REVENUE BRANCH
5. REVISION OF ASSESSMENT LIST OF PROPERTIES UNDER SECTION 72 OF
THE CANTONMENTS ACT, 1924 FOR TRIENNIAL CYCLE W.E.F 1-7-2012 TO
30-6-2015
Reference: CBR No. 9 dated 30-03-2012.
To re-consider and approve the ne cessary revision of assessment list / triennial
assessment cycle under section 72 of the Cantonments Act, 1924 for the period w.e.f 1-7-2012 to
30-06-2015 keeping in view of the present inflation scenario of the country.
In this regard, it is pertinent to mention here that the triennial assessment was
lastly revised / enhanced vide CBR No.13 dated 6-6-2003 w.e.f 1-7-2003 as under:-
a. Residential properties 3%
b. Commercial properties 5%

Thereafter, the case for revision was again placed before the Board vide CBR
No.8 dated 5-4-2006 and the Board after lengthy deliberations resolved with consensus to
continue with the existing ARV for the triennial period w.e.f 1-7-2006 to 30-06-2009. The
assessment for the triennial cycle 2009-2012 had not been revised due to the following reasons:-
1. Recovery of TIP tax on all previous transactions by the last owner
2. Resentment of taxpayers due to shortage of water
Now the state of provision of water to the esteemed tax payers has been improved
due to addition of one new water connection from KW&SB. On the other hand, the rates / prices
of all utilities have been increased alarmingly and CBC is facing financial constraints in
delivering “the best” municipal services to its residents. Therefore the assessment list is required
to be revised as required under section 72 of the Cantonments Act, 1924.
The matter was placed before the Board in its meeting held on 30-03-2012 and the
Board vide CBR under reference deferred the same till next Board meeting.

RESOLUTION: Considered and approved the proposed revision. The existing assessment
of properties be enhanced @ 10% for residential properties and 15% for
commercial properties. However, the said increase shall neither be
applied to such properties which have been assessed on actual rent as per
rent agreement nor to such properties which have been assessed after
03-07-2010.
6. PUBLIC UTILITY CHARGES.
To consider the levy of Public Utility Charges within the jurisdiction of Cantonment
Board Clifton in addition to the existing taxes / charges as is being charged by the City District
Govt: Karachi in its area of jurisdiction through a Gazette Notification published in the official
Gazette of City District Govt Karachi. Per month rates of Public Utility Charges for each
category of property as mentioned in above quoted notification are reproduced hereunder for
perusal please.
In this regard, it is apprised that DML&C Karachi Region has forwarded the above
mentioned notification vide RHQ Karachi letter No. 3/739/DKR/ Vol:1/Genl/ dated 04th
April

2012 with the advice to place the matter before the Board for consideration. It is further apprised
that the Board is empowered under Section 60 of the Cantonments Act, 1924 to impose any tax,
which, under any enactment for the time being in force, may be imposed in any municipality in
the Province wherein such Cantonment is situated.

RESOLUTION: Considered deliberately and unanimously resolved that prior to impose
“Public Utility Charges” within Cantonemnt area, all aspects should be
discussed at length and recommendations of the committee, constituted
hereunder may be put up to the Board in its next meeting for appropriate
consideration:-

7. WAIVER OF WATER CHARGES.
Reference CBR No.29 dated 02-02-2012.
To re-consider an application submitted by the owner of sub-units of Ground Floor of
Property No.29-E, Kh-e-Jami, Phase-II Ext, DHA requesting therein for waiver / deletion of
water charges due to the reason that water connection does not exist at site. In this regard, it is
apprised that upon receipt of said application, the matter was referred to the Water Supply
Section of Engineering Branch for verification of existence of water connection at site or
otherwise. Now, the water supply section has reported that water connection does not exist at
site. Therefore, following amount of water charges are required to be deducted from the annual
bills of the said property:-

The said case was placed before the Board in its meeting held on 02-02-2012 and the
Board vide CBR under reference deferred the case. Relevant file is placed on the table for
consideration.

