to negligence of the Contractor is an occurrence covered by the policy.

1.30 DAMAGE TO PUBLIC PROPERTIES DURING THE SUPPLY AND TRANSPORTATION OF MATERIAL, CONSTRUCTION WORKS AND MAINTENANCE PERIOD

Damaged caused by the Contractor to any public properties during the supply and transportation of material, maintenance period and construction works shall be repaired and restored at his own expense.

1.31 GENERAL CLEANLINESS ON SITE AND ENROUTE

The working site must be kept clean and tidy at the Contractor's own expense during both the construction and Defect Liability Periods.

1.32 RISE AND FALL

This Contract shall not be subject to adjustment either upwards or downwards due to movements in the cost of materials or labour or any other matters affecting the cost of execution of the works.

SECTION 1 - PRELIMINARIES AND GENERAL (cont’d ) 1.33 PAYMENT SCHEDULE The payment shall be processed on the basis of area handed over after development

and planting as completion of the Works. The certificate and the date there in for the practical completion of the work shall entitle the contractor for continuance of the maintenance for 12 months.

Payment Terms based on the item rates for the quantum of the certified practical

completion of the work shall be as follows:

a) 76% - On certified practical completion of works b) 24% - 2% Every month during twelve (12) month maintenance period

The Superintending Officer shall be fully empowered to hold the payment in case the contractor is observed negligent to the maintenance works, mortality of plants not attended by the contractor for immediate replacement of the same by healthy plants.

1.34 DEDUCTION FROM PAYMENT FOR MAINTENANCE WORKS For evaluation of maintenance work, a joint inspection will be carried out on 25th day

of every month or the 1st working day after the schedule date. In the event that the maintenance work not completed as per Schedule of

Maintenance, DBKU shall deduct a sum from the monthly maintenance payment for the incomplete Maintenance Works based on percentage value of work done.

1.35 WORKS PROGRAMME AND WORK SAFETY PLAN The Contractor is required to supply three (3) copies of his detailed Works

Programme and Work Safety Plan to the Superintending Officer at the start of the job for his approval. On receipt of the approval to Works Programme and Work Safety Plan the Contractor will be expected to adhere to the Works Programme to ensure completion of works without delay. The Contractor shall comply with the Work Safety Plan submitted and approve by Superintending Officer. All changes to the programme must be approved by the Superintending Officer.

1.36 SAFETY AND HEALTH COMPLIANCE

The Contractor shall comply with all the safety and health requirement as stated in the Tender Document including personal protective equipment; temporary traffic warning signs and lamps; and two (2) set of First Aid Kit completed with all necessary undue items. DBKU’s enforcement officer shall visit the site to ensure that the safety is adequately provided on site. Failure to comply with this provision shall be punishable to a fine of Ringgit Malaysia: Fifty (RM50.00) Only each day and shall be deducted from the payment Interim Certificate. Prior to the commencement of the Works, the Contractor shall at their own cost register the awarded Contract with the JKKP and furnish the evidence of the said registration to the Superintending Officer.

1. Temporary Road Furniture

a) Water - Filled HDPE Road Barrier Provide water – filled HDPE Road Barrier as shown on the Drawings and / or as directed by the Superintending Officer, and as specified including installing in the first position as shown on the drawings and storage, maintenance and replacement during construction period and removal on completion of the road works.

b) Warning Lamp (Blinker)

Provide warning lamp/blinkers with batteries as shown on the Drawings and / or as directed by the Superintending Officer and as specified including installing in the first position as shown on the drawings and storage, maintenance and replacement during construction period including removal from site at the end of each stage and at the completion of the road works.

2. Temporary Signs

(in accordance to JKR Arahan Teknik (Jalan) 2C/85 : Manual on Traffic Control Devices Temporary Signs and Work Zones Control) Provide and install in position all temporary traffic signs of fluorescent orange

prismatic retro-reflective sheeting including all posts brackets, painting and everything complete as shown on the Drawings and/ or as directed by the Superintending Officer including removal from site at the end of each stage and the completion of the road works.

SECTION 2 - SITE WORKS 2.01 CLEARING AND GRUBBING

2.01.1 Generally

This work shall consist of all clearing and grubbing necessary for the performance of the work covered by the Contract in accordance with these Specifications.

2.02 CONSTRUCTION METHODS

2.02.1 Extent Of Clearing, Cutting And Grubbing

No site clearing, cutting and grubbing shall be carried out to the area of the proposed site unless directed by the Superintending Officer.

2.02.2 Cutting Of Trees, Shrubs And Bushes

No trees shall be uprooted or cut down. No shrubs and bushes shall be cleared from the site unless directed by the Superintending Officer.

