Background History: Lake Forest was subdivided into two additions between 1947 and 1955. These subdivisions are not controlled by any covenants but are within the Three Lakes Design Review Area. Lots 2 & 3 are contained within the first filing of the subdivision. A copy of the PLAT that shows lots 2 & 3 are included as an exhibit to this report. Lots 2 & 3 total 0.96 acres. Lot 3 has a home that was constructed previously. The owner that constructed the house used Lot 2 as the primary access to the house and owned both lots. The residence has since been sold twice along with Lot 2 as an essential addition to Lot 3. The primary access to this residence, since it was built, has been along an access easement running through the north section of these properties and onto Lot 2 which accessed the front of the residence. Recently the first owner along this access easement decided to block his portion of the easement causing the applicant to construct a new driveway on the south of his property. The previous access from the North is still used and needed to access the front of the residence. In the future the applicant plans to build a detached garage between the existing access and the residence. This amendment would allow sufficient space for this building, as a side setback would not be required. These lots have been sold and used as one lot for numerous years and it would not make sense at this point to sell them individually. Therefore, the applicant wants to combine the lots and have it considered one from this point forward. Project Description: The applicant is proposing an amended final plat that will vacate the common lot line of Lot 2 and Lot 3. The reason for the application is to combine the two lots. They have been used as one lot since the house was built with a retaining wall crossing over the common lot line. The driveway also crosses both lots. The applicant also plans to build a detached garage on Lot 2 at a later date.

Compliance with the Grand County Master Plan, Zoning, Subdivision Regulations, CRS 43-2-301 et al – Vacation Proceeding: Roads, Streets and Highways

I. Master Plan The proposed application is not located in either a GC-Urban or Rural Growth Boundary and is in compliance with the Grand County Master Plan. (a) Future Considerations In the future, we should consider these types of updates (i.e. building envelope revisions, lot consolidations, lot line adjustments) through a simplified administrative approval process, rather than the full process for a subdivision. II. Zoning – Section 4.1, Residential Zone District Proposed use of the lot is single family residential. Single Family Residential is permitted in the Residential zone district. Amended Lot 2A area is 0.96 acres. The lot as it is proposed complies with County Zoning Regulations III. Subdivision – Section 4.4, Amended Final Plat Amended Final Plat shall be reviewed under the Final Plat provisions of the Subdivision Regulations. 4.3 Final Plat The amended final plat shall contain or be accompanied by the following information: (a) Title (which shall include the phrase “Amended Final Plat”), bar scale, North arrow and date). The title of the plat shall be amended to read:

(b) Legal description of property, together with a complete reference to the book and page of records of the County

Clerk and Recorder where the conveyance to the applicant is recorded. This requirement is met.

(c) Primary control points, or descriptions, and ties to such control points, to which dimensions, angles, bearings, and similar data on the plat shall be referred.

This requirement is met. (d) Tract boundary lines, right-of-way lines of streets, easements and other rights-of-way, and property lines of

residential lots and other sites, with accurate dimensions, bearings or deflection angles, and radii, arcs, and central angles of all curves with long chord bearings and distances.

This requirement is met. (e) Names and right-of-way width of each street or other right-of-way. This requirement is met. (f) Location, dimensions and purpose of any easement, including reference by book and page to any pre-existing

recorded easements. This requirement is met. (g) Number to identify each lot or site and acreage of each site to nearest 1/100th of an acre This requirement is met. (h) Purpose for which sites, other than residential lots, are dedicated or reserved. This requirement is met. (i) Location and description of monuments. This requirement is met. (j) Current title commitment. This requirement is met. (k) Statement by owner platting the property and dedicating the streets, rights-of-way, easements and any sites for

public uses. To be corrected as follows:

and other ways and places shown on the accompanying plat for the use of the public forever; and does hereby dedicate those portions of said real property which are created as easements on the accompanying plat to the use of the public forever as

easements for the purposes shown hereon, unless otherwise expressly provided thereon; and do hereby grant the right to install and maintain necessary structures to the entity providing the services for which the easements are established.

(m) Certificates for approval by the Planning Commission and the Board of County Commissioners. This requirement is met. (n) Certification by a qualified professional engineering, designing or planning firm, insuring compliance with the

design standards and all other requirements of the Grand County Subdivision Regulations, as follows: A planner’s certificate is not required. (o) A two and one-half by three inch (2 1/2" x 3") vertical box in the lower right hand corner shall be provided for use

by the County Clerk and Recorder. This requirement is met. (p) Executed original Restrictive Covenants and Articles of Incorporation and Bylaws of any Owners’ Association and

filing with the Secretary of State of Colorado. This requirement is not applicable.

(p) Documented proof of legal access. This requirement has been met. (q) A vicinity map. This requirement has been met. (r) The subdivider shall provide storm drainage plans, property survey, proof of ownership, sanitary sewer plans. This requirement has been met. Proof of ownership and property survey have been provided. The other requirements are not applicable. (s) The subdivider shall provide sites and land areas for schools and parks when such are reasonably necessary to

serve the proposed subdivision and the future residents thereof. This requirement is not applicable. (t) No subdivision shall be approved until such data, surveys, analyses, studies, plans and designs as may be required

by this section and by the County Planning Commission or the Board of County Commissioners have been submitted.

This requirement is met. (u) Major Activity Notice This requirement is not applicable. (v) Each month the Board of County Commissioners shall submit copies of the notice of filing to the Colorado Land Use

Commission. The Colorado Land Use Commission does not exist. (w) An 11” x 17” plat with approved addresses and road number as required. An address mylar is not required.

Recommendation  Staff recommends approval of Amended Final Plat, Davis Filing, Amended Lake Forest 1st Addition, a REPLAT of Lot 2 and Lot 3, Block 2, Lake Forest 1st Addition, Reception No. 76469 and the consolidation of Lots 2 and 3, Lake Forest 1st Addition with the following conditions:  1.  The title of the plat shall be amended to read:
