Rodney Chatman provided background and historical information that led up to the drafting of the model ordinance. He then provided an overview of the ordinance and advised he was seeking the PAC to endorse the ordinance as drafted.

C. Complete Streets Program Recommendation

Chelsea Favero updated the PAC members regarding the recommendations made by the Complete Streets Program subcommittee. She outlined each of the awards given. She advised these recommendations would be going before the Forward Pinellas Board at its next meeting and funding would begin in July of this year.

4. PLANNING TOPICS OF INTEREST A. Transit-Oriented Land Use Vision Map

Discussion

Linda Fisher reported that the Board has begun a discussion of the Vision Map, and whether the Greenlight Pinellas light rail transit (LRT) line should be replaced by other potential transit lines. She described the intended purpose of the map as both regulatory and visionary. Overall the PAC members felt that the LRT line should be kept on the map, but that other potential transit routes should be added, possibly without the station circles. They were also supportive of the possibility of having two maps; one for visioning and one for regulatory use. This topic will be further discussed at the upcoming Forward Pinellas Board Work Session on March 31, 2017.

B. Coastal High Hazard Area (CHHA) Update

Linda Fisher advised the PAC about the new Coastal High Hazard Area (CHHA) map that was released in July 2016. She related that this map should be the one being adopted into local comprehensive plans. It was discussed that evacuation clearance times may change as a result of the new map which could also affect local comprehensive plans. Rodney Chatman suggested that Forward Pinellas would send out information comparing the total acres included in the CHHA previously and currently. Linda Fisher offered to share the shapefiles with anyone who needed them.

5. OTHER PAC BUSINESS/PAC DISCUSSION AND UPCOMING AGENDA

A. Pinellas SPOTlight Emphasis Areas Update

Rodney Chatman briefly updated the PAC on the SPOTlight Emphasis Areas noting that Forward Pinellas continues its work with Pinellas County regarding the Economic Development Study for US 19 to include Tarpon Springs and Largo. Work also continues on the SR 60 multimodal implementation study. He advised that letters are going out from Forward Pinellas to the four local governments requesting funding for the Gateway Master Plan.

3A. Case CW 91-13 (SAP Change No. 5-2017) – City of Pinellas Park SUMMARY From: Activity Center (AC) To: Activity Center (AC) Area: 1.7 acres m.o.l. Location: 7651 US Highway 19 This proposed amendment is submitted by the City of Pinellas Park and seeks to amend a property totaling approximately 1.7 acres from and to AC (used to recognize those areas of the county that have been identified and planned for in a special and detailed manner, serve as identifiable centers of business, public, and residential activity that are the focal point of a community, and are served by enhanced transit commensurate with the type, scale, and intensity of use). The City of Pinellas Park proposes to amend the permitted density, intensity and uses on a parcel located within the Activity Center governed by the Pinellas Park Community Redevelopment Plan, providing for: an increase in the maximum permitted density from 12.5 to 24 dwelling units per acre; a decrease in the maximum permitted floor area ratio from 0.65 to 0.55; and a change in permitted uses from predominantly institutional to predominantly commercial in nature. The property is currently vacant, and is proposed to become an expansion to the existing automotive dealer (Crown Honda) to the north. FINDINGS Staff submits the following findings in support of the recommendation for approval:

A. The AC category recognizes the proposed use of the site, and is consistent with the criteria for utilization of this category.

B. The proposed amendment either does not involve, or will not significantly impact, the remaining relevant countywide considerations.

Relevant Countywide Considerations: 1) Consistency with the Countywide Plan and Rules – The City of Pinellas Park

proposes to amend the Countywide Map designation from Activity Center to Activity Center. The current and proposed Activity Center category is used to recognize those areas of the county that have been identified and planned for in a special and detailed manner, serve as identifiable centers of business, public, and residential activity that are the focal point of a community, and are served by enhanced transit commensurate with the type, scale, and intensity of use. The City of Pinellas Park proposes to amend the permitted density, intensity and uses on a parcel located within the Activity Center governed by the Pinellas Park Community Redevelopment Plan, providing for: an increase in the maximum permitted density from 12.5 to 24 dwelling units per acre; a decrease in the maximum permitted floor area ratio from 0.65 to 0.55; and a change in permitted uses from predominantly institutional to predominantly commercial in nature. The property is currently vacant, and is proposed to become an expansion to the existing automotive dealer (Crown Honda) to the north.

2) Adopted Roadway Level of Service (LOS) Standard – The amendment area is

located on U.S. Highway 19, which is classified as a major arterial roadway. It is operating at an LOS of “F”. Based on the City’s comprehensive plan, the traffic generation rates will change from 67 trips per day (Institutional, “other” use) to 487 (Commercial General) per acre. That increase will have a de minimus impact on the 1,026-acre Activity Center as a whole. The property owner will be subject to the Pinellas County Multimodal Impact Fee Ordinance which will be assessed at the time of the final site plan submittal.

