MINUTES PLANNING & ZONING COMMISSION The Brandon Planning & Zoning Commission met in regular session at 6:30 p.m. on July 16, 2020 at the Brandon City Council Chambers. Roll call was taken. Members present were Commissioners Brian Heidbrink, Brookes Noem, Chuck Parsons, Rob Schoeneman, Jim Starzl and Alica Thiele. Also present were Building Official Paul Clarke; City Administrator, Bryan Read and City Engineer Tami Jansma. Absent were Alderman Tim Jorgenson and Mayor Paul Lundberg. Vice-Chairperson Alica Thiele chaired the meeting. Commissioner Parsons moved Commissioner Heidbrink seconded to approve the agenda. Motion carried. Commissioner Noem moved Commissioner Parsons seconded to approve the consent calendar which contained the following items: a plat of Gehrke Addition Tracts 1, 2 & 3; a plat of Graff’s Subdivision Lot 10A; a plat of Heartland Business Park Addition Lot 8A & 10 Block 3 and a plat of Twin Rivers Crossing Addition Lot 8 Block 2 Motion carried. Commissioner Heidbrink moved Commissioner Starzl seconded to approve the minutes of the June 18, 2020 regular meeting. Motion carried. At 6:33 p.m. Commissioner Parsons moved Commissioner Schoeneman seconded to adjourn the Planning & Zoning Commission meeting. Motion carried. At 6:33 p.m. Vice-Chairperson Thiele called the Board of Adjustment meeting to order. Roll call was taken. Members present were Commissioners Brian Heidbrink, Brookes Noem, Chuck Parsons, Rob Schoeneman, Jim Starzl and Alica Thiele. Also present were Building Official Paul Clarke; City Administrator, Bryan Read and City Engineer Tami Jansma. Absent were Alderman Tim Jorgenson and Mayor Paul Lundberg. Commissioner Heidbrink moved Commissioner Starzl seconded to approve the agenda. Motion carried. A Variance Application for 1501 E. Rushmore Drive was presented. Applicant Joel McCulley, 1501 E. Rushmore Drive, was present for discussion. Joel is requesting a variance for the parking pad he recently installed on his property that does not meet the second front yard setback requirement. The required setback is 20’, the parking pad currently measures 16’ from the property line. Commissioner Parsons moved Commissioner Heidbrink seconded to deny the Variance Application as presented. Motion carried.

At 6:58 p.m. having no further business, Commissioner Parsons moved Commissioner Noem seconded to adjourn the Board of Adjustment meeting. Motion carried. At 6:58 p.m. Vice-Chairperson Thiele reconvened the Planning & Zoning Commission meeting. I-90 Plaza Concept Plan was presented. Daryl Vierick, 7321 W. 65th Street, Sioux Falls and Pat Schwebach, 26779 Country Acre Drive, Sioux Falls were present for discussion. Daryl discussed his concept for developing the southeast corner of N. Splitrock Blvd. and I-90 into a commercial development. Plans to develop with fast food/steakhouse, movie theatre, bank, hotels, convention center, grocery store, convenience store, lake. Roads would be private, association would maintain, snow removal, etc. Want to begin construction in 2021. Would be an entrance off E. Birch Street, through the residential neighborhood. Concerns with increased traffic through the residential neighborhood. No action required at this time. Gaylene Mielke, 1616 E. Legacy Circle, was present for discussion. Gaylene expressed her concerns with increased traffic in this residential neighborhood. Joe Brock was present via Zoom and expressed his concerns with increased traffic through his residential neighborhood along E. Birch Street. Holly Park Sand Mine Concept Plan was presented. Harold Gate, 3501 River Bluff Road, Sioux Falls and Eric Willadsen, Willadsen Lund Engineering, 902 S. Cleveland Avenue, Sioux Falls were present for discussion. Harold wants to develop a portion along W. Holly Blvd. into a sand extraction operation as phase I, and then high density residential/commercial in phase II. Approximately 50-60 trucks per day, less during the winter months. Would like to start in 2021. Building Permits for June were presented – #20200189 - #20200247. No action required. At 8:07 p.m., having no further business, Commissioner Parsons moved Commissioner Heidbrink seconded to adjourn the Planning & Zoning Commission meeting. Motion carried.

15-14-6 FENCE REGULATIONS Fences may be erected in required yards, provided they meet or exceed the following requirements: A. No barbed wire fence shall be erected or maintained, except in LI or HI Districts.

In those districts, all barbed wire must be at least six (6) feet above grade.

B. Exposed electrical and other abnormally dangerous fences are prohibited within all zoning districts.

C. No fence shall be erected or maintained in such manner as to unreasonably

obstruct the view of others or their access to light or air.

D. R-1, R-2, R-3, or R-4: Fences may be erected or maintained, provided that no fence over four (4) feet in height shall be erected or maintained in any front yard. On corner lots and double frontage lots, fences shall be no more than four (4) feet in height in the front yards; however, fences no more than six (6) feet in height may be allowed in the second front yard. In no case shall fences exceed a height of six (6) feet.

E. CB, GB, LI, HI, or IN: Fences not exceeding eight (8) feet in height may be

erected or maintained up to the lot's property lines.

F. No fence shall be erected that violates Chapter 15-14-1. A fence may be allowed in the required site triangle if the fence is not more than thirty percent (30%) solid.

G. Chain link fences for public tennis courts, public basketball courts, public baseball

fields, or similar outdoor public recreational uses may be constructed to a maximum height of twenty-four (24) feet provided that the fence is not located within the required setback area.

H. Fences that are adjacent to alleys shall be set back five (5) feet from the

street/boulevard right-of-way.

I. The side of the fence considered being the face (facing as applied to fence post) shall face abutting property.

J. Any fence placed within an easement that impedes the access or intended use of

that easement may be removed by the City or the City's representative at its owner's expense. Fences permitted in a drainage easement shall be either ninety percent (90%) open or at least two (2) inches above grade. No fence is allowed in a drainage easement if the cumulative width of the easement is greater than twenty (20) feet.
