Hong Kong SAR Agreement withthe Mainland (Aug 21)Beijing and Hong Kong sealed anagreement on avoidance of double tax-ation (RMRB, 22 Aug 06), which isexpected to reduce the tax burden ofHong Kong companies doing businessand investing on the mainland. Of-ficials also said the agreement wouldput Hong Kong ahead of Macau andSingapore in terms of the low taxrate applied under the scheme. Underthe agreement, Beijing agreed to allo-cate the right to tax Hong Kong res-idents or businesses over the transferof shares in mainland enterprises “ex-clusively to Hong Kong“. The agree-ment is entitled the Arrangement forthe Avoidance of Double Taxation onIncome and Prevention of Fiscal Eva-sion. Hong Kong investors who sellless than 25 per cent of a stake in amainland company - whose assets donot comprise mainly immovable prop-erty - will also be exempted from pay-ing a 10 per cent tax on the proceedsto the mainland under the new policybecause the tax right of the income,previously enjoyed by both jurisdic-tions, has been awarded exclusively toHong Kong. The agreement will alsoclarify certain tax rights of the two ju-risdictions to avoid double taxation ofthe same income. Before the agree-ment, a Hong Kong resident or com-pany were required to pay up to 20per cent and 10 per cent withholdingtax respectively for dividends, inter-est and royalties gained from main-land investments. Under the newpact, the top rates are reduced toa range of 5 to 10 per cent, lowerthan the 7 to 12 per cent adopted byMacau and Singapore. Speaking atthe signing ceremony yesterday, ChiefExecutive Donald Tsang Yam-kuensaid: “A comprehensive double taxa-tion arrangement with the mainland,together with CEPA [the Closer Eco-nomic Partnership Arrangement], willprovide added incentives for interna-tional investors to enter the mainlandmarket through Hong Kong.“ Yester-day, officials could not provide an esti-mate on tax savings for Hong Kong in-vestors and businesses under the deal.Last year, total Hong Kong invest-ment on the mainland amounted to

The newregulations include: - Free compul-sory education ensured “Equal com-pulsory education for children in citiesand the countryside“ was for the firsttime written into the newly-revisedCompulsory Education Law. The re-vised law aims to give children in bothcities and the countryside nine yearsof free compulsory education. Thecosts will be jointly covered by thecentral and local governments whichare required to put the expenditureinto their budgets. - Reservoir com-pensation funds guaranteed The StateCouncil’s Subsidy Policies for PeopleWho Were Relocated to Make Way forDams and Reservoirs becomes effec-tive on September 1. The central gov-ernment will spend more than 13bnyuan (1.63bn US dollars) every yearsubsidizing 22 million people who weremoved to make room for water reser-voirs created by dams. The moneywill be raised by increasing powerbills by 0.62 cents per kilowatt hour.China has built more than 3,000 largeand medium-sized dams since 1949 forflood control, electricity generation,irrigation and water supply. - Con-trols on explosives tightened China is-sued stricter new controls and regula-tions on the civilian use and storage ofexplosives after a series of accidentalexplosions in recent years. The gov-ernment will also establish a databaseto monitor all transactions and trans-port of explosives. The regulation will pro-tect and regulate the trade of wild ani-mals and vegetation, and comply withthe Convention on International Tradeon Endangered Species of Wild Faunaand Flora. - Protection of mappingdata The Mapping Management Reg-ulation states that important mappingdata must only be released by the gov-ernment. - Prohibition of fraud in fi-nancial aid to foreign countries TheMinistry of Commerce’s “Foreign AidGuidebook“ attempts to remove cor-ruption from the management of reliefmaterials and financial aid destinedfor foreign countries. No departmentor agency will be allowed to seek ille-gitimate gains through collusion withbidding companies, it said. Beijing, 31 August: The amendedCompulsory Education Law, whichcomes into effect in China on 1September contains a new provisionthat ensures the right to education forchildren of migrant workers no matterwhere they live. The provision stipu-lates that when both parents or legalguardians are migrant workers livingand working with their children in lo-cations other than where the familyis registered, local governments wherethey live and work must provide forthe child’s education. By the endof 2004, more than 6.4 million ruralchildren of compulsory education agewere living in cities with their parents.Another 22 million rural children re-main in their family’s rural homes,while their parents worked in cities,according to the Ministry of Educa-tion. Children who were brought tocities by their migrant parents are of-ten charged school fees that are muchhigher than those charged by schoolsin rural areas. Yet the likelihood thatthese children will move often makesit difficult for some cities to meet thedemand. Numerous private schoolsfor migrant children have been estab-lished to migrant children in cities andthey have been constantly attacked for

being ill-equipped, lacking infrastruc-ture and qualified teachers to guaran-tee quality of education. The Com-pulsory Education Law was promul-gated in 1986 and the revised Com-pulsory Education Law aims to givechildren in both cities and the coun-tryside nine years of free compulsoryeducation. Beijing, 30 August: China’s first regu-lation on the trade of endangered wildfauna and flora comes into effect on1 September, and Chinese officials sayit will be strictly enforced. The rulescover wildlife listed by the Conven-tion on International Trade in Endan-gered Species of Wild Fauna and Flora(CITES). China joined the interna-tional convention in 1980. Chen Jian-wei, deputy director of the Office ofState Endangered Species Trade Man-agement, said the rules forbid tradingof wildlife and related products thatare banned by the convention. Underthe rules, approval from the Chinesegovernment is required for export andimport wildlife or wildlife productsfor non-commercial purposes, such asscientific research, breeding, or ex-changes. Zhang Jianlong, deputy di-rector of the State Forestry Adminis-tration, said the rules, known as theRegulations on Trade in EndangeredSpecies of Wild Fauna and Flora, willplay an important role in protectingendangered species, safeguarding theecology and help sustain the species.Fan Xiaojian, deputy minister of agri-culture, said the rules will safeguardgrain and biological safety and pro-mote sustainable development of agri-culture and rural economy. China’srich bio-diversity boasts nearly 20,000aquatic animals and about 600 aquaticplants, and its grassland is home toabout 7,000 wild plants and 10,000 an-imals. The country’s wildlife resourcesare facing unprecedented threats fromfast economic and social development,said the vice-minister. Frequent in-ternational exchanges and a rapid in-crease of international trade in wildlifemay drain biological resources andlead to an invasion of foreign species,he warned. He said the Ministryof Agriculture, which is in charge ofmanagement of aquatic animals andplants, will enforce the regulations.Willem Wijnstekers, secretary-generalof CITES, welcomes the new regula-tions as it signals new progress Chinahas made in complying with the con-vention. Corporate Bankruptcy Law,adopted at the 23rd session of theStanding Committee of the 10th NPCon 27 Aug 06. (Presidential DecreeNo. 54, signed by State President HuJintao on 27 August 2006) China’stop legislature, the Standing Commit-tee of the National People’s Congress,on 27 August adopted a corporatebankruptcy law, aiming to protectboth creditors of bankrupt enter-prises and the people who work inthem. The law will come into ef-fect on 1 June, 2007. The currententerprise bankruptcy law will beabolished at the same time. The cur-rent bankruptcy rules, promulgatedin 1986 on a test basis, are widelyregarded as outdated as they fail togive sufficient protection to creditorsand only touch on State-owned enter-prises (SOE). The rules allow laid-offworkers to be paid before creditors.The new corporate bankruptcy lawwill apply to all kinds of enterprisesand financial institutions. All thecountry’s companies and enterprises,whether state owned or private, willhave to follow a unified corporatebankruptcy law if they founder. Thenew law stipulates that from 1 June,2007, all insolvent enterprises willpay credit guarantees to creditorsfirst, and use other assets not ear-marked as credit guarantees to paylaid-off workers. “The provision isa compromise that aims to protectboth creditors and workers of insol-

vent enterprises,“ said Cheng Siwei,vice-chairman of the NPC StandingCommittee. “The new law embodiesthe notion of putting people first, as itfully considers worker’s interests. Atthe same time it accords with stan-dard international practice in betterprotecting lenders’ interests,“ said JiaZhijie, member of the NPC Stand-ing Committee. Wang Xin, a lawprofessor at Renmin University saidpaying creditors first in insolvencycases is common practice in marketeconomies and will help boost foreigninvestors’ confidence in investing inChina. The new law makes an excep-tion for around 2,000 SOEs. The StateCouncil stipulated that SOEs that an-nounce bankruptcy before June 2007can be closed down with the aid ofgovernment bailouts and could paylaid-off workers first. >From 1994 to2005, China allowed 3,658 moribundstate enterprises to close with govern-ment subsidy support. In 2006, thecentral government set aside 33.8bnyuan to help bankrupt SOEs set-tle with laid-off workers. Expertscalled for the establishment of aneffective social insurance and wagepayment system that would eradicatethe phenomenon of workers remain-ing unpaid when a company goesbankrupt. The new law also providesa bankruptcy restructuring systemcomplete with liquidators, as well asrules on the prevention of cheatingduring the bankruptcy process. Thenew law stipulated that financial su-pervision institutions could apply forbankruptcy for financial institutions.To make special regulation on thebankruptcy of financial institutions inChina’s Corporate Bankruptcy Lawmarks that China began to standard-ize the bankruptcy of financial insti-tutions on the legal level, said expertsin law. According to the law, China’sfinancial supervision institution un-der the State Council could apply tothe people’s courts for reshuffle andbankruptcy of financial institutionsincluding commercial banks, insur-ance and securities companies whenthey cannot pay off debts due or meetsolvency. The corporate bankruptcylaw will also apply to foreign com-panies. The new law will also allowcompanies that are doing poorly toapply for reorganization. “This lawwill help redeem those organizationsor enterprises which are in financial