3) Location on a Scenic/Noncommercial Corridor (SNCC) – The amendment area is

not located on a SNCC, so those policies are not applicable. 4) Coastal High Hazard Areas (CHHA) – The amendment area is not located in a

CHHA, so those policies are not applicable. 5) Designated Development/Redevelopment Areas – The subject parcel is located

with the Community Redevelopment Area (CRA). However, there was no consideration of special provisions for redevelopment of this parcel in the adopted Community Redevelopment Plan. Therefore, this amendment is deemed consistent with the Community Redevelopment Plan.

6) Adjacent to or Impacting an Adjoining Jurisdiction or Public Educational Facility – The proposed amendment area is not adjacent to the unincorporated Pinellas County or adjacent to or impacting a public educational facility, so those policies are not applicable.

Conclusion: The proposed amendment is deemed consistent with the Relevant Countywide Considerations found in the Countywide Rules.

3B. Case CW 17-2 – City of Pinellas Park SUMMARY From: Retail & Services (R&S) and Target Employment Center To: Employment (E) and Target Employment Center Area: 1.9 acres m.o.l. Location: 11425 66th Street This proposed amendment is submitted by the City of Pinellas Park and seeks to amend a property totaling approximately 1.9 acres from R&S (used to depict areas developed with a mix of businesses that provide for the shopping and personal service needs of the community or region, provide for employment opportunities and accommodate target employment uses, and may include residential uses as part of the mix of uses) to E (used to depict areas that are developed with, or appropriate to be developed with, a wide range of employment uses, including primary industries (i.e., those with a customer base that extends beyond Pinellas County), allowing for flex space, and for uses that have minimal external impacts). The current and proposed Target Employment Center category is an overlay used to depict those areas of the county that are now developed, or appropriate to be developed, in a concentrated and cohesive pattern to facilitate employment uses of countywide significance. The subject property has been utilized used for retail/storage. The proposed use is for granite fabrication and manufacturing. If approved, this amendment will be consistent with the Pinellas Park Comprehensive Plan. FINDINGS Staff submits the following findings in support of the recommendation for approval:

CW 17-2 Forward Pinellas Staff Analysis

Relevant Countywide Considerations: 1) Consistency with the Countywide Plan and Rules – The City of Pinellas Park

proposes to amend the Countywide Map designation from Retail & Services and Target Employment Center to Employment and Target Employment Center. The current Retail & Services category is used to depict areas developed with a mix of businesses that provide for the shopping and personal service needs of the community or region, provide for employment opportunities and accommodate target employment uses, and may include residential uses as part of the mix of uses. The proposed Employment category is used to depict areas that are developed with, or appropriate to be developed with, a wide range of employment uses, including primary industries (i.e., those with a customer base that extends beyond Pinellas County), allowing for flex space, and for uses that have minimal external impacts. The current and proposed Target Employment Center category is an overlay used to depict those areas of the county that are now developed, or appropriate to be developed, in a concentrated and cohesive pattern to facilitate employment uses of countywide significance. The subject property has been utilized for retail/storage. The proposed use is for granite fabrication and manufacturing. If approved, this amendment will be consistent with the Pinellas Park Comprehensive Plan.

2) Adopted Roadway Level of Service (LOS) Standard – The amendment area is not located on a roadway operating at an LOS of “F”, therefore those policies are not applicable.

3) Location on a Scenic/Noncommercial Corridor (SNCC) – The amendment area is

not located on a SNCC, so those policies are not applicable. 4) Coastal High Hazard Areas (CHHA) – The amendment area is not located in a

CHHA, so those policies are not applicable. 5) Designated Development/Redevelopment Areas – The amendment area is not

located in a redevelopment area, so those policies are not applicable. 6) Adjacent to or Impacting an Adjoining Jurisdiction or Public Educational

Facility – The proposed amendment area is adjacent to the unincorporated Pinellas County and is also adjacent to or impacting a public educational facility. Pinellas County Planning Department and Pinellas County School Board staff found no immediate issues with this amendment area changing from Retail & Services and Target Employment Center to Employment and Target Employment Center, and will have an opportunity to comment at the Planners Advisory Committee meeting.

Conclusion: The proposed amendment is deemed consistent with the Relevant Countywide Considerations found in the Countywide Rules.

