BUDGET AND FINANCE COMMITTEE MEETING MINUTES

April 22, 2020

Due to statewide COVID-19 school closings the Budget and Finance Committee of the

Board of Education of the Toms River Regional Schools had a virtual committee meeting on April 22,

2020 from 6:40 P.M. to 7:40 P.M. Committee Chair, Mike Horgan, read the following opening

statement:

“Good evening, welcome to the Budget and Finance Committee Meeting of the Board of

Education of the Toms River Regional Schools. Notice of this meeting was published in the Asbury

Park Press and the Star Ledger on April 16, 2020, which constituted at least 48 hours notice as

required by law under the Open Public Meetings Act.”

In addition to the Committee Chair, in virtual attendance were Board members- Kathy Eagan,

Jennifer Howe, Kevin Kidney, Alex Mizenko, Joe Nardini, Anna Polozzo, Ginny Rhine and Michele

Williams, Superintendent- Dave Healy, Assistant Superintendents- Debra McKenna, Marc Natanagara

and Jim Ricotta, Business Administrator- Bill Doering and Board Secretary- Wendy Saxton. The

meeting was open to the public and an opportunity for public comment via email was provided.

As we do every month, the committee reviewed the expenditures listed in the Purchasing

Agenda, which was posted in the Board’s Google Docs folder prior to the Budget and Finance

Committee meeting. The Purchasing Agenda also included items of zero value, bids, change orders

and resolutions. Purchasing Agenda questions by various individual Board members were answered

by Mr. Doering and other members of the administration. The Purchasing Agenda for this month is in

the amount of $3,445,600.98 for the 2019-20 school year. The Budget & Finance Committee is

recommending the approval of the Purchasing Agenda by the full Board.

There were no District lease, sponsorship or other rental agreements for consideration this

month.

The committee was then apprised that at the April 23, 2020 Citizen’s Budget Advisory

Committee meeting, in addition to the budget being fully presented, the administration will

provide an update regarding potential offsets for some of the budget reductions previously

presented. Since the tentative budget was developed, we have received formal notification of a

number of staff retirements, we have received updated quotes for some insurances, we have been

notified that the Borough of South Toms River will cover our half of the cost for the Class III

officer at South Toms River Elementary School for $18,000 and Mr. Healy was able to negotiate a

one-year waiver of the YMCA swimming pool fee of $45,000! These items will be fully discussed

at the April 23, 2020 meeting.

BUILDINGS AND GROUNDS COMMITTEE MEETING MINUTES

April 22, 2020

The Buildings and Grounds Committee of the Board of Education of Toms River Regional Schools met on April 22,

2020, within a virtual live-streamed meeting, beginning at 8:47 P.M.

Committee Chair Joe Nardini read the following opening statement: “Good evening and welcome to the Buildings and

Grounds Committee Meeting of the Board of Education of Toms River Regional Schools. Notice of this meeting was

announced to the public through a notice published in the Asbury Park Press and the Star-Ledger on April 16, 2020,

which constituted at least 48 hours notice as required by law under the Open Public Meetings Act.”

In addition to the Committee Chair, in attendance were Board members Kevin Kidney, Jennifer Howe, Michael

Horgan, Anna Polozzo, Ginny Rhine, Alex Mizenko, Kathy Eagan, and Michele Williams; Superintendent- David

Healy; Assistant Superintendents- Debra McKenna, Marc Natanagara and James Ricotta; Business Administrator-

William Doering, Manager of Capital Projects- Mark Wagner, Manager of Facilities- Peter Tomko, and Derek Jordan

and Tom Brys of Maser Consulting. The meeting was open to the public and an opportunity for public comment was

provided.

Old Business discussion:

The Security / Central Registration changeout project continues to progress and construction completion is set for the

end of May or early June. District-wide demographic study and Facility Capacity Review continues with a request to

secure services from an outside vendor to compare data. The grant-funded outside classroom at HS North continues

with the ramp and stage ordered.

New Business discussion:

A minor renovation to the purchasing department on the third floor of 1144 continues to proceed with inspections.

Completion of the project is anticipated for next week.