The partnershiplaw is divided into six chapters - gen-eral principles, ordinary partnerships,limited partnerships, dissolution andliquidation of partnerships, legal lia-bilities, and supplementary articles -and has a total of 109 articles, andwill come into force on 1 June 2007.The law stipulates that partnershipis taken as ordinary partnership andlimited partnership. Ordinary part-nership is made up of ordinary part-ners and the ordinary partners assumeunlimited joint liabilities in the debtsof the partnership; and limited part-nership is made up of ordinary part-ners and limited partners, in whichthe ordinary partners assume unlim-ited joint liabilities in the debts of thepartnership while the liabilities borneby the limited partners in the debtsof the partnership are limited to theamount of capital put up by them.The law also stipulates that exclu-sively state-owned companies, state-owned enterprises, and listed compa-nies, as well as public-service insti-tutions and social organizations, arenot allowed to become ordinary part-ners. The law clearly provides that thepartnership agreement be concludedin written form after consultation withand the consensus of all the partners.Conclusion of the partnership agree-ment and establishment of the part-nership ought to abide by the princi-ple of voluntary participation, equal-ity, impartiality, and integrity. With

Article 2. These Mea-sures shall be applicable to the re-lease of news and information in text,photo, graphics and other forms inChina by foreign news agencies. Forthe purposes of these Measures, for-eign news agencies include other for-eign entities of the nature of a newsagency that release news and infor-mation products. Article 3. XinhuaNews Agency exercises unified admin-istration over the release of news andinformation in China by foreign newsagencies. Article 4. According tothe Decision of the State Council onEstablishment of Administrative Li-censes for Items Subject to Admin-istrative Examination and ApprovalThat Need to Be Retained, for re-leasing their news and information inChina, foreign news agencies shall besubject to approval by Xinhua NewsAgency and shall have entities des-ignated by Xinhua News Agency actas their agents (hereinafter referred toas designated entities). Foreign newsagencies shall not directly solicit sub-scription of their news and informa-tion services in China. Except thedesignated entities, no unit or indi-vidual shall distribute news and in-formation of foreign news agencies or

act as their agents. Article 5. Toapply for releasing news and informa-tion in China, a foreign news agencyshall meet the following requirements:(1) being legally qualified in its homecountry or region; (2) enjoying goodcredit in the field of news and infor-mation release; (3) having an explicitscope of business; (4) possessing thetechnological and transmitting meanscommensurate with its business; and(5) other requirements as prescribedby Chinese laws and administrativeregulations. Article 6. For releasingnews and information in China, a for-eign news agency shall submit a writ-ten application and the following ma-terials to Xinhua News Agency: (1)legal credentials issued by the compe-tent authorities of its home country orregion; (2) its records of good credit is-sued by the relevant organization of itshome country or region; (3) a detailedlist, explanation and samples of thenews and information release; (4) anillustration of its transmitting means;and (5) other materials as specified byXinhua News Agency. Article 7. Anentity to be designated as an agentof a foreign news agency for the dis-tribution of news and information inChina shall meet the following require-ments and submit a written applica-tion to Xinhua News Agency: (1) be-ing legally qualified; (2) enjoying goodcredit in acting as an agent for newsand information distribution; (3) pos-sessing the service network and trans-mitting means commensurate with itsbusiness; and (4) other requirementsas prescribed by Chinese laws and ad-ministrative regulations and rules ofgovernment departments. Article 8.Xinhua News Agency shall, within 20days from the date it receives thewritten application of a foreign newsagency or designated entity, make adecision on whether to grant or notto grant the application. If it decidesto grant the application, it shall is-sue the document of approval; other-wise, it shall notify the applicant ofthe decision in writing and explain thereasons why. Article 9. Before re-leasing news and information in Chinain accordance with the scope of busi-ness approved in the approval docu-ment, a foreign news agency shall signan agency agreement with the desig-nated entity, and within 15 days fromthe date of the agreement is signed,submit the agreement to Xinhua News

News and informa-tion released in China by foreign newsagencies shall not contain any of thefollowing that serves to: (1) violatethe basic principles enshrined in theConstitution of the People’s Republicof China; (2) undermine China’s na-tional unity, sovereignty and territo-rial integrity; (3) endanger China’s na-tional security, reputation and inter-ests; (4) violate China’s religious poli-cies or preach evil cults or supersti-tion; (5) incite hatred and discrimina-tion among ethnic groups, underminetheir unity, infringe upon their cus-toms and habits, or hurt their feelings;(6) spread false information, disruptChina’s economic and social order, orundermine China’s social stability; (7)propagate obscenity and violence, orabet crimes; (8) humiliate or slan-der another person, or infringe uponthe legitimate rights and interests ofanother person; (9) undermine socialethics or the fine cultural traditions ofthe Chinese nation; and (10) includeother content banned by Chinese lawsand administrative regulations. Arti-cle 12. Xinhua News Agency has theright to select the news and informa-tion released by foreign news agenciesin China and shall delete any materi-als as specified in Article 11 of theseMeasures. Article 13. To subscribe tonews and information services of for-eign news agencies, a user in Chinashall sign a subscription agreementwith a designated entity and shall not,by any means, directly subscribe to,translate, edit or publish the news andinformation released by a foreign newsagency. In using news and informa-tion from a foreign news agency, theuser in China shall clearly indicate thesources and shall not transfer them toanother party in any form. Article 14.Foreign news agencies and designatedentities shall, within the prescribedtime limit, submit reports each yearto Xinhua News Agency on their workin releasing news and information andin acting as agents respectively. Xin-hua News Agency may conduct exam-ination and inspection on the basis ofwhat is reported. Only those agenciesand entities that have passed the ex-amination and inspection are permit-

