Chapter I. GENERAL PROVISIONS Art. 2.1

Effective, more favourable transposition The Portuguese law in defining partner includes both those who live in de facto union, regulated by Law 7/2001, and those who have a durable relationship duly attested as defined under Art. 3. 2 (b) of the Directive. No reference was found however to “registered partnerships”. The PT law is even more favourable as it grants the status of family member even to partners in durable relationship.

Art. 3.1 Beneficiaries This Directive shall apply to all Union citizens who move to or reside in a Member State other than that of which they are a national, and to their family members as defined in point 2 of Article 2 who accompany or join them.

Without prejudice to any right to free movement and residence the persons concerned may have in their own right, the host Member State shall, in accordance with its national legislation, facilitate entry and residence for the following persons: (a) any other family members, irrespective of their nationality, not falling under the definition in point 2 of Article 2 who, in the country from which they have come, are dependants or members of the household of the Union citizen having the primary right of residence, or where serious health grounds strictly require the personal care of the family member by the Union citizen;

and law 7/2001 of 11.05 defines the legal regime applicable to persons living in de facto union for more than 2 years. NB: two years requirement – the Commission mentioned one year as an indicative threshold, but the reference to two years only applies to de facto unions regulated by Portuguese law and not to other durable relationships.

The host Member State shall undertake an extensive examination of the personal circumstances and shall justify any denial of entry or residence to these people.

Art. 3.3 3—A decisão relativa à entrada e residência das pessoas abrangidas pelo número anterior só pode ser tomada após análise de todas as circunstâncias pessoais relevantes, devendo ser fundamentada qualquer recusa de entrada ou de concessão de autorização de residência.

The decision regarding the entry and residence of the people falling under the previous paragraph can only be taken after extensive examination of all the personal circumstances and any denial of entry or residence shall be justify.

Y Literal transposition The previous paragraph is Article 3(2) transposing Article 3(2)(a) of the Directive. No need to apply this to Article 3(2)(b) since they have been granted the right to enter and reside as family members (thus no discretion).

Chapter II. RIGHT OF EXIT AND ENTRY

Art. 4.1 Right of Exit Without prejudice to the provisions on travel documents applicable to national border controls, all Union citizens with a valid identity card or passport and their family members who are not nationals of a Member State and who hold a valid passport shall have the right to leave the territory of a Member State to travel to another Member State.

Right of exit from the national territory Without prejudice to the provisions on travel documents applicable to national border controls, all Union citizens shall have the right to leave the national territory of a Member State to travel to another Member State with a valid identity card or passport as well as their family who hold a valid passport

Y Effective transposition The right of exit is granted even if the Union citizen is travelling outside the EU but this provision does not distinguish the nationality of the family member. However, since it is clear from the formulation of the provision that “ALL Union citizens” have the right to leave the country with ID or passport, it is also clear that the family members referred to in the provision can only be third country family members.

The citizen card is mandatory for all citizens, resident in Portugal or abroad, from 6 years of age or whenever their submission is required by a public service.

As for identity cards issues, Law 7/2007 has unified in the citizen card the ID, the social security number, the finance number and the health number.

Art.4.4 The passport shall be valid at least for all Member States and for countries through which the holder must pass when travelling between Member States. Where the law of a Member State does not provide for identity cards to be issued, the period of validity of any passport on being issued or renewed shall be not less than five years.

Y Effective transposition Since no specification was found of the territorial scope of the passport, the CA was contacted and clarified that passports issued in Portugal are valid for all Member States Moreover since Portugal applies the common features for all EU Passports included in Council Resolution of 23 June 1981 and Regulation 2252/2006 it is understood that this provision has been effectively transposed into national law.

Art. 5.1 Right of Entry 1. Without prejudice to the provisions on travel documents applicable to national border controls, Member States shall grant Union citizens leave to enter their territory with a valid identity card or passport and shall grant family members who are not nationals of a Member State leave to enter their territory with a valid passport.

Y Effective transposition The Portuguese provision makes a general reference to EC law which may broaden the scope of the situations where entry visa is required and will serve to cover amendments to the Regulation as well as any other EU act that could replace or complement the Regulation without needing to amend the law. For more specific information on the residence card please refer to Art. 15/4b of the Portuguese law. Law 23/2007 regulates the types of visas and the application procedures.

Member States shall grant such persons every facility to obtain the necessary visas. Such visas shall be issued free of charge as soon as possible and on the basis of an accelerated procedure.

Effective transposition This provision requires “family members” to show their identity and family links. In Portugal the beneficiaries include the family members who are third country nationals since, as stated under Art. 5.1 above, the Portuguese legislator does not seem to discriminate family members on the basis of their nationality. According with the Portuguese focal point (Dr. Mário Pedro) “reasonable oportunity” and “reasonably period of time” should be understood as an Administrative prerogative regarding which no guidelines need to be defined.

Both the long term residents and those that have that statute granted by an EU MS benefit from special measures of protection. Member States may adopt the necessary measures to refuse, terminate or withdraw any right conferred by this Directive in the case of abuse of rights or fraud, such as marriages of convenience. Any such measure shall be proportionate and subject to the procedural safeguards provided for in Articles 30 and 31.

The Portuguese provision makes Art. 35.1 of the Directive subject to the provisions on notification of decisions (Art. 25) and procedural safeguards (Art. 26) defined by national law, which as indicated above are also in line with the Directive, and includes the refusal or withdraw of social assistance.

Art.36 Sanctions Member States shall lay down provisions on the sanctions applicable to breaches of national rules adopted for the implementation of this Directive and shall take the measures required for their application. The sanctions laid down shall be effective and proportionate. Member States shall notify the Commission of these provisions not later than 30 April 2006 and as promptly as possible in the case of any subsequent changes.