Communication:

The Township Engineer contacted the district regarding property adjacent to 123 Walnut Street Facility and

Maintenance Compound. The fence replacement has started and is ongoing at this time.

Environmental:

Property in the vicinity of Pine Beach Elementary School has been noted as a CAE site by the Department of

Environmental Protection. As previously discussed at meetings, a former Cumberland Farms / Gulf gas station has

retained a Licensed Site Remediation Professional (LSRP) and is working closely with the DEP to monitor and plan an

effective clean up of this site. This firm has now sent notification requesting Board of Education approval for

additional wells to be placed on the property to monitor the groundwater. Facilities recommend permission be granted

to allow for the placement of the additional wells. The legal counsel has been consulted and agrees to the contract.

Board approval is requested for this agreement.

ESIP & Building Initiative Committee Meeting

April 22, 2020

Education of Toms River Regional Schools met on April 22, 2020, within a virtual live-streamed meeting on

the internet, beginning at 8:57 P.M.

Committee Chair Joe Nardini read the following opening statement: “Good evening and welcome to the ESIP

& Building Initiative Committee Meeting of the Board of Education of Toms River Regional Schools. Notice

of this meeting was announced to the public through a notice published in the Asbury Park Press and the Star-

Ledger on April 16, 2020, which constituted at least 48 hours notice as required by law under the Open Public

Meetings Act.”

In addition to the Committee Chair, in attendance were Board members Kevin Kidney, Jennifer Howe,

ESIP PROJECTS:

The Energy Management installation of control systems and connection points are continuing. Bi-weekly

status meetings have now become weekly virtual meetings due to Covid-19. Lighting Projects are in final

stages with the building department making final inspections and punch list items being completed.

BUILDING INITIATIVES PROJECTS: Priority I Projects were reviewed and updates provided. These projects included:

Site 174- Intermediate South exterior wall subcontractor is providing alternative solutions to the building

issue.

Security upgrades- Keyless entries, and cameras- Site 172 is out to bid with a bid receipt date of April 29,

2020.

JBAC- Air conditioning Site 168- this project is under construction and the contractor is working on gas,

utility lines, and concrete pads. The project schedule has been extended to July 10, 2020, due to equipment

manufacture delays attributable to Covid-19 .

54 Washington Street- Roof replacement Site 180A - currently out to bid with a bid receipt date of April 30,

2020.

High School East Chilled Water Piping Replacement Site 163A- Currently out to bid with a bid receipt date

of April 28, 2020.

Priority II Projects were reviewed including:

Paving-Phase II- Surveying & Documents Site 189- currently out to bid with a bid receipt date of May 1,

2020.

Phase II Projects- Beachwood, South Toms River, Joseph A. Citta Site 184- Project to be rebid in May.

North Region -Phase I Documents being prepared for HS North, Int. South, & ELC Site 181- May 1, 2020 bid

date. The process of securing approval from the Office of State Comptroller ( OSC) has been completed

allowing the project to be bid.

East Region- Phase I Documents being prepared for Int. East, Cedar Grove & Hooper Avenue Site 185-

HS East Entrance Canopy- Site 179, JBAC Sound System Upgrade- Site 169A- July 1, 2020 bid date.

Mr. Jordan of Maser Consulting took this opportunity to explain the virtual bid process, pre-bid meeting

process, contractor walkthrough process, and the newly installed drop box in the rear lobby entrance at 1144

Hooper Avenue. This dropbox will be used for bid document drop off to maintain social distancing during

the Covid-19 crisis.

Mid-month meeting- Meeting is requested for May 6, 2020, to award projects of the bids being taken in late

April.

The Citizens Budget Advisory Committee Meeting of the Board of Education of the Toms River

Regional Schools had a virtual committee meeting on April 23, 2020 at 6:10 P.M.

Board President Anna Nardini read the following opening statement: “Good evening, welcome to the

Citizens Budget Advisory Committee Meeting of the Board of Education of the Toms River Regional

In attendance were Board members Kathy Eagan, Michael Horgan, Jennifer Howe, Kevin Kidney, Alex

Superintendent David Healy; Assistant Superintendents Dr. Marc Natanagara, Debra McKenna, and

A budget overview was presented by Superintendent of Schools, David Healy.