ted to continue with their news andinformation release and agency busi-ness. Article 15. Any unit or individ-ual has the right to report to XinhuaNews Agency any violation of theseMeasures. And Xinhua News Agencyshall investigate and deal with the vi-olation according to law. Article 16.Where a foreign news agency violatesthe Measures in one of the followingmanners, Xinhua News Agency shallgive it a warning, demand rectificationwithin a prescribed time limit, sus-pend its release of specified content,suspend or cancel its qualifications ofa foreign news agency for releasingnews and information in China, onthe merits of each case: (1) releas-ing news and information beyond thescope of business as approved in theapproval document; (2) directly solic-iting subscription of news and infor-mation services, or doing so in dis-guised form; and (3) distributing newsand information which contains thematerial specified in Article 11 of theseMeasures. Article 17. Where a userin China violates the provisions ofthese Measures in one of the followingmanners, Xinhua News Agency shallgive it a warning, demand rectifica-tion within a prescribed time limit ororder the designated entities to sus-pend or rescind the subscription agree-ment, on the merits of each case:(1) using the news and informationfrom a foreign news agency beyondthe scope as prescribed by the sub-scription agreement; (2) transferringto another party news and informa-tion from a foreign news agency that ithas subscribed to; and (3) failing to in-dicate the sources clearly when usingnews and information from a foreignnews agency. Article 18. Where a unitor individual violates the provisionsof these Measures in one of the fol-lowing manners, Xinhua News Agencyshall submit a proposal to the rele-vant department of the State Councilto impose an administrative penaltyaccording to law: (1) releasing newsand information without approval byXinhua News Agency or subscribingto news and information of a foreignnews agency without going throughthe entity designated by Xinhua NewsAgency; (2) distributing news and in-formation of a foreign news agency oracting as its agent without approval;and (3) directly translating, editing orpublishing news and information of a

foreign news agency without approval.Article 19. Where a designated en-tity, in violation of the provisions ofthese Measures, acts as an agent fordistribution of the news and informa-tion of a foreign news agency thathas not obtained approval of XinhuaNews Agency, Xinhua News Agencyshall order it to rectify, and disci-plinary penalties shall be imposed onthe persons directly in charge and theother persons directly responsible. Ar-ticle 20. Where a staff member ofXinhua News Agency commits oneof the following acts, Xinhua NewsAgency shall impose on him a disci-plinary penalty: (1) issuing approvaldocument to an applicant that doesnot meet the requirements specified inthese Measures; (2) failing to performhis duties of supervision and admin-istration in accordance with law; (3)failing to investigate and deal with vi-olations of law upon receiving reportsthereon; and (4) abusing his powers,neglecting his duties, or engaging inmalpractices for personal gain, etc.Article 21. These Measures shall beapplied mutatis mutandis to the re-lease of news and information on themainland by news agencies and othernews and information releasing enti-ties of the nature of a news agencyin the Hong Kong Special Adminis-trative Region, Macao Special Admin-istrative Region and Taiwan. Article22. These Measures shall go into ef-fect as of the date of promulgation.The Methods for the Exercise of Ad-ministration over Publication in Chinaof Economic Information by ForeignNews Agencies and Their InformationSubsidiaries, promulgated by XinhuaNews Agency on April 15, 1996, are re-pealed simultaneously. The spouse, children and relatives ofa person appointed to the leading of-ficial post in a government or partyunit cannot be subordinate officials,accountants, auditors or human re-sources cadres in that unit during theofficial’s tenure. The ban appears ina regulation issued on 6 August bythe General Office of the CCP CC.Another important CCP regulationdealt with tenure of office and a thirdwith job mobility. The three regu-lations apply to officials of the CCPCentral Committee, the National Peo-ple’s Congress, the State Council, theChinese People’s Political Consulta-tive Conference, the Supreme Peo-ple’s Court and the Supreme Peo-ple’s Procuratorate, as well as localleading officials of party units, gov-ernment departments, people’s con-gresses and political consultative con-ferences, courts and prosecuting or-gans at and above county level. Thenew regulation said officials must notwork in a government office that con-trols or supervises any industry or en-terprise in which their family mem-bers hold shares. The regulation alsostipulated that officials cannot take onthe leading post in the CCP commit-tee, government, court and prosecut-ing organs of the county and prefec-ture in which they are born and growup. If officials fail to implement theregulation, they will be criticized orgiven disciplinary punishment. Theregulation on tenure of office said of-ficials should hold their posts for aterm of five years to ensure stableand consistent implementation of pol-icy. Officials must complete their five-year term unless they reach retirementage, are in poor health, fail to per-form their duties and need to be trans-ferred, or are demoted or dismissedfor wrongdoing, said the regulation.When the five-year term is up, offi-cials will be given an overall perfor-mance assessment of their work, andthe result will be an important factorin future promotion, said the regula-tion After working in the same postfor two consecutive five-year terms, of-ficials will no longer be recommendedor appointed to the post, said the reg-ulation. Article 3: Exchanges ofleading party and government cadres

