This purse is paid to the Nominators of stallions when a stallion’s offspringplace as shown below in the NRCHA Stakes. A Nominator is the person who pays upa Stallion’s offspring in the NRCHA Stallion Stakes for a specific foaling year.

A payment is made for a specific foaling year of a stallion’s offspring makingthem eligible for the NRCHA Stakes and the NRCHA Yearling Sale Purse.

A person other than the owner of a stallion can be the nominator of a stallion ifthey have a notarized “Permission to Nominate” form signed by the stallion owner onfile with the NRCHA.

Any three year old finalist in any division of the 2010 NRCHA Futurity may enterthe Performance Horse Sale as a suppplemental entry. The horse must be entered inthe Sale no later than 5:00 p.m. Thursday, September 30, 2010. The supplementalentry will pay the consigment fees, commission and repurhase fees as stated in thecontract. Futurity Finalist Supplement entries will be given unique Hip numbersand will be offered between the 2 Year-Old Sale and the Performance Horse Sale.

Each year Ward River Ranch donates the NRCHA Futurity Raffle Colt. Half ofthe raffle proceeds are used to sponsor the NRCHA 2 Year-Old Sale Purse. Thismoney, plus $150 from the entry fee of each NRCHA Select 2 Year-Old Saleentry are combined to make the NRCHA 2 Year-Old Sale Purse. NRCHAguarantees that the NRCHA 2 Year-Old Sale Purse will be at least $30,000. Onlyentries which sell and change ownership are eligible for the NRCHA 2 Year-Old Sale Purse. NEW - Consignors of the NRCHA 2 Year-Old Sale PurseIncentive winners will receive $1,500 for Open and $500 for the Non Pro fromthe Select 2 Year-Old Sale Incentive Purse funds. After the Consignor purse ispaid, the balance of the purse will be paid in the following manner: 70% to thehighest advancing 2010 Select 2 Year-Old Sale entry in the 2011 NRCHA OpenFuturity Preliminaries; 30% to the highest advancing 2010 Select 2 Year-Old Saleentry in the 2011 Non Pro Futurity Preliminaries. A horse sired by a stallion that was subscribed for the year it was foaled is NRCHAStakes Eligible and can show in the NRCHA Stakes as a 4 or 5 year-old.For Subscribed Stallions go to www.NRCHA.com.

For yearlings that are eligible for the NRCHA Stakes and actually sell to a newowner in the 2010 Select Yearling & Broodmare Sale or the 2010 Classic Yearling& Broodmare Sale. A nomination fee of $250 will pay the yearling up for theYearling Sale Purse. The $250 payment may be paid by the consignor prior to theSale or the buyer may pay after the purchase, however the payment must be madeno later than October 3, 2010 (the last Sunday of the NRCHA Futurity). TheAdded money, plus the nomination fees, will be paid to the highest advancingeligible 3 year old in the 2012 NRCHA Open Futurity Preliminaries.

All “RETURNED CHECKS” will be immediately turned over to the County DistrictAttorney’s Office for collection and charges. Cost of collection, including attorney’sfees, will be assessed to the buyer. In addition, there is a $50.00 charge for anyreturned checks.

Examine horses before bidding: Veterinary assistance is available at bidder’sexpense on request to the sales company. Please contact Equine MedicalAssociates, Inc. (sale veterinarian) through the sale office.

Acknowledgement of Purchase: After making the final bid on a horse, you mustcomplete and sign the Acknowledgement Of Purchase form. Be sure to confirm thecorrect hip number and price before you sign. Please print your name and addressclearly since this document is used for the AQHA, APHA & NRHA transfers,invoicing, and in publishing sale results.

Engagements: unless announced otherwise, all eligibility payments due after dateof sale are the responsibility of the buyer, who should promptly notify the properassociations of the new ownership in order to receive direct billing andinformation.

Announcements: to avoid making costly errors, please pay attention to allannouncements made from the sales office and the auction stand, especiallyconcerning horses on which you intend to bid.

Information in this catalog other than that provided by NRCHA, AQHA, NCHA,NRHA or djj Pedigrees LLC has been provided by the consignor or other thirdparty. Care of horses after sale: please be reminded that at the fall of the hammer thepurchaser assumes all risk and responsibility for the horse and must assume thecare of the horse once it is returned to the stall.

All horses must be removed from the sale premises by noon Monday, October 4,2010.

ALL SALES OR TRANSACTIONS FOR HORSES ENTERED IN THIS SALEMUST BE REPORTED TO AND MADE THROUGH THE SALE OFFICE.