The Curriculum and Instruction section was presented by Assistant Superintendents Debra McKenna

and Dr. Marc Natanagara.

The Co-Curricular section was presented by Assistant Superintendent James Ricotta.

The Benefits/Utilities/Insurance/General Administrative section was presented by Business

Administrator William Doering.

The Operations/Maintenance section was presented by Assistant Superintendent James Ricotta.

The Student/Special Services section was presented by Director Joy Forest.

The Transportation section was presented by Business Administrator William Doering.

The Technology section was presented by Assistant Superintendent Dr. Marc Natanagara.

The Revenue section was presented by Business Administrator William Doering.

Board comments and questions were discussed. The meeting was then opened for guests and press for

comments and inquiries.

Closing comments were made by Board President Anna Polozzo.

CURRICULUM COMMITTEE MEETING MINUTES

April 22, 2020

Due to statewide COVID-19 school closings, the Curriculum Committee of the Board of Education of

Toms River Regional Schools met virtually on April 22, 2020, beginning at 7:30 P.M.

Committee Chair Ginny Rhine read the following opening statement: “Good evening and welcome to the

Curriculum Committee Meeting of the Board of Education of Toms River Regional Schools. Notice of

this meeting was published in the Asbury Park Press and the Star-Ledger on April 16, 2020 which

constitutes at least 48 hours’ notice as required by law under the Open Public Meetings Act.”

Also in attendance were Board members Kathy Eagan, Jennifer Howe, Michael Horgan, Kevin Kidney,

Alex Mizenko, Joe Nardini, Anna Polozzo, and Michele Williams; Superintendent Dave Healy; Business

Administrator Bill Doering; Assistant Superintendents Debra McKenna, Dr. Marc Natanagara, and Jim

Ricotta; and Directors Cara DiMeo, Joy Forrest, John Green, and Dr. Estee Mailot. The meeting was

streamed live to the public and an opportunity for public comment via email was provided.

Superintendent Healy reported the results of the NJ Department of Education’s QSAC evaluation which

took place in February. For the second period in a row, the district has been rated as high performing. A

document with details has been posted on the district website.

Updates from the Department of Education clarified that state testing, which has been canceled, is no

longer a graduation requirement; most certified staff evaluations requirements have been waived for this

year; and we are waiting to see if the Governor will keep schools closed past May 15. Planning is

currently considering either a May, June, or September reopening of schools, with summer programs

being designed with both live and virtual options.

Mrs. McKenna and Dr. Natanagara provided updates on the implementation of virtual learning during the

COVID-19 school closings. Teachers, guidance counselors, SACs, child study team members, related

services providers, and administrators are working together to provide the best education and social-

emotional support possible under these circumstances. Over 1800 Chromebooks have been loaned to

families, grading is being adjusted for the final marking period, and a pass-fail option is being considered

for secondary students. The high schools still plan to have graduation ceremonies and the intermediate

school 8th grade promotion ceremonies once the Department of Education and health officials allow.

Mr. Healy presented the revised 2019-2020 district calendar, with the last day of school moved to June

12.

PERSONNEL COMMITTEE MEETING MINUTES

Due to statewide COVID-19 school closings a Personnel Committee Meeting of the Board of Education of the Toms River Regional Schools took place virtually on April 22, 2020 at 6:00 p.m. This meeting is not publicly advertised as the committee reviews personnel information which includes names of individual staff member as well as possible new staff members.

In attendance were Jennifer Howe, Chair, committee members, Alex Mizenko and Michele Williams. Site Access Agreement (CFI Grantee) 2016 Form

SITE ACCESS AGREEMENT

This Site Access Agreement (“Agreement”) is entered into by and between TOMS RIVER REGIONAL SCHOOLS (“Grantor”) and CUMBERLAND FARMS, INC. (“CFI” or “Grantee”) to allow CFI and its environmental consultants and contractors access to 101 Pennsylvania Avenue, Pine Beach, Ocean County, New Jersey (the “Property”) to perform certain environmental investigation and remediation work in accordance with the terms and conditions of this Agreement.