mentioned in these regulations referto reshuffles of positions of leadingparty and government cadres by partycommittees (leading party groups) atall levels and their organization (per-sonnel) departments through transfersand reassignments within their areasof competence for cadre management.Separate regulations shall be formu-lated regarding the work of temporaryassignments for the purpose of gainingtoughening experience. Chapter II:Personnel involved in exchanges Arti-cle 4: Personnel involved in exchangesshall primarily include the following:(1) Those who need to undergo ex-changes due to the needs of work; (2)Those who need to gain tougheningexperience and improve their leader-ship abilities through exchanges; (3)Those who have worked for quite along time in a locality or department;(4) Those who need to be recused pur-suant to rules and regulations; and (5)Those who need to undergo exchangesfor other reasons. The key person-nel involved in exchanges are leader-ship members in chief and deputy po-sitions and other leadership membersof local party committees and gov-ernments, as well as leadership mem-bers in chief and deputy positionsof commissions for discipline inspec-tion, people’s courts, people’s procu-ratorates and some work departmentsof party committees and governments,at or above the county level. Arti-cle 5: Leadership members of localparty committees and governments ator above the county level who haveserved in the same positions for 10years must undergo exchanges. Withapproval, restrictions may be appro-priately relaxed for leading party andgovernment cadres of ethnic minoritiesin autonomous ethnic regions. Thosewho have held the same party andgovernment leadership positions for10 years in the same areas shall un-dergo exchanges. Newly promotedlocal party and government leader-ship members at or above the county(city, district and banner) level shalltake positions in a planned mannervia exchanges from elsewhere. Article6: Leadership members in chief posi-tions of local discipline inspection or-gans (supervision departments), orga-nization departments, people’s courts,people’s procuratorates and public se-curity departments at or above thecounty level who have held the same


positions for 10 years must undergoexchanges; as a rule, the newly pro-moted shall take up their positions viaexchanges from other places. Lead-ership members in deputy positionsshall undergo exchanges after havingserved on the same leadership teamsfor 10 years. Article 7: Leadingcadres at or above the division levelin party and government institutions,especially leading cadres who are en-gaged in the work of discipline and lawenforcement, cadre and personnel af-fairs, auditing, project review and ap-proval, and fund management, shallundergo exchanges after having servedin the same positions for 10 years. Ar-ticle 8: Leading cadres at or above thecounty (division) level who lack ex-perience of grassroots work or whosejob experience is confined to one as-pect of work shall undergo exchangesin a planned manner. Article 9: Lead-ership members in chief positions inunits that practice dual cadre manage-ment with higher-level functional de-partments primarily exercising man-agement shall undergo exchanges af-ter having served on the same leader-ship teams for 10 years. Article 10:Exchanges of leading party and gov-ernment cadres for purposes of recusalshall be carried out pursuant to rel-evant rules and regulations. Article11: In any of the circumstances, ex-changes of leading party and govern-ment cadres may be dispensed withor suspended: (1) Where less thanfive years remain from the age lim-its for the positions in question (thework of those for whom exchangesare mandatory may be adjusted inlight of different circumstances); (2)Where exchanges are unsuitable forhealth reasons; (3) Where investiga-tions by discipline inspection, super-vision or judicial organs on suspicionof violations of discipline and the laware continuing with the conclusionspending; and (4) Where exchangesare inappropriate for other reasons.Chapter III: The scope and methodsof exchanges Article 12: Cadre ex-changes may be carried out among re-gions and departments, between local-ities and departments, and betweenparty and government institutions onthe one hand and state-owned enter-prises, public institutions, civic orga-nizations and mass organizations onthe other hand. Article 13: As arule, cadre exchanges at the prefecture

(department) level shall be carriedout within the province (autonomousregion or municipality directly un-der the central government), or, de-pending on the needs of work, maybe carried out across provincial (au-tonomous regional or municipal) lines.As a rule, cadre exchanges at thecounty (division) level shall be carriedout within the city (prefecture, au-tonomous prefecture or league). De-pending on the needs of work, ex-changes of county (city, district andbanner) party committee secretariesand county (city, district and banner)magistrates may be carried out withinthe province (autonomous region ormunicipality directly under the cen-tral government). Article 14: Inter-regional cadre exchanges shall be car-ried out around state strategies re-garding economic and social develop-ment and skilled personnel, local eco-nomic and social development setups,pillar industries and major develop-ment projects. Article 15: Centralparty and government institutions andprovincial party and government insti-tutions shall pay attention to trans-ferring cadres with experience of lo-cal work, especially outstanding youngcadres from party and governmentleadership teams in cities (prefectures,autonomous prefectures and leagues)and counties (cities, districts and ban-ners), to positions in the institutions.At the same time, cadres from the in-stitutions shall be sent to take up po-sitions in localities in a planned man-ner depending on the needs of work.Article 16: Cadre exchanges shall becarried out between party and govern-ment institutions on the one hand andstate-owned enterprises and public in-stitutions on the other hand. Lead-ing personnel from state-owned enter-prises and public institutions shall betransferred to positions in party andgovernment institutions, and leadingparty and government cadres shallbe recommended to take up positionsin state-owned enterprises and pub-lic institutions. Article 17: Lead-ing cadres in units that practice dualcadre management with higher-levelfunctional departments primarily ex-ercising management may undergo ex-changes within the same establish-ment. Exchanges may also be carriedout with localities or other establish-ments. Chapter IV: Organizing im-plementation Article 18: Implementa-