4A. Transit-Oriented Land Use Vision Map Follow Up SUMMARY At the Planners Advisory Committee (PAC) meeting in February a discussion took place regarding the Transit-Oriented Land Use Vision Map and whether or not the Greenlight Pinellas light rail transit (LRT) line should be removed and/or replaced with other corridors. Overall the PAC members felt that the LRT line should be kept on the map, but that other potential transit routes should be added, possibly without the station locations. They were also supportive of the possibility of having two maps; one for visioning and one for regulatory use. The Forward Pinellas Board plans to take up this matter in more depth at its work session on March 31, 2017. Forward Pinellas staff will provide an update to the PAC regarding any outcomes resulting from the work session. ATTACHMENT(S): None ACTION: None required; informational item only

4B. Pinellas County Stormwater Manual SUMMARY Over the last couple of years Pinellas County has worked with the development community as well as regulatory agencies to develop a comprehensive and systematic approach that incorporates a variety of traditional and green infrastructure (i.e. low impact development) options to address stormwater quantity/quality impacts as redevelopment occurs. This initiative is in keeping with Pinellas County’s commitment to superior environmental stewardship and will enable the redevelopment, adaptive reuse, and/or retrofit of sites around the county in a responsible and sustainable manner. The manual does not deviate from typical stormwater quantity and conveyance requirements however, in an effort to incentive redevelopment, promote urban regeneration and provide adequate water quality treatment, the manual includes a pollutant reduction methodology when calculating the required water quality treatment. This enables the development community to utilize a variety of best management practices (BMPs), not just typical wet or dry ponds, to meet their water quality requirements. Case studies were also developed to demonstrate the use of the manual. The case studies included a cost analysis of implementing these techniques as well as other benefits associated with the new standards and mechanisms to meet those standards. On February 21, 2017, the stormwater manual (http://www.pinellascounty.org/plan/pdf_files/PC_Stormwater_Manual.pdf) was adopted by the Board of County Commissioners (BCC) with an effective date of April 1, 2017. In order to ensure that engineering consultants and municipal partners have a good understanding of the manual, Pinellas County is holding two one-day workshops to introduce the manual and instruct participants in its use during the development, design, and permitting processes. The workshops include an overview and introduction to an industry program known as BMPTRAINS, which is the current Florida standard for modeling and BMPs. The workshops will be held in the Magnolia Room of Pinellas County Extension, located at 12520 Ulmerton Road in Largo, on the following dates:

5B. Truth in Annexation Online Worksheet – Update for 2016/17 Fiscal Year

SUMMARY Since 2006, we have maintained an interactive online worksheet known as “Truth in Annexation,” which allows unincorporated county residents to estimate the cost of property taxes, utility taxes, and service fees before and after annexation into a given municipality. This year, in addition to updating the calculation data to the current fiscal year, we are relaunching the application on our new Forward Pinellas website. Staff will give a brief demonstration of the new worksheet at the April meeting. We appreciate the assistance of everyone who responded to our request for updated local tax and fee information in the last few weeks. If additional changes are needed, now or during the remainder of the year, please let us know. Your input helps us keep the worksheet as accurate and useful as possible. At the request of the board, we have also tracked usage of the worksheet since 2008, as shown below.

5C. Legislative Update SUMMARY The 2017 Legislative Session began on March 7, with more than 1,700 bills filed. A summary prepared by the Florida Chapter of the American Planning Association (APA), including a broad array of bills filed dealing with land use, economic development and other planning issues, is attached for your reference. We will keep the Board and advisory committees updated as the legislative session continues. In the interim, a few bills of interest are summarized below. Community Redevelopment Areas HB 13, filed by Representative Raburn, would have significant impacts on Community Redevelopment Areas (CRAs). The bill proposes to:

Prohibit the creation of new CRAs as of July 1, 2017.

Prohibit existing CRAs from issuing new debt or initiating new projects on or after October 1, 2017.

Require termination of an existing CRA on the expiration date stated in the agency’s charter or on September 30, 2037, whichever is earlier. If the CRA has outstanding bond obligations past both of those dates, it may continue to exist until the maturity of the bond, but may not extend them.

Declare any CRA reporting no revenues, expenditures, or debt for three consecutive fiscal years to be inactive.

The bill is moving quickly, having passed one subcommittee with only one more remaining. Companion SB 1770 is moving more slowly, having been referred to four subcommittees, one of which deferred consideration of the bill at its first agenda appearance. Vacation Rentals The original version of SB 188 filed by Senator Steube, and companion bill HB 425 filed by Representative La Rosa, would have broadly prohibited local governments from regulating vacation rentals based on classification, use or occupancy. The language of both bills has since been amended, and now states that a local law, ordinance or regulation may regulate activities that arise when a property is used as a vacation rental provided that the regulation applies uniformly to all residential properties. However, local governments may not prohibit vacation rentals or regulate the duration or frequency of rentals. The provisions do not apply to a local law, ordinance or regulation adopted on or before June 1, 2011, unless it is being amended to be less restrictive. Both bills are moving steadily through the subcommittee process. Conversely, a competing pair of companion bills, SB 1516 filed by Senator Rader and HB 6003 filed by Representatives Richardson and Moraitis, would reverse the current prohibition on local regulation of vacation rentals altogether. These bills have not yet been heard by any subcommittees.