In consideration of the mutual covenants contained herein and other good and valuable consideration, the sufficiency of which are hereby acknowledged, Grantor and CFI agree as follows:

1. Access and Work. Grantor hereby authorizes Grantee and its environmental consultant (one or more independent contractors hired by Grantee identified in accordance with Section 9 together with their subcontractors) access to the Property to perform environmental work as particularly described as follows: (the “Work”):

Install two (2) permanent groundwater monitoring wells on the property.

Periodically access the monitoring wells for the collection of groundwater samples as part of ongoing environmental investigation and remediation activities.

Decommission the wells, as necessary.

2. Notice. Grantee agrees to notify Grantor at least five (5) days in advance of the initial commencement of the Work.

3. Grantor’s Presence. Grantor or its representative may be present for the Work and, upon request and notice to Grantee, Grantor may collect split samples and/or conduct confirmatory soil and groundwater sampling.

4. Termination. The rights and privileges granted by this Agreement shall cease upon the earlier of:

(a) completion of the Work as determined by the Grantee; (b) some other time mutually agreed by the parties; or (c) notice from Grantor pursuant to Section 14 below.

5. Work Performance. The Work shall be performed in a good and workmanlike manner and in conformity with industry standards. Grantee and its environmental consultant in exercising the rights granted hereunder shall act reasonably and minimize to the extent possible any interference with Grantor’s operations on the Property, including Grantor’s access to or use of the Property.

6. Compliance with Laws. In connection with its activities on the Property, including performance of the Work and the disposition of any wastes generated in connection therewith, Grantee shall comply with all applicable federal, state, and local statutes, regulations, rules and ordinances.

7. Confidentiality. Each party hereby agrees that it will keep the results of the Work confidential, and that neither it, its consultant, those acting on its behalf or performing the Work, will divulge such information to any third party without having obtained prior approval of the other party; provided

however, the results of the Work (a) may be disclosed by either party if required by law, (b) may be disclosed by Grantee to any government agency overseeing or requiring performance of the Work or requiring submission of documentation of the Work, and (c) may be disclosed by Grantor (i) to its lenders to the extent disclosure is required by its lenders or (ii) pursuant to a contractual obligation.

8. Copies of Reports. Within thirty (30) days of submitting to the New Jersey Department of Environmental Protection any soil and groundwater analytical data and any reports resulting from the Work, Grantee shall submit a copy of same to the Grantor.

9. Notice of Consultant. Prior to the start of the Work, Grantee shall notify Grantor in writing (using the attached “Notification of Consultant for Site Access Agreement” form) of the name, address and contact person of Grantee’s environmental consultant that will conduct the Work on the Property.

10. Restoration. At the conclusion of the Work, as soon as is practicable but in no event later than sixty (60) days after the conclusion of the Work, Grantee, at its sole cost and expense, will restore the Property affected or damaged by the Work to as close to the condition existing at the time the Work began as is reasonably possible. This Section 10 shall survive the expiration or earlier termination of this Agreement.

11. Indemnity. (a) In this Section 11 only, “Claim(s)” are defined as “claims, demands and causes of action asserted by any person (including Grantor’s, Grantee’s, and Grantee’s environmental consultant’s employees or any other third party) for personal injury or death or for loss of or damage to property directly arising from the Work.”

(b) Grantee shall indemnify, defend and hold harmless Grantor from Claims asserted against Grantor, including without limitation reasonable attorneys’ fees, directly arising out of Grantee’s or Grantee’s environmental consultant’s performance of the Work at the Property. Where claims result from the joint negligence or willful misconduct of Grantor, Grantee’s duty of indemnity shall be in proportion to Grantee’s and its environmental consultant’s allocable share of joint negligence or willful misconduct. .

(c) The foregoing indemnity is subject to Grantor providing written notice to Grantee within sixty (60) days of the date after Grantor receives an initial notice or has actual knowledge of a Claim. Until such time that Grantor provides Grantee with said notice, Grantor shall take all steps necessary to defend the Claim and to prevent prejudice to the defense and/or Grantee. In addition, Grantor shall fully cooperate with Grantee in the investigation and defense of such Claims. Grantee shall have the exclusive right to designate and retain counsel to represent Grantor in the defense of any such Claim.

(d) For the avoidance of doubt and as clarification of the foregoing subsections, Grantee’s obligations under this Section 11 do not apply to any alleged liability or responsibility of Grantee regarding any potential environmental contamination at, on, or from the Property.

(e) Section 11 shall survive the expiration or earlier termination of this Agreement.

12. Insurance. While performing the Work, Grantee and its environmental consultant shall maintain, at a minimum, the following insurance with companies having a rating by A.M. Best of A-, VII or better, with limits of liability no less than those stated below:

(a) Comprehensive General Liability: Combined single limit for bodily injury and property damage of not less than $1,000,000.00 each occurrence and $2,000,000.00 annual aggregate.

(b) Worker’s Compensation Insurance and Employer’s Liability Insurance: With limits of liability not less than those required by law.

(c) Automobile Liability: For any auto with limits of coverage not less than $1,000,000 combined single limit

(d) Grantor shall be named as an additional insured on the liability policies specified above, to the extent permitted.

(e) As an alternative to subparagraphs (a) – (c) above, Grantee may provide a program of self-insurance for itself and require that its consultants and contractors maintain the levels of insurance specified in subparagraphs (a)-(c). If Grantee opts to self-insure, Grantee shall provide Grantor with a letter of self-insurance within thirty (30) calendar days of the effective date of this Agreement or prior to any Work beginning on the Property, whichever is earlier.

13. Liens. Grantee will permit no liens of any kind to be fixed upon or against the Property, or any of Grantee’s contractors, subcontractors, or suppliers, and will indemnify and save Grantor harmless from and against all damages incurred by Grantor, including attorney’s fees, resulting from such claims and liens.

14. Default. Grantee shall be deemed to be in default hereunder if Grantee fails to promptly comply with any material term or provision contained herein and fails to cure such breach within thirty (30) days after notification by Grantor. Unless Grantor receives evidence that such breach has been cured within such thirty (30) day period, Grantor may, at its election, immediately terminate this Agreement at any time after the expiration of the foregoing cure period by notifying Grantee of such election.

15. No Admission or Assumption of Liability. No provision under this Agreement or any actions taken under or by reason of this Agreement shall be construed as an admission by Grantee of any liability, fault, past or present wrongdoing, violation of law or regulation, or any breach of duty at any time. Grantor and Grantee fully reserve their rights to pursue any claims that they have or may have against each other or any third party, and nothing contained in this Agreement shall alter or in any way affect any rights Grantor or Grantee may have against any party or any defenses Grantor or Grantee may have in response to any claims by any party.

16. Notice Procedure. Unless otherwise provided herein, any notice required or permitted to be given hereunder by one party to the other shall be in writing and delivered by hand delivery, commercial courier with fees pre-paid and proof of delivery, email with acknowledgement of receipt by a duly authorized representative, facsimile with verification of receipt, or certified mail, returned receipt requested. The effective date will be the date received per the acknowledgements and verifications indicated above, except for certified mail, wherein notice will be deemed received upon the date of acceptance, rejection or failure to accept delivery after two (2) delivery attempts. Notwithstanding the foregoing, if any notice is received after 5:00 p.m. on a business or non-business day where the addressee is located, then the notice is deemed received at 9:00 a.m. on the next business day. 17. Assignment. Grantee may assign its rights and delegate its duties under this Agreement without the prior written consent of Grantor, including without limitation, in connection with any merger, consolidation or reorganization involving Grantee (regardless of whether Grantee is a surviving or disappearing entity), or a sale of all or substantially all of Grantee’s business or assets and liabilities to an unaffiliated third party.

18. Grantor’s Notice of Access Agreement. Grantor agrees that any lease, sublease, conveyance or the like of the Property to a third party will specifically recognize the existence of this Agreement.

19. Enforceability. If any part of this Agreement is for any reason found to be unenforceable, all other portions nevertheless remain enforceable.

20. Waiver. The waiver of any breach or any term or condition of this Agreement does not waive any other breach of that term or condition or of any other term or condition.

21. Applicable Law. The laws of New Jersey, without giving effect to its choice of law principles, govern all matters arising out of or relating to this Agreement and all of the transactions it contemplates, including, without limitation its validity, interpretation, construction performance and enforcement.

