THE DIFFERENCES BETWEEN THE CONVEYANCING SYSTEMS OF JERSEY AND GUERNSEY

From French to English – the big change!

In both islands, contracts to be passed before the Royal Court were historically written in French. In Guernsey this changed in 1969 and in Jersey this changed in 2005.

Although the conveyancing systems in Jersey and Guernsey have similar roots, each Island’s laws and processes have developed separately. There are certainly many similarities but, as briefly set out below, there are some differences which those purchasing and/or selling freehold property in both Islands should be aware of.

Jersey Guernsey

The conveyancing system in Jersey is quite unique! When you buy the freehold immovable property in Jersey you acquire the land the property is built on and everything beneath and above it.

The conveyancing system in Guernsey has some similarities to the Scottish system. When you buy immovable property in Guernsey, you do not strictly speaking own but merely ‘an estate of inheritance’, or the right to occupy it.

1) Once the parties have agreed a price, the Estate Agent will inform, by way of letter, both the vendor’s (seller’s) advocate and purchaser’s advocate of the proposed transaction and any special terms or conditions. The advocates will then prepare all documents required to give effect to the agreement.

1) In Guernsey, conditions of sale are usually drawn up by the Estate Agent using a standard form. The purchaser’s advocate will ask to check the terms, which can include, for example terms such as “subject to survey and legal title”.

2) The purchaser’s advocate will check that the vendor has good and legal title to the property which they are proposing to sell – these checks will confirm whether or not the property has the benefit of or is subject to any servitudes, convenants, restrictions or rights. When the contract is in agreed form and all necessary consents (such as Housing Consent and Agricultural Consent, if applicable) have been obtained the parties can proceed to completion. This process ordinarily takes between 4 to 6 weeks.

2) Once the conditions of sale are agreed, the buyer will usually pay a non-refundable deposit of 10% which is normally held by the Estate Agent in an escrow account.

3) Completion involves both parties personally appearing before (or alternatively their appointed attorneys appearing on their behalf) the Royal Court of Jersey at 2.30pm on a Friday only and in the presence of the purchaser’s/vendor’s advocate or conveyancer.

3) Approximately two to four weeks after the conditions of sale have been agreed, legal completion of the conveyance takes place. Normally this involves both parties personally appearing (although it is possible to appoint an attorney for this purpose) in the conveyancing court of the Royal Court of Guernsey on a Tuesday or a Thursday in the presence of the purchaser’s advocate or conveyancing clerk.

4) The contract, once passed before the Royal Court, is then registered in the Public Registry and enrolled in the Public Registry Index and Document Enrolment (PRIDE) computer system. Upon the passing of the contract before court, the keys are handed over to the purchaser and possession of the property is normally granted on the Saturday or Sunday.

4) On completion of the transaction, the keys are handed over. The title deeds are sent to the buyer by their advocate once the conveyance has been registered at the Greffe, the island’s central land registry and public records office. The title deeds themselves, however, are of little value, as it is the registration of the transaction at the Greffe that evidences title.

ABOUT US: The Jersey Estate Agents’ Association was established in 1995 to provide a structure for its members to follow in order to encourage best practice and to safeguard its customers. This comes in the form of a Code of Practice. Here are some FAQs about the Association:

How big is the membership? We have 12 member companies, with many individual members within those companies.

How do you become a member? Once the business has been running for two years and/or the business or an individual is a member of a professional body for example the National Association of Estate Agents (NAEA) and you have Professional Indemnity insurance in place, you may apply to become a member.

Does this give your customers comfort? Yes our customers know that we are an association of professionals working from a Code of Practice offering legal security.

How does membership work? Once a member joins, they can remain a member indefinitely providing they meet the criteria, and we are always encouraging new members to join.

How much is membership? The annual subscription is £250 per company and we get together for lunch or breakfast meetings periodically with informative presentations. This year we are pleased to announce that we are going to launch a website complete with a new logo, which is very exciting… watch this space…

Are Estate Agents in Jersey regulated? Whilst there are no specific laws regulating Jersey estate agents, they are nevertheless required to be registered with the Jersey Financial Services Commission as a specified Schedule 2 business under the Proceeds of Crime (Supervisory Bodies) (Jersey) Law 2008 and are required to collect customer due diligence in accordance with the Money Laundering (Jersey) Order 2008. That is the culture we now live with.

Can customers benefit from the JEAA? Certainly, the JEAA act as a form of redress for complaints received from customers against its members and then looks into resolving the situation.

Would you encourage customers to use a Member Agent? Absolutely, that would give them comfort knowing that the agent operates from a Code of Practice in their everyday operation. The JEAA emphasise that their members work for the vendor in the case of a sale, and the landlord in the case of a rental. A fact that often gets overlooked in trying and clinch a deal!!!