RESOLUTION: Considered at length and resolved that since water connections do
not exist at above sites and the demand was un-necessarily inserted
in the Computer, hence all such entries be deleted from the
computer.

8. DECISION UNDER SECTION 84 OF CANTT. ACT, 1924 APROPOS
RE-ASSESSMENT TO PROPERTY NO.M-65/I, KH-E-ITTEHAD,
Reference CBR No.16 dated 21-11-2011 & No. 26 dated 02-02-2012.
To re-consider the decision of Appellate Officer DML&C, Karachi Region Karachi in
respect of the assessment / reassessment of subject property. The property in question was
assessed on 27-12-2010 from the retrospective date i.e. 16-06-2003 by the assessment
Committee in its meeting held on 27-12-2010. The proposed annual rental value of Rs.4,18,400/-
was calculated on the existing approved rates and conveyed to the owner. The owner accordingly
field objection, which were considered and ARV finalized by the Assessment Committee @
Rs.3,00,000/-
Considering dissatisfied, the owner filed an appeal under section 84 of Cantt.
Act, 1924 before the Appellate authority i.e. the DML&C. Parawise comments were asked by
the Appellate Authority which were forwarded accordingly and the Appellate Authority i.e. the
DML&C, Karachi passed an order dated 27-08-2011 said authority, which is reproduced
below:-
“It is settled principal that taxes cannot be levied by applying rates of current
year with retrospective effect, Hence, the Board is directed to re-assess the
property by applying the rates on the yardstick of 2002 with sliding scale up to
2010”
The said case was placed before the Board in its meeting on 21-11-2011 and the
Board vide CBR No.16 considered and discussed in detail and decided to put-up the said case in
next meeting alongwith financial impact due to the decision of the Appellate Officer. The
requisite financial impact is as under:-

The said case was again placed before the Board in its meeting held on 02-02-
2012 and the Board vide CBR No.26 considered and deferred.

RESOLUTION: Considered and remanded the case to the Assessment Committee for
re-consideration the assessment of Property No.M-65/I, Kh-e-
Ittehad, DHA Clifton Cantonment, Karachi as per orders of the
Appellate Authority.

9. AMENDMENT / ADDITION / ALTERATION IN NOTIFICATION – TAX ON
BOARDS ON SHOPS.
Reference CBR No.38 dated 23-02-2012.
In continuation to CBR referred to above; to consider the final settlement of proposal for
making amendment/addition/alteration in Notification No.571/66 dated 22-04-1966 pertaining to
the tax imposed upon shops on installation of sign boards, as required under sub-section 3 of
Section 63 of the Cantonments Act, 1924.
In this regard, it is apprised that the said proposed amendment / addition /
alteration has been approved by the Board vide CBR under reference with the direction to
process the case further under section 61 & 62 of the Cantonments Act, 1924 for publication of
notice in daily newspapers for inviting objections and thereafter forwarding the case to the
Federal Govt: through ML&C Deptt: for publication of notification in the Official Gazette. In
compliance of the direction, the said amendment / addition / alteration has been got published in
following newspapers for inviting objections:-
a. Daily Dawn dated 26-03-2012
b. Daily Jang dated 23-03-2012
c. Daily Awami Awaz (Sindhi) dated 23-03-2012
In this regard, it is necessary to mention here that the said publication was
uploaded at the official website of Cantonment Board Clifton www.cbc.gov.pk and also pasted
at the Notice Board of the CBC office for vide publicity. No objection from any inhabitant has
been received within stipulated period of 30 days.
Proposal alongwith following documents are placed on the table for perusal and
final settlement of the Board:-
i. Existing Notification No.571/66 dated 22-04-1966
ii. Proposed amendment / addition / alteration