tion of the work of cadre exchangesshall be organized pursuant to the ar-eas of competence for cadre manage-ment. Depending on the needs ofwork, party committees (leading partygroups) at higher levels and their orga-nization (personnel) departments mayalso directly organize implementation.Cadre exchanges in groups betweencentral party and government insti-tutions and localities shall be car-ried out after coordination with theCCP Central Committee’s Organiza-tion Department; individual cadre ex-changes shall, in principle, be handledthrough consultations between trans-ferring and receiving units. Cadre ex-changes by departments that practicedual cadre management shall be pro-posed by the units that primarily ex-ercise management, and the views ofthe units that assist in managementshall be solicited. Article 19: As arule, the work of cadre exchanges shallbe carried out pursuant to the fol-lowing procedures: (1) Organization(personnel) departments draw up ex-change plans and nominate person-nel for exchanges; (2) The views oftransferring and receiving units are so-licited; (3) Party committees (leadingparty groups) collectively hold discus-sions and make decisions; (4) Partycommittees (leading party groups) ororganization (personnel) departmentshold talks with the cadres involvedin exchanges in order to hear theirviews and carry out ideological work;and (5) Organization (personnel) de-partments attend to transfer proce-dures. Article 20: Cadre exchangesshall be carried out through betterplanning and targeting with key ar-eas given prominence, and attentionshall be paid to combining them withchange-of-term reshuffles of leadershipteams. As a rule, party and govern-ment leadership members in chief po-sitions at the city and county levelsshall not undergo exchanges if theyhave not served out a term, and partyand government leadership membersin chief positions in the same areashall not undergo exchanges at thesame time. As a rule, the numberof members of a leadership team thatare subject to exchanges shall not ex-ceed one-third of the total member-ship. Exchanges of cadres who needto be elected or appointed or dis-missed pursuant to statutory proce-dures shall be carried out pursuant to


statutory procedures. Auditing shallbe conducted if auditing upon leav-ing office is required pursuant to rel-evant rules and regulations. Chap-ter V: Discipline in the work of ex-changes Article 21: The following dis-cipline must be strictly enforced forcadre exchanges: (1) All localities andunits must enforce the decisions ofhigher-level party committees (lead-ing party groups) regarding cadre ex-changes and may not refuse to enforcethem for any reasons. (2) Party com-mittees (leading party groups) at alllevels must strictly implement cadreexchange procedures and collectivelyconsider and decide on the personnelinvolved in exchanges. They may notuse cadre exchanges as a pretext tobring forth and promote cadres. Noindividuals may use cadre exchangesas a pretext to retaliate against cadres.(3) Cadres shall obey their organi-zations’ decisions on exchanges. Af-ter receiving notification of exchanges,they must attend to procedures forhanding off their duties as quickly aspossible and report for duty withinthe specified time limits. Administra-tive ties and ties of party membershipshall be transferred at the same timeas interregional and interdepartmentalexchanges. Cadres who refuse to ac-cept their organizations’ arrangementswithout legitimate reasons shall be re-moved from office or demoted locally.(4) Transferring units shall transferthe personnel files on cadres to receiv-ing units as quickly as possible. Theyshall provide truthful information anddata and may not engage in falsifica-tion. Receiving units shall review rel-evant data carefully. (5) When cadresare transferred, their staff membersmay not be transferred along withthem in violation of relevant rules andregulations, nor are they allowed totake goods that belong to the publicwith them. Cadres may not interferewith the work of their original unitsafter they have been transferred. Ar-ticle 22: An accountability system forthe work of cadre exchanges shall beimplemented. Violations of disciplineor laxity in enforcing discipline shallbe subject to severe criticism and edu-cation; where serious consequences arecaused, the persons with principal re-sponsibility and other people with di-rect responsibility shall be brought toaccount. Article 23: Party commit-tees (leading party groups) and their

organization (personnel) departmentsshall be responsible for supervisingand inspecting the work of cadre ex-changes, for receiving tips and com-plaints, for halting and correcting actsthat violate these regulations, and foroffering views or suggestions for deal-ing with relevant responsible parties.Chapter VI: Supporting measures Ar-ticle 24: A sound mechanism of in-centives for cadre exchanges shall beestablished. The integration of ex-changes and training for employmentshall be upheld, and policies and mea-sures that are conducive to cadres’healthy development shall be adoptedto encourage cadres to toughen them-selves and make contributions in re-mote areas with hard conditions, incomplex environments, and at key de-velopment projects and the grassrootslevel. Article 25: Party commit-tees (leading party groups) and theirorganization (personnel) departmentsshall show concern and care for thecadres involved in exchanges, makeproper arrangements for their workand lives, and bring their roles intofull play. Units that transfer and re-ceive cadres shall work with one an-other to help the cadres involved in ex-changes resolve difficulties and prob-lems and dispel their worries. Arti-cle 26: Whether or not the spousesand children of cadres involved inexchanges shall be transferred alongshall be dealt with pursuant to rel-evant rules and regulations based onthe cadres’ wishes. Where spouses andchildren are transferred along, properarrangements shall be made for theiremployment and schooling. Article27: Party committees (leading partygroups) and their organization (per-sonnel) departments shall track thementality and work of cadres involvedin exchanges and strengthen educa-tion, management and supervision.Chapter VII: Supplementary articlesArticle 28: Cadre exchanges of tradeunions, the Communist Youth League,women’s federations and other civicorganizations as well as public insti-tutions affiliated with party and gov-ernment institutions at or above thecounty level shall be carried out withreference to these regulations. Article29: Localities and departments maydraw up implementation measures onthe basis of these regulations. Arti-cle 30: The CCP Central Commit-tee’s Organization Department shall