22. Effective Date/Counterpart Originals. This Agreement, executed in duplicate originals, shall be effective on the date last written below.

23. Authority. Each person executing this Agreement represents that the party on whose behalf the person is executing this Agreement has duly authorized the execution of this Agreement and that such person is authorized to execute the Agreement on behalf of such party.

24. Prevailing Wage. All laborers conducting the Work on the Property shall be paid in accordance with the applicable provisions of the New Jersey Prevailing Wage Act, N.J.S.A. 3:11-56.25 et. seq.

WHEREAS, the Ocean County Department of Corrections recognizes the need for Adult

Basic Education for criminal offenders; and

WHEREAS, the Toms River Board of Education of the Toms River Regional School

District has agreed to provide these services, and

WHEREAS, funds for this agreement shall be encumbered from the Trust Account

entitled the Inmate Welfare Food / Commissary Account, Account No. 210-200-0106.

WHEREAS, the total agreement shall not exceed $35,000.00 for the period of July 1,

2020 through June 30, 2021.

WHEREAS, the Ocean County Department of Corrections wished to enter into an Inter-

Governmental Agreement with the Toms River Board of Education of the Toms River Regional

School District to provide Adult Basic Education for criminal offenders.

NOW, THERFORE, BE IT FURTHER RESOLVED, BY THE BOARD OF

INTER-GOVERNMENTAL AGREEMENT2020-2021

This Agreement made on this day of June 03, 2020 by and between the Ocean County Department of Corrections, herein after referred to as the "Jail" and the Toms River Board of Education, herein after referred to as the "Board":

WHEREAS, the Jail and the Board recognize the need to establish an Inter-Governmental Agreement for the Adult Basic Education Program for Criminal Offenders: and

NOW, THEREFORE, it is agreed by and between the parties as follows:

The Board shall provide the Jail with part time instructors to teach Basic Skills, General Educational Development, and English as a Second Language for a total of 1000 hours at the cost of $35.00 per hour. Board President Anna Polozzo thanked everyone for attending our first ever virtual

live stream meeting of the Toms River Schools Board of Education. Our staff consists of

Superintendent Healy, Assistant Superintendents, McKenna, Natanagara, Ricotta,

Business Administrator Doering, Board Secretary Saxton, Board Attorney Leone and

Attorney Burns.

SUPERINTENDENT COMMENTS

Superintendent Healy stated this is our first ever live stream board meeting. This

was a huge undertaking and to prepare the largest suburban district for online instruction.

Superintendent Healy commended our leadership team and entire support staff for

working the better part of a month to make sure that the transition was overall seamless.

Superintendent Healy stated April is National Autism Awareness Month. The

most recent statistic from the Center for Disease Control and Prevention states that

nationally 1 in 59 were identified with Autism Spectrum Disorder. New Jersey has the

highest rate of autism in the United States, with 1 in every 45 children identified with

autism spectrum disorder, according to a study by the Centers for Disease Control and

Prevention released last year. Autism is the fastest growing developmental disability in

the United States, affecting more than three million people.

In this evening’s agenda there is an approval of Resolution of the Toms River

Regional Schools Board of Education proclaiming the month of April as Autism

Awareness Month.

Superintendent Healy discussed State Aid and believes we have received some

attention with some influential law makers that are hearing us regarding the State Aid

formula and evidence of critical flaws we have been able to present on the formula. We

have not given up the fight and are relentless.

The Budget and Finance Committee of the Board of Education of the Toms River

Regional Schools met on March 11, 2020 at 1144 Hooper Avenue, Toms River, New

As we do every month, the committee reviewed the expenditures listed in the

Purchasing Agenda, which was posted in the Board’s Google Docs folder prior to the

Budget and Finance Committee meeting. The Purchasing Agenda also included items of

zero value, bids, change orders and resolutions. Purchasing Agenda questions by various

individual Board members were answered by Mr. Doering and other members of the

administration. The Purchasing Agenda for this month is in the amount of $2,826,214.78

for the 2019-20 school year. The Budget & Finance Committee is recommending the

approval of the Purchasing Agenda by the full Board.