RESOLUTION: Considered at length and approved subject to fulfilment of all legal
formalities/procedure. Draft Notification be sent to the competent
authority for publication in the Official Gazette of Pakistan.
10. AMENDMENT / ADDITION / ALTERATION IN NOTIFICATION – TRADE
AND PROFESSION TAX.
Reference CBR No.63 dated 28-07-2011 & CBR No.25 dated 02-02-2012.
In continuation to CBR referred to above; to consider the final settlement of proposal for
making amendment/addition/alteration in Notification No.903 dated 13-04-1946 amended vide
Notification No.1871/71 dated 28-08-1971 pertaining to the Trade and Profession Tax as
required under sub-section 3 of Section 63 of the Cantonments Act, 1924.
In this regard, it is apprised that the said proposed amendment / addition / alteration has
been approved by the Board vide CBRs under reference with the direction to process the case
further under section 61 & 62 of the Cantonments Act, 1924 for publication of notice in daily
newspapers for inviting objections and thereafter forwarding the case to the Federal Govt:

11. DELETION OF WATER CHARGES
To consider an application dated 19-10-2011 diary No.12445 submitted by
Mr. Muhammad Salahuddin owner of property No.20-C, Hall No.2, Ground Floor, Ittehad Lane
No.12, Phase-II, for deletion of wrongly entered water charges @ Rs.28,620/- upto 30-06-2012.
Water connection does not exist in said building as reported by Water Supply section of
Engineering Branch.
All necessary documents are placed on table.
RESOLUTION: Considered at length and resolved that since water connections does
not exist at above sits and the demand was un-necessarily inserted in
the Computer, hence such entry be deleted from the computer.
SANITATION BRANCH
12. INSURANCE CBC VEHICLES
Reference CBC letter No.CBC/Sanitation/2258 dated: 26-03-2012 & NICL
letter No. 132/NICL/03 dated: 29-03-2012.
To consider & approve payment of Rs. 3,06,469/- to M/s. National Insurance Company
Limited on account of payment of comprehensive insurance for the period 26-03-2012 to
25-03-2013 in respect of CBC vehicles as per details below:-

for the period from 26.03.2012 to 25.03.2013 from M/S. National
Insurance Company Limited against payment of Rs.306469/- is approved.

13. GRANT OF ASSISTANCE PACKAGE OF RS. 2,00,000/- TO THE FAMILY OF
DECEASED, MUHAMMAD NADEEM, EX-ENGINE DRIVER, CBC.
To confirm the action taken by the Executive Officer under section 25 of the
Cantonments Act, 1924 (II of 1924) for the grant of Assistance Package of Rs.2,00,000/- to the
bereaved family of Late Muhammad Nadeem S/o Abdul Razzak, Ex-Engine Driver of
Cantonment Board Clifton , who met an accident while performing official duties and expired on
the same date i.e. 17-04-2012.
The Assistance Package has been granted according to Government of Pakistan,
Establishment Division, Islamabad O.M No. 7/10/2005-E-2 dated 13-06-2006.

SAWAB & BROTHERS
To consider & approve the report of IWMP CBC on account of extension of Conservancy
Agreement upto 15.08.2012. It pointed that conservancy contract (Beach) is expiring on
30.06.2012. All conservancy contracts, other than that of Beach are renewed in August every
year. For facilitation / simplification Beach contract may also be renewed in August, 2012
alongwith all other conservancy contracts. However, the existing Beach contract may be
extended upto 15.08.2012 at the existing rates i.e. Rs.12,84,000/- per month.

vogue CBC is collecting 100% charges against vetting of each commercial building as per detail
given below, thereafter CBC refund the payment of 75% to registered Vetting Engineer after
receipt of bill from the concerned vetting engineer and retained 25% infavour of this office.

Now this prevailing lengthy / time taking procedure as mentioned above created several
ambiguities / uncertainty towards lessees / owners / builders and the registered vetting engineers
of this office due to refund of vetting charges / fees.
In view of above circumstances and to facilitate the lessess / owners and vetting
engineers, it is suggested that in future CBC may collect only 25% of the vetting fee and
remaining fee of 75% may please be paid directly to the concerned vetting engineer suggested by
this office by the lessee / owner / builder.
All connected papers are placed on the table.
RESOLUTION: Considered and resolved that advice may be obtained from the
Regional HQ Karachi for raising the vetting charges as proposed.

