ROC Presidents Details about the office TOP JOBThe presidency is the highest and most powerful position in ROC politics. The president is not only head ofstate and commander-in-chiefofthe armed forces; he or she has the authority to appoint the head ofthe ExecutiveYuan(=premier),of theJudicialYuan(aswellasitsgrandjustices[dafaguan ]),of theControl Yuan, and ofthe Examination Yuan. Furthermore, the president represents the ROC in foreign relations. In Chinese, thepresidentiscalledzongtong andthevicepresidentfuzongtong ,theirofficezongtongfu (term applies both to the institution and its building in downtown Taipei). If theofficeof theROCpresidentbecomesvacant,thevicepresident(VP)servestheremainderof theterm until its expiration. Ifduring that time the VP becomes incapacitated as well, the Constitution ofthe ROC (Zhonghua minguoxianfa )providesthefollowinglineof succession:Presidentof theExecutiveYuan/Premier (xingzhengyuan yuanzhang ), Vice President ofthe Executive Yuan/Vice Premier (xingzhengyuan fuyuanzhang). Since1948,theinaugurationdateof theROCpresidentattheonsetof eachnewtermhasbeenMay20, following the election in the first quarter ofthe same year. In June 1980, its Chinese name was changed from sifa xingzhengbu to its present form. While the Legislative Yuan has the power to pass all ordinary legislation and to review legislative bills proposed by the four other Yuan, and the Judicial Yuan as the highest judicial organ oftheROCischargedwithinterpretingtheROCConstitutionandsupervisingthelowercourts,theMOJis responsibleforcarryingoutvariousjudicialfunctionsintheROClikeformulatingandreviewinglegalproposals, participatinginthelegalpreparationsandactivitiesof theExecutiveYuananditsministriesandagencies,revising the Civil Code (minfa ) and the Criminal Code (xingfa ), planning the prosecutorial system and supervising prosecutorial affairs, executing anti-corruption work, researching on the causes and prevention ofcrime, propagating the knowledge oflaw and protecting crime victims as well as handling and processing international and cross-strait legal affairs. Capital punishment in the ROCThe MOJ is the government agency in charge ofadministering the death penalty(sixing ),andtheMinisterof Justicealsoapprovespendingexecutionsandsignsexecutionorders. Although the minister does have the authority to refuse to sign an execution order, only a court oflaw can overturn a death sentence.