Nevada Sales TaxNevada Sales Tax of 7.725% will be charged and added to the purchase priceof all horses purchased except those with documented exemption claims.

In order to qualify for exemption from Nevada Sales Tax the buyer must sign aresale certificate and must also present to the auctioneer a copy of a sales taxpermit or resale permit issued by the Nevada Department of Taxation (NDT) ortheir home state. This documentation is required to be copied and retained bythe auctioneer / NRCHA, and must be valid as of the date of purchase. If thebuyer’s home state exempts the sale of horses from sales tax, then the buyermay qualify for exemption by completing an affidavit that the purchase is be-ing made for resale in the normal course of business in their home state, andthat their home state does not tax the sale of horses. To qualify for exemptionat the time of settlement, this documentation must be presented before buyersettlement.

If specified documentation is not presented to the auctioneer before settlementof the Horse Sale, sales tax will be charged and must be paid. If valid docu-mentation is received at the NRCHA Office no later than October 12, 2010, thebuyer will qualify for consideration of exemption from Nevada Sales Tax andthe NRCHA will issue a check for a refund of taxes paid.

MULTIPLE EMBRYOS. Since the American Quarter Horse Association(AQHA) rule change allowing more than one foal (multiples) to be registeredout of a mare in the same year, it is not possible for the AQHA, NRCHA, theSale Company and/or the Sale Catalog Company to know how many live foalsa mare has produced each year. PLEASE NOTE: the fact that a foal is anembryo transfer does not necessarily mean it is one of multiple foals. The factthat a foal was born naturally out of a mare does not necassarily mean it is asingle foal. Neither the Sale Company nor the Sale Catalog Company will beheld responsible for providing information as to multiple embryos (foals of thesame year) and/or embryo transfers out of mares or dams in sale; nor willeither be held liable in any way for buyer’s belated awareness of suchinformation. Embryo Tansfer status of sale entries may be announced at thesale.

National Snaffle Bit Futurity SalesFIRST - The 2010 NRCHA Snaffle Bit Futurity Sales are held in conjunction with

the National Reined Cow Horse Association Snaffle Bit Futurity Show. Buyerhereby acknowledges that The National Reined Cow Horse Association,hereinafter referred to as “NRCHA”, and Professional Auction Services. Inc.are not responsible for the warranties of the Consignor. Hereinafter, theNRCHA Sale Committee and Professional Auction Services, Inc., collectively,shall be referred to as “Sale Management”.

SECOND - Horses are offered for sale according to the laws of the State ofNevada. Rights of consignors to bid are reserved unless otherwise an-nounced.

THIRD - THE BUYER HAS THE RESPONSIBILITY TO EXAMINE HORSESBEFORE BIDDING. Horses entered in the NRCHA Snaffle Bit Futurity Saleswill be available for inspection. Bidders are encouraged to have a veterinar-ian perform a pre-purchase examination on any horse they may considerbuying.

FOURTH - There is no warranty expressed or implied by NRCHA, Sale Manage-ment, Professional Auction Services, Inc., auctioneer, sponsors, owner orConsignor, as to the performing soundness, merchantability or fitness forany particular purpose of any horse offered in this sale, other than thosemade specifically by the consignor. All horses are sold “AS-IS” with allexisting conditions and defects, except as set forth below in conditionsFourteenth or Fifteenth.

FIFTH - Terms of sale are cash and payment in full must be made within 30minutes of the completion of the session in which the horse sells or Buyermust notify Professional Auction Services, Inc. that payment will be madewithin 30 minutes of the completion of the last session of the Sales. Absen-tee and Online Bidders must pre-register and make advance arrangementswith Professional Auction Services, Inc. Pay the cashier in all cases. Methodof payment shall be Cash, Cashier's or Certified Check, Personal Check (withproper bank letter of guarantee or introduction and picture identification,such as driver's license), Traveler's Checks or MasterCard or Visa. Foreigncredit cards cannot be accepted. No bank drafts. Checks must be madepayable to NATIONAL REINED COW HORSE ASSOCIATION or NRCHA. ABuyer's Premium of 5% will be added to the purchase price. The Buyer'sPremium will be discounted for the part of purchases paid by cash or check.In no case shall the Buyer pay any part of the purchase price directly to theconsignor, as such payment shall not be valid or entitle the buyer to obtainthe horse. Foreign Buyers must pay with a check drawn on a U.S. Bank,American Currency or International Money Order. Buyer agrees not to stoppayment on check for any reason. A fee of $50.00 will be charged on anycheck that is returned.