Medical Marijuana There are currently several different bills proposing to implement Amendment 2 by allowing and regulating broader use of medical marijuana. These bills have overlapping provisions and will likely evolve rapidly during the session. Highlights include:

SB 406 filed by Senator Bradley, SB 1666 filed by Senator Braynon, and SB 1758 filed by Senator Grimsley are similar bills that require the Department of Health to register caregivers of medical marijuana patients as well as the patients themselves, and create a process for certifying medical marijuana treatment centers, provisions that are also found in the bills listed below. SB 406 has been placed on one subcommittee agenda for April 3, while SB 1666 and SB 1758 have not yet begun to move through their subcommittees. None of the bills has a House companion.

SB 1388, filed by Senator Artiles, is similar to the above bills, but contains additional provisions for creating and regulating medical marijuana testing facilities. It has not yet begun to move through its subcommittees and does not have a House companion bill.

SB 614, filed by Senator Brandes, allows companies to be licensed in different capacities of the industry simultaneously (i.e., growing, processing, transporting, and/or dispensing), and would eliminate limitations on how many medical marijuana treatment centers can exist. It has not yet begun to move through its subcommittees and does not have a House companion bill.

HB 1397, filed by Representative Rodrigues, creates a sales tax exemption for medical marijuana, provides for the establishment of testing laboratories, and includes a $9 million appropriation to help implement Amendment 2. The bill has passed one subcommittee thus far and does not have a Senate companion bill. HB 7095, filed by Representative Plasencia, is a “linked” bill that would exempt medical marijuana patients from public records laws. It has not yet begun to move through its subcommittees and does not have a Senate companion bill.

SB 1472, filed by Senator Galvano, establishes the Coalition for Medicinal Cannabis Research and Education within the H. Lee Moffitt Cancer Center and Research Institute. The bill has passed one subcommittee thus far. Companion HB 1177, filed by Representative Toledo, has not yet begun to move through its subcommittees.

TBARTA Of particular relevance to transportation planning in Pinellas County is SB 1672, which was filed by Senator Latvala and has received a great deal of attention. Early reporting erroneously stated that the bill seeks to merge the MPOs in the Tampa Bay region, but it is purely about reorganizing the Tampa Bay Area Regional Transportation Authority (TBARTA) with a narrower focus on developing regional transit within the four-county area of Pinellas, Hillsborough, Pasco and Manatee Counties. A summary and observations by our executive director are provided below:

The bill renames TBARTA as the Tampa Bay Area Regional Transit Authority, and requires that it undertake a Regional Transit Development Plan (TDP). Since 1990, Florida has required a Transit Development Plan for each transit agency to be eligible for transit block grant funding from the state. It’s not clear if this is just a regional version of the TDPs that HART and PSTA now produce, taking from each to create the regional plan, or something altogether different in scope. The Regional TDP could potentially serve as an implementation plan for the Tampa Bay Premium Transit Plan currently under development by HART, although this too is unclear.

The bill does not mention the role of the MPOs (or MPO) in helping to develop, coordinate or review the Regional Transit Development Plan, and thus, would appear to separate transit planning and project development from the MPO process.

The bill would mandate that TBARTA assess whether to sustain, modify or eliminate its current committee structure, including the MPO Chairs Coordinating Committee (CCC), which is the only

reference to the MPOs and their role. If the CCC goes away, we lose the formal coordination mechanism in place for all of the MPOs in the 8-county Tampa Bay region.

It’s unclear how this new TBARTA relates to the Tampa Bay TMA Leadership Group (MPOs in Pasco, Pinellas and Hillsborough).

The bill does not provide any additional funding to accomplish its tasks, and it’s unclear where TBARTA would get staff/administrative funding support, other than by request of the local governments, which is the current practice.

Any other contiguous county that is party to an agreement of participation may join the new TBARTA, but it appears they would have no direct representation on the board.

Cities like Tampa and St. Pete, which have the most demand for transit service, would have no direct representation.

An amended version of the bill with minor changes to the governing board membership is currently under review. A companion bill, HB 1243, filed by Representative Raulerson, also includes the membership changes. Both bills are moving through the subcommittee process. Another bill, SB 1720 filed by Senator Rouson, is a strike-all amendment that would abolish TBARTA altogether. It was not yet been heard by any subcommittees, and does not have a House companion bill. state-of-the-practice of transportation planning across the eight

counties of West Central Florida. The May 12 collaborative workshop

will then focus on how do we get better results by working together.

Defining what successful regional coordination means for Tampa Bay,

and identifying barriers to it, will guide the next phase of the study:

independent research into national best practices. A second

collaborative workshop will be held after that research is complete.
