I am sure there is going to be court challenges due to differences in interpretation along with many therapists losing work and many practices having to tighten the purse strings or all together close. Most of you know the problems chiropractors are having in Texas and with healthcare reform on the forefront, it seems that we are in very uncertain times. I still remain optimistic. That being said, please read Dr. Woody Brown’s article on PIP. It raises some very key points and is very comprehensive. Our next general meeting will be March 27, 2012. The speakers will be Steven “Woody” Igou and Dr. Herbst. The topic will be traumatic brain injury. I hope to see most of you there. Being the editor of a Chiropractic publication in Florida, I feel the

need to write about PIP. I’m sure you know the gist of what took

place in Tallahassee in the last few days of the legislative session

this year. I am going to give you my take on the situation. First and

foremost, it is clear that the governor is no friend of chiropractic.

The original House bill, sponsored by Representative Boyd from

Bradenton, excluded chiropractic entirely as a treatment available

under PIP. Senator Negron’s proposal over in the Senate was much

more palatable for chiropractors and seemed to be more focused on

actually reducing fraud. The resulting compromise was essentially

the HB119 with an amendment to include chiropractic limited, in

most cases, to $2500. Reports from the frontline is that Governor

Scott and CFO Atwater pushed hard, in the final hours, for

leadership in the House and Senate to favor the more restrictive

House bill.

How did this happen? The fact is that people are committing fraud

in Florida. Clinic owners are staging accidents and billing for

services that aren’t even performed. Last month Tampa saw nine

people arrested in three clinics that allegedly were fraudulently

billing PIP insurance. The names of these clinics: Tampa Rehab

Center, Auto Injury Doctors of Tampa and PVC Medical Center. In

2010, 53 people were arrested in Tampa at four different clinics for

staging accidents and fraudulently billing PIP. Those clinics were:

Doctor Florida Rehabilitation, Healing Touch, Injury Health Care

Therapy, and Recovery Rehabilitation Services. Notice that none of

the clinics that were busted in Tampa have ‘Chiropractic’ in their

name. Out of the 62 arrests, I couldn’t find a single person who

was a chiropractor. I will get back to that. It’s clear that a problem

exists with PIP. There are people scamming the system and driving

up insurance costs for Floridians.

Floridians have this problem and most elected officials really

delight in solving problems for their constituents. Obviously many

of the folks elected to represent Floridians in the Senate and

House have very little real world knowledge of PIP. They learn

much of what they know from stake holders in the debate.

Stakeholders who contribute money, help in campaigns and stay in

contact with tend to have an easier time getting the attention of the

decision makers. All the contributions in the world wouldn’t sway

some of the people I heard debating in Tallahassee. A few

legislators simply do not value what chiropractors do. They look at

the problem of PIP fraud as an opportunity to limit the practice of

chiropractic in Florida.

Going forward, I really think the chiropractic profession as a whole

can do a better job of being involved in the political process. While

it would be hard to match the contributions that large corporations

such as insurance companies and hospitals, we should all know our

representatives by name and they should know us. Go to

fundraisers and give what you can. Introduce yourself and make

sure candidates know what you do. I don’t think PIP will be

re-addressed while Governor Scott is in office, but it will come up

again. When it does, I hope we are better poised to protect our

interests and the interest of our patients.

Bottom line is that the state government, in an effort to fix a real

problem, sided with insurance companies. I’m not entirely sure

why, but I have my suspicions.

How it will affect our individual practices will depend on a several

factors. Specifics of the bill are still a bit ambiguous. Some

practices will have to reduce staff, others may close. A lot of

licensed massage therapists will probably be laid off in the coming

year. Here is a breakdown from the FCA Website:

Assuming it is approved by the Governor, which is almost certain,

the new PIP bill takes effect on July 1, 2012, as to general

provisions applicable to PIP policies such as EUOs (examinations

under oath) for insureds, but the benefit limitations apply to PIP

policies issued or renewed on or after July 1, 2012. That means

that by June 30, 2013, all PIP policies will be replaced with this

new type of policy. The bill as passed by both the House and the

Senate and does the following:

•The accident victim must seek treatment within 14 days of the

accident.

•The insured is allowed to seek his/her full $10,000 in PIP benefits

only if he/she is diagnosed with an “Emergency Medical

Condition”.

“Emergency Medical Condition” is defined as:

Acute symptoms of sufficient severity such that the

absence of immediate medical attention could

reasonably be expected to result in: SERIOUS

jeopardy to patient health SERIOUS impairment of

bodily function SERIOUS dysfunction of any bodily

organ or part.

A chiropractor is excluded from being able to make

that diagnosis of EMC; only M.D.s, D.O.s, P.As, and

ARNPs are authorized to make that diagnosis.

•A patient could get chiropractic and other follow-up care up to

the $10,000 in benefits if the patient first gets a diagnosis of an

EMC from an M.D., D.O., P.A., or ARNP. The Chiropractor is

then allowed follow-up care for treatment limited tothe initial

diagnosis up to the full $10,000 in benefits.

•If the insured is not diagnosed with an EMC or if the insured

wants to seek treatment initially directly with the chiropractor, the

patient gets to use up to $2,500 in (reimbursed) PIP benefits.

•The insured gets $0 in PIP benefits if he/she seeks treatment

beyond the 14 days after the motor vehicle accident.