The committee then reviewed the District lease, sponsorship and other rental

agreements and these are also being recommended for board approval.

The committee was then apprised that the 2020-21 tentative budget will be on the

March 18, 2020 Board agenda for submission to the NJ Department of Education. It was

noted that the tentative budget is a starting point, and a Citizens’ Budget Ad-Hoc

Committee meeting has been scheduled for March 25, 2020 at 6:00 PM at the HS North

Media Center whereby the details of the tentative budget will be presented.

Finally, the committee then discussed the process for the RFQ submissions for the

professionals for 2020-21 (such as attorneys, engineers, banks, etc). Most submissions

will be received on March 25, 2020.

Building & Grounds Committee – Mr. Nardini

The Buildings and Grounds Committee of the Board of Education of Toms River

Regional Schools met on March 11, 2020, in Conference Room A at 1144 Hooper

Avenue, Toms River, NJ beginning at 9:19 P.M.

Old Business discussion:

The Security / Central Registration changeout project continues to progress and

construction completion is set for May 30, 2020. District-wide capacity review continues

with an evaluation of different models within our locations. The PHC renovation is

currently in progress. A recent meeting was held with building leadership and teachers at

High School North to review quotes for the outside classroom funded by a grant.

New Business discussion:

A minor renovation to the purchasing department on the third floor of 1144 is scheduled

to be completed over spring break by our maintenance department. This shift of space

will allow for more efficient organizational operations.

Environmental:

An abandoned septic tank located in the back area of East Dover Elementary has been

remediated following DEP guidelines and consultation with our engineers regarding

abandoning this type of underground tank.. Property in the vicinity of Pine Beach

Elementary School has been noted as a CAE site by the Department of Environmental

Protection. As previously discussed at meetings, a former Cumberland Farms / Gulf gas

station has retained a Licensed Site Remediation Professional (LSRP) and is working

closely with the DEP to monitor and plan an effective clean up of this site. This firm has

now sent notification requesting Board of Education approval for additional wells to be

placed on the property to monitor the groundwater. Facilities recommend permission be

granted to allow for the placement of the additional wells, but has requested additional

insurance documents and a modified access agreement. These documents are anticipated

shortly. A review of CoronaVirus precautionary measures was discussed as our custodial

and transportation teams have been tasked with increasing daily disinfection of

surfaces/touch points in classrooms and school buses using district standard disinfection

agent Virex II 256 disinfectant product to maintain the health and safety of all students,

staff, and visitors.

Building & Grounds ESIP & Referendum Committee – Mr. Nardini

The ESIP & Building Initiative Committee of the Board of Education of Toms River

Regional Schools met on March 11, 2020, in Conference Room A at 1144 Hooper

In addition to the Committee Chair, in attendance were Board members Kevin Kidney,

the public and an opportunity for public comment was provided.

ESIP PROJECTS: The Energy Management installation of control systems and connection points are

continuing. This work is being completed in conjunction with the referendum mechanical

work. Lighting Projects are in final stages with the building department making final

inspections. Incentive applications are currently being completed to make sure all

funding due to the district is received.

Priority I Projects were reviewed and updates provided. These projects included:

Site 174- Intermediate South exterior wall where the report has been finalized and after

testing results were analyzed, the report shows that the roof that is still under warranty

will require some repairs. The major issue appears to be that the existing brick outer wall

was built without an air cavity. An outside vendor is being consulted to provide

additional options to remediate this issue.

Security upgrades- Keyless entries, and cameras- Site 172 is out to bid with a due date of

April 1, 2020.

JBAC- Air conditioning Site 168- this project is ongoing as the new mechanical units are

being ordered and manufactured. The project is on schedule at this time for completion

by late May, early June.

54 Washington Street- Roof replacement Site 180A - bids are to be received on April 1st.

High School East Chilled Water Piping Replacement Site 163A- Currently out to bid

with a due date of March 24, 2020. Anticipating to award this project at the April 1st

special meeting to provide contractor lead time for equipment delivery enabling summer

2020 completion.

Curriculum Committee – Mrs. Rhine

The Curriculum Committee of the Board of Education of Toms River Regional Schools

met on March 11, 2020, in Conference Room A at 1144 Hooper Avenue, Toms River,

New Jersey, beginning at 7:30 P.M.