2.02.3 Grubbing And Removal Of Stumps And Roots

Stumps and tree roots shall, unless otherwise directed by the Superintending Officer, be grubbed up, burnt or removed and disposed off in approved dumps to be provided by the Contractor. Holes and cavities resulting from the clearing and grubbing up shall be backfilled with approved materials which shall be deposited and compacted in layer not exceeding 230 mm depth to the same dry density as that of the adjoining soil. This backfilling shall be considered incidental to the works of clearing and grubbing and will not be measured for payment.

2.02.4 Clearing Existing Water Courses

All existing natural water courses shall be cleared of obstructions and kept open throughout the works. Earth bunds or mounds formed during clearing by mechanical means shall be levelled off to permit drainage of water into the existing natural water courses.

2.02.5 Demolition And Removal Of Obstructions

Structures and superficial obstructions on the site in the way of or otherwise affected by the works, shall be demolished, broken up and removed from site.

2.02.6 Damage To Adjacent Property

All care shall be taken to ensure that neighbouring property shall not be damaged or destroyed during the site clearing grubbing and burning and all claims for compensation by others shall be the responsibility of the Contractor.

2.02 CONSTRUCTION METHODS (Cont’d)

2.02.7 Disposal Of Unwanted Materials And Rubbish

Unwanted material from clearing and grubbing which are surplus to, or unsuitable for use in the works shall become the property of the Contractor and shall be disposed off by him either off the site to his tip or, if agreed by the Superintending Officer, on the site in an approved manner. On no account shall timbers, stumps and other materials to be burnt or taken away be pushed into the ravines, valleys, rivers or drains.

2.03 EARTHWORKS

2.03.1 Definition Of Earthwork Materials

The following definitions of earthwork materials shall apply to this and other clauses of the Specifications in which reference is made to the defined materials: 1. Top soil' shall mean the top layer of soil that can support vegetation

and shall include turf. 2. Suitable Material' shall comprise all that which is acceptable in

accordance with the Contract for use in the works and which is capable of being compacted to form a stable fill having suitable side slopes.

3. Unsuitable Material' shall mean other than suitable materials and shall

include:

a) Material from swamps, marshes or bogs; b) Peat, logs, stumps and perishable and toxic materials; c) Material susceptible to spontaneous combustion; d) Clay of liquid limit exceeding 55; e) Plastic materials having a moisture content greater than four

percent (4%) above the plastic limit for that material; f) Non plastic material having a moisture content greater than

two percent (2%) above the optimum for British Standard Heavy Compaction.

4. Earth' shall include all excavation at site except that classified as

unsuitable material and rock. 5. Rock shall include only excavation which in the judgement of the

Superintending Officer, is not practicable to excavate without the use of pneumatic tool or drilling and blasting.

6. Rock shall not include boulders less than one (1) cubic meter in

volume.

2.03 EARTHWORKS (Cont’d) 2.03.2 Use Of Top Soil

The use of top soil shall be restricted to surface layers in positions not subject to loading by pavement or structures. Top soil shall not be used as base formation material. Top soil shall be excavated and deposited as general filling anywhere on the site in approved position or removed from site as directed by the Superintending Officer.

The Contractor shall make all arrangement for the loading, transporting, dumping, spreading or removal of these materials.

2.03.3 Removal of Unsuitable Material

If unsuitable material is encountered below formatic level, such material shall be excavated as directed by the Superintending Officer and shall be hauled to the Contractor's own tip-off site.

2.03.4 Excavation of Rock

If blasting of rock is needed by the Contractor on site to remove the material classified as hard rock, the Contractor shall store explosive in an approved separate store magazine with a separate compartment for detonator. Explosives shall be handled only by currently approved short-fires. The Contractor shall ensure that there no unauthorised issue of improper use of explosive brought on the site. Explosives shall be used in the quantities and manner recommended by the Manufacturers. The written permission of the Superintending Officer small be obtained for each location or series of locations where the Contractor wishes to use more than 10 kg. of explosives in one (1) blast. Such permission shall not in any way relieve the Contractor of his liabilities in any misuse of explosives.

Prior to blasting, the Contractor shall inform the Superintending Officer or his Representative and the Police. When blasting is carried out, the Contractor shall ensure by adherence to proper safety distances and by the use of heavy blasting mats where necessary to prevent dispersal of materials, so that no damage is caused to persons or property on the site. Special precaution shall be taken when blasting in wet ground. Blasting will be such that no building or structure will be damaged due to the explosion. Payment of Hard Rock excavation will be under Variation Order.

