TelemachmakesitpossiblefortheusersoftheNET2GO package to concludeaSubscribersagreementwiththesamepersonalphonenumberthat the user received for the NET2GOpackage.WhentheuserswitchesfromtheNET2GOpackagetoregularmobileInternetsubscription,anypossibleremainingbalancecannotbecountedascredittowardsthepaymentofmonthlyobligationsundertheregularmobileInternetsubscription.

SwitchingfromaregularsubscriptiontoTelemach’smobileInternetpackageoranyothercontractualsubscriptiontotheNET2GO package is not possible.

TheMSISDNofanotheroperatormaynotbeusedfortheNET2GO package.

Lowest balance

ThebalanceonyouraccountmaynotbelowerthanEUR1foraccessingtheInternet.Intheeventofanactivedatasessionatthemomentwhentheprepaidperiodexpiresorintheeventofthecommencementofadatasessionoutsideoftheprepaidperiod,thenextprepaidperiodisactivatedautomaticallyfortheuser,providedthattheaccountbalanceissufficient.

orthefailureofanindividualdatasessionmaycausedamage(criticalenvironments).Theusershallnotusetheservicesincriticalenvironments.Telemachshallnotbeheldliableforanyformofdamagewhichmaybecausedtotheuserduetothenon-operationoftheservicesataparticularmicro-locationorduetothenon-operationofaconnectionwithaparticularbandwidth.ThemaximumbandwidthofthemobilebroadbandInternethasbeendeterminedinaccordancewiththespecificationsofthemanufacturersofcommunicationsequipmentwhichisusedbyTelemachtoprovideitsservices.

Telemachdesignedthepackagewiththepurposeofprovidingauserexperiencewhich,foranaverageuser,constitutestheunlimiteduseofservices;ithasdonethisbyallocatingsuchahighvolumeofservicesthattheaverageuserusuallydoesnotuseitupinaspecificperiod.Incertaincases,especiallywhentheuseofthispackagebeginstosignificantlydeviatefromaverageuseorwhenTelemachusestrafficevaluationtoassesthattheuser is not using the service in accordance with usual usage patterns of an averageTelemachuser(especiallyinthecaseoftheuseinP2Pnetworksorwithlargerdatatransfersortransfersofalargeramountoffiles,andinthecaseofmaintainingaconsistentconnection,regardlessofspeed),Telemachreservestheright,aftersendingapriorSMSnoticeoriftheuserdoesnotimmediatelyterminateitsviolations,torestrictthepossibilityof

theuseofservicesinordertoprotectthequalityofservice,theintegrityofthenetwork,andtheprotectionofthenetworkfromoverloading;Telemachdoesthisbyimplementingoneofthefollowingmeasures:(i) it restricts the transferspeedofdatasessions,(ii)temporarilystopstheuseofservices,(iii)beginschargingexcessuseinaccordancewiththePriceList,providedthatsuchameasureisforeseen,or(iv) activates the next billing period.
