I have with me this morning a group of people f rom Sparta High
School . They have accomplished an unbelievable f eat , as f ar as
I ' m concerned . They have won the -- they are the State math
champions , and they have won that and done that f or khe past f our
consecutive years . They have won ehe State title ken of the last
f if teen years . We have the whole team here, some of them in the
-.- in the -- in the balcony . I would like to introduce the
seniors and khe keacher and ehe principal here on khe F'loor behind
Illy desk . The seniors are Jonathan Morton, Todd Sparks , Nicolas
Ruhmann, Nakalie Heck p Ben Reum, Bryce Alms . Their teacher is
Eric Hof elich and their principal is Doug Mcrarland . Would like ,
if you will , please , to welcome them. And if they ' 11 stand in the

1procedure. Second, the bill would amend the Consumer Fraud Act.

House Bill 3426 defines residency for public school students. It
allows school districts to conduct hearings to dekermine
residency. Any ékudent found to be a nonresident may be charged
tuition by the school board. It provides that any person who
knowinqly enrolls, or aktempts to enroll: a studenk who is not a
resident on a tuition-fee (sic) (tuition-free) basis shall beguilty of a Class C misdemeanor. I would ask for a favorable
vote, and answer any queskions.

Senator Parker, I understand there was some opposition to this
billy in that the argumenk was made that ik's too narrowly defined
as far as who is the custodial keeper of children. Has -- have
you had any discussion? My analysis shows that you were going to
hold it on 2nd to have a meeting. Has the meeking gone forth?

ïes. That meetlng has gone forth, and the bill was amended.
There was a concern between -- they had SCOPE and School
Management Alliance on the one concernp and the okher was with a '
legal atd lobbyist and Department of Public Ald. They did meet.
The have come to an aqreement. And what it was is that we added
on, as an amendment, we added on two separate additional
clarifications for residency. One was custody exercised by an
adult caretaker who is receiving aid under the Illinois Public Aid
Code for the pupil who resides with khat adulk for reasons other
than having access to the educational programs of the district. .I
So that -- helped Public Aid. And the other that we added was 'l

custody exercised by an adult who demonstrakes that he or she has
assumed, and exercises, legal responsibility for the pupil and
provides the pupil with a regular fixed niqhtkime abode for
purposes other than having access to the educational programs of
the district. So it has been amended and everybody is in
agreement.

Thank youz Mr. President. I Wanted to compliment the sponsor.
There Was some serious concerns when the bill was presented to
committee, but they have been worked out by the amendment. Some
of the previous opponents: such as the Legal Asaistance
Foundation, the Association of School Social Workers - they are on
board now, and I'm pleased to see that their concerns Were
responded to. urge an Aye vote.

Thank you, Mr. Presidentr Ladies and Gentlemen of the Senate.
House Bill 3436 came to khe Senate on a unanimous vote by the
House, because lt dealt with the stopping of motor vehicles on
railroad tracks. And *he changes were supported, and are
supported, by the School Bus Transportation Association and the
Illinois Railroad Association. In committee we added several
amendments. 0ne was ko require all school buses, whether theydre
in charter serviee or not, to stop at railroad crossings. We had I
a amendment that would allow Ehat school pre-trip inspections
could be done by mechanics, rather than the driver, because l
they're better acquainted and better qualified to do so. We also '
had changed the vehicle widths as created by the National HighwayI
System. That was supporked by IDOT. We closed a loophole in the;
railroad grade crossing law, and ik's supported by the Illinois
Commerce Commission. And the last amendment Was requested by the
Township Officials, which dealt with khe commercial drivers'!
license Act about the drug and alcohol abuse testing for small
townships under three thousand population. And 1111 answer any
questions; otherwise, I'd ask for your support.i

juvenile offender portions of Public Ac* 89-428, which was lateryear's Senate Bill 721, which, as you'll recallw was held to be
unconstitutional by a Cook Pounty Circuit Court Judge last week, I
believe, based upon the single subjeck rule, because the bill wastled wlth several other provisions which the court found to be
unrelated. What this bill does is it simply beings back khe sex
offender notification provisions and a few other criminal laW
changes, such as the creation of a predatory criminal sexual
assaulk act, and a few amendmenks to the Code of Corrections in
the Juvenile Court Act, and I1d be happy to answez any queBtions.
We had a roll call on this vote last yearz which Was 49 to
nokhing, even when it included some other unrelated matters.

but that's a separate part of the bill and doesn't have anything
to do with the sex offender notification provisions.

Thank you, Mr. President. House Bill 2651, as amended, is
brought to us because of the plight of a school district in -- in
my district, as well as one in Senator Shadldls district and one
in Senator Bowles' district. Because of a reassessment of some
industrial property, a small unik district: Illinois Valley
Central, stands to lose a million dollars this year because of@
'
this reassessment from thirky-six million ko twelve million. This
bill would allow that district and a couple of others for one year
to use the prior-year EAV, which would not make up khat
difference, but would allow them to make up some four hundred
thousand dollars under the fornula. I know that this would come
from the rest of our districts who benefit under khe formula. It
is not without precedent. We have done it in former Senakor
Rigney's district, and in a number of other districts over khe
years. Be happy to answer any questions, otherwise would ask for
your support of House Bill 2651, as amended.

us to take this seriously and nok continue tinkering with our
children, and this is a very good example of having to do that.i

hundred thousand dollars - approximately twenty percent - towards