Section E – Special Specification

SECTION 3 - EXCAVATOR 3.01 GENERALLY

The Contractor shall provide all labour, plant, equipment and materials for carrying out all works in connection with excavating, filling and backfilling including removal from site of all surplus excavated materials and debris from abandoned services and demolished structures where encountered in strict accordance with the requirement to the tip as directed by the Superintending Officer.

3.02 SITE CONDITIONS

The Contractor shall make his own investigation as to the nature of the ground to be excavated. Any existing services, pipes and drains encountered during excavation shall be diverted as directed or cut off and sealed. Any concrete, brickwork or other artificial obstructions met with during excavation are to be broken up and got out and removed from the site.

3.03 FORMATION LEVELS

The Contractor shall excavate or as the case may be, fill with earth available from site to required levels, prior to actual construction work. Where earth required for filling to make up the required formation levels is not sufficient, then he must bet the same from an approved tip.

3.04 EXCAVATIONS AND EXCAVATION BELOW REQUIRED DEPTHS

All excavations shall be square, level and plumb and shall be to such width as may be necessary to carry out the work safely and properly. The bottoms shall be consolidated and shall be to the exact levels required.

The Contractor is to give notice to the Superintending Officer and to any other Authorities when the excavations are ready to receive concrete and these are not to be laid until the excavations have been approved and the depths noted.

Should any excavation be made without authority to greater depths than shown on the drawings or as instructed then the Contractor is to fill in to the correct level with concrete (1:3:6) at the Contractor's expense. However, in the case piles, no such filling is to be done. The piles are to be driven from the actual excavated level and the foundation length in concrete of the class specified thereof or to the corrected level. Additional reinforcement has also to be provided as necessary to the approval of the Superintending Officer.

3.05 EXCAVATION IN ROCK

Rates for excavations will include for excavating in hard laterite or shale, but with the exception of rock which in the opinion of the Superintending Officer requires the use of compressor drills, explosives or other special methods of removal (i.e. not removable by changkol, spade, pick or by hand). Such excavations will be measured as "Extra Over", ordinary excavations and the Superintending Officer will be the sole judge in deciding what is to be defined as "rock". Materials which can be loosened and removed by the use of a pick are shall not be classified as Rock.

SECTION 3 - EXCAVATOR ( cont’d ) 3.06 USE OF EXPLOSIVE

No explosives are to be used for removal of work or for any other purpose without the permission of the Superintending Officer in writing. If permission is granted the Contractor is to be responsible for informing all other interested parties of his intention and shall take all precautions to prevent damage to any services of statutory undertakings or local authorities or to adjacent property. The Contractor shall indemnify the Proprietor against any claim, loss or expense arising from any damage and make good at his own expense any damage arising from the use of explosives or similar means of breaking up rock or other obstructions.

The contractor shall store explosives in a licensed store of magazine provided with a separate compartment for detonators. Explosives shall be handled only by currently licensed short firers. The Contractor shall ensure that there is no unauthorised issue or improper use of explosives brought onto the site.

Explosives shall be used in the quantities and manner recommended by the Manufacturer.

3.07 SURPLUS MATERIALS

All excavated materials suitable for filling shall be kept in an approved location on the site. All surplus excavated materials or unsuitable spoils shall be removed from the site to a tip to be provided by the Contractor at his own expense. Clay or earth containing any organic matter will not be permitted as fill.

SECTION 4 - MAINTENANCE DURING DEFECTS LIABILITY PERIOD 4.01 GENERAL

The Contractor shall maintain and establish the works for a period of twelve (12) months, during which he shall make good all defects, after the issue of the Certificate of Practical Completion by the Superintending Officer. The Contractor shall undertake maintenance operations to the satisfaction of the Superintending Officer and/or in accordance with the agreed Schedule of Maintenance. Plants which die or fail to make satisfactory growth during the Defects Liability Period shall be replaced at the Contractor own expense with plants equal to those first planted, in the opinion of the Superintending Officer and/or in accordance with the specification. Planting maintenance shall include but not be limited to all necessary watering weeding, pruning, trimming, manuring, replacement of unacceptable material straightening plants which sag or lean, adjustment of tree ties and any other procedure consistent with good horticultural practise necessary to insure, normal, vigorous and healthy growth of all work under this contract. These procedures are to be carried out when necessary as directed by Superintending Officer and/or in accordance with the Schedule of Maintenance. The Contractor shall be responsible for the use of all materials, labour and equipment and any injury to plant material caused by such material, labour and equipment shall be corrected, repaired or replaced by the Contractor at his own expense.