Later on, the Lessee applied for refund of Rs. 1,03,800/- stating therein that road and
ramp cutting was not done as already laid pipe duct was used and only berm cutting was
involved. In order to verify the statement of the lessee, the KESC was approached vide CBC
letter No. CBC/SCE-I/547/2012 dated: 07th
Mar, 2012 to clarify the position on ground. In
response, M/s. KESC Ltd. vide their letter no. PR2/2K8/DEF-76/5092 Dated: 14th
Mar, 2011
endorsed the statement which is reproduced hereunder:-
“in this regard we would like to inform you, during execution of above
scheme as per drawing no. HT/SA 8231-B Dt: 07-12-2011, our underground
department observe that across the road Hume pipe are already exist under
the road, therefore underground department laid the HT cable inside the
Hume pipe without any road cutting. Hence no road cutting was involved in execution of the said scheme”.

To correct amount of composition fee of Rs.8,20,91,728/- @ 17/% imposed by the Board
vide CBR, referred to above, on the total cost of construction plus cost of land, whereupon
unauthorized construction was carried out by M/S Bahria Foundation. It is pointed out that due
to �ypographical mistake composition fee was erroneously typed Rs.82,09,728/- instead of
Rs.8,20,91,728/- .

3/654/DKR/General / 40 dt: 10-05-2010 regarding composition cases involving violations /
deviations for regularization under section 185 of Cantonments Act 1924. wherein the worthy
DGML&C, has verbally directed the DML&C, Karachi to ask CEO, CBC to process all cases of
composition, In case it is decided to remit the amount retained by DHA Karachi on account of
composition fee to Cantonment Board Clifton. then such decision of Ministry of Defence will be
binding upon the DHA Karachi. DHA has remitted composition fee against each case as per
detail given below.

3/654/DKR/General / 40 dt: 10-05-2010 regarding composition cases involving violations /
deviations for regularization under section 185 of Cantonments Act 1924. wherein the worthy
DGML&C, has verbally directed the DML&C, Karachi to ask CEO, CBC to process all cases of
composition, In case it is decided to remit the amount retained by DHA Karachi on account of
composition fee to Cantonment Board Clifton. then such decision of Ministry of Defence will be
binding upon the DHA Karachi. DHA has remitted composition fee against each case as per

In reply of this office letter referred above, DHA returned the case vide their letter
referred above dated 09-09-2011 with the observation that excessive covered area of ground
floor to stair tower is already permitted / granted vide DHA letter letter No.
DHA/TP&BC/SSI/WL-1942 dated 13-01-2011. However, it is relevant to mention that in similar
nature cases, of property No. 8-C/I & 6-C, Ittehad Lane-12, Ph-II-Ext, was forwarded to RHQ
Karachi whereby same returned vide letter No. 6/141/DKR/Clifton /26 dt: 26-08-2011 with the
observation that “Why DHA has approved full mezzanine floor against 1/3 Mezzanine floor
without compounding it, the matter may be placed before the board explaining full detail
of the case and any deviation from approved plan be compounded and concurrence be
obtained as required under section 185 of Cantonment Act 1924.”

building submitted by the lessee Mr. Saleem Jangda. In this context, it is relevant to mentioned
that the proposed building plan was forwarded by DHA vide their letter No. DHA/ TP&BC/ SSI/
WL-1693 dt: 02-12-2008 comprising Basement + G + 1st to 5
th Floor thus this office approved
only Basement + G + 1st to 4
th Floors vide this office letter No. C-19-C, Kh-e-Nishat/460 dated

It is pertinent to mention that scrutiny fee & betterment charges had been
recovered from the lessee including 5th

