2015 CONFERENCE HighlightsLEGISLATIVE UPDATE: Attorney Russell Hollrah of Hollrah LLC

This session will provide an overview of the most significant legislative, regulatory and legal developments affecting caregiver registries – at the federal and state level – and discuss strategies for responding to them by PCA and by individual registries. The session will

include an update on the general regulatory climate affecting caregiver registries and on any pending litigation involving registries.

Russell A. Hollrah is an “AV” rated attorney with a national practice dedicated to employee-benefits, employment taxes, and the specific application of those laws to contingent workers, such as independent contractors and leased employees.

Maury Baskin, Shareholder, Littler Mendelson, Washington, DC. Baskin is lead counsel representing the home care industry in the case of Home Care Association of America et al. v. Weil challenging the DOL’s proposed changes to the companionship and live-in exemptions.

Angelo Spinola, Shareholder, Littler Mendelson, Atlanta, Ga. Angelo is a leading practitioner in the home care and home health care field, advising numerous home care agencies and registry clients on compliance issues under both federal and state law and litigating cases on their behalf.

On behalf of several industry associations, Littler Mendelson led the challenge to the DOL rule that would have prevented third-party employers from availing themselves of the companionship and live-in exemptions from minimum wage and/or overtime and that would have narrowed

the definition of “companionship services” exempt from minimum wage and overtime under the Fair Labor Standards Act. A federal judge granted Littler’s motions to vacate the DOL rule, and consequently, the Court effectively blocked all of the DOL’s attempts to eliminate the federal minimum wage and overtime exemptions for home care aides. The DOL has appealed these decisions, and a decision is expected in the near future.

Baskin and Spinola discuss the impact of the Court of Appeals’ decision and update the status of the litigation, any potential appeal to the Supreme Court and the impact the current status of the litigation has on the registry model. They will review the most common areas of risk associated with registry models and ways to mitigate risks based on the current state of the law.