SIXTH - NEVADA SALES TAX of 7.725 % will charged on all purchases and willbecome a part of the purchase price, unless the Buyer has complied with therequirements for documented exemption claims. See additional informationin this catalog.

SEVENTH - IF ANY PERSON SHALL PURCHASE A HORSE AND NOT PAY FORIT AS PRESCRIBED ABOVE, the Sale Management or Consignor shall havethe right to resell the horse, or at their option, bring legal action in whichevent buyer agrees to pay all cost of such suit together with reasonableattorney fees as fixed by the court. In the event of resale the defaulting buyeragrees to pay all costs of resale and price deficiency, if any. Interest of 1-1/2% per month will be charged on the unpaid balance of any account not paidfor as set forth in these conditions.

EIGHTH - Bidding Procedure: The person making the highest bid recognized bythe Auctioneer shall be the buyer. The Auctioneer shall immediately presentthe buyer with a document entitled Acknowledgement of Purchase forsignature. Should such presentation not be made prior to commencement ofbidding on the next lot offered, the buyer shall forthwith identify himself/herself to auctioneer as buyer and sign Acknowledgement of Purchase. In theevent that a person other than the recognized buyer signs theAcknowledgement of Purchase, such action shall not give such other personany right or title, and immediately that such erroneous signing of theAcknowledgement of Purchase becomes known to the auctioneer, he shallcause the Acknowledgement of Purchase to be presented to the recognizedbuyer for signature. If the highest bidder fails to immediately execute theAcknowledgement of Purchase or otherwise fails to comply with the Condi-tions of Sale, or in the event of a mistake by the Auctioneer, Sale Manage-ment reserves the option to re-sell the animal and such resale shall terminateall obligations of Sale Management and Consignor to honor any bid. TheAuctioneer has the right to decline any bids made by parties who havedefaulted in former purchases or by persons, who in his judgment, are notresponsible bidders.

NINTH - Ninth - Absentee bidders must make arrangements with ProfessionalAuction Services, Inc. prior to the auction. Funds in the amount of theanticipated high bid must be received by check made to NRCHA or bank wiretransfer to NRCHA before bids will be placed on a horse. Credit cards willnot be accepted for absentee bids unless prior arrangements have beenmade.

TENTH - BUYERS ASSUME ALL EXPENSES AND RISKS ON HORSES AFTERTHEY HAVE BEEN STRUCK DOWN TO THEM. Upon receiving payment forthe horse the cashier will be issue a two-part receipt to the Buyer. Buyermust present the pink copy of the receipt to Sale Management or security, ifrequested, at the time the horse is removed from the grounds. All horsesmust be removed from sale grounds by Noon of the day following the lastday of the NRCHA Snaffle Bit Futurity Show. Failure to remove the horse forany reason will obligate the buyer to pay all costs associated with board andtransportation of the horse. Buyer is responsible for the care of the horseimmediately after bidding.

ELEVENTH - All registration papers will be withheld by the sale managementuntil all checks clear the bank (approximately 21 days) at which time they willbe mailed, with completed transfer reports to AQHA for Quarter Horses andto the buyer for other registries. NOTE: If any buyer desires to obtain papersimmediately, horses must be paid for with cash or cashier's check.

TWELFTH - Every effort has been made to assure correctness of the catalogbut NRCHA, Professional Auction Services, Inc., Sale Management andauctioneers are not responsible for errors or omissions and assume noliability on the part of the seller as to any such statements, either verbal orwritten, regarding horses sold. All statements and corrections at the sale willsupersede the catalog.

THIRTEENTH - NRCHA, Professional Auction Services, Inc., Sale Management,auctioneers and staff do not act for or represent the buyer or seller, butmerely provide a medium for bringing together the buyer and seller for thepurpose of sales transactions. NRCHA, Professional Auction Services, Inc.,Sale Management and sales personnel assume no responsibility whatsoeverto anyone for blemishes, defects, the physical condition or health of anyhorse and makes no warranties or representations of any kind in the sale.The Consignor hereby specifically waives all implied warranties of fitnessand merchantability. All responsibility FOR REPRESENTATIONS lies betweenthe consignor and the buyer.