Committee Chair Ginny Rhine read the following opening statement: “Good evening and

welcome to the Curriculum Committee Meeting of the Board of Education of Toms River

Regional Schools. Notice of this meeting was published in the Asbury Park Press and the

Also in attendance were Board members Kathy Eagan, Jennifer Howe, Michael Horgan,

Kevin Kidney, Alex Mizenko, Joe Nardini, Anna Polozzo, and Michele Williams;

Superintendent Dave Healy; Business Administrator Bill Doering; Assistant

Superintendents Debra McKenna, Dr. Marc Natanagara, and Jim Ricotta; and Directors

Norma DeNoia, Cara DiMeo, Joy Forrest, and Dr. Estee Mailot. The meeting was open

to the public and an opportunity for public comment was provided.

Progress on the annual district goals was discussed. In the area of student achievement,

Ms. DeNoia shared examples of K-12 tiered interventions, student formative

assessments, and the use of data to drive instruction. Under finance, Mr. Doering

emphasized the district’s leadership in the state funding fight and successful efforts in

earning grants and sponsorships, to the tune of $230,000 in new grants, $260,000 in

continuing grants, $235,000 in sponsorships, and new eligibility for federal Perkins

funding. Cost reductions from our Energy Education program have also achieved savings

of $6.5 million to date. Mr. Ricotta outlined progress to date on referendum and ESIP

projects addressing the facilities goal. The timeline is updated monthly and posted on our

district web page. Dr. Natanagara outlined progress on the technology applications to

differentiate instruction, provide new career and technical education opportunities, and

lead the district in the state Computer Science for All initiative. Superintendent Healy led

the discussion of the community and communications goal. A dozen new community

partnerships have been formed this year to support student programs; staff are involved in

state, regional, and community organizations and presentations; and each month, dozens

newspaper articles, web pages, and social media posts are generated to inform the

community and celebrate staff and student accomplishments.

The 2020 QSAC process, which assesses every aspect of district operations, was

completed by the NJ Department of Education’s Executive County Superintendent’s

Office on February 26 and 27. The verbal feedback received at the time was positive and

we are still awaiting the official results.

Dr. Mailot presented on the 2019 NJ Student Learning Assessment Science results, the

first year of the new test that counts as the district baseline. It is hoped that the state will

release details of the results to allow staff to revise curriculum and instruction to improve

student performance. The idea of an algebra-based physics course was discussed as a

means to improve results on the 11th grade test.

Under other business, a tentative Board resolution opposing state testing was presented

for discussion; guidelines for K-12 homework practices were discussed; and the latest

information on COVID-19 and virtual school days is being shared with the community

and updated almost daily on the district webpage.

Personnel Committee – Mrs. Howe

A Personnel Committee Meeting of the Board of Education of the Toms River

Regional Schools took place at the Administrative Offices, 1144 Hooper Avenue,

Conference Room A, Toms River, New Jersey on March 11, 2020 at 8:30 p.m. This

meeting is not publicly advertised as the committee reviews personnel information which

includes names of individual staff member as well as possible new staff members.

In attendance were Jennifer Howe, Chair, committee members, Alex Mizenko and

Michele Williams. Also attending was Anna Polozzo, Board President.

The meeting was opened at 6:00 p.m. by Jennifer Howe. David Healy,

Superintendent, discussed with the members was recommendations for extra-curricular

positions being recommended for employment and job descriptions at the board meeting

on Wednesday, March 18, 2020.

Ms. Morrison thanked the entire district for making the transition to online education

seamless for our children during this crisis and for the free/reduced meals.

Ms. Remelgado discussed impending 2020-21 budget cuts, student education without

access to non-mandated programs.

Ms. Runion discussed employee pay during the COVID19 shut down and sick leave.

Ms. Siciliano asked Superintendent Healy what his discussion was with Senator

Sweeney.

Mr. Nesteriak discussed video conference platforms for students.

A motion was made by Mrs. Rhine, seconded by Mrs. Howe and carried that the

meeting be adjourned at 8:31 P.M.
