The programs and services offered initially and criteria for adding programs and services; d. The initial service area and the line extension policy; e. The time for construc- tion; f. Customer service policies and system testing. g. The legal, technical, and financial qualifications of the applicant; h. The proposal for community services, including public, educational, and govern- mental access and/or institutional network services; and i. Other factors deemed relevant by the Town. In no event will submission of a conforming application entitle any applicant to grant of a franchise and the Township expressly reserves the right to reject both conforming and non- conforming applications. Any applicant(s) selected by the Town Board will be required to accept the Franchise granted within thirty (30) days after adoption. ISSUANCE OF A CABLEFRANCHISE

Notice is hereby given that it isthe intent of the Board of Supervi-sors of Credit River Township, Min-nesota, to consider issuance of afranchise authorizing operation ofa system to provide cable service inthe Township. This notice is givenin accordance with Minnesota law.

Any person seeking to providecable service must submit an appli-cation. Copies of the official appli-cation instructions are availableupon request at the Town Hall lo-cated at 18985 Meadow View Boule-vard, Prior Lake, MN 55372, tele-phone (952) 440-5515.

Applications in response to thisNotice must be submitted to theTownship by 11:00 a.m. on Decem-ber 17, 2009 at the Town Hall andcomply with the official applicationinstructions.

Applications must be in writ-ing, notarized, and consistent withthe application instructions. Ap-plicants submit an original and tencopies of the application. A copy ofthe application must also be mailedor delivered to Robert J.V. Vose,Esq., Kennedy & Graven, 470 USBank Plaza, 200 South Sixth Street,Minneapolis, MN 55402.

Each application shall be sub-mitted along with an applicationfee of $2500.00 in the form of a certi-fied check made payable to theCredit River Township, Minnesota.

The minimum system designand services to be offered must meetor exceed those required of the in-cumbent cable operator, MediacomMinnesota, pursuant to the Town’sexisting cable franchise. The de-sired design includes a system: serv-ing the entire Town based on a rea-sonable service area/line extensionpolicy; capable of delivering in ex-cess of 100 video programmed chan-nels with the potential for increas-ing channels; providing a reason-able number of public, educationaland governmental access channelsand reasonable access support, and;providing connections and free ser-vices to the Town Hall. Desired op-erations and services include: rea-sonable rates; a mix, level and qual-ity of programs and services com-parable to other systems, and; cus-tomer service and system mainte-nance plans to ensure the provisionof the high quality services to thesubscriber.

Factors that will be consideredin evaluating applications and mak-ing determinations are as follows:a. The completeness ofapplications;b. The proposed systemdesign;c. The programs andservices offered initially andcriteria for adding programs andservices;d. The initial service areaand the line extension policy;e. The time for construc-tion;f. Customer servicepolicies and system testing.g. The legal, technical, andfinancial qualifications of theapplicant;h. The proposal forcommunity services, includingpublic, educational, and govern-mental access and/or institutionalnetwork services; andi. Other factors deemedrelevant by the Town.In no event will submission of aconforming application entitleany applicant to grant of afranchise and the Townshipexpressly reserves the right toreject both conforming and non-conforming applications.Any applicant(s) selected by theTown Board will be required toaccept the Franchise grantedwithin thirty (30) days afteradoption.