FOURTEENTH - Broodmares are guaranteed only to be bred to stallions asindicated. No guarantee is made of pregnancy status or eventual foalingunless made specifically by consignor. No return privileges or live foalguarantees accompany mares unless stated by consignor with proof inwriting of such agreement issued by stallion owner. Each broodmare sellingas bred to a stallion will have been examined by a veterinarian within 10 (ten)days of the Sale Date and reported at the sale as “in foal”, “open” (whichshall mean not in foal), or “bred” (meaning an insufficient amount of time haspassed to determine pregnancy). Any purchaser of a broodmare sold in thissale may have the mare examined by an acceptable veterinarian within 24hours after the start of the session in which the horse sells and before thehorse leaves the sale premises. Any broodmare so examined whose preg-nancy or breeding soundness status is found not to be as represented at thetime of sale, may be returned to the consignor as unsold, and the consignorshall pay veterinarian's fee for examination.

FIFTEENTH - If buyer finds a horse to be significantly lame (1 out of 5 or greaterby AAEP Standards) within 24 hours of the start of the Sale session in whichthe horse sells and prior to the horse leaving the Reno Livestock EventsCenter, the buyer must notify Sale Management by a statement from the SaleVeterinarian. Broodmares and horses represented only as breeding stockare exempt from the Lameness Warranty. The Sale Veterinarian shall state indetail the results of the examination. Examination and related expenses shallbe at the expense of the buyer. Sale Management shall review the statementto determine if the condition existed prior to the Sale. The decision to allowor disallow the rejection of the horse by the buyer will be consistent with theopinion of the Sale Veterinarian and the decision of Sale Committee shall befinal in all respects. The Consignor has the responsibility to disclose if anydrug or medication is being administered to a horse for the maintenance ofany condition.

SIXTEENTH - In the event a horse is returned to the Consignor in accordancewith conditions Fourteenth or Fifteenth, the Consignor agrees to pay allreasonable costs involved with the sale and return of the horse, includingtransportation, board and appropriate sale fees. If legal action is initiated byany party, for any horse entered in this auction the Consignor and Buyer,jointly and severally, agree to indemnify NRCHA, Professional AuctionServices, Inc., and Sale Management from such suit including legal fees andall related costs incurred by these entities.

SEVENTEENTH - Repository for Radiographs. Radiographs will be available forsome Sale entries and will be maintained by Dr Joe Carter, the Sale veterinar-ian. The radiographs may be viewed by appointment with Dr Carter. Radio-graphs have been recommended, not required, by NRCHA. Buyer shall beassumed to have knowledge of any fault, defect or condition that a reason-able inspection of the horse, or the radiographs on repository, should reveal.Buyer is responsible for inspecting horse and for viewing any radiographsbefore bidding. With respect to the repository a) Maintenance of repositoryshall not alter the Conditions Of Sale, which shall be binding on all parties; b)Sale Management (NRCHA and Professional Auction Services, Inc.) will NOTreview and shall not be responsible for the radiographs on repository andmakes no warranty, whatsoever, regarding the completeness or accuracythereof; c) Knowledge of information in the repository shall not be imputedto Sale Management; d) Consignor shall be solely responsible for all of theinformation placed in the repository; and e) Submitted radiographs becomethe property of NRCHA and will not be available for viewing after the horse issold.

EIGHTEENTH - The Sale Management shall not be bound by any oral or writtenagreement or alleged agreement varying from these CONDITIONS OF SALE,between the Buyer and the Consignor unless agreed to by the Sale Manage-ment, and any controversy or claim between the Buyer and the Consignorarising under any such agreement shall be a matter for their resolution.

NINETEENTH - Buyers and spectators are cautioned to be careful while on thegrounds and particularly while horses are being sold or shown in the salering. NRCHA (National Reined Cow Horse Association), the officers, staff andemployees of NRCHA, the NRCHA Sale Committee and Professional AuctionServices, Inc. and its staff and employees, are not responsible for accidents,injuries or loss of property.

TWENTIETH - Admission to the premises constitutes your agreement to bephotographed, filmed, videotaped or otherwise recorded in connection withthe shows and sales and other events at the NRCHA Snaffle Bit FuturityShow and Sales, or related activities, and your agreement that your likenessand voice may be broadcasted, distributed or displayed in connection withany promotion created from these events without any compensation beingpaid to you. The taking of photographs and the making of drawings orpaintings of the NRCHA Snaffle Bit Futurity Show and Sales and relatedactivities are permitted for personal use only. All commercial uses areprohibited without the express written consent of NRCHA or ProfessionalAuction Services, Inc., as it may apply.