2010 regarding grant of NOC from municipal point of view to the proposed amalgamation of
plot No. 29/IV, & 29/III, Kh-e-Muslim, PH-VI, DHA, measuring 450 Sq. Yds. and 550 Sq. Yds.
into one plot measuring 1000 Sq. Yds. The DHA vide letter No. DHA/TP&BC/A-14382
dt: 04-10-10 has forwarded the case for amalgamation. The case was placed before building
committee in its meeting held on 09-02-2011 building committee resolved as under:-
“After amalgamation, the plot will automatically fall in the
category of 1000 Sq. Yds and thus the exiting structures over these
plot, constructed as per 450 & 550 Sq. Yds category will violate the
bye-laws pertaining to the plot size 1000 Sq. Yds. It is therefore
recommended to ask the lessee to do the needful in this regard
before processing of amalgamation.”
Thereafter the case was placed before Building Committee in its meeting held on 05-05-
2011 and the Committee resolved as “ To ask the owner to come in person before the next
Building Committee meeting”

In this connection, its is relevant to mentioned that the subject case was placed before
Building Committee meeting as 4th
time and the Building Committee held on 22-02-2012
recommended as under:-
“Relaxation in terms of parking may be extended vide Para 39(b) of building bye-
laws. The emergency exit steps may be allowed in the rear COS vide Para 2. XXII of
Building Bye- Laws.”
Consequently, the case was placed before Board in its meeting held on 23-02-2012 and
Board in the light of instructions of RHQ letter no. 3/433/DKR/Vol:3/Genl/138 dated
22-02-2012 resolved the case vide CBR No. 13(H) dated 23-02-2012 as under:-
“Considerd and discussed at length. It was decided to refer the case to RHQ for
vetting and then building plan be placed before the Board meeting.”
Now, the RHQ vide letter no. 3/433/DKR/Vol:3/Genl/139 dated 08-03-2012 directed that

following tour notes of the worthy DGML&C made during the visit of Karachi Region vide item

“In order to handle the legal matters prudently, the DG ML&C agreed with the
proposal of DML&C Karachi for appointing Law Officer against the vacant slot
at RHQ by the Cantonment Board Clifton and its placement at the disposal of

as MEO Hyderabad on requirement basis. This arrangement will be contained

53. WIDENING /RE-CARPETING OF “P” STREET BETWEEN KH-E-RAHAT AND
KH-E-SEHAR PH-VII, ESTIMATED COST RS.4.68 (M)
Ref:- CBR No.10, S.No.(iii), dated 29.9.2011
To consider the physical dimensions of “P” Street in between Kh-e-Rahat & Kh-e-Sehar
provided by DHA vide letter No.DHA/TP&BC/104-Gen, dated 25.4.2012 wherein the total
width of carriage way has been restricted to 40’-00”.
In this context, it is mentioned that on the request of the residents of the subject area
regarding widening / Re-carpeting of “P” Street in between Kh-e-Rahat & Kh-e-Sehar Ph-VII
DHA, this office prepared an estimate and got approved from the Competent Authority vide
DML&C letter No.6/14/DKR/2011-2012/Clifton/08, dated 6.9.2011with estimated cost of
Rs.4.68 (M). After completion of codal formalities this office issued work order to M/s. A.H
Warsi & Sons vide W.O No.CBC/CCE/7334, dated 3.10.2011 to complete the work within 100
days
The original estimate includes:-
� Nature of proposed road : Dual Track
� Length of road : 1100’-00”
� Width of each track : 20’-00”
� Pipe Drain in Center median : 1100’ feet
Immediately after commencement of work at site, the DHA Vigilance staff stopped the
work on the directives of Director TP&BC. This exercise remained continuous for so many days.
Consequently, the Engineering Staff of this office Coordinated with DHA counterparts
wherein CBC stated that Existing width of the road at site 67’-00” (average) but as per DHA

stance, only 40’-00” is reserved for road and remaining 27’-00” feet is DHA land whereas as per
site on one side, the road is running along the building line of the banglows. On other side on
strip of 27’-00” is lying idle in b/w the edge of the existing road and the building line.
Now the DHA vide their letter No.DHA/TP&BC/104-Gen, dated 25.4.2012 alongwith
site plan of P-Street b/w Rahat & Sehar wherein marked width of Road as 40”-00” and also
marked remaining 27”-00 feet DHA Land.