SECTION 4 - MAINTENANCE DURING DEFECTS LIABILITY PERIOD (Cont’d) 4.02 COMMENCEMENT OF MAINTENANCE WORKS DURING DEFECT LIABILITY

PERIOD

Maintenance works shall commence from the date of Practical Completion, not withstanding any rectification works to be carried out in respect to the contract works.

4.03 WEEDING

Keep all planted areas free from weeds and undesirable grasses, by a method and by materials approved by the Superintending Officer. The Contractor may use either manual or mechanical methods or both but the type of mechanical method used must be approved by the Superintending Officer no spraying of weedicide allowed. The weeding programme is to be carried out accordance to the Schedule of Maintenance.

All area of planting bed for shrub, ground cover and hardscape base shall be free of grass/weeds at all time. Weeds/grass at these areas shall be manually removed (manual – Weeding) by pulling each of its stem out, so as to carry with it as much roots as possible to minimise its future growth. Contractor shall avoid damaging ornamental plants during the weeding process. Method of weeding to be used shall be 30cm radius from plant stems / dumps / structure / hardscape shall be free of weed. Contractor shall use appropriate weeding tools such as sickles and others as approved by Superintending Officer. Beside weeding, contractor need to cleaning and cleansing of shrub trunk and branches of all foreign vegetation, roots, creepers, diseased and damaged branches. Also get rid all dead shrub and ground cover. All garden refuse / debris / waste shall be placed in plastic bags, to be removed and disposal – off to dumping site on the same day. The Contractor shall not apply and use weed control / weedicides and burning are totally prohibited.

4.04 WATERING

Water plant materials to maintain the desired level of moisture necessary to maintain vigorous and healthy growth. The quantity of water applied at one (1) time shall be sufficient to penetrate the soil to a minimum depth of 8” at a rate which will prevent saturation for the soil. The watering programme shall be carried out accordance to the Schedule of Maintenance.

4.05 DISEASE AND INSECT PEST CONTROL

Inspect all plant materials at least once a month to locate and identify any disease or peat infestation and submit the proposed method of control to the Superintending Officer for approval prior to application of control measures. Any pesticides approved, to be used shall be applied in accordance to the manufacturers instruction.

SECTION 4 - MAINTENANCE DURING DEFECTS LIABILITY PERIOD (Cont’d) 4.06 PRUNING, TRIMMING AND REPAIR

The amount of pruning shall be limited to the minimum necessary to remove dead or injured twigs and branches and to compensate for the loss of roots as a result of transplanting operations. All cuts shall be made flush, leaving no stubs. On all cuts over 3/4” in diameter and bruises or scars on the bark, the injured cambium shall be traced back to living tissue and removed; wounds shall be smoothed and shaped so as not to retain water; and the treated area shall be coated with shellac or other specified wound dressing. Basic maintenance pruning is to be carried out to shrubs and ground covers to prevent from growing beyond certain limits to the satisfaction of the Superintending Officer and shall be carried out accordance to the Schedule of Maintenance.

Formal hedges and topiary for shrub shall be pruned in a accordance with the pattern and design as directed by the Superintending Officer. The Contractor shall pruned shrub and ground cover to control growth, remove dead, diseased, damage, water shoot, broken branches, branches extending beyond the face of curbs, side walls or are climbing buildings walls. Branches of tree to a height of not less than three (3) meters from ground level shall be pruned.

All debris shall be collected, place in plastic bags and disposal off on the same day. Contractor shall use appropriate pruning tools such as pruning shears, clippers, blades, saws powered pruning saw sharp and others as approved by Superintending Officer. Twigs to be pruned with secateurs of clipped with shears, larger branches to be sawn through. Care must be taken to avoid tearing, under side of the branch must be cut first to a dept of a quarter of its thickness, followed by cutting on the upper side. As the two (2) cuts approach each other, the branch will break. The unever cut surface has to be trimmed to smoothen it. For hedges pruning is to be done manually with shears or secateurs or by powered pruning saw.

4.07 MANURING/FERTILIZING

Manuring is to be carried out accordance to the Schedule of Maintenance. Any fertilizers used shall be approved by the Superintending Officer.

For shrub and ground cover type of formulation shall be non-flowering plants NPK 15:15:15 + TE flowering plants NPK 12:12:17 + TE method of application shall be scatter/broad cast granular around the planting bed within 30cm radius from base of plants with a ratio of 10gm for shrub/each ground cover.

