ARCHITECTS PROFESSIONAL
CONDUCT REGULATIONS
The Architects Professional Conduct Regulations are primarily for the guidance ofthe architects. In exercise of the powers conferred by Section 45 of the ArchitectAct, 1972, the council of architecture has published the regulations dealing withthe professional conduct which regulations are known as Architects( ProfessionalConduct) Regulations, 1989.
The object of the regulations is to provide a general standard to architects tofollow. It should be noted that these regulations relate only to offences of aprofessional character and does not include offences of a general nature whichshould be regarded as disgraceful.
The architect has obligations to the clients, to the public and to relatedprofessionals but most importantly he has obligations to the society.
The Council of Architecture also reviews the matter of the appointment and thefees of architects .

ARCHITECT AND
SOCIETY
An architect shall :
(i) ensure that his professional activities do not conflict with his general
responsibility to contribute to the quality of the
environment and future welfare of society.
(ii) apply his skill to the creative, responsible and economic development of his
country;
(iii) provide professional services of a high standard, to the best of his ability;
(iv) maintain a high standard of integrity
(v) promote the advancement of architecture, standards of architectural
education, research, training and practice;
(viii) when working in other countries, observe the requirements of codes of
conduct applicable to the place where he is working.

An architect shall:
(i) If in private practice, inform his client of theconditions of engagement and scale of charges andagree that these conditions shall be the basis of his
appointment
(ii) not sub-commission to another architect orarchitects the work of which he has beencommissioned without prior agreement of his client
(iii)not give or take discounts, commissions, gifts orother inducements for the introduction of clients orof work
(iv) act with fairness and impartially when administeringa building contract

PROFESSIONAL CONDUCT REGULATIONS
ON ARCHITECTS ADVERTISEMENT
An architect shall not advertise his professional services nor shall allow
his name to be included in advertisement or to be used for publicity
purposes save the following exceptions :-
(a)a notice of change of address may be published on three occasionsand correspondents may be informed by post.
(b)an Architect may exhibit his name outside his office and on a
building, either under construction or completed, for which he is or
was an Architect, provided the lettering does not exceed 10 cm. in
height
(c)advertisements including the name and address of an Architect
may be published in connection with calling of tenders, staff
requirements and similar matters.

(d)may allow his name to be associated with illustrations anddescriptions of his work in the press or other public mediabut he shall not give or accept any consideration for suchappearances.
(e)may allow his name to appear in advertisements insertedin the press by suppliers or manufacturers of materialsused in a building he has designed, provided his name isincluded in an unostentatious manner and he does notaccept any consideration for its use.
(f)may allow his name to appear in brochure prepared byClients for the purpose of advertising or promoting projectsfor which he has been commissioned.
(g)may produce or publish brochures, pamphlets describinghis experience and capabilities for distribution to thosepotential Clients whom he can identify by name and
position.
(h) may allow his name to appear in the classified columns ofthe trade / professional directory and/or telephonedirectory

ARCHITECT AND BROTHER
IN PROFESSION
An architect shall
(i) provide their employees with suitable working environment, compensate them fairly and facilitate theirprofessional development
(ii) recognize and respect the professional contribution of his employees,
(iii) provide their associates with suitable working environment, compensate them fairly and facilitate theirprofessional development
(iv) recognize and respect the professional contribution of his associates and the consultants.
(v) enter into agreement with them defining their scope of work, responsibilities, functions, fees and mode ofpayment
(vi) conduct himself in a manner which is not derogatory to his professional character, nor likely to lessen theconfidence of the public in the profession, nor bring architects into disrepute.
(vii) comply with Councils guidelines for architectural competitions and inform the Council of his appointmentas assessor for an architectural competition
(viii) not have or take as partner in his firm any person who is disqualified for registration by reason of the factthat his name has been removed from the Register under Section 29 or 30 of the Architects Act, 1972

(ix) compete fairly with other architects
(x) not attempt to obtain, offer to undertake or accept acommission for which he knows another architect hasbeen
selected or employed until he has evidence that the selection,employment or agreement has been terminated and he
has given the previous architect written notice that he is sodoing; provided that in the preliminary stages of works, theclient may consult, in order to select the architect, asmany architects as he wants, provided he makes paymentof charges to each of the architects so consulted
xi) observe and uphold the Council's conditions of
engagement and scale of charges
(xii) not supplant or attempt to supplant another
architect(xiii) not prepare designs in competition with other
architects for a client without payment or for a
reduced fee (except in a competition conducted in
accordance with the architectural competition
guidelines approved by the Council)

Schedule Of ServiceThe architect shall after taking instructions from client render the following services:
1. Site evaluation & analysis report with circulation, activity distribution & interaction
and external linkages.
2. Preliminary report on environmental impact of project and finalise it after discussion
with client stating measures for mitigating adverse impact.
3. Prepare approximate estimates and conceptual designs with reference to
requirements given.4. Modify conceptual design incorporating required changes and prepare prelim
designs & study model for clients approval along with revised estimate.
5. Prepare drawing required for submission to statutory bodies for sanction.
6. Prepare working drawings, specification & schedule of quantities sufficient to
prepare estimates of cost.7. Prepare a short list of contractors with apt justification.
8. Prepare working drawings including full scale details, detailed specifications &
schedule of quantities sufficient to invite tenders.
9. Submit complete working drawings & details sufficient to commence work at the
site.