be responsible for interpreting theseregulations. Article 31: These regu-lations shall take effect on the dateof their promulgation. Article 3 Married couples,blood relatives, collateral relativeswithin three generations, and closerelatives by marriage may not serve inpositions directly under the same lead-ing official or in positions with directsuperior-subordinate relations in thesame institution; nor are they allowedto serve in work related to organiza-tion (personnel), discipline inspection(supervision), auditing, and finance inan institution where one of the partiesholds a leadership position. Article4 Where a leading cadre’s spouse,children, and children-in-laws operateenterprises or commercial people-runnon-enterprise units in the form of soleproprietorships, partnerships, or sub-stantial equity holdings, the leadingcadre in question may not be a mem-ber of the leadership in a departmentthat exercises industry regulation orfunctional supervision over said en-terprises or units. Article 5 Leadingcadres may not serve as the chief lead-ership members in county (city) partycommittees, governments, disciplineinspection organs, organization de-partments, people’s courts, people’sprocuratorates, and public securitydepartments in the places where theygrew up. As a rule, they may notserve as the chief leadership membersin city (prefecture and league) partycommittees, governments, disciplineinspection organs, organization de-partments, people’s courts, people’sprocuratorates, and public securitydepartments in the places where theygrew up. The provisions of the pre-ceding paragraph shall be used asreference with regard to ethnic lead-ing cadres in ethnic minority areasthat practice autonomy. Article 6Where there is a need for avoidanceat the time a leading cadre takesoffice, the organization (personnel)department shall present its viewson avoidance to the party committee(leading party group) for decision pur-suant to the areas of competence forcadre management. If necessary, theorganization (personnel) departmentmay ask the leading cadre in questionto report on the circumstances thatwarrant avoidance in the position tobe taken. Article 7 Where circum-stances warranting avoidance ariseduring a leading cadre’s term of of-

fice, the cadre in question shall file anavoidance application. If the party or-ganization of the unit in question findscircumstances that warrant avoidance,it shall make an avoidance sugges-tion and, after verification by theorganization (personnel) department,present its views to the party commit-tee (leading party group) for decisionpursuant to the areas of competencefor cadre management. Article 8 In-dividuals and organizations have theright to report circumstances war-ranting avoidance by leading cadres.Agencies that receive said reportsshall forward them to relevant orga-nization (personnel) departments forhandling pursuant to their areas ofcompetence for cadre management.Article 9 Where circumstances war-ranting avoidance mentioned in Arti-cle 3 of these regulations arise, as arule, the party that holds the lower-grade job shall avoid the position ifthe grade levels of the jobs involvedare different; if the grade levels areequivalent, the avoiding party shallbe decided according to the needs ofwork and the actual circumstances.Article 10 Where avoidance requirescross-regional or cross-departmentaladjustments that are difficult to ar-range at the level in question pursuantto the areas of competence for cadremanagement, the organization (per-sonnel) department at the higher levelshall be requested to coordinate effortsto seek a resolution. Article 11 Whereleading cadres elected by people’scongresses need to avoid positions inspecific areas, adjustments shall bemade during their terms of office inlight of the actual circumstances ifsaid adjustments can be made duringtheir tenures; if adjustments are dif-ficult to make during their terms ofoffice, said adjustments shall be madeafter their terms of office expire. Ar-ticle 12 Before presenting their viewson avoidance to party committees(leading party groups) for decision,organization (personnel) departmentsmay hear the views of the leadingcadres in question and relevant per-sonnel. Article 13 Leading cadreswho do not report in a timely manneror who intentionally conceal circum-stances warranting avoidance shallbe criticized. If the circumstancesare serious, they shall be disciplinedby their organizations. Article 14Leading cadres must obey avoidance