SECTION 4 - MAINTENANCE DURING DEFECTS LIABILITY PERIOD (Cont’d) 4.08 REPLACEMENT OF PLANTS

The Contractor shall replace within the twelve (12) months maintenance period any unsuccessful plants. Such replacement shall be subject to the notification and approval as specified for the initial planting and shall not constitute as extra to the contract. The replacement shall be carried out within Two (2) weeks from the date of Superintending Officer instruction otherwise the client shall replace the plant and charge the cost to the contractor. However, this clause will not apply to intentional and malicious theft and damage to the plant materials.

4.09 SOIL SUBSIDENCE

Any soil subsidence or erosion which may occur after the soil filling and preparation operations shall be made good.

4.10 WIND-FIRMNESS, STAKES AND TREE TIES

All plants shall be regularly inspected for wind firmness and firmed as necessary at the same time. Stakes shall likewise be checked for firmness and all tree plant ties inspected and made good if required. Stakes and tree ties that go missing should be replaced by the Contractor immediately and at his own expense during both construction and Defect Liability Periods.

4.11 URGENT WORKS

Not withstanding anything to the contrary of the contract, the Superintending Officer may instruct the Contractor to perform urgent maintenance works. Should the Contractor fail to carry out the work within three (3) days the Superintending Officer, reserves the right without further notice to employ others to carry out such work and may charge it to the Contractor.

4.12 INSURANCE

The Contractor is advised to ensure adequate insurance to cover his work during the Maintenance and Plant Establishment Period.

4.13 PROTECTION

Contractor shall protect all plants and lawns from damage at all times. The moving of heavy equipment or materials over the lawn areas shall be done on planks or pontoon. Any soil, manure or similar material which has been brought on the paved areas shall be removed and the paved areas shall be kept clean at all times. The Contractor shall periodically or as directed during the progress of this work, remove and properly dispose of debris and keep the premises reasonably clean of hazardous obstruction. Upon completion of his work, he shall remove all his temporary construction facilities and unused materials provided for the work and put the premises in anneal and clean condition and do all cleaning required.

Certificate of Practical Completion shall be issued by the Superintending Officer when all works had been performed in accordance with the drawings, specification and as per authorised filed adjustments. The defects liability maintenance period shall commence upon issuance of Certificate of Practical Completion.

4.15 FINAL INSPECTION

The Contractor must give two (2) days notice in advance of the anticipated date of inspection before the end of the Defects Liability Period. This condition applies equally to the reseeding of areas of grass which fail to become satisfactorily established within the Defects Liability Period. Only when the defects are made good will the Defects Liability Period end.

4.16 CLEANUP AND FINISH AFTER PLANTING

During course of planting excess and waste materials shall be continuously and promptly removed, lawn areas kept clean and all reasonable precautions taken to avoid damage to existing structure, plants and grass. When the planting in an area has been completed the area shall be thoroughly cleaned up. Debris, rubbish, subsoil and waste materials shall be cleaned up and removed from the area. Existing grassed areas which have been injured by the work shall be regarded and sodded and the entire area, when completed, shall be neat and clean to the satisfaction of Superintending Officer.

4.17 RESTORATION

All pavements, sodded and planted areas, structures and sub-structures not specifically provided for in the Contract disturbed by the Contractor during the execution of the work shall be restored by the Contractor to their original conditions. All cost incurred shall be borne by the Contractor.

4.18 GRASS CUTTING WORKS

The scope of works for grass cutting shall include but not be limited to the maintenance of all grass areas and non-ornamental vegetation such as shrubs, bushes and etc., within the contracted areas;- i) The Contractor shall maintain up to the trunks of all ornamental shrubs and to

the edge of all planting beds of ground covers. Care must be taken so that all roots, stems or branches of such plants are not damaged or removed;

ii) All grass shall be levelled and evenly cut. An average cut height of between

50 mm and 75 mm above ground level shall be used as a general guideline. To achieve this ‘sit on’ or/ and ‘push on’ lawn mowers or lawn trimmer machine shall be used. The use of string blade (nylon) brush cutters is upon the approval of Superintending Officer Representative only;

iii) The Contractor shall after each cut ensure that edges abutting planting beds

are kept neat using a suitable edging tool to clean straight lines or smooth curves;

iv) All grass within planting beds cycling tracks or concrete drain and other

structures edges, shall be trimmed to a regular line and on earth drain wall to cut evenly. This is to be done by using manual trimming or using mechanical hedge trimmer or string blade (nylon) brush cutters;

v) The Contractor shall sweep and clear debris from grass cutting activities etc.,

from the site daily. The swept materials shall be placed in recyclable bags, collected and disposed-of on the same day;