10. Visit the site of work & provide periodic supervision to clarify any discussion or
interpretation of the drawings and specifications that may be necessary.
11. For frequent or constant supervision clerk of works shall be appointed by the
architect and shall be paid by the client or, may be employed by the architect, who
shall be reimbursed the cost of the said employment. The overall cost of the clerk
of works shall not exceed 0.5% of overall cost of project.
12. On completion of the work, the architect will prepare and submit two sets of as
built drawings (one set on reproduction prints) of the building and services.

Clients Responsibilities
The following shall be the responsibilities of the client:
1. Provide detailed requirements of the project.
2. Provide a correct site plan showing boundaries, contours, existing physical features
including any roads, paths, trees, existing structures and service & utility lines to
which proposed service can be connected.3. Furnish reports on soil conditions and soil test.
4. If the client is a government agency, it will furnish Public Works Department
schedule of rates, codes of practice and other documents pertaining to state.
5. Pay the fees of the architect within one month of submission of bills.
6. Take note of the observations made by the architect on his inspections & visits andensure the correction of deficiencies in the work.
7. On the advice of the architect prepare a short list of approved contractors and select
the contractors for the project in consultation with the architect.

STANDARD TERMS FOR
COMPREHENSIVE ARCHITECTURAL
SERVICES
1. Standard scale of fees is for comprehensive services including pre-design study,
architectural, structural, electrical and plumbing designs, air conditioning, heating,
acoustics and interiors. To ensure quality work, architects will be engaged only on
comprehensive services & partial services should be avoided.
2. The fee structure is based on tendered cost of the total project. Where whole or
part of the project is not executed, the fee will be on the cost calculated on
prevailing rates, i.e., market rates plus current tender percentage. The fee
structure takes into consideration any repetition in design work as well as total
volume of work and no reduction will be made on grounds of repetition or size ifproject.
3. It will be expected that housing units are not repeated more than a reasonable
number of times to promote sound and acceptable environmental standards. The
practice of developing standard designs & planning them all over the country will
be totally discouraged.

4. The services included in urban design will be pre design study, layout building
volumes and form and architectural controls. The fee shall be calculated on the
estimated cost on prevailing rates.
5. Pre design study shall include location and site analysis requirement analysis
and environmental impact assessment. The client shall also provide all the
possible assistance and data for the study in case of complex projects like hospital
where considerable research is involved such research will be additionally paid
for.
6. The mode of payment and other terms & conditions shall be as indicated in theappended standard Letter of Appointment which shall constitute the
agreement between the client and the architect.
7. It shall be the responsibility of the client to furnish accurate site survey details
described below and the architect shall be responsible for the time schedule only
from the date such details are furnished.
8. As part of the services, the architect shall, from time to time, certify that their
drawings are being correctly interpreted at site and the finishing is of acceptable
quality. In case of adverse certification, the payments of the contractor shall be
withheld until the defects have been rectified. In case the architect is required to
verify and certify the bills of contractors, additional fee of 1% shall be payable.

The above scale of fees is the minimum payable for services listed under scope of
work. Architects, depending on complexity are free to quote higher fees. Quoting
less fees and furnishing partial services would be detrimental to the project and
not in the interest of the client. If an architect has been accepting any job (except
those of social or philanthropic nature with intimation to COA) on low fees, thefirm maybe declared ineligible for any public work in future.

An architect carries responsibility on account of
the confidence placed in his judgement andintegrity.
The client expects the following basic skill in an Architect :
1. Knowledge of the techniques and skill required to carry out thedesign.
2. The purpose and function of building to be erected.
3. A working knowledge of Act, Bye-laws and other regulations.
4. The ability to advise on costs.
5. Skills in the preparation of drawing,plans and specification toensure that the building fulfill all requirements at the most
economic cost .
6. Ability to superintend the design and construction.
7. Ability to issue certificate of payment.

The council of architecture has precribed the condition of
engagement and the fees payable to architect.
The conditions cast a grave resonsibility on the architect to ensure
that the design evolved by him is capable of being built.
It is necessary that drawings must be complete and adequate for
the purpose , in general.
a. Standard size drawing and format.
b. Consistent scale , lettering , annotation, dimensioning,anddegree.
c. Subjects and formation should be grouped.
d. All required information should be given , without unnecessary
repetition and irrelevant information excluded.
e. Adequate cross reference and interrelation between drawings.f. Scale, in general to be 1:100 for main floor plans , elevation and
section . For detailed section and large scale details of critical
and special area , scale to be 1:50 and 1:25.

4. Sections through all major spaces scale 1:1005. Sections and larger details of all typical and special areas ; Scale 1:50
6. Large scale plans and section of stairs ,ramps and lifts : Scale 1:50
7. Large scale plans ,elevations and sections of toilets , kitchen, pantries,
showing fixtures , counters,tiles , Scale 1:50
8. Schedule of doors and windows and grills schedule of hardware.