decisions. If they refuse to obey with-out legitimate reasons, they shall beremoved from office or demoted intheir original places of work. Arti-cle 15 Other than the circumstancesspelled out in Articles 3, 4, and 5 ofthese regulations, where other lawsand regulations provide for the avoid-ance of positions by leading cadres,said provisions shall apply. Relevantdepartments shall formulate separateregulations regarding the avoidanceof positions by leading cadres in thecountry’s agencies abroad. Article16 Party committees (leading partygroups) at all levels and their organi-zation (personnel) departments shallbe responsible for organizing the im-plementation of these regulations, forsupervising the implementation of thesystem of avoiding positions by lead-ing party and government cadres, andfor remedying acts that violate theseregulations pursuant to their areas ofcompetence for cadre management.Article 17 The avoidance of positionsby leading cadres in trade unions, theCommunist Youth League, women’sfederations, and other civic organiza-tions as well as in public institutionsaffiliated with party and governmentorgans at or above the county levelshall be carried out with referenceto these regulations. Article 18 Theparty committees of provinces (au-tonomous regions and municipalitiesdirectly under the central govern-ment) shall formulate measures re-garding the avoidance of positions byleading cadres in townships (townsand neighbourhoods) on the basisof these regulations. Article 19 TheCCP Central Committee Organiza-tion Department shall be responsiblefor interpreting these regulations. Beijing, 5 September: The Chinesegovernment on 5 September issuednew rules aimed at tighteningland supply in another bid to pre-vent overheating of the economy. Thenew rules warn local leaders that theywill be penalized if they fail to stopor investigate illegal land sale cases inareas under their jurisdiction, accord-ing to a State Council notice. Underthe new rules, the use of farm land forconstruction purposes will no longer


be approved by the State Council foreach project, but should be reportedto provincial governments and submit-ted to the State Council for approvalon an annual basis. Land manage-ment authorities must keep a closerwatch on local governments and stopland supply applications from localgovernments that may breach regula-tions, according to the notice. Civilservants who have violated the landsupply rules shall be disciplined andprosecuted if they have broken thelaw, the notice said. The Ministryof Supervision in collaboration withthe Ministry of Land and Resourcesand other central departments shallsoon launch a nationwide crackdownon irregularities in land supply, thenotice said. China recorded an eco-nomic growth of 10.9 per cent in thefirst half of this year on the back of a30-per cent growth in fixed asset in-vestment, both the highest in recentyears. In its bid to prevent a possi-ble economic meltdown, China has re-peatedly raised the benchmark inter-est rate and clamped down on unau-thorized investment projects. Thegovernment believes that illegal landsupply is a leading cause of the run-away investment. A survey of 16 citiesby the Ministry of Land and Resourceslast year showed that nearly 50 percent of the new land under develop-ment was acquired illegally. Beijing, 5 September: Chinese po-lice are no longer allowed to shackledrunks or put children, elderly, preg-nant women or breast-feeding moth-ers involved in non-criminal cases intocustody. The Ministry of Public Se-curity recently published the revisedRegulations on the Procedure ofHandling Administrative Casesby Police Departments. Under theRegulations, police can use belts instead of handcuffs to control drunkswho might cause a public disturbance.Drunks should not be shackled whenbeing questioned after they are sober.People between the ages of 14 and 18who are charged with violating pub-lic security regulations for the firsttime, women who are pregnant orbreast-feeding a baby younger thana year, and elderly people 70 andolder can not be detained for mi-nor offences. Children 14 and 16

should be exempted from administra-tive punishment, but their guardianswill be ordered to better supervisethem. Punishment for those between14 to 18 could be reduced. Accordingto the revised Regulations, once thesuspects are issued a summons, policeshould timely inform their family ofthe charges via short messages (SMS),fax or phone calls. The PLA [People’s Liberation Army]General Staff Department recentlypromulgated the “PLA Regulationson the Wartime Support Given bythe Armament Maintenance Unitsand Detachments“, the “PLA Regu-lations on the Armament WarehouseWartime Support“, the “PLA Regula-tions on the Wartime Support Givenby Armament Repair Factories“, andthe “PLA Regulations on the WartimeSupport Given by the Special Ar-mament Service Units and Detach-ments“. These regulations providedconcrete, real-war-oriented and stan-dard legal guarantees for the perfor-mance of support tasks by varioustypes of armament support detach-ments in wartime. This indicated thatthe legal system for the wartime ar-mament support had basically takenshape in our armed forces. For thefirst time, the four sets of regulationscomprehensively standardize the ar-mament support actions of the arma-ment maintenance units and detach-ments, the armament warehouses, thearmament repair factories being runas enterprises, and the special arma-ment service units and detachments atall levels in the future military opera-tions under the condition of informa-tization. They constitute an impor-tant component part of the new op-eration regulation system and arma-ment legal system of our armed forces,and provide the basic grounds forall types of armament support unitsand detachments at all levels to orga-nize wartime armament support andarrange training. The four sets ofregulations clearly specify the statusand role, the main tasks, the guidingconcepts, and the basic principles ofwartime armament support, standard-ize the basic procedures, methods, andrequirements for the armament sup-port actions in various campaign andbattle stages, and also specify the re-

lationships and the actions that needto be coordinated. They give expres-sion to the features and rules of thejoint operations in the future localwarfare in the form of informatiza-tion. The four sets of regulations stip-ulate that when organizing armamentsupport, all types of armament sup-port units and detachments must fol-low the guidance of Mao Zedong Mili-tary Thought, Deng Xiaoping’s think-ing on military force building in thenew period, Jiang Zemin’s thinkingon national defence and military forcebuilding, and Chairman Hu’s impor-tant theses on military force building,must carry out the military strategicprinciple for the new period, carry for-ward the fine tradition and style of ourarmed forces, flexibly organize and usethe support forces, give full play tothe overall support strength of boththe military and civilian sectors and ofall arm branches and services, compre-hensively provide timely, efficient, sus-tained, and stable armament supportfor operation actions, especially forthe priority operation actions.