vi) The Contractor shall ensure that all shrubs, ground cover, planting bed,

hardscape base and tree guard of saplings are free of all grass/weed. To clear off completely grass, weeds, creepers etc. from trees, plants, to within 30cm of plant stems, landscaped features and structures, public amenities and infrastructures using machines, e.g. bush cutter with string blades at ONLY where tree guards are available; and/ or Manual (weeding) – to pull off grass, weeds, creepers etc. by (force of) hands only; use of sickles is prohibited;

vii) All area of plants and planting bed for shrub, ground cover, tree sapling and palms, hardscape base and inside tree guard of tree sapling shall be free of grass/weeds at all time. Weeds/grass at these areas shall be manually removed (manual – Weeding) by pulling each of its stem out, so as to carry with it as much roots as possible to minimize its future growth. Contractor shall avoid damaging ornamental plants during the weeding process;

viii) Manual (weeding) – As illustrated in the Appendix, around stems, clump of

plants to a radius of minimum 30cm, of all areas of planting beds. Contractor shall avoid using non specialized machines, tools, e.g. bush cutter or sickles, to perform this work;

ix) All garden refuse / debris / waste shall be placed in bags, to be removed and

disposed – off to the approved dumping site on the same activity day; x) All weeding works in this contract shall be completed at every 15 days per

session as in the maintenance programme Appendix A;

xi) The Contractor shall not apply or use weed control / weedicides and burning are totally prohibited.

(a) Tools And Equipment

i) All equipment and necessary supplies including but not

restricted to: mowers for open spaces/ flat areas, edgers, blowers; grass cutter with string blades for areas such as along/ around edges of structures, tree/plant stems/trunks etc., and other equipment approved by the Superintending Officer.

ii) The equipment furnished by the contractor must be in good

repair and shall be maintained so as to produce a clean, sharp cut to the grass at all times. Equipment which in any way pulls or rips grass or damages the turf shall not be allowed to operate under this contract. All equipment will be of such a type so that the height of cut can be adjusted to a minimum of 50mm and maximum of 70mm. The contractor shall have enough equipment and personnel to complete each grass cutting and/ or mowing session at each site contracted for;

iii) Equipment and supplies may not be stored overnight or for

extended periods of time on work site.

(b) Disposal of Extracted Materials

Precaution shall be undertaken by the Contractor to avoid spillage of fluid and extracted materials on site and road during storage and transportation.

(c) Appearance

All grass areas are to be maintained green. The Contractor shall remove all cut grass within the same day of cutting. Use of weed killers or related chemicals on sites is totally prohibited. All foreign vegetation (weeds) shall be removed manually and all foreign materials such as debris, garden refuse and all other wastes with the exception of industrial and domestic refuse shall be cleared and removed from site to dumping ground within the same day.

SECTION 5 - PLANTING SPECIFICATION 5.01 GENERAL

Preparation works include all necessary grading, subsoil planting and drainage, replacement and/or addition of top soil, general planting and any other work as described and shown in the Drawings and the protection of the above work until it is handed over to Dewan Bandaraya Kuching Utara.

5.02 SETTING OUT OF WORKS

Location of all works, positions of planting beds and plants shall be accurately set out and approved by the Superintending Officer before any further site work or planting commence.

5.03 GENERAL PLANTING

Planting by an approved method shall be to a minimum depth of 300mm for shrubs, 1000mm for trees and 150mm for grass, unless otherwise stated in the Drawings. The genera, species, size, root specification and numbers of all plants required are listed in the Schedule of Plant materials in the plan.

5.04 TOP SOIL

All top soil on the site is the property of Dewan Bandaraya Kuching Utara and shall be carefully conserved. 5.04.01 Additional Requirement Of Imported Top Soil

Additional requirement of imported top soil are to be included in the quotation.

5.04.02 Quality Of Imported Top Soil

Top soil is to be good quality clean medium loam vegetable soil free from sub-soil, pernicious weeds or other extraneous material including stones 75mm and above in size and ph complying with the current B.S. 3883, 1965 value to be the same as the existing soil or neutral. Where plants requiring lime-free soil conditions are planted, the ph value of the soil, existing or imported must be between 6 and 7.

The Contractor shall submit a sample load of not less than 5 cubic metres for approval and this load must be kept intact for comparison and to ensure that all subsequent deliveries are similar to the approved sample load. Any substandard loads shall be removed from the site at the expense to the Contractor.

The Contractor shall provide the sample of organic and lime content of existing or imported top soil as requested by the Superintending Officer.

Suitable top soil from an approved source shall be imported as necessary to fulfill the above requirements.

5.04.02 Spreading The Top Soil

All works shall be carried out in appropriate weather conditions to avoid over compaction and destruction of title. Spreading and grading of topsoil shall not be carried out when the subsoil or topsoil are waterlogged.

5.04.03 Finished Levels

Finished levels shall be in accordance with the appropriate standard details for plant beds and grass finishes and where applicable shall be 150mm below the finished floor level of buildings and 25mm for grass above kerbs. Surface shall be graded to given suitable surface drainage away from building and to avoid pounding, to a minimum fall of 1 in 60 and maximum fall of 1 in 5 in accordance with B.S. 4428, 1969.

5.05 INSPECTION

The Superintending Officer or his representative will inspect all excavated tree pits, shrub beds or other work prior to these being backfilled or covered up. The Contractor shall give at least twenty four (24) hours notice to the Superintending Officer to inspect all works before backfilling or covering up. Should the Contractor fail to give such notice, he may be required to uncover and cover same at his own expense.

5.06 FINISHING

All soiled areas once prepared shall be kept free of any weeds, rubbish, rubble, debris and all other extraneous matter, and in a neat and tidy condition to the satisfaction of the Superintending Officer.

5.07 DAMAGE

The Contractor shall take adequate precautions to protect the works from any damage until it is handed over to Dewan Bandaraya Kuching Utara. Damage caused by the Contractor to any property shall be made good at his own expense.

SECTION 5 - PLANTING SPECIFICATION (cont’d) 5.08 PLANT MATERIAL

The Contractor is to disclose his source of planting material. Plants are to be delivered to site in the good, healthy and uninfected condition as at the nursery and handled at all times in such a manner as to prevent damage in transit.

5.09 PLANTING CONDITIONS

Planting shall not be carried out if the soil is very wet and waterlogged or during periods of adverse or extreme weather or windy conditions.

5.10 ADVANCED PLANT

(a) Plant sizes: Refer Planting Schedule.

(b) Handling: Plants with a root ball may have their roots partially exposed to facilitate handling. Handling of the large container grown plants may only be done with a tree trailer and they are to be removed from the nursery and planted in a prepared hole in one (1) operation.

No advanced trees shall be stored on site.

(c) Planting procedures advanced trees. Advanced trees:

1. Thoroughly moisten plant roots before planting and soak all container grown stock.

2. Dig hole of a sufficient size, with domed bottom of take root ball without

restricting the root diameter.

The Contractor shall provide a rate per cu metre for rock excavation in the Schedule of Works.

3. If the soil is very dry fill with water and allow to drain completely. 4. Cut back any roots that may have been damaged to healthy tissue. 5. Place fertiliser in the bottom of the hole and cover with soil to ensure

that is no contact between roots and fertilizer. 6. Planting: Spread roots of open rooted stock evenly in the hole. Do not

bend tree roots to fit the hole. Place the tree into the hole to match level as it is grown in the nursery. Place by tree trailer for advanced container grown stock.

7. Gently cover the roots with approved garden soil in layers of 150 mm

and compacted around the perimeter of the hole with the foot to ensure no air pockets and root ends bend downwards. Ensure roots are not pressed against the bottom of the hole due to too quickly back filling or lumpy soil.

5.10 ADVANCED PLANT (cont’d)

Advanced trees (cont’d): 8. Firm the soil gently with the foot to a level approximately 30 mm below

the surrounding soil surface level to create ‘watering-bowl’. 9. Staking: Allow to provide two (2) 50mm Belian pepper post stakes

per Advanced Tree, set a minimum of 450 mm apart to avoid root damage. Use approved ‘webbing’ type flexible ties to secure tree trunk stakes.

Advanced grass:

1. Thoroughly moisten plant roots before planting. 2. Dig hole of a sufficient size, minimum diameter 100 mm. If the soil is

very dry, fill with water and allow to drain completely. 3. Place turf block in the dug hole with the grass growing in about 100 mm

of soil. 4. For good early growth it is essential that the turf blocks be inserted into

the prepared planting bed. 5. Top soil is spread over the turf to partially cover the individual turf

blocks after the grass has been planted. 6. Water is to be applied to soaking proportion.

5.11 WATERING

All plants are to be thoroughly watered-in immediately and once daily. Thereafter for seven (7) days after planting and at such times during the Contract Period as is required to maintain growth free from water stress.

5.12 MAINTENANCE OF WORKS DURING DEFECT LIABILITY PERIOD

The Contractor is responsible to replace at own expense all losses of plant material due to nursery stock failure or improper horticultural care during construction and defect liability period. Programme to be carried out accordance to Schedule of Maintenance attached. (Refer Appendix B).

Section E – Special Specification

SECTION 6 - SUPPLY OF PLANT MATERIAL 6.01 GENERAL

All plant materials supplied shall correspond exactly with the species, varieties and sizes stated. All plant materials shall be well grown, healthy, well established nursery transplant of good form, stock and strain and furnished with a good fibrous root system. Where applicable they shall be furnished with straight sturdy stems and well branched heads.

6.02 SUBSTITUTES

The Contractor shall make no amendment to the items in the Summary of Tender. No substitutes will be made unless authorized by the Superintending Officer in writing on a fair and reasonable basis.

6.03 PLANT MATERIALS NOT TO SPECIFICATION

Any plants which do not, in the Superintending Officer’s opinion, meet with the Specification will be rejected and must be removed from the site and replaced with suitable approved materials. All plants shall be inspected prior to being planted. Plants shall be true to species have a well developed root system within the rootball and be free from pests and diseases generally, healthy and in good shape.

6.04 SUPPLY SIZE NOT TO SPECIFICATION

Plant materials which failed to conform to the specified size but are accepted shall be subject to a proportional reduction in cost price. The reverse however does not apply to plants which are bigger than Specification. Plants not meeting the size and height in the judgement of the Superintending Officer shall be removed and replaced upon order of the Superintending Officer. The plants shall be measured in their normal positions, but plants shall not be pruned prior to delivery except upon special approval by the Superintending Officer. Height of tree materials shall be measured from its first branch to the ground level.

6.05 POT GROWN PLANT

Pot grown plant shall not be removed from the pots until they are on site and the planting pits have been prepared.

6.06 STANDARDIZED NAMES

Plants names used in the schedule of planting materials should conform to the standardized plant names generally accepted in the Botanical terms.

6.07 INSPECTION

Plants shall be subject to inspection and approval by the Superintending Officer at the place of growth or upon delivery, for quality, size and variety. Such approval shall not impair the right of inspection and rejection at the site, during progress of work, for size and condition of ball or roots, latent defects or injuries. Rejected plants shall be removed immediately from the site.

Must be shown to prove no root bound condition. No container plants that have cracked or broken balls of earth when taken from the container shall be supplied except upon special approval by the Superintending Officer.

6.09 PLANT REPLACEMENT

Any plants found to be dead, damaged or missing through any cause whatsoever until the delivery/supply is completed shall be replaced at the Contractor’s expense.

6.10 TIME OF PLANTING

As plants arrive on site they shall be planted immediately in their prepared positions. Care shall be taken to ensure that as little disturbance as possible occurs to the roots of the plants and soil balls shall be kept intact during planting operations. Planting are advised to be carried out best in the early morning and evening.

6.11 WATERING

All plant materials shall be well watered in at the time of planting, unless conditions are such as to prohibit watering, in which cases they shall be watered at the earliest opportunity. All shrubs which are supplied with their roots balled or pot grown, shall be well soaked prior to planting. Frequent watering subsequent to planting is essential.

6.12 MINOR DAMAGE

Any roots, shoots or branches which have suffered minor damage prior to planting are to be carefully pruned. Plants showing more than minor damage will be rejected and must be replaced. In the case of trees, wounds exceeding 25 mm diameter must be treated with three (3) coats minimum of an approved sealant.

6.13 STAKING AND ITS MAINTENANCE

As and when the Superintending Officer directs, the Contractor shall ensure all stakes and the strings use to secure the plants to the stakes, must be properly maintained. Fallen stakes must be made upright again and broken or rotted one (1) replaced. The Contractor shall ensure the strings does not cut into the stems of the plants or cause the plants to bend.

When the plants are bigger and does not require staking the Contractor shall remove the stakes and dispose of form site as directed by the Superintending Officer.

This is a Lump Sum Contract. This Schedule of Rates shall only be used for ascertainment of prices for variations. Unless otherwise stated, the rates so set in by the tenderer shall deemed to include the cost of all preliminaries, all plants, equipment, labour, materials, transport, supervision, erection, insurance, overhead, attendance, profit and everything necessary for the completion and maintenance of each item of work in conformity with every aspect of the condition of contract, specification and drawings. The rates so set in shall be subjected to agreement with the Supervising Officer to ensure that they are reasonable and such agreement shall form part of the Contract. The Contractor is advised not to insert absurd and unrealistic rates. When called upon to prove and substantiate his rates, it shall be the duty of the Contractor to do so, failing which he will be considered not to have submitted a bona-fide tender.
